Marx’s concept of bird-freedom or Vogelfreiheit— drawn from German legal history in which it meant “outlaw status” — describes the situation of free labor as “doubly free”: not enslaved as well as landless. The metaphorical valences of his satirical emphasis on the cynicism of the idea of “free labor” returns in many of Marx’s other satirical reworkings of concepts which refer to the state of nature. This essay looks at two such concepts engaged in explaining the process of “primitive accumulation” (...) in Capital, Volume 1: the notion of the idyll (“idyllic relations” or “idyllic proceedings”) and the notion of outlawry as “bird-freedom.” The essay exemplifies the ways in which both moments constitute “natural-historical images,” in Theodor Adorno’s terms: a concept of hybridity, historical texture, and transition that might add to the scholarship on Marx’s philosophy of nature. Does consciousness collapse the quantum wave function? This idea was taken seriously by John von Neumann and Eugene Wigner but is now widely dismissed. We develop the idea by combining a mathematical theory of consciousness (integrated information theory) with an account of quantum collapse dynamics (continuous spontaneous localization). Simple versions of the theory are falsified by the quantum Zeno effect, but more complex versions remain compatible with empirical evidence. In principle, versions of the theory can be tested by experiments with (...) quantum computers. The upshot is not that consciousness-collapse interpretations are clearly correct, but that there is a research program here worth exploring. (shrink)

In Philosophy Without Intuitions, Herman Cappelen focuses on the metaphilosophical thesis he calls Centrality: contemporary analytic philosophers rely on intuitions as evidence for philosophical theories. Using linguistic and textual analysis, he argues that Centrality is false. He also suggests that because most philosophers accept Centrality, they have mistaken beliefs about their own methods.To put my own views on the table: I do not have a large theoretical stake in the status of intuitions, but unreflectively I find it fairly obvious that (...) many philosophers, including myself, appeal to intuitions. Cappelen’s arguments make a provocative challenge to this unreflective background conception. So it is interesting to work through the arguments to see what they might and might not show.In what follows I aim to articulate a minimal notion of intuition that captures something of the core everyday philosophical usage of the term, and that captures the sense .. Philosophy and Phenomenological Research, EarlyView.

