However diverse and even conflicting definitions of world literature may be, there is a consensus in previous scholarship about circulation as a key defining feature. Being circulation modeled and (in)validated by a corpus of statutes, rules, and regulations, the absence of a law-oriented approach to world literature appears completely contradictory. This essay is a first step toward a more sustained treatment of world literature and law. Here I claim that in the late 1830s the history of world literature as mastered (...) by the West started to change as a consequence of the first two international copyright laws in the world––the Prussian Statute of 11 June 1837 and the British Act of 31 July 1838. The Prussian law is discussed in relation to the evolution of the Collection of British Authors of the German firm Tauchnitz between 1841 and 1847 by paying special attention to the case of American writers. The British law, in turn, is discussed in relation to French piracies of works printed in the UK by focusing on Frances Trollope’s Domestic Manners of the Americans (1832). Both laws sowed the seeds of the 1886 Berne Convention, whereby a vast transcontinental geography with a population of over five hundred million people was created for the legal circulation of literary works. I address the objection that the concept of racism has become overly inflated. Critics of the conceptual inflation of “racism” argue that theories of institutional racism engage in untoward conceptual inflation insofar as they undermine our moral understanding of racial phenomena, hinder our ability to explain the causes of racial inequality, and even undercut struggles for racial justice. I develop an original account of institutional racism and show that it is immune to all three versions of the conceptual inflation challenge.

Organized youth sport has become a prominent activity in Western societies, one around which myriad families structure their daily lives. Despite its popularity, or rather because of it, youth sport is besotted with complex problems. One distinctive set of problems pertains to children’s opportunities to benefit from engagement in sport. Such problems require a reflection on the conditions of justice. The goal of this paper is to explore ethical guidelines to make youth sport more just. The paper begins by characterizing (...) childhood, youth, and youth sport. Then, it articulates considerations of justice in youth sport. Together, these sections provide a basis to formulate the general features of a just youth sport. What emerges is a vision of youth sport that the adults involved in it should emphasize and implement if their young charges, and youth sport, are to flourish, as well as a novel approach to formulating and justifying normative criteria to make youth sport more just. One important limitation of the current renditions of interpretivism is that its emphasis on the moral dimension of sport has overlooked the aesthetic dimension lying at the core of this account of sport. The interpretivist’s failure to acknowledge and consider the aesthetic implicitly distances this realm from the moral. Marcia Muelder Eaton calls this distancing the separatist mistake. This paper argues that interpretivism presupposes not only moral but also aesthetic principles and values. What it sets out to demonstrate is that (...) interpretivism is an integralist, or nonseparatist, account of sport, one in which ethical and aesthetic values are not exclusive. Making explicit and specifying interpretivism’s combined moral-aesthetic approach to sport not only helps to better distinguish the whole range of values that make up sport as well as their interconnection but also encourages sportspeople to pursue more coherent sport and, thus, more enriching lives. I defend impact-based accounts of institutional racism against the criticism that they are over-inclusive. If having a negative impact on non-whites suffices to make an institution racist, too many institutions (including institutions whose affirmative action policies inadvertently harm its intended beneficiaries) would count as racist. To address this challenge, I consider a further necessary condition for these institutions to count as racist—they must stand in a particular relation to racist ideology. I argue that, on the impact-based model, institutions are racist (...) if they have a negative racial impact AND this impact is legitimized by racist ideology. Racist ideologies limit social criticism of and collective action against institutions that have a negative racial impact, and in so doing, lend stability to systems of racial domination. (shrink)

