According to virtue epistemology, knowledge involves cognitive success that is due to cognitive competence. This paper explores the prospects of a virtue theory of knowledge that, so far, has no takers in the literature. It combines features from a couple of different virtue theories: like Pritchard's [forthcoming; et al. 2010] view, it qualifies as what I call an ‘impure’ version of virtue epistemology, according to which the competence condition is supplemented by an additional condition; like Sosa's 2007, 2010 view, it (...) construes the ‘because’ relation at issue in the competence condition in terms of competence manifestation. I argue that this virtue epistemology can steer clear of a number of old and new problems that arise for its rivals on both sides. (shrink)

Recent knowledge first epistemology features a number of different accounts of justified belief, including a knowledge first reductionism according to which to believe justifiably is to know Sutton, Littlejohn, Williamson, a knowledge first version of accessibilism Millar and a knowledge first version of mentalism Bird. This paper offers a knowledge first version of virtue epistemology and argues that it is preferable to its knowledge first epistemological rivals: only knowledge first virtue epistemology manages to steer clear of a number of problems (...) that its competition encounters. Ausgehend von einer Verortung der Kategorie der ethischen Tugend im Feld der Tugenden überhaupt wird deren Struktur und ontologischer Status zunächst anhand von sieben grundlegenden Merkmalen näher bestimmt, um dann aus normativer Perspektive das für sie konstitutive Zusammenspiel von kognitiver, motivationaler und affektiver Dimension zu charakterisieren. Abschließend wird im Licht von drei konkurrierenden philosophischen Modellen der Frage nachgegangen, was es überhaupt erlaubt, einen bestimmten Charakterzug als Tugend zu bestimmen.

: During the "institutional revolution" between 1870 and 1910 almost two dozen physics institutes were newly erected in Germany. The design of these buildings was largely determined by sets of precautions against various sorts of disturbances. These undertakings were by no means unique. Recent historical studies have identified similar attempts in physics institutes outside Germany. But as yet, hardly a word has been wasted on the necessity of these precautionary measures. It seems to be self-explanatory that disturbances should be precluded (...) from scientific investigations. My paper criticizes this approach. The evidential nature of this assertion rests on the questionable assumption that disturbances are "external factors," which hinder physical research. I examine the 'architecture of disturbance' and show that it is the set of precautions itself which sometimes produces 'disturbing' effects. I then focus on particular sources of disturbance that were taken into account in the design of the buildings, and analyze the aporias that characterize the 'external' definition of disturbances. In conclusion, an alternative understanding of disturbances is offered. Following Michel Serres's concept of the parasite, I suggest that disturbances indicate the "being of relation" in physics research around 1900. From this point of view I finally sketch two novel features that governed the design of physics institutes after the turn of the century. (shrink)

This book brings a new perspective—mainly out of German intellectual discussions rooted in Hegel—to bear on the problems of equality as discussed in Anglo-American conceptions of liberalism.

Robots have been introduced into our society, but their social role is still unclear. A critical issue is whether the robot’s exhibition of intelligent behaviour leads to the users’ perception of the robot as being a social actor, similar to the way in which people treat computers and media as social actors. The first experiment mimicked Stanley Milgram’s obedience experiment, but on a robot. The participants were asked to administer electric shocks to a robot, and the results show that people (...) have fewer concerns about abusing robots than about abusing other people. We refined the methodology for the second experiment by intensifying the social dilemma of the users. The participants were asked to kill the robot. In this experiment, the intelligence of the robot and the gender of the participants were the independent variables, and the users’ destructive behaviour towards the robot the dependent variable. Several practical and methodological problems compromised the acquired data, but we can conclude that the robot’s intelligence had a significant influence on the users’ destructive behaviour. We discuss the encountered problems and suggest improvements. We also speculate on whether the users’ perception of the robot as being “sort of alive” may have influenced the participants’ abusive behaviour. (shrink)

Most contemporary legal philosophers tend to take force to be an accessory to the law. According to this prevalent view the law primarily consists of a series of demands made on us; force, conversely, comes into play only when these demands fail to be satisfied. This book claims that this model should be jettisoned in favour of a radically different one: according to the proposed view, force is not an accessory to the law but rather its attribute. The law is (...) not simply a set of rules incidentally guaranteed by force, but it should be understood as essentially rules about force. The book explores in detail the nature of this claim and develops its corollaries. It then provides an overview of the contemporary jurisprudential debates relating to force and violence, and defends its claims against well-known counter-arguments by Hart, Raz and others. This book offers an innovative insight into the concept of Pure Theory. In contrast to what was claimed by Hans Kelsen, the most eminent contributor to this theory, the author argues that the core insight of the Pure Theory is not to be found in the concept of a basic norm, or in the supposed absence of a conceptual relation between law and morality, but rather in the fundamental and comprehensive reformulation of how to model the functioning of the law intended as an ordering of force and violence. The paper introduces, compares and contrasts formal models of source reliability proposed in the epistemology literature, in particular the prominent models of Bovens and Hartmann and Olsson :127–143, 2011). All are Bayesian models seeking to provide normative guidance, yet they differ subtly in assumptions and resulting behavior. Models are evaluated both on conceptual grounds and through simulations, and the relationship between models is clarified. The simulations both show surprising similarities and highlight relevant differences between these models. Most importantly, however, our (...) evaluations reveal that important normative concerns arguably remain unresolved. The philosophical implications of this for testimony are discussed. (shrink)