The main objective of this study is to eliminate the obstacles that the stylistic, structural, and methodological aspects of the text place in the way of reading and understanding Ludwig Wittgenstein's later work. The characteristic features of these elements are developed and discussed in the context of a close reading of the short section on reading in the Philosophical Investigations. Wittgenstein's aim in this section is the negative one of completely undermining explanatory accounts of the meaning of reading in terms (...) of mental states, experiences, or neurophysiological functions of the brain. In this respect the section on reading forms a clearing ground and a propaedeutic to Wittgenstein's conception of understanding as a rule-following activity. ;The signature of Wittgenstein's style is characterized by a dialogic terseness, an economy of expressions manifest in the brevity of numbered remarks, and a number of strategically indirect rhetorical devices. The structure of the text is shown to be discontinuous and multidirectional. The textual organization forms an overlapping and complex network that mirrors the complexity and multifaceted structure of language. The discontinuity easily inhibits following Wittgenstein's thought, and results in a judgment and dismissal of the text as being fragmented, frayed, and thus lacking structure. ;Wittgenstein's method is contrasted to the application of the scientific method to solving philosophical problems and to the phenomenological method of examining experiences. The argument for the existence of a method at all consists in focussing on and developing three methodological principles: recalling the course of philosophical nonsense; reminding ourselves of what we already know; and arranging and rearranging what already lies open to view. ;Bringing philosophical problems to an end by exposing them as pseudo-problems that often are caused by the forms of our expressions, is reached by an Ubersicht, an overview, of the multiple facets of language. Such an overview is gained by an application of Wittingenstein's method. An analysis of the section on reading in terms of its philosophical purpose and point illuminates the complex interplay of the methodological aspects, the unconventional structure of the text, and the profile of Wittgenstein's unique philosophical style. Having worked on the concept for my Master’s thesis in 2004, I’m very interested in everything related to time. We all think about time. This book is a comprehensive study of the writings of Jean-Paul Sartre. As well as examining the drama and the fiction, the book analyses the evolution of his philosophy, explores his concern with ethics, psychoanalysis, literary theory, biography and autobiography and includes a lengthy section on the still much-neglected study of Flaubert, L'Idiot de la famille. One important aim of the book is to rebut the charges made by many theorists and philosophers by revealing that Sartre is in fact a (...) major source for concepts such as the decentred subject and detotalised truth and for the revolt against individualistic humanism. Dr Howells also takes into account much posthumously published material, in particular the Chaiers pour une morale, but also the Lettres au Castor and the Cranets de la drole de guerre. The work is a substantial contribution to Sartre studies, but has been written with the non-specialist in mind; to that end all quotations are translated into English and gathered in an appendix. This essay utilizes Plato's insights into the role of shame in dialogical interactions to illuminate the aesthetic dimensions of deliberative democracy. Through a close analysis of the refutation of Polus in Plato's dialogue, the "Gorgias", I show how the emotion of shame is central to the unsettling, dynamic, and transformative character of democratic engagement and political judgment identified by recent aesthetic critics of Habermas' model of communicative action and democratic deliberation. Plato's analysis of shame offers a friendly amendment to these (...) aesthetic critiques by showing how the psychological forces at the heart of shame make the outcome of our political engagements with others uncertain and unsettling, even while they make possible the kind of self-reflexivity necessary to foster the deliberative virtue of sincerity or truthfulness. This essay collides with the aesthetic of wilderness cultivated by the North American retail chain Bass Pro Shops. Through elaborate displays and décor that render each store part rustic lodge, aquarium, amusement park, natural history museum, and hunting simulator, the stores represent the natural world and its inhabitants as abundant resources for human consumption. The stores’ aesthetic is primarily wrought through the arrangement of taxidermied animals. These animals include both traditional wildlife mounts posed in lifelike attitudes as well as animatronic (...) taxidermy that becomes “alive” in response to players’ achievements in a shooting range game. By exploring the stores’ traditional and animatronic taxidermy as well as its conflation of animal and machine, this essay explores the conception of environmental conservation and animal ontology upheld by Bass Pro Shops. This article takes as its point of departure unexpected similarities in the ways that the experimental educator, writer and filmmaker Fernand Deligny and Jean-Luc Nancy conceptualize community. Deligny is remembered for his alternative community for non-speaking children with autism, established in the Cévennes in 1967 and founded on the absence of language and relationality as it is commonly understood. This article probes the paradox that in this community we find a rapprochement with Nancy's relational ontology. Drawing on Deligny's theoretical responses (...) to the dynamics he witnessed and the cartographical methods employed to trasce the movements of the children as they roamed, and placing these in dialogue with Nancy's texts on community through the decades, I suggest a kinship between the two thinkers which opens onto broader questions about the relationship between theories and practices of community. In this article, we suggest an alternate approach to interpreting the US Constitution, using founding-era translations. We demonstrate how both symmetries and asymmetries in structure and vocabulary of the languages involved can help in deciding nowadays’ problems of constitutional interpretation. We select seven controversial passages of the US constitution to illustrate our approach: Art. I, § 8, cl. 3 ; Art. II, § 1, cl. 5 ; Art. II, § 2, cl. 3 ; Art. I, § 6, cl. 1/Art. I, (...) § 8, cl. 10/Art. IV, § 2 ; and Art. IV, § 2, cl. 1. Since these passages have recently been debated by constitutional scholars, reassessing them using our method can establish the additional value of our approach to constitutional practice. We presume that our approach is not limited to interpreting the US constitution, but suggest that constitutional hermeneutics in general could profit from adding a translation approach to the toolkit. Using a queer theory and disrupting heteronormativity framework, we applied a model lesson in the elementary methods course to understand preservice teachers’ experiences with LGBTQ individuals and families and their beliefs about utilizing children׳s literature portraying LGBTQ families in the elementary classroom. Participants reported a range of personal experiences with LGBTQ individuals and families and relatively positive responses to the family text set presented but wavered on LGBTQ themed books due to perceived conflict, religious beliefs, and ideas about what is (...) appropriate content for young learners. A discussion of the findings also includes preservice teachers’ intentions for future teaching related to LGBTQ topics. Implications for teacher education and social studies education are explored. In a post-apartheid South Africa, the value of reflective memories and their impact on community history gives credibility to their relationship with personal struggles such as disability, be it physical or political. Shaped by South African Indian heritage, an isolated individualised case of a second-generation descendant’s ability–disability experience is researched and narrated in this article. The respondent, Dr Kasturi Varley is a woman of the South African Indian community, who was born almost 101 years after the first shipload of Indian (...) indentured labourers arrived in the then Colony of Natal. Her memories shed light on a unique Indo-African-European experience. Her indentured paternal grandfather arrived in the African continent in August 1900. Her reflective memories and shared experiences of various episodes of the ability–disability paradigm add to the body of knowledge of the Indian indentured labour system that already exists and partially fills up the prevalent gaps in the research on this topic. Her story is unique in that she worked wheelchair-bound at the International Atomic Energy Agency in Vienna, Austria and subsequently settled in the United Kingdom. This study applied a qualitative research methodology.Contribution: This article provides insight on reflective memories within the domain of social memory and contributes to an understanding of the historiography of the descendants of Indian indentured labourers in South Africa. In 2020, this community commemorated the 160th anniversary of the arrival of the labourers to the Colony of Natal. (shrink)