The aim of this paper is to provide an appreciation of Michel Foucault’s The Order of Things reception, from the latest book by Ivan Domingues entitled “Foucault, a arqueologia e As palavras e as coisas: cinquenta anos depois” (Ed. UFMG, 2023). One of the scopes of the book is to examine the range of The Order of Things and its archaeological strategy to account for the presentation of the birth of human sciences, as well as its fragility and instability in (...) the face of a possible change in the disposition of knowledge. Or Episteme’s disposition, according to Foucault terminology, whose signs of change can be observed on the occasion of the advent, in the twentieth century, of Lacanian psychoanalysis, ethnology and structural linguistics. By privileging its repercussions, expansions and rectifications fifty years later, it is not intended to “correct” Foucault from an epistemological point of view, but to point out the fertility and power of his thoughts for posterity. It is about going through “fertile errors and anodyne truths” (DOMINGUES, 2020, p. 386). The bet is that possible gaps, errors or confusions identifiable by Foucault himself and by his critics at the time never invalidate the fertility of a discussion concerning human sciences, which were never the same after Foucault. This paper argues that racism should not only be conceived as a moral concept whose main aim is to condemn severe wrongs in the domain of race. The paper advances a complementary interpretation of racism as an explanatory concept--one that plays a key role in explaining race-based social problems afflicting members of subordinate racialized groups. As an explanatory concept, the term 'racism' is used to diagnose and highlight the causes of race-related social problems. The project of diagnosing race-based social problems (...) contributes to the pragmatic anti-racist end of developing better political and policy strategies for solving these social problems. The paper defends this interpretation of racism as an explanatory concept through a critical engagement with Urquidez's moral-philosophical account of racism. (shrink)

In 1939, the influential psychophysicist S. S. Stevens proposed definitional distinctions between the terms ‘number,’ ‘numerosity,’ and ‘numerousness.’ Although the definitions he proposed were adopted by syeveral psychophysicists and experimental psychologists in the 1940s and 1950s, they were almost forgotten in the subsequent decades, making room for what has been described as a “terminological chaos” in the field of numerical cognition. In this paper, I review Stevens’s distinctions to help bring order to this alleged chaos and to shed light on (...) two closely related questions: whether it is adequate to speak of a number sense and how philosophers can make sense of the claim by cognitive scientists that numbers are perceptual entities. Moreover, I offer further support to Stevens’s distinction between numerosity and numerousness by showing that they are relational properties that emerge through different relationships between agents and their environments. The final conclusion is that, by adopting Stevens’s distinctions, numbers do not need to be seen as perceptual entities, since the so-called number sense is better described as a sense of numerousness. The first goal of this paper is to reply to a number of criticisms levied by Gunnar Breivik and Robert L. Simon against an account of sporting skills I published almost 20 years ago in which I distinguished between constitutive and restorative skills and examined their normative significance. To accomplish this goal, I first summarize my characterization and classification of skills and then detail the criticisms. After responding to the latter, and thus reconsidering and hopefully strengthening my account of skill (...) in sport, I turn my attention to Scott Kretchmar and Tim Elcombe’s inquiry into the skills involved in competitive sport. These authors claim that contesting skills demand the same respect usually accorded to testing skills. The second goal of this paper is then to explore Kretchmar and Elcombe’s inquiry under the light of my reconsidered analysis of skill. I specifically advocate a plausible relationship, both in terms of their distinctive character and relative import, between testing and contesting skills and constitutive and restorative skills. In doing so, I seek to present a more comprehensive account of skill in non-competitive and competitive sport. (shrink)

The field of numerical cognition provides a fairly clear picture of the processes through which we learn basic arithmetical facts. This scientific picture, however, is rarely taken as providing a response to a much‐debated philosophical question, namely, the question of how we obtain number knowledge, since numbers are usually thought to be abstract entities located outside of space and time. In this paper, I take the scientific evidence on how we learn arithmetic as providing a response to the philosophical question (...) of how we obtain number knowledge. I reject the view that numbers are abstract entities located outside of space and time and, alternatively, derive from the scientific evidence a novel account of the nature of numbers. In this account, numbers are reifications of the counting procedure and arithmetic statements are seen as describing the functioning of counting and calculation techniques. (shrink)

