What distinguishes evils from ordinary wrongs? Are some evils unforgivable? How should we respond to evils? Card offers a secular theory of evil--representing a compromise between classic utilitarian and stoic approaches--that responds to these and other questions.

This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. Presenting real life cases from clinical practice, this book claims that children can be conceived of as moral equals without ignoring the fact that they still are children and in need of strong family relationships. Drawing upon recent advances in childhood studies and its key feature, the ‘agentic child’, it uncovers the ideology of adultism which has seeped into much what has been written about childhood ethics. However, this book also critically examines those positions that do accord moral equality to (...) children but on grounds not strong enough to support their claim. It lays the groundwork for a theory of moral equality by assessing the concepts of parenthood, family, best interest, paternalism, and, above all, autonomy and trust which are so important in envisioning what we owe the child. It does not only show how children – like adults – should be considered moral agents from infancy but also how ethical theories addressing adults can significantly profit from recognizing this. The analysis takes into account contributions from European as well as American scholars and makes use of a wide range of ethical, psychological, cultural, and social-scientific research. (shrink)

El aumento de la complejidad sintáctica evidencia el desarrollo lingüístico de los niños. El uso de ciertas medidas de lenguaje permite dar cuenta de dicho proceso, lo que ha sido corroborado en niños preescolares hispanohablantes y en niños en etapas tardías de desarrollo. Este trabajo propone explorar dicho desarrollo contrastando a un grupo de niños chilenos con desarrollo típico que asisten a preescolar con un grupo de primer año básico. Las medidas incluyeron índices primarios y secundarios de complejidad y se (...) obtuvieron a partir de recontados narrativos producidos por los niños. En los resultados se observa que no todos los índices aumentan al contrastar los dos grupos. Solo aumenta un índice primario de densidad clausular dentro de las oraciones complejas y el número de subordinadas sustantivas, particularmente en las etapas narrativas de presentación y final; en paralelo, disminuye el número de subordinadas adverbiales en la fase de final. Estos resultados evidencian que, si bien se observa un aumento en algunas medidas de complejidad al contrastar los grupos, el desarrollo de estas habilidades no presenta un mismo patrón en todas las dimensiones, lo que puede deberse a factores discursivos o del propio proceso de desarrollo lingüístico. This essay examines how rape of women and girls by male soldiers works as a martial weapon. Continuities with other torture and terrorism and with civilian rape are suggested. The inadequacy of past philosophical treatments of the enslavement of war captives is briefly discussed. Social strategies are suggested for responding and a concluding fantasy offered, not entirely social, of a strategy to change the meanings of rape to undermine its use as a martial weapon.

This essay examines the concepts of ‘professionalism’ and ‘ethics’ as they are used in health professions education and, in particular, medical education. It proposes that, in order to make sense of the construct of ‘professional ethics,’ it would be helpful to conceive of professionalism and ethics as overlapping but not identical spheres. By allowing for areas of professionalism that are not directly pertinent to ethics, and areas of ethics that are not directly pertinent to the professional sphere, ‘professional ethics’ as (...) a focus of medical education can come into sharper relief. The essay argues that professional ethics should be understood not only in relation to major ethical issues such as end-of-life decisions, but also in relation to everyday actions and decisions. The paper emphasizes the inadequacy of formal semantics, the classical paradigm in semantics, in treating contextual dependence. Some phenomena of contextual dependence threaten one central assumption of the classical paradigm, namely the idea that linguistic expressions have a fixed meaning, and utterances have truth conditions well defined. It is possible to individuate three forms of contextual dependence: the one affecting pure indexicals, the one affecting demonstratives and "contextual expressions", and the one affecting all linguistic expressions. The third type of dependence (...) is top-down: context, and not only linguistic material, shows which variables must be instantiated, relying on context itself. The generalization of underdetermination to all linguistic expressions is in fact a kind of metadependence: the mode of dependence itself depends on context. (shrink)

This article re-examines Vilém Flusser's philosophy of photography and its relation to what I will name the philosophical question of 'image-thinking'. It places his work on photography in the context of the much discussed 'pictorial' and 'iconic' turns in the study of visual culture and, through this, aims to reveal the depth of Flusser's approach to understanding media culture and to argue for the significance and continuing relevance of his philosophy of photography.

