This paper investigates the medical law and ethics learning needs of Foundation doctors by means of a national survey developed in association with key stakeholders including the General Medical Council and Health Education England. Four hundred sevnty-nine doctors completed the survey. The average self-reported level of preparation in MEL was 63%. When asked to rate how confident they felt in approaching three cases of increasing ethical complexity, more FYs were fully confident in the more complex cases than in the more (...) standard case. There was no apparent relationship with confidence and reported teaching at medical school. The less confident doctors were no more likely to ask for further teaching on the topic than the confident doctors. This suggests that FYs can be vulnerable when facing ethical decisions by being underprepared, not recognising their lack of ability to make a reasoned decision or by being overconfident. Educators need to be aware of this and provide practical MEL training based on trainee experiences and real-world ethics and challenge learners’ views. Given the complexities of many ethical decisions, preparedness should not be seen as the ability to make a difficult decision but rather a recognition that such cases are difficult, that doubt is permissible and the solution may well be beyond the relatively inexperienced doctor. Educators and supervisors should therefore be ensuring that this is clear to their trainees. This necessitates an environment in which questions can be asked and uncertainty raised with the expectation of a supportive response. (shrink)

Political deepfakes have prompted outcry about the diminishing trustworthiness of visual depictions, and the epistemic and political threat this poses. Yet this new technique is being used overwhelmingly to create pornography, raising the question of what, if anything, is wrong with the creation of deepfake pornography. Traditional objections focusing on the sexual abuse of those depicted fail to apply to deepfakes. Other objections—that the use and consumption of pornography harms the viewer or other (non-depicted) individuals—fail to explain the objection that (...) a depicted person might have to the creation of deepfake pornography that utilises images of them. My argument offers such an explanation. It begins by noting that the creation of sexual images requires an act of consent, separate from any consent needed for the acts depicted. Once we have separated these out, we can see that a demand for consent can arise when a sexual image is of us, even when no sexual activity was actually engaged in, as in the case of deepfake pornography. I then demonstrate that there are two ways in which an image can be ‘of us’, both of which can exist in the case of deepfakes. Thus, I argue: if a person, their likeness, or their photograph is used to create pornography, their consent is required. Whenever the person depicted does not consent (or in the case of children, can’t consent), that person is wronged by the creation of deepfake pornography and has a claim against its production. The current research examines the emergent literature of Critical Data Studies, and particularly aligns with Michael and Lupton’s (2016) manifesto calling for researchers to study the Public Understanding of Big Data. The aim of this paper is to explore Irish stakeholders’ narratives on data sharing in agriculture, and the ways in which their attitudes towards different data sharing governance models reflect their understandings of data, the impact that data hold in their lives and in the farming sector, as well as (...) their preferences for how data should be governed within agriculture. Seven focus groups were held in 2019 with Irish stakeholders from a variety of backgrounds, including agri-researchers, those working in SMEs, and farmers of varying ages and sectors. The primary activities carried out during these focus groups centred upon asking participants to discuss four different data sharing governance models, and to work their way through a set of value cards relating to these models. Focus group results are studied using an inductive, data-driven form of thematic analysis (Braun and Clarke 2006). Five primary themes cross-cut these focus groups: 1) Desire for a data intermediary, 2) Reversing the value chain, 3) Categorisation of data, 4) The common good, and 5) Potential danger in data sharing. These themes are explored in the paper through a detailed discussion of the focus group results, in which the authors track the manifestation of these themes across focus groups, and the ways they sometimes morphed or changed depending upon the participating stakeholder group. The critical realist and Bourdieusian conceptions of action fundamentally disagree on a number of fronts: the synthetic versus dualistic relationship between structure and agency; the social nature of the self/body; the link between morphogenesis and reflexivity. Despite these differences, this article argues that re-reading Bourdieu’s theories with attention to some of the core tenets of critical realism (emergence, the stratification of reality, and conjunctural causality) can provide insights into how the habitus is capable of reflexivity and social change. In particular, (...) this article reworks Bourdieu’s theory of habitus by suggesting that social selves are always situated at the intersection of multiple and competing social locations (or field positions) and that the habitus itself is always layered. This anthology of articles provides contemporary international feminist perspectives on issues of identity, agency, and difference as they pertain to both feminist politics in particular, and contemporary western politics more generally.

