This article consists of three parts, two introductory, in which the limits and the methods of analysis of dialogues are expounded, and the major part, in which the main features of a philosophical theory of disputation are outlined.It was an essential aim of the philosophical analysis of argumentative dialogues to develop tools of substantiation for cases in which logic doesn't help any more. In the first part of this paper I show that such tools can and will be developed only (...) by analyzing argumentations (“argumentation” in the sense of a monologue in which arguments for a thesis are brought forward), and that the analysis of argumentative dialogues doesn't contribute anything to the development of such tools.The systematically first task of the philosophical analysis of dialogues consists in understanding the general practical aims of philosophically interesting types of dialogue. Only subsequently the rules of the dialogue can be reconstructed as good means for reaching these aims. Dialogical games constructed without referring to such a purpose are externally senseless and useless.The third part is an outline of a philosophical theory of disputation (“disputation” here will mean: (learned) dialogue in which the participants cooperatively though perhaps controversially attempt to find out by means of arguments and mutual criticism whether a thesis is true or false). Disputations contain argumentations, and many functions of a disputation can also be fulfilled by argumentations alone. Certifying the truth of convictions is the specific aim of disputation. This is accomplished by eliminating errors of substantiation and foundation as effectively as possible, in revising false convictions and their foundations, thereby making the remaining convictions more certain. Based on this analysis of the aim of disputation, the basic rules of disputations will be critically reconstructed: possible moves, rules of sequence, and the internal aim and ends of disputations. In this article, a new, idealizing-hermeneutic methodological approach to developing a theory of philosophical arguments is presented and carried out. The basis for this is a theory of ideal philosophical theory types developed from the analysis of historical examples. According to this theory, the following ideal types of theory exist in philosophy: 1. descriptive-nomological, 2. idealizing-hermeneutic, 3. technical-constructive, 4. ontic-practical. These types of theories are characterized in particular by what their basic types of theses are. The main task of this (...) article is then to determine the types of arguments that are suitable for justifying these types of theses. Surprisingly, practical arguments play a key role here. This paper explores the phenomenon of meta-emotions. Meta-emotions are emotions people have about their own emotions. We analyze the intentional structure of meta-emotions and show how psychological findings support our account. Acknowledgement of meta-emotions can elucidate a number of important issues in the philosophy of mind and, more specifically, the philosophy and psychology of emotions. Among them are (allegedly) ambivalent or paradoxical emotions, emotional communication, emotional self-regulation, privileged access failure for repressed emotions, and survivor guilt.

Assertion is the central vehicle for the sharing of knowledge. Whether knowledge is shared successfully often depends on the quality of assertions: good assertions lead to successful knowledge sharing, while bad ones don't. In Sharing Knowledge, Christoph Kelp and Mona Simion investigate the relation between knowledge sharing and assertion, and develop an account of what it is to assert well. More specifically, they argue that the function of assertion is to share knowledge with others. It is this function that (...) supports a central norm of assertion according to which a good assertion is one that has the disposition to generate knowledge in others. The book uses this functionalist approach to motivate further norms of assertion on both the speaker and the hearer side and investigates ramifications of this view for other questions about assertion. ACTION-THEORETICALLY EXPLANATORY INTERPRETATIONS AS A MEANS OF SEMANTIC MEANING ANALYSIS The article first develops a general procedure for semantic meaning analysis in difficult cases where the meaning is very uncertain. The procedure consists of searching for one or more possible hypothetical causal explanations of the text, these explanations containing, among other things, the semantic intention of the author, his subjective reasons for this meaning and for the writing down of the text, but also the path of transmission of the text (...) from the writing down to the respective present text version. These hypothetical explanations (interpretations) are deductive-nomological or probabilistic, therefore presuppose corresponding general law hypotheses. If there is only one possible (hypothetical) explanation of the text at hand, this hypothetical explanation is also true. Very often, however, there are several possible explanations. In this case, the probabilities of these possible explanations must be determined; these probabilities then carry over to the individual hypotheses in the explanation (according to Bayes' law). This general procedure of meaning analysis is used in the second part of the article to reconstruct two famous interpretations (by Wapnewski and Hahn) of a poem by Walther von der Vogelweide ("Nemt, frowe, disen kranz"). -/- GERMAN ABSTRACT In dem Artikel wird zunächst ein allgemeines Verfahren zur semantischen Bedeutungsanalyse in schwierigen Fällen entwickelt, in denen die Bedeutung sehr unsicher ist. Das Verfahren besteht darin, daß eine oder mehrere mögliche hypothetische kausale Erklärungen des Textes gesucht werden, wobei diese Erklärungen u.a. die semantische Intention des Autors enthalten, seine subjektiven Gründe für diese Bedeutung und für die Niederschrift des Textes, aber auch den Weg der Tradierung des Textes von der Niederschrift bis zur jeweils vorliegenden Textversion. Diese hypothetischen Erklärungen (Deutungen) sind deduktiv-nomologisch oder probabilistisch, setzen deshalb entsprechende allgemeine Gesetzeshypothesen voraus. According to Fred Dretske's externalist theory of knowledge a subject knows that p if and only if she believes that p and this belief is caused or causally sustained by the information that p. Another famous feature of Dretske's epistemology is his denial that knowledge is closed under known entailment. I argue that, given Dretske's construal of information, he is in fact committed to the view that both information and knowledge are closed under known entailment. Hence, if it is true (...) that, as Dretske also believes, accepting closure leads to skepticism, he must either embrace skepticism or abandon his information theory of knowledge. (shrink)