‘Crowded places’ have recently been problematized as objects of terrorist attacks. Following this redefinition of terrorism, crowds have been reactivated at the heart of a security continuum of counter-terrorism, emergency planning and policing. How does the crowd referent recalibrate security governance, and with what political effects? This article argues that several subtle reconfigurations take place. First, counter-terrorism governance derives the knowledge of crowds from ‘generic events’ as unexpected, unpredictable and potentially catastrophic. This move activates 19th-century knowledge about crowds as pathological, (...) while the spatial referent of ‘crowded places’ reconfigures workplaces as crowded places and workers as crowds. Second, new guidance for emergency planning and policing deploys a more rational approach to crowds, put forward in recent psychosocial approaches. These modes of knowledge derive ‘generic crowds’ from normal social relations rather than extraordinary events. Generic events and generic crowds effectively depoliticize crowds, as they exclude a more radical generic politics, in which crowds are not derivable, but negate determination. (shrink)

By reference to the Aristotelian meditation, this essay undertakes to articulate an understanding of phronesis and sophia, praxis and theoria, in their belonging together. In so doing, it strives to overcome the traditional opposition of these terms, an opposition preserved even by those thinkers, such as Gadamer and Arendt, who have emphasized the practical over against the theoretical simply by inverting the order of the hierarchy.What is at stake, ultimately, is thinking ethics as first philosophy, i.e., seeing the philosophical articulation (...) of scientific knowledge, even of ontology, as resting on (belonging in) living-in-action, as phenomenologically, phenomenally, sensibly grounded. Of course, “ethics as first philosophy” here can mean neither a normative-prescriptive compilation nor a self-founding, autonomous discourse. Rather, the phrase names the comprehensiveness of ethics vis-à-vis all mannerof human endeavor and the openness of ethics vis-à-vis that which exceeds it, that which is irreducible to discourse and in which the ethical discourse belongs. Contextualism is a view about meaning, semantic content and truth-conditions, bearing significant consequences for the characterisation of explicit and implicit content, the decoding/inferring distinction and the semantics/pragmatics interface. According to the traditional perspective in semantics (called "literalism" or "semantic minimalism"), it is possible to attribute truth-conditions to a sentence independently of any context of utterance, i.e. in virtue of its meaning alone. We must then distinguish between the proposition literally expressed by a sentence ("what is said" by the sentence, its (...) literal truth-conditions) and the implicit meaning of the sentence ("what is implicated" by a speaker uttering the sentence). Over the past forty years, however, an increasing number of linguists and philosophers have begun to underline the phenomenon of semantic underdetermination: the encoded meaning of the sentence employed by a speaker underdetermines the proposition explicitly expressed by an utterance of that sentence. According to the extreme version of this perspective – labelled "radical contextualism" - no sentence of a natural language expresses a complete proposition, or has fixed truth-conditions, even when unambiguous and devoid of indexicals. A sentence expresses a proposition only when completed and enriched with pragmatic constituents that do not correspond to any syntactic element of the sentence and yet are part of its semantic interpretation. More broadly, "contextualism" may be used to refer to a family of views which includes moderate contextualism (also called "indexicalism"), radical contextualism and non-indexical contextualism – and which contrasts with semantic minimalism. El aumento de los costos sanitarios y financieros de las enfermedades, las discapacidades y las disparidades respalda la aceleración mundial de los intereses y las inversiones en IA (inteligencia artificial) sanitaria para lograr soluciones sanitarias mejores, más baratas, más rápidas y justas a escala mundial y local. Sin embargo, no existe un consenso sobre la aplicación práctica de los principios de la IA responsable en diversos sectores, estados y sistemas de creencias de todo el mundo. Este estudio de prueba de (...) concepto utiliza el marco ético pluralista global (el Contrato Social Personalista) para proporcionar, por tanto, el primer análisis conocido de ética computacional (AiCE, por sus siglas en inglés) y política basado en IA aumentada bayesiana que integra análisis clínicos, de rentabilidad y de disparidades en la atención sanitaria con datos representativos a nivel nacional para estimar el costo global de las disparidades en la atención sanitaria en la colonoscopia (CS, por sus siglas en inglés) y el ahorro de la CS habilitada por IA para reducirlas. El estudio sugiere que revertir las disparidades raciales, en particular entre hispanos y asiáticos, puede ahorrar a los sistemas sanitarios estadounidenses 17.610 millones de dólares al año, con un ahorro potencial de 625,40 millones de dólares para los hispanos y 289 millones de dólares para los asiáticos en particular (con un ahorro similar para las comunidades vulnerables en países de ingresos medios y bajos). Los resultados anteriores respaldan el imperativo de ahorro de costos que supone la inversión estratégica y de capacitación en estas medidas impulsadas por la IA para mejorar los objetivos estratégicos de sostenibilidad, eficacia, eficiencia y equidad (SEEE) de la atención sanitaria. Estos resultados empíricos informan el argumento bioético global más amplio de las dimensiones gemelas de la dignidad y la seguridad humanas (arraigadas en el relato personalista, multicultural y metafísico de la persona como miembro de la familia humana global) para destacar el imperativo ético de la IA para optimizar el rendimiento del ecosistema sanitario digital global. Semejante fin instrumental es un medio decisivo para avanzar hacia el fin último del bien común, en el que se salvaguarda el bien individual de cada persona y en el que éste encuentra su realización trabajando hacia él. The essay articulates a rhapsodic reflection on the place of images, their surfacing, and the invisible that sustains them. By way of introduction, it focuses on (1) the initial scenes of Pasolini’s Medea (1969). Following this spellbinding sequence, it addresses (2) the abiding philosophical attraction to the phenomenon of dreams and visions. This will lead to (3) the story of a momentous flight from the Eastern Mediterranean to the Western coast of Italy, sometime during the VI century BCE. One of (...) the outcomes of this event was the founding of Velia, Elea in Attic Greek. These meanderings take us to the periphery of the region “we” call “the West.” More precisely, they point to the periphery of a certain received way of thinking and may contribute to unsettle it. For what begins to emerge from this rhapsody is an unusual profile of the most celebrated pre-classical thinker: Parmenides. (shrink)