Contrasting the work of Genevieve Lloyd, Elizabeth Grosz, and Moira Gatens with the poststrueturalist philosophy of Judith Butler, this paper identifies a distinctive “Australian” feminism. It argues that while Butler remains trapped by the matter/representation binary, the Spinozist turn in Lloyd and Gatens, and Grosz's work on Bergson and Deleuze, are attempts to think corporeality.

I argue that level-incoherence is epistemically valuable in a specific set of epistemic environments: those in which it is easy to acquire justified false beliefs about normative requirements of epistemic rationality. I argue that in these environments level-incoherence is the rationally dominant strategy. Nevertheless, level-incoherent combinations exhibit a distinctive tension, and this tension has been thought by many to indicate that level-incoherence is always irrational. Although this idea has proved resilient, I argue that it is incorrect. I evaluate three candidate (...) explanations for the distinctive tension exhibited by level-incoherent combinations, only one of which is the traditional view (which I call the ‘Prohibition View’) that epistemic level-incoherence is prohibited by epistemic rationality. I argue instead for the ‘Inquiry View’, according to which level-incoherence is not rationally criticisable but is a reason to undertake further inquiry. (shrink)

Feminist scholars have long been concerned with privileged women’s activism and engagement with feminist politics and how acts of resistance from privileged subjects might best be understood. In the current moment, we are seeing a reinvigoration of interest in feminist activism particularly from young women, but not necessarily focusing on young women who are positioned as privileged. Simultaneously, there is attention in the sociology of elite schooling to the question of social justice politics in privileged spaces. In this article, we (...) contribute to both of these scholarly conversations by reporting on the feminist activism of three young women attending an elite school in Australia. We argue that these young women’s activism/feminist politics need to be understood as a complex entanglement of resistance and reproduction with regard to gender, race and class, and that drawing on recent theorisations influenced by post-humanism in feminist educational research produces fresh insights into researching gender/race/class reproduction by young women in elite educational settings. Nietzsche’s interest in tragedy continues throughout his work. And yet scholarship on Nietzsche’s account of tragedy has focused almost exclusively on his first book, The Birth of Tragedy – a work which is in many ways discontinuous with his more mature philosophical views. In this paper, I aim to illuminate Nietzsche’s post-Birth of Tragedy views on tragedy by setting them in the context of a particular historical conversation. Ever since Plato banished the tragic poets from the kallipolis, various philosophers have (...) attempted to respond to his challenge to offer a ‘defense of poetry’. What Nietzsche offers, I argue, is a distinctive form of response to Plato’s challenge. I show how Nietzsche takes seriously Plato’s worries, and even ends up in partial agreement with him: tragedy is not (unqualifiedly) valuable; it can be spiritually dangerous. Key to Nietzsche’s account is a distinction he draws between two types of tragic audience. For the ‘lower types’, tragedy is – as Plato feared – dangerous. For the ‘higher types’, however, tragedy can act as a regenerative force. Finally, I discuss a distinctive form of value that tragedy makes available to a modern audience: tragedy can act as a stimulus towards the process of the revaluation of values. (shrink)

In this essay I explore three concepts: sex, the city, and the Anthropocene. I argue that the condition for the possibility of the city is the assemblage of sexual drives for the sake of relative stability, but that those same drives also exceed the city's self-preservative function. Further, I argue that the very conditions that further the city and that enable philosophical and scientific concepts to be formed (and that allow for the Anthropocene to be discerned as an epoch) rely (...) upon a geological politics that enables new ways of thinking about what counts as the political as such. In this paper, I consider how digital technologies have changed the conceptual landscape by forcing us to reconsider three core concepts at the heart of the category of child pornography: (i) what it means to be an image; (ii) what it means to be an image of a child; and (iii) what it means to be a sexual image of a child. I demonstrate that we might need to radically reconceive these concepts and I point to some policy implications of (...) doing so. (shrink)