_Nietzsche: Naturalism and Interpretation_ offers a resolution of one of the most vexing problems in Nietzsche scholarship. As perhaps the most significant predecessor of more recent attempts to formulate a postmetaphysical epistemology and ontology, Nietzsche is considered by many critics to share this problem with his successors: How can an antifoundationalist philosophy avoid vicious relativism and legitimate its claim to provide a platform for the critique of arguments, practices, and institutions? Christoph Cox argues that Nietzsche successfully navigates between relativism (...) and dogmatism, accepting the naturalistic critique of metaphysics and theology provided by modern science, yet maintaining that a thoroughgoing naturalism must move beyond scientific reductionism. It must accept a central feature of aesthetic understanding: acknowledgment of the primacy and irreducibility of interpretation. This view of Nietzsche's doctrines of perspectivism, becoming, and will to power as products of an overall naturalism balanced by a reciprocal commitment to interpretationism will spur new discussions of epistemology and ontology in contemporary thought. Much recent discussion in social epistemology has focussed on the question of whether peers can rationally sustain a disagreement. A growing number of social epistemologists hold that the answer is negative. We point to considerations from the history of science that favor rather the opposite answer. However, we also explain how the other position can appear intuitively attractive.

According to virtue epistemology, knowledge involves cognitive success that is due to cognitive competence. This paper explores the prospects of a virtue theory of knowledge that, so far, has no takers in the literature. It combines features from a couple of different virtue theories: like Pritchard's [forthcoming; et al. 2010] view, it qualifies as what I call an ‘impure’ version of virtue epistemology, according to which the competence condition is supplemented by an additional condition; like Sosa's 2007, 2010 view, it (...) construes the ‘because’ relation at issue in the competence condition in terms of competence manifestation. I argue that this virtue epistemology can steer clear of a number of old and new problems that arise for its rivals on both sides. (shrink)

: During the "institutional revolution" between 1870 and 1910 almost two dozen physics institutes were newly erected in Germany. The design of these buildings was largely determined by sets of precautions against various sorts of disturbances. These undertakings were by no means unique. Recent historical studies have identified similar attempts in physics institutes outside Germany. But as yet, hardly a word has been wasted on the necessity of these precautionary measures. It seems to be self-explanatory that disturbances should be precluded (...) from scientific investigations. My paper criticizes this approach. The evidential nature of this assertion rests on the questionable assumption that disturbances are "external factors," which hinder physical research. I examine the 'architecture of disturbance' and show that it is the set of precautions itself which sometimes produces 'disturbing' effects. I then focus on particular sources of disturbance that were taken into account in the design of the buildings, and analyze the aporias that characterize the 'external' definition of disturbances. In conclusion, an alternative understanding of disturbances is offered. Following Michel Serres's concept of the parasite, I suggest that disturbances indicate the "being of relation" in physics research around 1900. From this point of view I finally sketch two novel features that governed the design of physics institutes after the turn of the century. (shrink)