This paper develops computational models to monitor patients with hip replacement surgery. The Kinect camera is used to capture the movements of patients who are performing rehabilitation exercises with both lower limbs, specifically, ‘side step’ and ‘knee lift’ with each leg. The information is measured at 25 body points with their respective coordinates. Features selection algorithms are applied to the 75 attributes of the initial and final position vector of each rehab exercise. Different classification techniques have been tested and Bayesian (...) networks, supervised classifier system and genetic algorithm with neural network have been selected and jointly applied to identify the correct and incorrect movements during the execution of the rehabilitation exercises. Besides, prediction models of the evolution of a patient are developed based on the average values of some motion related variables. These models can help to fasten the recovery of these patients. Paul Gaffney has provided an excellent exploration of teamwork in athletic contexts, a topic that in spite of its prominence and relevance in the sporting world has been relatively neglected in the philosophy of sport literature. In this paper, I present and discuss three areas of Gaffney’s exploration of teamwork relevant to organized youth sport that might help stimulate reflection on the most auspicious conditions and responsible methodologies for young athletes to become themselves through organized sport.

O caráter comunitário da filosofia de Aristóteles resulta das diversas formas de análise da política que o filósofo apresenta na articulação dos seguintes aspectos: a tese de que o ser humano é um animal político; o modo como esta é realizada na comunidade política, na qual o logos se manifesta como atividade discursiva compartilhada; o cultivo de determinadas virtudes ético-políticas presentes na convivência humana, sobretudo, a amizade; a autossuficiência do cidadão e o seu vínculo com a autarquia da comunidade política. A retomada de um moderno conceito de comunidade, na tentativa de reatualizar os princípios gerais do comunitarismo aristotélico, pode ser compatível com determinadas teses liberais, sobretudo a questão da liberdade (autonomia) individual e o fato do pluralismo ético e político nas sociedades modernas. The communal nature of Aristotle's philosophy results from the various forms of analysis of the politics the philosopher shows in the articulation of the following features: the thesis that man is a political animal; the way the political community is accomplished through this thesis, in which the logos itself manifests as a shared discoursive activity; the cultivation of certain ethical and political virtues present in the human companionship, above all, friendship; citizen self-sufficiency and its relationship with the autarchy of the political community. In an attempt to bring up to date the general principles of Aristotelian communitarianism, the resumption of a modern concept of community can be compatible with certain liberal theses, especially the issue of individual freedom (autonomy) and the fact of the ethical and political pluralism in the modern societies. O artigo mostra como Michel Foucault se afasta da referência à Revolução para pensar a política moderna, principalmente desde que aquela passou a ser interpretada pelos parâmetros estalinistas do Partido Comunista. Em contrapartida, ele indica que o ponto de partida da política é constituído pelas resistências à governamentalidade observáveis na atitude crítica, nas contracondutas e nas insurreições. Esses operadores conceituais procuram ressaltar não as teorias e os sistemas propositivos de uma política justa, e sim a perspectiva dos próprios governados quando (...) buscam desprender-se das obediênciasconsentidas, bem como do silenciamento diante de ações governamentais intoleráveis. Nesse sentido, a política tem como nova referência os processos de subjetivação a partir dos quais buscamos nos tornar completamente outros em um mundo inteiramente outro. A essas experiências políticas de dessubjetivação e transformação de nós mesmos, detectáveis principalmente nos movimentos de contracondutas, Foucault deduz uma espiritualidade política, irredutível às avaliações das lutas em termos de êxito ou fracasso. Tanto desde el punto de vista teórico como desde una perspectiva práctica, el fenómeno de la "estetización" no parece ser portador de buenos augurios. En el ámbito teórico, la estetización ha sido vinculada con la crisis de los discursos orientados en términos de verdad, mientras que en el terreno práctico, ella ha sido asociada a ciertos procesos culturales que conducirían a la debacle de los principios normativos. Dejando de lado la problemática teórica, el presente trabajo se concentra en el debate (...) en torno al fenómeno práctico de la estetización de la política. En primer lugar, nos remontamos a la historia de la condena filosófica de la estetización de la esfera política para ocuparnos luego, en un segundo momento, de algunas posiciones esteticistas y antiesteticistas de finales del siglo XX. Posteriormente, procuramos avanzar en una redescripción de esta problemática que nos permita rescatar un sentido productivo de lo estético para el pensamiento político. Para esto último, nuestro trabajo se apoya en las reflexiones de la actual coeditora de la Neue Zeitschrift für Sozialforschung, Juliane Rebentisch. Tomando como parámetro algunos de los supuestos de sus investigaciones, aquí intentaremos demostrar hasta qué punto la estetización de la vida política puede contribuir al desarrollo de una concepción renovada de esta última. Both from a theoretical and from a practical perspective, the phenomenon of "aestheticization" does not seem to anticipate anything particularly good. On a theoretical level, it has been linked to the crisis of discourse-oriented in terms of truth, while in the practical, has been associated with certain cultural processes that lead to the the collapse of the normative principles. Leaving aside the theoretical issues, this paper focuses on the debate on the phenomenon of the aestheticization of the political culture. First, it goes back to the history of philosophical condemnation of the aestheticization of the political sphere. In a second time, he deals with some conceptions of the late twentieth century. Subsequently, the paper seeks to advance a redescription of this problem that allows rescue a productive sense of aesthetics for political thought. For the latter, our article is based on the reflections of Juliane Rebentisch and attempts to show how the aestheticization of political life can help to develop a new concept of the same. (shrink)