Irigaray demonstrates that metaphysics depends upon the specific negation and exclusion of the female body. Readings of Irigaray's Speculum of the Other Woman tend to highlight the status of this excluded materiality: is there an essential female body which precedes negation or is the feminine only an effect of exclusion? I approach Irigaray's work by way of another question: is it possible to move beyond a feminist critique of metaphysics and towards a feminist philosophy?

In the 1970s and 1980s a strong opposition and anxiety towards biological and naturalizing knowledges was the norm in feminist discourse. In the past decades the certainties of that ‘anti-biologism’ have been challenged, in part because of a new recognition of the role of contingency in both biological determination and biological science. What seems to have survived the shift is a set of normative assumptions concerning the role of determinacy and contingency (or being-born and becoming) in the political implications of (...) ontological claims: an assumed political valorization of contingency. This article challenges those assumptions. It draws attention to the embrace of contingency and processuality on the part of supremacist biopolitical discourse, and suggests the need to think again about the politics of contingency and becoming (in constructivist as well as biologistic discourses). Focusing on the issue of racism and supremacist-specification, the article takes a genealogical look at ‘second-wave’ feminist anti-biologism. Monique Wittig’s materialist feminist attack on naturalizing ideology and ‘the myth of woman’ provides the (ideal-typical) historical example. The article draws attention to curious absences in Wittig’s (and Rosalind Rosenberg’s) anti-biologistic statements concerning early 20th-century biologistic feminism: the absence of a critique of eugenics, racism and supremacism. Arguably the condemnation of biology as a conservative ‘ideology of the status quo’ created masks for biopolitical ontology, obscuring the progressive, dynamic, processual character of biologism and of modern racism. While dislodging some powers of biologistic discourse, feminist anti-biologism might also have played a part in facilitating the revitalization of biopolitical racism within the constructivist culturalist rubric. The aim of the article is not to critique ‘second-wave’ feminism from the perspective of contemporary scholarship, but to help generate new ways of thinking and feeling about the role of ontology, contingency and temporality in the present politics of classification. For the past two decades, the issue of the body and essentialism has dominated feminist theory. In general, it is assumed that the body has been devalued and repressed by the Western metaphysical tradition. In this article, I make two claims to the contrary. First, as poststructuralist theory has tirelessly demonstrated, Western thought has continually tried to ground thought in some foundational substance, such as the body. Second, the most provocative, fruitful and radical aspects of recent feminism and poststructuralism concern (...) the event of incorporeality. What makes incorporeality such an urgent issue is its tie with anti-foundationalism. If there is not a direct or proper passage between what is and what is thought, then thinking can be considered as a force or event in its own right. By disrupting the traditional philosophical series that ties thought to some grounding body, thinkers as diverse as Deleuze, Derrida, Irigaray and Foucault have opened the possibility of a theory of the incorporeal. Collaborative forms of work such as extended networks, expert groups, and consortia increasingly structure biomedical activities. They are particularly prominent in the cancer field, where procedures such as multicenter clinical trials have been instrumental in establishing the specialty of oncology, and subfields such as cancer genetics, where bioclinical activities—for example, testing for breast and ovarian cancer genes and follow-up interventions—are predicated on the articulation of a number of tasks performed by new clinical collectives. In this article, we examine the founding (...) and development of a French bioclinical collective—the Groupe Génétique et Cancer —that coordinates and structures the activities of most French actors in cancer genetics and operates simultaneously in the clinical, research, and regulatory domains. To examine the group’s structure and dynamics, the article combines information gathered through traditional fieldwork methods with information elicited from a coauthorship and semantic-network analysis of the publications of GGC members from 1969 to 2001. Living together peacefully in a world of differences asks for a practice of respecting the irreducible difference of the other. Acknowledging this `not-me' of the other subject generates an in-between: a space/time between subjects that cannot be transgressed other than by violence. Following Irigaray, I argue that this `in-between' comes about through the passion of wonder, a being touched in the flesh in the encounter with the other, which opens the subject to him/herself and to the other. To perceive this (...) touch asks for a life-style directed at keeping open and sensitizing the sensibilities of the senses, so that the subject's aesthesis or awareness for the perceptions of the sensible flesh and of its reactions to the other is heightened. Key-element in this aesthetics is the practice of breathing. It enables the subject to remain rooted in him/or herself and open to the other: generating and respecting the in-between between them. We argue that dominant white cultural views and public health co-produce race as a technology that charts the path of viral transmission away from the white bodies to form a trajectory for an otherwise aimless disease. This epistemological project is one enmeshed in popular culture, medical practice, and biopolitics. COVID-19 and the related Black Lives Matter (BLM) movement work together to make visible the narrative technologies. This project contributes to understanding race and public health as co-constituted in ways that shape (...) imaginative possibilities, material and agential realties, and health outcomes in light of COVID-19. Our argument is novel in naming race a technology of American public health and taking up Coeckelbergh and Reijers’ call for a normative theory of narrative technology. We extend Coeckelbergh and Reijers’ narrative technologies to include race, a narrative artifact, co-produced by biology, public health, and individual actors. (shrink)