Management accounting and control seeks to provide information that substantiates decision-making at all firm levels and thus may also foster ethical decision-making. Against this background, this article presents a systematic literature review of research on management accounting and control and business ethics that has been published in the Journal of Business Ethics. Through this review, we intend to bring to the forefront a research topic that has been widely neglected in broader literature reviews on accounting ethics research and that has (...) been covered by a small number of articles published by traditional leading accounting journals only. Our systematic literature review is guided by a theoretical framework that integrates the decision-facilitating and decision-influencing roles of management accounting and control information and the stages of the ethical decision-making process. Through this theoretical lens, we analyze 64 management accounting and control articles published in the Journal of Business Ethics over more than three decades. Synthesizing and structuring this research, we discuss prior accomplishments and elaborate on avenues for future research. (shrink)

Heuristics make decisions not only fast and frugally, but often nearly as well as “full” rationality or even better. Using such heuristics should therefore meet health care standards under liability law. But an independent court often has little chance to verify the necessary information. And judgments based on heuristics might appear to have little legitimacy, given the widespread belief in formal rationality.

The Honorable Merchant as an ideal of business ethics has a long-standing tradition. However, this ideal focusses a lot on the individual person and less on situational conditions, constraints and incentives under which people act. The Order Ethics approach helps conceptualize and justify why business ethics for the globalized market economy might shift this focus and put situational conditions on top of the agenda. This holds within companies as well: Instead of insisting on the ideal of the honorable merchant, companies (...) should change structural incentives and conditions, by way of mechanisms such as Corporate Social Responsibility and others. Specialist philosophy periodicals first appeared in the early eighteenth century. Germany led the way with Acta Philosophorum . Published in Halle and edited by the theologian Christoph August Heumann, this pioneering journal reflected the great developments taking place in German intellectual life. In tone and content it embodies the era's growing enthusiasm and interest in all matters relating to both the history and the recent developments of philosophy. It forms a fascinating document not only of Germany's intellectual progress but (...) also of the earliest steps of the Enlightenment. Acta Philosophorum 's articles cover ancient philosophy as well as discussion of the current issues of the day and summaries of major philosophical works. With a broad European focus, contents include a description of the life of Locke, and discussions of Thomas Burnet, Bruno, Galileo and Stanley's History of Philosophy . Originally appearing in 18 parts, Acta Philosophorum includes several fold-out tables and engraved portraits, and is indexed by author and subject. This exceptionally rare document of pre-Kantian philosophy and the German Enlightenment is now available as an important historical resource for libraries. (shrink)

The notions of well-being and happiness are widely used today in a range of disciplines, areas of research, educational practice and daily life. However, these terms have to be considered critically, and careful reflection on their meaning is needed in each context where they are used. One reflection in the context of education has been conducted in relation to positive psychology as well as philosophical concepts and questions such as how to live a good life, the art of living and (...) especially Schmid’s concept of Lebenskunst or ‘art of living’. Still, the research undertaken to connect these concepts with the area of early childhood education in particular has been rather limited. The current paper is one step to bridge this gap by exploring how the concept of the art of living relates to early childhood education and the notion of well-being as it is used in the New Zealand early childhood curriculum Te Whāriki. It is proposed that early childhood educators can support the development of children’s abilities to enable them to engage actively in shaping their own lives and developing their own art of living earlier rather than later in their lives. Further, suggestions are made for teaching practice about ways early childhood educators can support young children to become reflective, autonomous and knowledgeable human beings, who are able to take responsibility for their own lives. The paper critically discusses an empirical study by Mizrahi & Dickinson 2020, which analyzes in a huge data base (JSTORE) the incidence of three types of philosophical arguments. Their results are: 1. Deductive arguments were the most commeon type of argument in philosophy until the end of the 20th century. 2. Around 2008 a shift in methodology occurred, such that the indcutive arguments outweigh other types of argument. The paper, first, criticizes the empirical study as grossly false and considers the (...) - very limited - possibilities of recognition of argument types by present computer programs. (shrink)