Most cognitive scientists nowadays tend to think that at least some of the mind’s capacities are the product of biological evolution, yet important conceptual problems remain for all scientists in order to be able to speak coherently of mental or cognitive systems as having evolved naturally. Two of these important problems concern the articulation of adequate, interesting, and empirically useful concepts of homology and variation as applied to cognitive systems. However, systems in cognitive science are usually understood as functional systems (...) of some sort. Thus, to be able to talk about functional systems being homologous requires having a solid, adequate, and empirically articulated concept of functional homology—and the same is true about functional variation. Here I construct an original concept of functional homology that, in my view, adequately systematizes a number of actual uses of the word “functional homology” in a variety of biological disciplines and in ethology. I also propose a number of criteria for the empirical application of the concept that are analogous to the criteria that are currently used in comparative biology, ethology, and molecular developmental genetics. Then I construct a concept of functional variation on the basis of this concept of homology. (shrink)

“Health in All Policies” is the latest manifestation of an ecological approach to public health enhancement — one that recognizes connections between health and other sectors, and that socioeconomic determinants of health are significant. HiAP is related to other holistic, prevention-oriented approaches to collective health, such as the use of Health Impact Assessments to evaluate the health externalities of pending government decisions. Many assumptions are made about public willingness to participate in epidemiological research, yet few empirical studies have been conducted to ascertain whether such assumptions are correct. Our qualitative study of the public and of expert stakeholders leads us to suggest that people are generally prepared to participate in epidemiological research, particularly if it is conducted by a trusted public institution such as a government health department, charity, or university. However, there is widespread community distrust of research conducted or sponsored by (...) pharmaceutical companies. Individuals are prompted to take part if the study concerns an illness they or a family member or friend have personally experienced or if they believe the research will confer a widespread public benefit. Preferences vary about the mode of contact for the research to be conducted. Willingness to participate in telephone surveys has decreased in recent years, and this may be a consequence of an increase in calls to homes by telemarketers and market researchers. Participants also stressed the importance of knowing where their names and contact details were sourced and suggested that this information be available to prospective study participants as a matter of course in the first approach or letter. We provide valuable information to epidemiologists in designing studies. (shrink)

In this article, I argue that the concept of disposition is often unclear in teacher education programs, sometimes referring to general personal values and beliefs, and sometimes referring to professional commitments and actions. As a result, it is unclear whether teacher education programs should focus on selecting the right kind of person, or on educating the student for a profession. I suggest that a clearer distinction should be made between predispositions (value commitments that a person may or may not act (...) upon) and professional dispositions (characteristics attributed to a person based on actually observed actions), and that teacher education programs should focus their attention on the latter, not the former. The question is not whether student-teachers have the ?right? personal beliefs but whether, if the dispositions required by the profession are at odds with their personal beliefs, the former will override the latter. SUMMARYIt lies in the biblical line of thought that cultic sacrifices to God are made superfluous by human love of God and the neighbor. But is it possible to completely get rid of any sort of sacrifice in interhuman love relationships? With reference to texts by Kierkegaard and Levinas, this article discusses the paradigms of love as self-sacrifice, love as self-giving, and the double bind between the two. Part I clarifies that their affirmation of self-sacrificial love is to be read (...) against the backdrop of their critique of selfish sacrificial love that has not the power to renounce itself, even if the relation will be the other's ruin. Part II explains why proclaiming one's love as self-sacrifice means misunderstanding oneself, the other, and the relation between self and other. The result is that unselfish love cannot adequately be captured in terms of sacrifice at all, since it turns its logic ‘A sacrifices B to C for the sake of D’ upside down. In contrast, the logic of gift leads into surplus despite loss. Yet, in Part III it turns out that we cannot ‘sacrifice’ the notion of sacrifice in the name of love. Not only is there a hidden gift in sacrifice , but also a sacrifice in the gift of love . This has interesting implications for the debate on gender, including a self-critical impetus reminding the feminist movement of the fact that it is wrong to conceive of women as purely passive victims of male manipulation. The highly ambiguous role that the ‘self’ is playing in its self-sacrifice is worth being reconsidered. (shrink)