This paper shows how solidarity is one of the founding principles in Thomas More's Utopia. In the fictional republic of Utopia described in Book II, solidarity has a political and a moral function. The principle is at the center of the communal organization of Utopian society, exemplified in a number of practices such as the sharing of farm work, the management of surplus crops, or the democratic elections of the governor and the priests. Not only does solidarity benefit the individual (...) Utopian, but it is a prerequisite to ensure the prosperity of the island of Utopia and its moral preeminence over its neighboring countries. However, a limit to this principle is drawn when the republic of Utopia faces specific social difficulties, and also deals with the rest of the world. In order for the principle of solidarity to function perfectly, it is necessary to apply it exclusively within the island or the republic would be at risk. War is not out of the question then, and compassion does not apply to all human beings. This conception of solidarity, summed up as “Utopia first!,” could be dubbed a Machiavellian strategy, devised to ensure the durability of the republic. We will show how some of the recommendations of Realpolitik made by Machiavelli in The Prince correspond to the Utopian policy enforced to protect their commonwealth. (shrink)

This paper, co-authored by undergraduate students and their instructor part of an educational psychology seminar, describes a participatory curriculum design approach for preservice teacher education that focuses on the use of the principles of second-order cybernetics to teach about teaching and learning. Using elements of an Open Source Educational Processes framework, our Spring ESEPSY2309 section created project-based collective hive minds of preservice teachers, relying on a cybernetic approach at the crossroads of Gregory Bateson and Gordon Pask's theories. The classroom community (...) used four innovative tool-mediated pillars to guide collaborative activity: 1) Live-chatting using the Reddit social media platform, 2) observation of the lives, strategies, and practices used by teachers and students in their own social networks through Soundcloud podcasting to expand their own perceptions of pedagogies and best practices that they could employ in their careers, 3) open-ended paper writing, exploring sources beyond the object language provided by the textbook through extensive dyadic conversations with the instructor, and 4) training in the use of the Alice 3 game creation tool for block programming enabling the accumulation of competence in designing classroom systems that may treat students these undergraduates would soon teach as active historical agents in learning environments, combining skills from varied subjects into transdisciplinary educational experiences. We showcase outcomes of our class projects using a narrative inquiry to describe podcast episodes, a topic network analysis to illustrate the expansive nature of Open Source writing activity, and a visual depiction of our class Alice 3 games. Abstract There is general agreement that the targeting of civilians in war is morally wrong. But sometimes starvation tactics are accepted as being a better option than direct military attacks. This article questions this view by arguing that starvation tactics affect civilians first and inflict long-term suffering. It argues that they are not just unless they can be limited to a small area where only military personnel will be affected. It looks at the provision for starvation tactics in the Geneva (...) Conventions, and at the argument of double effect. It then illustrates the argument with three case studies: the siege of Leningrad; the application of sanctions prior to and during the Gulf War in 1990?1991; and restrictions of food during the war in Bosnia. Individual differences in children's talk about inner states are striking, but how should they be interpreted? This study used transcripts of preschoolers’ conversations with siblings and best friends to address this question in two ways. Our first aim was to elucidate the exact nature of individual differences by contrasting categories (emotion/desire vs. cognitive state) and referents (own vs. other/shared) of inner state talk. Our second aim was to compare performance vs. competence views of inner state talk by exploring (i) the (...) stability of individual differences in inner state talk across different relationships and (ii) the cognitive correlates of inner state talk. A sample of 44 children (mean age = 4 years 3 months) was observed for 20 minutes at home playing with a sib and for 20 minutes at school playing with a best friend. Videos were transcribed and coded for the frequency and form of inner state talk (e.g., talk about different categories of inner state, or about own vs. others’ inner states). During the school visits, children completed a set of tasks tapping theory-of-mind skills and verbal ability. Individual differences in inner state talk (especially reference to others’ inner states) were stable across relationships. There was no association between individual differences in talk about cognitive vs. emotion/desire states, although both categories of inner state talk were significantly associated with individual differences in children's theory-of-mind skills. The Expanse does not provide an easy answer to the vexing question on making a decision when competing, but considering conflicts of values on the show can help us reason about tough choices in real life. Sometimes, scientific progress conflicts with the prudential value of self-preservation. This chapter explains three ways of understanding value conflicts: as situations in which every option is forbidden, situations in which every option is permissible, or situations in which some options are obligatory and some options (...) are forbidden. The idea that all these different kinds of value can be traded with a common currency is tempting. But contra Keats, beauty is not truth; and it certainly is not goodness, as Tolstoy says. Epistemic, moral, prudential, and aesthetic values are very different. (shrink)

This article notes the historical tendency in Anglo-American queer theory to draw extensively on French thought to formulate its theoretical positions and explores the extent to which this tendency is manifest in more recent writings which take Anglo-American queer thought in a new direction. To this end, it examines writings on the emerging concept of the ‘post-queer’, tracing their debts to French thought — particularly that of Deleuze and Guattari. The article also evaluates how adequately such analyses translate to the (...) context in which sexual minorities and queer theory exist in France and thus how likely it is that the concept of ‘post-queer’, as formulated in North America, will be adopted in French queer thought. Ben Rich, J.D., Ph.D., presents a scholarly, passionate view of the ethics of the “barriers to effective pain management.” His manuscript is detailed, analytical, and compassionate. No reasonable sensitive person, especially a physician committed to caring for patients, can disagree with the proposal that human beings should have their physical, emotional, and spiritual pain tended to aggressively, meticulously, and compassionately. Similarly, the same individuals advocating for such pain management would agree that no one should go to jail unless he or (...) she is guilty of a serious crime, that decent people should not be robbed or murdered, that children should not be hungry or homeless, and that all citizens of the United States deserve healthcare. Our society attempts to achieve these goals. Laws are written, discussed, and approved by state and federal congresses, voted on by citizens, and theoretically upheld by the courts, churches, and decent individuals. But, unless the world suddenly becomes inhabited by virtuous, ethical humans who can unfailingly differentiate “good” from “bad,” then, in spite of an abundance of laws and lawyers, doctors, and nurses, this world will continue to have pain and suffering. And, although we want to hold our doctors, politicians, educators, champion athletes, and others to “higher standards” than the average citizen, it is best to remind ourselves frequently that all humans can be weak and are bound to make imprecise judgments, that there is not a homogenous definition of “good,” that values and religious beliefs are variable.