Many social philosophers and ethicists contend that a modern society cannot remain stable merely by its citizens obeying all of its rules. Such prominent theoreticians as J. Habermas, J. Rawls, D. Gauthier or R. Rorty hold the view that the citizens of a modern society must exhibit additional anthropological qualities which are termed moral surpluses here. Christoph Lütge argues, however, that no moral surplus is immune to erosion by systematic counter-incentives and that anthropological qualities in general cannot serve as (...) a basis for ethics in the globalized world. An order ethics, which is based on weaker prerequisites, namely the characteristics of situations and their basic conditions (orders), is more likely to count on cross-cultural approval in the era of globalization. We present a method for integrating rippling-based rewriting into matrix-based theorem proving as a means for automating inductive specification proofs. The selection of connections in an inductive matrix proof is guided by symmetries between induction hypothesis and induction conclusion. Unification is extended by decision procedures and a rippling/reverse-rippling heuristic. Conditional substitutions are generated whenever a uniform substitution is impossible. We illustrate the integrated method by discussing several inductive proofs for the integer square root problem as well as the algorithms extracted (...) from these proofs. (shrink)

Among early modern Christian kabbbalists such as Pico della Mirandola and Christian Knorr von Rosenroth, Kabbalah counts as part of philosophia perennis and esoteric Jewish philosophy. Bruckers differentiation between Kabbalah as esoteric Jewish philosophy and Maimonides as exoteric Jewish philosophy is taken up by Tiedemann and Hegel, and is well known to Schelling and Molitor. In opposition to this taxinomy among Christian philosophers, Jewish philosophers and scholars of »Wissenschaft des Judentums« like Salomon Munk, Manuel Joel, Hermann Cohen or Julius Guttmann (...) exclude Kabbalah from the canon of Jewish philosophy proper, exemplified by Yehuda Halevi or Maimonides. It is only after World War I that Gershom Scholem inaugurates the modern research of Kabbalah as »mysticism«, juxtaposed to philosophy and to the rationalistic traditions inJudaism. (shrink)

Die These, dass neben dem Wohlergehen und der Moral der Sinn eine dritte, irreduzibel eigenständige und fundamentale Dimension des guten Lebens darstellt, hat im Zuge des erneuten Interesses an der Kategorie des Sinns breite Beachtung gefunden. Das Ziel dieses Beitrags besteht erstens darin zu erkunden, was diese These eigentlich beinhaltet. Bei näherer Prüfung zeigt sich nämlich, dass die These auch und gerade von ihren Vertretern bisher überwiegend durch Appelle an Intuitionen und durch Abgrenzung zu alternativen Positionen, aber eben nur unzureichend (...) positiv motiviert und konturiert wurde. Insbesondere wird vorgeschlagen, zwischen einer axiologischen und einer rationalitätstheoretischen Variante der These zu unterscheiden. Während Sinn gemäß der axiologischen Eigenständigkeitsthese eine irreduzibel eigenständige, fundamentale Wertdimension bildet, entlang derer ein Leben als mehr oder weniger gut qualifiziert werden kann, behauptet die rationalitätstheoretische Eigenständigkeitsthese, dass Sinn eine irreduzibel eigenständige, fundamentale Quelle praktischer Gründe bildet. Diese Unterscheidung ist nicht zuletzt deshalb bedeutsam, weil die zweite These die erste vorauszusetzen scheint, während das Umgekehrte nicht gilt: Selbst Hauptvertreter der axiologischen Eigenständigkeitsthese machen sich die rationalitätstheoretische Variante nur mit großen Einschränkungen zu eigen, die wiederum zu kritischen Fragen auch an die axiologische Fassung Anlass geben. Zweitens soll im Zuge einer Erkundung des durch die axiologische wie auch durch die rationalitätstheoretische Version der Eigenständigkeitsthese aufgespannten Problemfeldes gezeigt werden, dass bisher keine überzeugenden Argumente für die Eigenständigkeitsthese vorgebracht und auch keine plausiblen inhaltlichen Kandidaten für eine Theorie des Sinns, die die Anforderungen an eine solche eigenständige Dimension des guten Lebens und Quelle praktischer Gründe sui generis erfüllen würden, identifiziert werden konnten. Des Weiteren sprechen auch allgemeine wert- und rationalitätstheoretische Erwägungen gegen die Annahme einer solchen Dimension. (shrink)
