I examine some recent claims put forward by L. A. Paul, Barry Dainton and Simon Prosser, to the effect that perceptual experiences of movement and change involve an (apparent) experience of ‘passage’, in the sense at issue in debates about the metaphysics of time. Paul, Dainton and Prosser all argue that this supposed feature of perceptual experience – call it a phenomenology of passage – is illusory, thereby defending the view that there is no such a thing as passage, conceived (...) of as a feature of mind-independent reality. I suggest that in fact there is no such phenomenology of passage in the first place. There is, however, a specific structural aspect of the phenomenology of perceptual experiences of movement and change that can explain how one might mistakenly come to the belief that such experiences do involve a phenomenology of passage. According to virtue epistemology, knowledge involves cognitive success that is due to cognitive competence. This paper explores the prospects of a virtue theory of knowledge that, so far, has no takers in the literature. It combines features from a couple of different virtue theories: like Pritchard's [forthcoming; et al. 2010] view, it qualifies as what I call an ‘impure’ version of virtue epistemology, according to which the competence condition is supplemented by an additional condition; like Sosa's 2007, 2010 view, it (...) construes the ‘because’ relation at issue in the competence condition in terms of competence manifestation. I argue that this virtue epistemology can steer clear of a number of old and new problems that arise for its rivals on both sides. (shrink)

: During the "institutional revolution" between 1870 and 1910 almost two dozen physics institutes were newly erected in Germany. The design of these buildings was largely determined by sets of precautions against various sorts of disturbances. These undertakings were by no means unique. Recent historical studies have identified similar attempts in physics institutes outside Germany. But as yet, hardly a word has been wasted on the necessity of these precautionary measures. It seems to be self-explanatory that disturbances should be precluded (...) from scientific investigations. My paper criticizes this approach. The evidential nature of this assertion rests on the questionable assumption that disturbances are "external factors," which hinder physical research. I examine the 'architecture of disturbance' and show that it is the set of precautions itself which sometimes produces 'disturbing' effects. I then focus on particular sources of disturbance that were taken into account in the design of the buildings, and analyze the aporias that characterize the 'external' definition of disturbances. In conclusion, an alternative understanding of disturbances is offered. Following Michel Serres's concept of the parasite, I suggest that disturbances indicate the "being of relation" in physics research around 1900. From this point of view I finally sketch two novel features that governed the design of physics institutes after the turn of the century. (shrink)