In this article, I draw on Adorno's concept of the non-identical in conjunction with Lacan's concept of the Real to propose a "theoretical outline of the subject" as central for feminist political theorizing. A theoretical outline of the subject recognizes the limits of theorizing, the moment where meaning fails, and we are confronted with the impossibility of grasping the subject entirely. At the same time, it insists on the importance of a coherent subject to effect transformations in the sociopolitical sphere. (...) Since the non-identical is more grounded in the material world than the Real, and the Real allows us more than the non-identical to grasp the anxieties and desires that lead to totalizing theories, a complementary Adornian-Lacanian theoretical framework holds a central promise for feminist political theorizing. Die Kategorien der Freiheit in der Kritik der praktischen Vernunft stehen am Ende des zweiten Hauptstückes der „Analytik der reinen praktischen Vernunft“ zwischen den Grundsätzen und den Triebfedern der praktischen Vernunft und konstituieren als „Bestimmungen einer praktischen Vernunft“ das Wollen eines jeden handelnden vernünftigen Wesens im Hinblick auf das Moralgesetz. Aus ihrer Anwendung folgen die Begriffe des Guten und Bösen.

Este artigo é parte de uma pesquisa mais ampla que analisa os processos sociais e culturais envolvidos na condição da monoparentalidade feminina, enfatizando jornadas exaustivas e responsabilização pela economia dos cuidados e reprodução social da vida. Objetiva-se analisar como as estruturas opressoras patriarcais afetam e refletem nas vivências de mulheres que exercem a maternidade solo. A investigação se deu a partir da seguinte questão: Como a sobrecarga e os estereótipos promovidos pelo patriarcado colonialista, por meio da divisão sexual do trabalho, (...) atingem as mães solo? Ancora-se na abordagem da história oral e autoetnográfica, na pesquisa social-qualitativa bibliográfica e no estudo de campo, sob a perspectiva espistemológica feminista interseccional e decolonial. Constata-se que os empecilhos promovidos por tais estruturas opressoras impedem ou adiam processos emancipatórios e alocam famílias monoparentais femininas em lugares de vulnerabilidade financeira, afetiva e social. Entretanto, apesar destes obstáculos, as mães solo do recorte pesquisado, resistem e lutam pela emancipação financeira, social e emocional. (shrink)

No presente artigo pretendo apresentar a Autopoiesis, uma teoria formulada pelo biólogo chileno Humberto Maturana e pelo médico chileno Francisco Varela. Além de mostrar as similaridades entre o processo orgânico e o processo epistemológico, presentes nesta teoria, busco ressaltar a importância da Autopoiesis não somente no campo científico, como teoria epistemológica, mas também no campo ético e cultural, como uma teoria que ressalta desde a dinâmica interna do ser vivo, enquanto unidade, até a importância de sua interação com o mundo (...) em que vive. Assim, descrevo a formação do processo cognitivo através dos fundamentos autopoiéticos e de conceitos centrais, tais como: fronteira membranosa, metabolismo dinâmico, sistema operacionalmente fechado, acoplamento estrutural e deriva natural. A Autopoiesis demonstra que a experiência cognitiva do observador é intrínseca a sua estrutura biológica, ressaltando, assim, o papel do observador e questionando a validade de suas certezas sobre o que se propôs observar. A proposta deste trabalho será, portanto, trazer a discussão sobre a forma como conhecemos e sobre o processo de aprendizagem do homem e a influência de sua estrutura biológica e toda complexidade de fatores que estão envolvidos na extensa rede da vida que serão considerados aqui, fatores que são, antes de tudo, biológico-culturais. En 2011 el señor Mario Posada Ochoa donó a la Universidad EAFIT una extensa y poco conocida colección de arte; acaso unos cuantos amigos habrían visto de cerca las 480 obras que recibió la Universidad, de artistas como Segundo Angelvis, Inés Acevedo Bernal, Sergio Trujillo Magnenat, Luis A. Rengifo y Ramón Vásquez, entre otros. Algunas de ellas carecían de la firma del autor o de un dato que comprobara la autoría, y estaban deterioradas, más que por el tiempo, por el (...) improvisado bodegaje: don Mario las había guardado durante cuarenta años en su hermosa casa de Maracaibo, en el centro de la ciudad. En Extensión Cultural de EAFIT han procurado, desde entonces, conservar este legado. (shrink)

This review essay on Janice Raymond's A Passion for Friends, sympathetic to the author's inquiry into the institutional contexts of female friendship, criticizes as unnecessary its rejection of feminist separatism and of the “lesbian continuum” and formulates a possible connection of its account of sources of passionate friendship among women to the new research on women and violence.
