Collective Action, Philosophy and Law.Teresa Marques & Chiara Valentini (eds.) - 2021 - London: Routledge.
Collective Action, Philosophy and Law brings together two important strands of philosophical analysis. It combines general philosophical inquiry into collective agency with analyses of specific questions about plural entities and activities in the legal domain. These are issues of growing interest in areas of philosophy like action theory and social ontology, as well as in philosophy of law. The book contains thirteen original chapters written by an international team of leading philosophers and legal theorists, and is divided into four clear (...)

Understanding the Cognitive Immersion of Hospitality Architecture in Culture and Nature: Cultural Psychology and Neuroscience Views.Haihui Xie, Qianhu Chen, Chiara Nespoli & Teresa Riso - 2022 - Frontiers in Psychology 13.
Hotel architectural design plays a critical role in the hospitality experiences of consumers, and it is important to consider that people may have different aesthetic cognitions toward the sensory properties of nature, such as its color and texture, as well as the landscape. While neuroaesthetics has emerged as a nascent field in hospitality research, few studies have investigated how nature reflects aesthetic experiences in the human brain. Moreover, the neuroaesthetic interpretation of architecture through the aesthetic triad is a novel interdisciplinary (...)

In the Region of Middle Axioms: Judicial Dialogue as Wide Reflective Equilibrium and Mid-level Principles.José Juan Moreso & Chiara Valentini - 2021 - Law and Philosophy 40 (5):545-583.
This article addresses the use of foreign law in constitutional adjudication. We draw on the ideas of wide reflective equilibrium and public reason in order to defend an engagement model of comparative adjudication. According to this model, the judicial use of foreign law is justified if it proceeds by testing and mutually adjusting the principles and rulings of our constitutional doctrines against reasonable alternatives, as represented by the principles and rulings of other reasonable doctrines. By this, a court points to (...)

This handbook offers a deep analysis of the main forms of legal reasoning and argumentation from both a logical-philosophical and legal perspective. These forms are covered in an exhaustive and critical fashion, and the handbook accordingly divides in three parts: the first one introduces and discusses the basic concepts of practical reasoning. The second one discusses the main general forms of reasoning and argumentation relevant for legal discourse. The third one looks at their application in law as well as at (...)

The structure of social practices and the connection between law and morality.Giorgio Bongiovanni, Antonino Rotolo, Corrado Roversi & Chiara Valentini - 2009 - Ratio Juris 22 (1):1-23.
In his work, Jules Coleman has held that the rule of recognition, if conceived of as a shared cooperative activity, should be the gateway through which to incorporate moral constraints on the content of law. This analysis, however, leaves unanswered two important questions. For one thing, we do not know when or even why morality becomes a criterion of legality. And, for another thing, we still do not know what conception of morality it is that we are dealing with. In (...)

The dialogue focuses on the major issues of the contemporary theoretical debate on judicial review and the Supreme Court's role in American constitutional democracy. The discussion begins with the US Supreme Court's case Hamdan v. This paper highlights the results of a theoretical analysis aiming to prove that the key dimensions of Global Competence framework as proposed by OECD in 2016 are integrated in the so-called Pedagogy of Communion: the educational approach sprouted from the experience of Chiara Lubich and the Focolare Movement. The socio-ontological intelligence theoretical model may represent a valid support to all parties interested in developing the emerging OECD Education 2030 Framework aimed at establishing a common grammar and language, to support (...)

This collection is the final volume of a four book survey of the state of phenomenology fifty years after the death of Edmund Husserl. Its publication represents a landmark in the comprehensive treatment of contemporary phenomenology in all its vastness and richness. The diversity of the issues raised here is dazzling, but the main themes of Husserl's thought are all either explicitly treated, or else they underlie the ingenious approaches found here. Time, historicity, intentionality, eidos, meaning, possibility/reality, and teleology are (...)

History After Lacan.Teresa Brennan - 1993 - New York: Routledge.
Lacan was not an ahistorical post-structuralist. Starting from this controversial premiss, Teresa Brennan tells the story of a social psychosis. She begins by recovering Lacan's neglected theory of history which argued that we are in the grip of a psychotic's era which began in the seventeenth century and climaxes in the present. By extending and elaborating Lacan's theory, Brennan develops a general theory of modernity. Contrary to postmodern assumptions, she argues, we need general historical explanation. An understanding of historical (...)