Fragen wir nach den Pflichten und Rechten, die wir einander gegenüber haben, so ist die erste Antwort der Moderne, dass es Pflichten und Rechte der Gleichheit sind: Gleichheit ist die vorrangig nromative Idee der Moderne. Das gilt im Moralischen ebenso wie im Politischen. Gleichheit ist die Grundidee der modernen Moralphilosophie und der modernen Verfassungsstaaten. Die moderne Begründung und Durchsetzung der Gleichheitsidee begleitet jedoch wie ein Schatten eine andere Einstellung: eine Haltung der 'Befragung' der Gleichheit. Diese andere Einstellung betrachtet die Gleichheitsidee (...) von außen, in ihren Folgen für das Leben der Individuen; sie betrachtet die Gleichheit in ihren Brechungen und Spiegelungen in deren Leben. Das ist die Methode der Befragung der Gleichheit: Sie ist eine 'Reflexion' der Gleichheit im Verhältnis zur Individualität. Die Idee der Gleichheit kann für die Individuen Einschränkungen, gar Verzerrungen und Verletzungen bedeuten; was für alle gerecht ist, ist nicht für jeden gut. Das ist der Inhalt der Befragung der Gleichheit: Sie ist eine 'Kritik' der Gleichheit am Maßstab der Individualität. Christoph Menke geht es in seinem Buch um dieses Unternehmen einer Befragung der Gleichheit. Dazu bezieht er sich auf wichtige Stationen ihrer Geschichte: die romantische Revolutionskritik (Burke, Schiller), Nietzsches Genealogie der Moral, Schmitts Theorie der Souveränität, Adornos negative Dialektik der Gleichheit. Zugleich betrachtet er die gegenwärtigen philosophischen Debatten um die Idee der Gleichheit: die Debatte um den Begriff der Gerechtigkeit (Derrida); um den Wohlfahrtsstaat (Luhmann, Taylor, Foucault); zwischen Liberalismus und Kommunitarismus (Rawls). The Honorable Merchant as an ideal of business ethics has a long-standing tradition. However, this ideal focusses a lot on the individual person and less on situational conditions, constraints and incentives under which people act. The Order Ethics approach helps conceptualize and justify why business ethics for the globalized market economy might shift this focus and put situational conditions on top of the agenda. This holds within companies as well: Instead of insisting on the ideal of the honorable merchant, companies (...) should change structural incentives and conditions, by way of mechanisms such as Corporate Social Responsibility and others. Die These, dass neben dem Wohlergehen und der Moral der Sinn eine dritte, irreduzibel eigenständige und fundamentale Dimension des guten Lebens darstellt, hat im Zuge des erneuten Interesses an der Kategorie des Sinns breite Beachtung gefunden. Das Ziel dieses Beitrags besteht erstens darin zu erkunden, was diese These eigentlich beinhaltet. Bei näherer Prüfung zeigt sich nämlich, dass die These auch und gerade von ihren Vertretern bisher überwiegend durch Appelle an Intuitionen und durch Abgrenzung zu alternativen Positionen, aber eben nur unzureichend (...) positiv motiviert und konturiert wurde. Insbesondere wird vorgeschlagen, zwischen einer axiologischen und einer rationalitätstheoretischen Variante der These zu unterscheiden. Während Sinn gemäß der axiologischen Eigenständigkeitsthese eine irreduzibel eigenständige, fundamentale Wertdimension bildet, entlang derer ein Leben als mehr oder weniger gut qualifiziert werden kann, behauptet die rationalitätstheoretische Eigenständigkeitsthese, dass Sinn eine irreduzibel eigenständige, fundamentale Quelle praktischer Gründe bildet. Diese Unterscheidung ist nicht zuletzt deshalb bedeutsam, weil die zweite These die erste vorauszusetzen scheint, während das Umgekehrte nicht gilt: Selbst Hauptvertreter der axiologischen Eigenständigkeitsthese machen sich die rationalitätstheoretische Variante nur mit großen Einschränkungen zu eigen, die wiederum zu kritischen Fragen auch an die axiologische Fassung Anlass geben. Zweitens soll im Zuge einer Erkundung des durch die axiologische wie auch durch die rationalitätstheoretische Version der Eigenständigkeitsthese aufgespannten Problemfeldes gezeigt werden, dass bisher keine überzeugenden Argumente für die Eigenständigkeitsthese vorgebracht und auch keine plausiblen inhaltlichen Kandidaten für eine Theorie des Sinns, die die Anforderungen an eine solche eigenständige Dimension des guten Lebens und Quelle praktischer Gründe sui generis erfüllen würden, identifiziert werden konnten. Des Weiteren sprechen auch allgemeine wert- und rationalitätstheoretische Erwägungen gegen die Annahme einer solchen Dimension. (shrink)

Variants of the slogan that a succession of experiences does not amount to an experience of succession are commonplace in the philosophical literature on temporal experience. I distinguish three quite different arguments that might be captured using this slogan: the individuation argument, the unity argument, and the causal argument. Versions of the unity and the causal argument are often invoked in support of a particular view of the nature of temporal experience sometimes called intentionalism, and against a rival view sometimes (...) called extensionalism. I examine these arguments in light of the individuation argument. In particular, I show that the individuation argument is, at least prima facie, neutral between those two views of temporal experience; and once the individuation argument is in place, the unity and causal argument also lose their force against extensionalism. Heuristics make decisions not only fast and frugally, but often nearly as well as “full” rationality or even better. Using such heuristics should therefore meet health care standards under liability law. But an independent court often has little chance to verify the necessary information. And judgments based on heuristics might appear to have little legitimacy, given the widespread belief in formal rationality.

The present article sets out to defend the thesis that among the more or less familiar enemies or challenges an adequate theory of virtue has to cope with is another, less obvious one – virtue ethics itself. The project of establishing virtue ethics as a third paradigm of normative ethics at eye level with consequentialism and deontological approaches to ethics threatens to distort not just our ethical thinking but the theory of virtue itself. A theory of virtue that is able (...) to meet the demands of a full-blown virtue ethics necessarily has to face three fundamental dilemmas and thus seems to fail as an adequate theory of virtue. And vice versa: An ontologically and normatively viable theory of virtue will be unsuited to provide a promising starting point for virtue ethics as the “third kid on the block” among the options of self-standing paradigms of normative ethics. Most contemporary legal philosophers tend to take force to be an accessory to the law. According to this prevalent view the law primarily consists of a series of demands made on us; force, conversely, comes into play only when these demands fail to be satisfied. This book claims that this model should be jettisoned in favour of a radically different one: according to the proposed view, force is not an accessory to the law but rather its attribute. The law is (...) not simply a set of rules incidentally guaranteed by force, but it should be understood as essentially rules about force. The book explores in detail the nature of this claim and develops its corollaries. It then provides an overview of the contemporary jurisprudential debates relating to force and violence, and defends its claims against well-known counter-arguments by Hart, Raz and others. This book offers an innovative insight into the concept of Pure Theory. In contrast to what was claimed by Hans Kelsen, the most eminent contributor to this theory, the author argues that the core insight of the Pure Theory is not to be found in the concept of a basic norm, or in the supposed absence of a conceptual relation between law and morality, but rather in the fundamental and comprehensive reformulation of how to model the functioning of the law intended as an ordering of force and violence. In other cities, too, students, artists, and professors rose up against authoritarian ways of life and institutions, pointing to the “fascism” of the Nazi period that their parents wished to repress. But remembrance likes the beauty of appearances, and the revolt in Berlin was initially colored by something unreal and playful, a counterpoint led to its conclusion, something both bounded and experimental. This something was lost between 1967 and 1969, though (...) it was even less present outside of Berlin, perhaps because of the delay with which the revolt spread beyond.. (shrink)