Are these claims compatible: the future is contingent, and yet prophecies reveal the future? William of Ockham argues that they are in _Tractatus de praedestinatione_ (q.1, d.8) and in the _Fourth Quodlibet_ (q.4). But his two solutions to the puzzle of how prophecy and future contingency can be reconciled face significant objections that seem to undermine Ockham’s theory of future contingents. In this paper, I argue that the relevant objections lose their force once Ockham’s views on prophecy are properly understood. (...) In the first part of the paper, I closely examine the puzzle as well as Ockham’s solutions and the objections raised against him. Pretende-se oferecer aqui uma justificativa, tal como ela parece ter sido indicada por Platão no Teeteto, para o método de Sócrates, anunciado em Apologia como uma anthropíne sophía, capaz de avaliar os diferentes tipos de conhecimento. O recurso à imagem da maiêutica, no Teeteto, traz a representação de um aspecto desse método, posterior à refutação, em que o examinador ou parteiro elevam as opiniões do interlocutor até um princípio transcendente, para mostrar-lhes ou sua vacuidade ou sua solidez. Por fim, o (...) Diálogo de Platão parece não apenas representar o método de Sócrates, mas se inspirar nele para a composição do seu discurso, que joga com a forma de fazer ver e com aquilo que se vê a partir dele. En esta investigación, por un lado, se caracterizan las ideologías lingüísticas sobre el mapuzugun que tienen los estudiantes del último grado de un establecimiento de enseñanza secundaria de Temuco (Chile) y, por otro, se evalúa la influencia en la formación de dichas ideologías del taller de mapuzugun impartido en la unidad educativa. El trabajo se desarrolló desde una perspectiva teórica interdisciplinaria y con una estrategia metodológica mixta. Se observa el predominio de una ideología probilingüismo, mientras que en dos grupos minoritarios (...) se identificaron ideologías de la lengua dominante moderada y radical, respectivamente. No se observó una influencia significativa del taller de mapuzugun en la conformación de las ideologías. (shrink)

Affiliation with a scientific area or degree program could affect one´s religious beliefs and acceptance of evolution; however, this issue has been poorly studied. Moreover, little information is available regarding Chilean university scientists’ views on religion and evolution. This study aims to provide the first documentation of the opinion of scientists at a Chilean University with regard to religion and evolution. This was done by conducting a personal survey of first and last year undergraduate students, graduate students, and faculty. We (...) found that nonreligiosity, as well as acceptance of Darwinian evolution, increased with possession of an advanced degree and this correlation was stronger for individuals who study biology and physics in comparison to those who study chemistry. Although less than 30 percent of undergraduate students are atheists/agnostics, more than 70 percent of faculty members are atheist or agnostic. However, most of the surveyed scientists did not see a conflict between science and religion. (shrink)