The Interpretation of the Flesh: Freud and Femininity.Teresa Brennan - 1992 - Routledge.
The `riddle of femininity', like Freud's reference to women's sexuality as a `dark continent', has been treated as a romantic aside or a sexist evasion, rather than a problem to be solved. In this first comprehensive study, Teresa Brennan suggests that by placing these theories in the context of Freud's work overall, we will begin to understand why femininity was such a riddle for Freud.

This article argues for the need for philosophical reflection on political myth. It does so by addressing the twofold question “Why philosophy?” and “Why political myth?” The first part of the essay examines the ways that political philosophy could contribute to a better understanding of political myth. In particular, it proposes to look at political myth as a process rather than as an object, and to define it as the work of a common narrative, which grants significance to the political (...)

- 2007 - Routledge.
The black women's club movement is frequently seen as definitive of "first-wave" African American feminism. However, this six-volume collection from the History of Feminism series draws together key documents that show the varied political work African American feminists were undertaking well before the turn into the 20th century. African American Feminisms brings together writings that document distinctly African American feminist organizing from as early as the late 1820s through female benevolent and literary societies, as well as writings that document African (...)

This article provides a conceptual map of the debate on ideal and non‐ideal theory. It argues that this debate encompasses a number of different questions, which have not been kept sufficiently separate in the literature. In particular, the article distinguishes between the following three interpretations of the ‘ideal vs. non‐ideal theory’ contrast: (i) full compliance vs. partial compliance theory; (ii) utopian vs. realistic theory; (iii) end‐state vs. transitional theory. The article advances critical reflections on each of these sub‐debates, and highlights (...)

Is democracy a requirement of justice or an instrument for realizing it? The correct answer to this question, I argue, depends on the background circumstances against which democracy is defended. In the presence of thin reasonable disagreement about justice, we should value democracy only instrumentally (if at all); in the presence of thick reasonable disagreement about justice, we should value it also intrinsically, as a necessary demand of justice. Since the latter type of disagreement is pervasive in real-world politics, I (...)

When and why do socially constructed norms—including the laws of the land, norms of etiquette, and informal customs—generate moral obligations? I argue that the answer lies in the duty to respect others, specifically to give them what I call “agency respect.” This is the kind of respect that people are owed in light of how they exercise their agency. My central thesis is this: To the extent that (i) existing norms are underpinned by people’s commitments as agents and (ii) they (...)

In his recent bookThe Idea of Justice, Amartya Sen suggests that political philosophy should move beyond the dominant, Rawls-inspired, methodological paradigm – what Sen calls ‘transcendental institutionalism’ – towards a more practically oriented approach to justice: ‘realization-focused comparison’. In this article, I argue that Sen's call for a paradigm shift in thinking about justice is unwarranted. I show that his criticisms of the Rawlsian approach are either based on misunderstandings, or correct but of little consequence, and conclude that the Rawlsian (...)

A globalized world, some argue, needs a global democracy. But there is considerable disagreement about whether global democracy is an ideal worth pursuing. One of the main grounds for scepticism is captured by the slogan: “No global demos, no global democracy.” The fact that a key precondition of democracy—a demos—is absent at the global level, some argue, speaks against the pursuit of global democracy. The paper discusses four interpretations of the skeptical slogan—each based on a specific account of the notion (...)

Which standards should we employ to evaluate the global order? Should they be standards of justice or standards of legitimacy? In this article, I argue that liberal political theorists need not face this dilemma, because liberal justice and legitimacy are not distinct values. Rather, they indicate what the same value, i.e. equal respect for persons, demands of institutions under different sets of circumstances. A prominent view in contemporary political theory, the ‘associative view’, says that duties of justice are triggered by particular cooperative relations between morally significant agents, and that ‘therefore’ principles of justice apply only among fellow citizens. This view has been challenged by advocates of global justice, who point to the existence of a world-wide cooperative network to which principles of justice apply. Call this the challenge from geographical extension. In this paper, I pose a structurally similar challenge to the associative (...)

We ought to do what the law commands because the law commands it, and not because of the law's content—i.e., the independent merits of the actions it prescribes. Despite its popularity, the notion of content-independence is marked by ambiguity. In this paper, I first clarify what content-independence is.