The article outlines a general epistemological theory of argument: a theory that regards providingjustified belief as the principal aim of argumentation, and defends it instrumentalistically. After introducing some central terms of such a theory (2), answers to its central questions are proposed: the primary object and structure of the theory (3), the function of arguments, which is to lead to justified belief (4), the way such arguments function, which is to guide the addressee's cognizing (5), objective versus subjective aspects of (...) argumentation (6), designing different types of argument (7). Then the notion of '(argumentatively) valid argument' is defined and criteria for the adequate use of such arguments are introduced (8). Finally, this conception is justified as, among others, leading to more true beliefs than competing conceptions (9). (shrink)

In apparent motion experiments, participants are presented with what is in fact a succession of two brief stationary stimuli at two different locations, but they report an impression of movement. Philosophers have recently debated whether apparent motion provides evidence in favour of a particular account of the nature of temporal experience. I argue that the existing discussion in this area is premised on a mistaken view of the phenomenology of apparent motion and, as a result, the space of possible philosophical (...) positions has not yet been fully explored. In particular, I argue that the existence of apparent motion is compatible with an account of the nature of temporal experience that involves a version of direct realism. In doing so, I also argue against two other claims often made about apparent motion, viz. that apparent motion is the psychological phenomenon that underlies motion experience in the cinema, and that apparent motion is subjectively indistinguishable from real motion. Promotion of pro-social attitudes and moral behaviour is a crucial and challenging task for social orders. As traditional ways such as moral education have some, but apparently and unfortunately only limited effect, some authors have suggested employing biomedical means such as pharmaceuticals or electrical stimulation of the brain to alter individual psychologies in a more direct way — moral bioenhancement. One of the salient questions in the nascent ethical debate concerns the impact of such interventions on human freedom. Advocates argue (...) that moral bioenhancements do not pose a serious threat to freedom. This contention, however, is based on an overly narrow, if not impoverished, sense of freedom, which comprises only freedom of action and freedom of will. Mind-altering interventions primarily affect another sense of freedom: freedom of mind, a concept that has not received much attention although it should rank among the most important legal and political freedoms. The article introduces three senses of mental freedom potentially infringed upon by moral bioenhancement and places it in a broader perspective. Ignorance of mental freedom has far-ranging consequences for the shape of the political and legal order at large. As many advocates are apparently not aware of the freedoms they seek to undermine, their calls for moral enhancement programmes are dangerously premature. (shrink)

An influential strand in recent action-theory employs constitutivist arguments in order to present accounts of individual agency and practical identity. I argue for an extension of this framework into the interpersonal realm, and suggest using it to reassess issues in jurisprudence. A legal system is an instantiation of the solution to the inescapable tasks of self-constituting action and identity-formation in the presence of other agents. Law's validity and normativity can be enlightened when the constitutivist approach considers the external prerequisites of (...) individuals' self-conceptions qua agents. More specifically, this argumentative strategy allows a reassessment of Fuller's “internal morality of law.” Whereas, pace Fuller, morally substantive conclusions cannot be derived from formal criteria of legality, there are unconditional normative requirements that constrain law. Robots have been introduced into our society, but their social role is still unclear. A critical issue is whether the robot’s exhibition of intelligent behaviour leads to the users’ perception of the robot as being a social actor, similar to the way in which people treat computers and media as social actors. The first experiment mimicked Stanley Milgram’s obedience experiment, but on a robot. The participants were asked to administer electric shocks to a robot, and the results show that people (...) have fewer concerns about abusing robots than about abusing other people. We refined the methodology for the second experiment by intensifying the social dilemma of the users. The participants were asked to kill the robot. In this experiment, the intelligence of the robot and the gender of the participants were the independent variables, and the users’ destructive behaviour towards the robot the dependent variable. Several practical and methodological problems compromised the acquired data, but we can conclude that the robot’s intelligence had a significant influence on the users’ destructive behaviour. We discuss the encountered problems and suggest improvements. We also speculate on whether the users’ perception of the robot as being “sort of alive” may have influenced the participants’ abusive behaviour. (shrink)