A 4 años y más de 30 mil muertes, el clima de inseguridad y violencia permanente permanece. El artículo estudia su historia, desmonta sus justificaciones y analiza sus múltiples consecuencias negativas. Detrás de la situación actual y el fracaso de la estrategia punitiva aparecen fenómenos (...) como la crónica debilidad del Estado mexicano y el trastocamiento del orden informal local tras la llegada del Ejército. Por ello se aboga por el necesario término de una lucha centrada en lo punitivo y su cambio por una que incluya el aspecto social y preventivo del problema, que entienda las drogas como un asunto de salud pública. This text examines the determining characteristics of Descartes' methodological way of thinking. The first concerns the little importance Descartes attributed to the demonstrative expedient and its absorption into acquiring knowledge. The second is that the Cartesian method is resolutive rather than deductive, with knowledge generated by solving difficulties and problems. The third refers to the constitutive stages of resolution, summarized by the operations of analysis and construction. The fourth relates to Descartes' use of the unknown so that an epistemic structure (...) commanded by it generates knowledge. The fifth characteristic is that the method can be universalized, not only because of reason's unique way of operating but also because construction and resolution acquire determinations that can be adapted to the nature of the objects and the particularity of each domain. For Suárez, the general notion of efficient causality and the reality of it are known not through an abstraction from supposed “primitive” experiences of connection between causes and effects but indirectly, through a reasoning that begins with what is directly observed and ends with the evidence that it is really in the things themselves. In this paper, I intend to show the plausibility of this interpretation in the following way: first, I will quickly present a passage in which Suárez claims (...) that efficient causality is evident; second, I will show in which sense the principle “nothing can transfer itself from nonbeing to being” has an empirical basis; and, third, I will show how the reality of efficient causation among things of the empirical world can be demonstrated from the experience of a rational order in them. A continuación, abordamos el sentido que tiene lo dionisíaco en el libro en que se presenta por primera vez, El nacimiento de la tragedia. La investigación actual ha puesto de relieve la centralidad del lenguaje de la religión para un estudio científico de la disciplina en Latinoamérica, esta afirmación contrasta con el hecho que el lenguaje de la religión ni siquiera es indicada en los manuales como una subdisciplina, o apenas mencionada como un área en construcción, esto muestra la falta de una fundamentación teórica sobre el estatus epistémico de esta disciplina. El lenguaje de la religión no se refiere al carácter instrumental del lenguaje (...) sino a una política del signo que constituye un sistema semiótico que está en el origen de cada cultura. Así las cosas, el artículo propone un modelo semiótico y entrega algunas pistas semióticas para un estatuto epistémico del lenguaje de la religión en Latinoamérica. A partir de categorías semióticas como las de lugar, producción de textos y textos límites, a partir de lo cual exponemos que el lenguaje de la religión produce textos extraños, límites, los cuales están vinculados a lugares de producción, prácticas, creencias, valores que configuran el espacio social y construyen el espacio de la religión. The complexity of work in our time presents new challenges for a theology that understands this fundamental dimension of existence and gives it an integrating, truly human meaning and a path to holiness. In order to embrace all modern forms of work, a definition of work is proposed as an action that involves the whole person and leads to fulfilment through work. Not only is work not a punishment, but the punishment would be not to be able to work. In (...) work there is a convergence between nature and spirit. In order for the relationship between them to be harmoniously realised, a mediation is necessary that can only be exercised by man in which both meet. This avoids the risk of materialism and spiritualism in the understanding of work. But this mediation is limited to "this" concrete work. In order for there to be a mediation that includes all work, a Mediator is necessary, and that Mediator is Christ. The work that Jesus of Nazareth carried out was an exercise of his pro-existence and was therefore redemptive and salvific. It is in union with Christ that human work finds its ultimate meaning and transcendent efficacy. (shrink)