Promotion of pro-social attitudes and moral behaviour is a crucial and challenging task for social orders. As traditional ways such as moral education have some, but apparently and unfortunately only limited effect, some authors have suggested employing biomedical means such as pharmaceuticals or electrical stimulation of the brain to alter individual psychologies in a more direct way — moral bioenhancement. One of the salient questions in the nascent ethical debate concerns the impact of such interventions on human freedom. Advocates argue (...) that moral bioenhancements do not pose a serious threat to freedom. This contention, however, is based on an overly narrow, if not impoverished, sense of freedom, which comprises only freedom of action and freedom of will. Mind-altering interventions primarily affect another sense of freedom: freedom of mind, a concept that has not received much attention although it should rank among the most important legal and political freedoms. The article introduces three senses of mental freedom potentially infringed upon by moral bioenhancement and places it in a broader perspective. Ignorance of mental freedom has far-ranging consequences for the shape of the political and legal order at large. As many advocates are apparently not aware of the freedoms they seek to undermine, their calls for moral enhancement programmes are dangerously premature. (shrink)

An influential strand in recent action-theory employs constitutivist arguments in order to present accounts of individual agency and practical identity. I argue for an extension of this framework into the interpersonal realm, and suggest using it to reassess issues in jurisprudence. A legal system is an instantiation of the solution to the inescapable tasks of self-constituting action and identity-formation in the presence of other agents. Law's validity and normativity can be enlightened when the constitutivist approach considers the external prerequisites of (...) individuals' self-conceptions qua agents. More specifically, this argumentative strategy allows a reassessment of Fuller's “internal morality of law.” Whereas, pace Fuller, morally substantive conclusions cannot be derived from formal criteria of legality, there are unconditional normative requirements that constrain law. In March 2008, the German Federal Constitutional Court (GFCC) has passed an important, even though preliminary, decision concerning data retention. The GFCC’s decision accepts the storage of data, but greatly restricts their use to serious offenses like murder and organized crime. From an ethical point of view, it is particularly interesting to look at the justification given by the GFCC, which relies heavily on the argument that the “impartiality” (Unbefangenheit) of communication will be thoroughly damaged if feelings of being watched (...) spread in a society. This argument is examined in view of two contrasting theoretical approaches: Discourse ethics and evolutionary contractarian theory. (shrink)

This article proposes an empirical approach to understanding the life of an organism that overcomes reductionist and dualist approaches. The approach is based on Immanuel Kant’s analysis of the cognitive conditions required for the recognition of an organism: the concept of teleology and the assumption of a formative power of self-generation. It is analyzed how these two criteria are applied in the cognition of a developing organism. Using the example of a developmental series of a plant leaf, an active and (...) relational process between observer and developing organism is shown, within which the teleology and self-generating power of the organism can be empirically observed through the mental faculties of understanding and will. Furthermore, it is emphasized that, according to Kant, even physical objects are not readily given, but are actively constituted through the unification of sense perceptions with concepts. This Kantian mode of objectification facilitates cognition of the physical properties of an organism. It can be supplemented with a participatory and co-constitutive mode of realization, in which the life of the organism (its teleologically organizing and self-generating power) can become an object of empirical research. Furthermore, it is argued that the participatory mode also facilitates an expanded conception of nature that allows for the existence of living beings within it. Finally, an analogy to Goethe’s approach to the living organism is highlighted. In summary, it is stated that to understand life, one must consciously participate in it. (shrink)

Many traditional conceptions of ethics use categories and arguments that have been developed under conditions of pre-modern societies and are not useful in the age of globalisation anymore. I argue that we need an economic ethics which employs economics as a key theoretical resource and which focuses on institutions for implementing moral norms. This conception is then elaborated further in the area of business ethics. It is illustrated in the case for banning child labour.

A number of recent allegations of scientific misconduct in Germany have led to judicial proceedings. Two examples are analyzed in depth, showing evidence for mutual incompatibilities between the legal system and the scientific system. In particular, it seems doubtful whether basic rules of good scientific practice are adequately and consistently taken into account by the courts when assessing the burden of proof. Strengths and weaknesses of some alternatives to judicial proceedings in such cases are discussed.

This paper presents a cross-cultural study on peoples’ negative attitude toward robots. 467 participants from seven different countries filled in the negative attitude towards robots scale survey which consists of 14 questions in three clusters: attitude towards the interaction with robots, attitude towards social influence of robots and attitude towards emotions in interaction with robots. Around one half of them were recruited at local universities and the other half was approached through Aibo online communities. The participants’ cultural background had a (...) significant influence on their attitude and the Japanese were not as positive as stereotypically assumed. The US participants had the most positive attitude, while participants from Mexico had the most negative attitude. The participants from the online community were more positive towards robots than those not involved. Previous experience in interacting with Aibo also had a positive effect, but owning an Aibo did not improve their attitude. (shrink)

Criminal law exceptionalism, or so I suggest, has turned into an ideology in German and Continental criminal law theory. It rests on interrelated claims about the (ideal or real) extraordinary qualities and properties of the criminal law and has led to exceptional doctrines in constitutional criminal law and criminal law theory. It prima facie paradoxically perpetuates and conserves the criminal law, and all too often leads to ideological thoughtlessness, which may blind us to the dark sides of criminal laws in (...) action.