In March 2008, the German Federal Constitutional Court (GFCC) has passed an important, even though preliminary, decision concerning data retention. The GFCC’s decision accepts the storage of data, but greatly restricts their use to serious offenses like murder and organized crime. From an ethical point of view, it is particularly interesting to look at the justification given by the GFCC, which relies heavily on the argument that the “impartiality” (Unbefangenheit) of communication will be thoroughly damaged if feelings of being watched (...) spread in a society. This argument is examined in view of two contrasting theoretical approaches: Discourse ethics and evolutionary contractarian theory. (shrink)

This paper tries to provide a complete list and classification of the motives for acting in accordance with morals, to explain the mechanisms underlying the less transparent among these motives, and to probe which of these motives are suited for justifying morals. (1) After giving reasons for the importance of an empirical theory of moral motives for ethics, and after specifying the exact question of the present study (2) a general model of moral action (3) and a main classification of (...) the motives for acting morally is presented. (4) Self-transcendent motives, (5) motives close to morals, like sympathy and respect, (6) and moral motives in the narrow sense, which proceed from moral judgements, are scrutinized in detail. Only the motives near to morals and interest in cooperation but not the moral motives in the narrow sense are suited for justifying morals. (7) A concluding sketch of the development of moral judgements shows that only motives near to morals and interest in cooperation (but not e.g. pure reason) are also the sources of autonomously developed moral criteria. This contribution discusses some problems of Pragma-Dialectics and explains them by its consensualistic view of the function of argumentation and by its philosophical underpinnings. It is suggested that these problems can be overcome by relying on a better epistemology and on an epistemological theory of argumentation. On the one hand Pragma-Dialectics takes unqualified consensus as the aim of argumentation, which is problematic, (Sect. 2) on the other it includes strong epistemological and rationalistic elements (Sect. 3). The problematic philosophical underpinnings of (...) Pragma-Dialectics, specifically Critical Rationalism as well as Logical Constructivism and Dialogic Logic of the Erlangen School, are among the sources of this incoherence (Sect. 4). A detailed critique of the Pragma-Dialectical discussion rules shows the negative consequences of this foundation and indicates how they could be avoided (Sects. 5, 6). (shrink)

This article develops an assessment of the present-day European crisis management, referring to Wolfgang Streeck’s recent interpretation of the European ‘consolidation state’ as an attempt to install a ‘Hayekian’ regime of liberalized transnational markets. This article arrives at a diagnosis different from Streeck’s: if there has been a ‘Hayekian’ regime, it had already developed after the collapse of the Bretton Woods system in 1973 and the subsequent dismantling of capital controls in the USA and Europe. As it appeared in the (...) financial crisis of 2007–2008, the ultimate practical test of the Hayekian vision was dramatically negative. European crisis management, as it is still largely occupied with the imperative to maintain the solvency of troubled Euro states vis-à-vis the capital markets, is not following a Hayekian script. Rather, it is confronted with the challenge of removing the debris of the collapse of the former Hayekian regime, taking the form of zombie banks and large uncovered capital claims. To master this challenge, not only intact European institutions and transnational cooperation in Europe would be required, but also much more democratic pressure from below. (shrink)

Um Transaktionen vorzunehmen, müssen die Transaktionsinstanzen mit besonders autorisierten Zeichen versehen werden, deren Ausgabe historisch von der Staatlichkeit monopolisiert worden ist. Der von der Bundesdruckerei produzierte elektronische Personalausweis ist der Versuch, für den digitalen Raum entsprechende Zeichenregime zu schaffen. Damit nimmt diese Institution für das Regieren in und mit dem Internet eine wichtige Position ein, anhand derer sich wesentliche Aspekte einer (...) digitalen Gouvernemedialität aufzeigen lassen. In modern societies, transactions are highly significant events of transmission, connected to praxis of authentification and authorization. In order to carry out transactions, the instances of transaction have to be provided with especially authorized signs, the issuing of which has been monopolized by the State. The electronic ID-card produced by the Federal Printing Office can be considered as an attempt to create corresponding regimes of signification for the digital sphere. This institution thus occupies an important position for governing in and with the Internet; hence, its examination can point out essential aspects of digital. (shrink)
