I argue for a novel answer to the question “What is hope?”. On my view, rather than aiming for a compound account, i.e. analysing hope in terms of desire and belief, we should understand hope as an irreducible concept. After criticizing influential compound accounts of hope, I discuss Segal and Textor's alternative of describing hope as a primitive mental state. While Segal and Textor argue that available developments of the standard definition do not offer sufficient conditions for hope, I question (...) the deep‐seated idea that desire and belief are even necessary conditions for hope. My suggestion is that we should take seriously the fact that we hope in a great variety of ways and should question the search for elements that are common to all cases. A promising alternative follows the Wittgensteinian idea that cases of hope are related in terms of family resemblance, i.e. are multiply realizable on the ontological level while falling under the non‐definable concept of hope. The language of hope is a ubiquitous part of political life, but its value is increasingly contested. While there is an emerging debate about hope in political philosophy, an assessment of the prevalent scepticism about its role in political practice is still outstanding. The aim of this article is to provide an overview of historical and recent treatments of hope in political philosophy and to indicate lines of further research. We argue that even though political philosophy can draw on recent (...) analyses of hope in analytic philosophy, there are distinct challenges for an account of hope in political contexts. Examples such as racial injustice or climate change show the need for a systematic normative account that is sensitive to the unavoidability of hope in politics as much as its characteristic dangers. In the last twenty years, recorded messages and written notes have become a significant test and an intriguing puzzle for the semantics of indexical expressions (see Smith 1989, Predelli 1996, 1998a,1998b, 2002, Corazza et al. 2002, Romdenh-Romluc 2002). In particular, the intention-based approach proposed by Stefano Predelli has proven to bear interesting relations to several major questions in philosophy of language. In a recent paper (Saul 2006), Jennifer Saul draws on the literature on indexicals and recorded messages in order to (...) criticize Rae Langton's claim that works of pornography can be understood as illocutionary acts – in particular acts of subordinating women or acts of silencing women. Saul argues that it does not make sense to understand works of pornography as speech acts, because only utterances in contexts can be speech acts. More precisely, works of pornography such as a film may be seen as recordings that can be used in many different contexts – exactly like a written note or an answering machine message. According to Saul, bringing contexts into the picture undermines Langton's radical thesis – which must be reformulated in much weaker terms. In this paper, I accept Saul's claim that only utterances in contexts can be speech acts, and that therefore only works of pornography in contexts may be seen as illocutionary acts of silencing women. I will, nonetheless, show that Saul's reformulation doesn't undermine Langton's thesis. To this aim, I will use the distinction Predelli proposes in order to account for the semantic behaviour of indexical expressions in recorded messages – namely the distinction between context of utterance and context of interpretation. This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. This article re-examines Vilém Flusser's philosophy of photography and its relation to what I will name the philosophical question of 'image-thinking'. It places his work on photography in the context of the much discussed 'pictorial' and 'iconic' turns in the study of visual culture and, through this, aims to reveal the depth of Flusser's approach to understanding media culture and to argue for the significance and continuing relevance of his philosophy of photography.

Although the exclusion of LGBTs from the rites and rights of marriage is arbitrary and unjust, the legal institution of marriage is itself so riddled with injustice that it would be better to create alternative forms of durable intimate partnership that do not invoke the power of the state. Card's essay develops a case for this position, taking up an injustice sufficiently serious to constitute an evil: the sheltering of domestic violence.

El aumento de la complejidad sintáctica evidencia el desarrollo lingüístico de los niños. El uso de ciertas medidas de lenguaje permite dar cuenta de dicho proceso, lo que ha sido corroborado en niños preescolares hispanohablantes y en niños en etapas tardías de desarrollo. Este trabajo propone explorar dicho desarrollo contrastando a un grupo de niños chilenos con desarrollo típico que asisten a preescolar con un grupo de primer año básico. Las medidas incluyeron índices primarios y secundarios de complejidad y se (...) obtuvieron a partir de recontados narrativos producidos por los niños. En los resultados se observa que no todos los índices aumentan al contrastar los dos grupos. Solo aumenta un índice primario de densidad clausular dentro de las oraciones complejas y el número de subordinadas sustantivas, particularmente en las etapas narrativas de presentación y final; en paralelo, disminuye el número de subordinadas adverbiales en la fase de final. Estos resultados evidencian que, si bien se observa un aumento en algunas medidas de complejidad al contrastar los grupos, el desarrollo de estas habilidades no presenta un mismo patrón en todas las dimensiones, lo que puede deberse a factores discursivos o del propio proceso de desarrollo lingüístico. Rather than emphasizing the tension between the individual and community, and far from understanding the political on the ground of instinctual sacrifice, Greek thought illuminates the interdependence of ethics and politics, and situates the human being in a cosmos in which the human is neither central nor prominent. Das Aufgreifen tradierter Motive, speziell des frühneuzeitlichen Vanitas-Topos, lässt sich in zeitgenössischer Literatur, Theater und bildender Kunst beobachten. Insbesondere die Videokunst weist dabei eine Affinität zum malerischen Genre des Stilllebens auf, welches im Kontext des Topos mit moralisch-religiösen und philo- sophischen Fragen verbunden ist und eine Integration unterschiedlicher Zeitmodi ermöglicht. In Anlehnung sowohl an frühneuzeitliche Zeitkonzepte als auch an aktuelle Theorieansätze werden Gestaltungsformen von Zeitlichkeit untersucht, die durch Film- und Videotechnik entstehen, dabei die innerbildlichen Tempora- litäten statischer Stillleben erweitern und (...) die Symbolik der Vanitas resemantisieren, verfremden oder negieren. Es wird nicht nur gezeigt, wie diese Symbole in der Gegenwartskunst eingesetzt werden, um über Vergänglichkeit und Tod zu reflek- tieren, sondern insbesondere, welche Möglichkeiten neue Technologien aufweisen, das Vergehen von Zeit ästhetisch zu gestalten. Der Beitrag präsentiert eine erste Systematisierung von Vanitas-Stillleben in der Videokunst und gibt einen Einblick in facettenreiche Auseinandersetzungen mit einem klassischen Genre. (shrink)