Los convulsos acontecimientos de estos últimos años han demostrado, a escala global, cuán enajenante es nuestra experiencia presente del tiempo. Las tendencias actuales de la teoría crítica y otros enfoques histórico-sociológicos insisten en el ritmo devorador de la aceleración (P. Virilio; H. Rosa) y en la reconfiguración temporal a partir del “presentismo” (Koselleck; F. Hartog). Sin embargo, sabemos que estas cuestiones distan de ser absolutamente nuevas, y que ya preocupaban a los filósofos y a los fenomenólogos en la primera mitad (...) del siglo XX. La publicación reciente de los últimos tratados del Ereignis y de los Cuadernos negros, redactados en los años 1930 y 1940, nos permite acceder a una reflexión original sobre lo que Heidegger nombra la maquinación o fabricación [Machenschaft]. Nos gustaría analizar la manera en la que, a partir de la fabricación, se puede replantear el sentido de nuestra experiencia temporal íntima frente a la situación moderna. Más concretamente, ahondaremos en las formas en las que la primacía de la fabricación funciona como cerrazón de posibilidades, llegando a impedir que pueda ocurrir algo realmente “histórico”. O artigo versa sobre a possibilidade de uma história crítica da verdade no pensamento de Michel Foucault, ressaltando seu distanciamento do vínculo tradicional entre sujeito e conhecimento da verdade em benefício da articulação entre práticas históricas (práticas discursivas, práticas sociais e práticas de si) e produção de verdade. Destaca ainda em que aspectos sua investigação está inserida no projeto crítico inaugurado por Kant e em que medida, paradoxalmente, dele se afasta.

El artículo se propone indagar en la concepción de la «realidad» que tiene la sofística, como referente fundamental para entender mejor su propuesta crítica ante el avance que en esa época está teniendo la «filosofía dogmática» de tipo metafísica. En particular centrando el análisis en la invectiva que al respecto realiza Gorgias de Leontinos en los fragmentos conservados de dos de sus obras fundamentales: el tratado De lo que no es o de la naturaleza y el discurso Encomio de Helena. (...) Aquí se considera que esta es una posible ruta que permite reconstruir parte de su sediciosa propuesta filosófica. El núcleo fundamental que impulsa la reflexión gorgiana es la infranqueable distancia que separa la concepción de una supuesta «realidad en sí» del pensamiento y lenguaje; ante esta prerrogativa es factible entender el poder que le atribuye al logos para influir en las almas y acciones de los seres humanos, pero también en la capacidad del discurso para «hacer diciendo»; en este sentido perfila su perspectiva extrema de que las palabras estrictamente humanas en su fuerza performativa hacen factible «crear la realidad». No presente artigo pretendo apontar, primeiramente, a relação entre diagnóstico do presente e atitude crítica a partir do pensamento de Michel Foucault. Na sequência, indicarei que a noção de atitude crítica é ao mesmo tempo parceira e adversária da governamentalidade, no sentido de que ela designa uma arte plural de não ser governado de determinada maneira e pelos mesmos agentes, sem, contudo, se posicionar fora do jogo governamental. Mostrarei ainda que as lutas políticas contra a saturação do jogo governamental podem (...) ser pensadas como um desdobramento da atitude crítica. Finalmente, procurarei demonstrar que a tentativa cotidiana de viver e refletir democraticamente diante de um exercício autoritário do poder, como se pôde vislumbrar especialmente nos últimos anos no Brasil, pode ser entendida como um gesto de ressignificação da atitude crítica. A problematização deste campo de análise não foi diretamente tratada por Foucault, mas tem se tornado um objeto de estudo irrenunciável para o diagnóstico político de nosso presente. (shrink)

Diseñar experiencias de aprendizaje se convirtió en el gran desafío de los educadores en muchos puntos de la geografía tanto colombiana como de otros países, y que además de cumplir con los contenidos exigidos por los planes curriculares fueran memorables o que propiciaran anclajes de gratificación en los estudiantes. Por ello, el siguiente documento tiene como objetivo presentar las características del modelo que se ha denominado DEMA -Diseño de Experiencias Memorables de Aprendizaje- como contribución y reflexión de las prácticas educativas (...) tanto análogas como digitales que se construyen en los contextos educativos.