Social anxiety disorders (SAD) are among the most prevalent mental disorders (lifetime prevalence: 7–12%), with high impact on the life of an affected social system and its individual social system members. We developed a manualized disorder-specific integrative systemic and family therapy (ISFT) for SAD, and evaluated its feasibility in a pilot randomized controlled trial (RCT). The ISFT is inspired by Helm Stierlin’s concept of related individuation developed during the early 1980s, which has since continued to be refined. It integrates solution-focused (...) language, social network diagnostics, and genogram work, as well as resource- and problem orientation for both case conceptualization and therapy planning. Post-Milan symptom prescription to fluidize the presented symptoms is one of the core interventions in the ISFT. Theoretically, the IFST is grounded in radical constructivism and “Cybern-Ethics,” multi-directional partiality, and a both/and attitude toward a disorder-specific vs. non-disorder-specific therapy approach. SAD is understood from the viewpoint of social systems theory, especially in adaptation to a socio-psycho-biological explanatory model of social anxiety. In a prospective multicenter, assessor-blind pilot RCT, we included 38 clients with SAD (ICD F40.1; Liebowitz Social Anxiety Scale, LSAS-SR > 30): 18 patients participated in the ISFT, and 20 patients in Cognitive Behavioral Therapy (CBT; age:M = 36 years,SD = 14). Within-group, simple-effect intention-to-treat analyses showed significant reduction in social anxiety (LSAS-SR; ISFT:d = 1.67; CBT:d = 1.04), while intention-to-treat mixed-design ANOVA demonstrated the advantage of ISFT (d = 0.81). Per-protocol analyses supported these results. The remission rate based on blind diagnosticians’ ratings was good to satisfactory (Structured Clinical Interview, SCID; 78% in ST, 45% in CBT,p = 0.083); this has yet to be verified in a subsequent confirmatory RCT. The article will present the ISFT rationale and manual, including a special focus on multi-person settings, and the central findings from our pilot RCT. (shrink)

BackgroundWe conducted a survey to identify what types of health/medical research could be exempt from research ethics reviews in Australia.MethodsWe surveyed Australian health/medical researchers and Human Research Ethics Committee members. The survey asked whether respondents had previously changed or abandoned a project anticipating difficulties obtaining ethics approval, and presented eight research scenarios, asking whether these scenarios should or should not be exempt from ethics review, and to provide comments. Qualitative data were analysed thematically; quantitative data in R.ResultsWe received 514 responses. (...) Forty-three per cent of respondents to whom the question applied, reported changing projects in anticipation of obstacles from the ethics review process; 25% reported abandoning projects for this reason. Research scenarios asking professional staff to provide views in their area of expertise were most commonly exempted from ethics review ; scenarios involving surplus samples and N-of-1 studies were most commonly required to undergo ethics review. HREC members were 26% more likely than researchers to require ethics review. Need for independent oversight, and low risk, were most frequently cited in support of decisions to require or exempt from ethics review, respectively.ConclusionsConsiderable differences exist between researchers and HREC members, about when to exempt from review the research that ultimately serves the interests of patients and the public. It is widely accepted that evaluative research should be used to reduce clinical uncertainties—the same principle should apply to ethics reviews. (shrink)

In his stimulating book SHADOWS OF THE MIND, Roger Penrose presents arguments, based on Gödel's theorem, for the conclusion that human thought is uncomputable. There are actually two separate arguments in Penrose's book. The second has been widely ignored, but seems to me to be much more interesting and novel than the first. I will address both forms of the argument in some detail. Toward the end, I will also comment on Penrose's proposals for a "new science of consciousness".

This paper highlights the need to apply an equity lens when assessing the impact of preemption and related legal doctrines on community health. Community autonomy to set and pursue public health priorities is an essential part of achieving health equity. Unfortunately, the priorities of organized industry interest groups often conflict with health equity goals. These groups have a history of successfully using law to limit community autonomy to pursue public health measures, most notably through preemption and related legal doctrines. We (...) examine this phenomenon using two examples. First, we look at dental association efforts to block the spread of dental therapists in Indian Country. Native dental therapists have been improving the oral health of native people in Alaska for over a decade; yet the national and state dental associations have sought with mixed success to leverage state and federal laws to hinder other tribal governments from utilizing these providers. We compare these efforts with a restaurant association-led movement to limit what municipal governments can do to address food-based health inequities, focusing on a “model” ALEC bill that started in Ohio. Finally, we discuss how municipalities and Tribes are fighting back and continuing to pursue health equity for their communities. (shrink)

The learning society has been advocated as an answer to current economic, political and social problems by a wide coalition of interests, including politicians, employers and educators. Here we critically analyse the concept as a myth; that is, as an idea which may or may not have validity, but which many people believe in. For the purpose of this analysis, the learning society is set alongside four other myths upon which it builds: those of productivity, change, lifelong education and the (...) learning organisation. It is argued that the United Kingdom cannot currently be considered to be a learning society, nor is it likely to become one in the foreseeable future. But the idea of the learning society retains an important role as a myth, in drawing together and channelling energies in directions sought by policy-makers. (shrink)

Responsibility is central to Emmanuel Levinas as well as Hannah Arendt. A reading of their understanding of the concept and role of responsibility for politics and ethics and in regard to its social-ontological status of primacy, its reference to historical, worldly, and human conditions, brings out the similarities and differences of their work. Regarding their historical context, they could have engaged in a dialogue; but they never did. Their personal temperament and thematic approach to key issues concerning the concept of (...) responsibility—such as subjectivity, primordiality, or relationality—can be used to build pillars for a bridge between the two thinkers’ respective approaches. In den ersten zwei Jahrhunderten unserer Zeitrechnung erfuhren viele Bestimmungen jüdischer Zugehörigkeit eine Umformulierung. Eine der Neuerungen war die Entstehung der jüdischen Matrilinearität. In dem Aufsatz werden die Hintergründe dieses Wandels und ihre Auswirkungen auf das zeitgleich entstehende Christentum beschrieben, das an der Patrilinearität der antiken Gesellschaften festhielt. In einem letzten Abschnitt wird auf die Konsequenzen der modernen Reproduktionsmedizin für diese Regelwerke hingewiesen.

This paper highlights several problems in the contemporary phenomenological analysis of religious experience in Continental philosophy of religion, especially in its French iteration, as manifested in such thinkers as Jean-Luc Marion, Michel Henry, Jean-Yves Lacoste, Jean-Louis Chrétien, Emmanuel Falque, and others. After laying out the main issues, the paper proposes a fuller investigation of religious practices, such as liturgy or ritual, as a fruitful way to address some of the identified limitations. The final section of the paper assesses what questions (...) remain and how one might draw on existing resources in these thinkers to push a phenomenological analysis of religious practices further in ways that broaden phenomenology of religion beyond its current somewhat narrow strictures and commitments.