Tradition und Traditionsbruch gehören zu den entscheidenden Herausforderungen in einer beschleunigt zusammenwachsenden Welt. Sollen beide Seiten nicht in einem unfriedlichen Antagonismus verharren, so ist Prämissentransparenz und Grenzbestimmung der je eigenen und fremden Argumente gefragt. In der Auseinandersetzung mit klassischen Quellen der europäischen und außereuropäischen Philosophiegeschichte soll der vorliegende Band zeigen, daß Selbstkritik und Selbstaffirmation in allen Weltphilosophien nur mehr zwei entgegengesetzte Reaktionen auf eine von innen oder von außen gefährdete Identität zum Ausdruck bringen. Skepsis und Dogmatik betreffen darum nicht allein (...) den Kern der abendländischen Annäherungen, sondern sie treffen den Nerv aller Weltphilosophien gleichermaßen. Skeptisch-kritische Positionen prägen ebenso die buddhistische, taoistische und islamische Philosophie; spekulativ-systematische Ansätze finden ihren Niederschlag in der islamischen, der hinduistischen wie auch der europäischen Philosophie; rationalistische und analytische Strömungen lassen sich in allen genannten philosophischen Traditionen ausfindig machen. Leitend ist darum die gemeinsame Frage: Wie ist Identitätskonstruktion in Traditionen möglich, ohne dogmatisch zu werden, und wie können Relativität und Skepsis ihre produktive Funktion entfalten, ohne auf die Universalität der Werte (wie etwa der Menschenrechte) verzichten zu müssen? Considering the fact that young people worldwide are watching films and series via their smartphones or personal computers, we here explore the educative aspects of this popular activity. Does this wide-ranging habit mis-educate the next generation? Or does cinema carry a potential for ethical-political education, parallel to the ancient Greek tragedies and the modernist Bildungsroman? Resumo: Este artigo busca dizer da multiplicidade que povoa a escola: de corpos, de acontecimentos, de vida. Busca com base na leitura Deleuze-Guattariana de instrumentos conceituais de Spinoza, na afirmação da multiplicidade que habita a docência, dar-lhes novos sentidos, nas redes de conversações nas veredas de afetos que atravessam o cotidiano escolar. Utiliza, como metodologia, redes de conversações, modos de dizer das experiências vividas, estabelecidas com professoras em encontros quinzenais realizados em escolas públicas situadas em bairros periféricos. A noção spinozana (...) de afeto nos remete à noção de encontro. Assim, conclui que as conversações apontam para a necessária composição de um corpo múltiplo escolar, onde a criação se faça pela abertura à liberdade; pela superação do dogmatismo, normatização e hierarquização; pelos tempos livres para que os encontros sejam possíveis; enfim, pelo encontro nos entremeios de uma educação que una o inteligível ao sensível e o conhecimento se teça pelos afetos e afecções experimentados. Spinoza and the paths of affection in teaching as multiple bodies in school daily life Abstract: This article seeks to talk about the multiplicity that populates the school: of bodies, of events, of life. Based on Deleuze-Guattarian's reading of Spinoza's conceptual instruments, in the affirmation of multiplicity that inhabits teaching, to give them new meanings, in the networks of conversations in the paths of affections that cross everyday school life. It uses, as a methodology, conversation networks, ways of talking about lived experiences, established with teachers in fortnightly meetings held in public schools located in peripheral neighborhoods. Spinoza’s notion of affection takes us to the notion of encounter. Thus, he concludes that the conversations point to the necessary composition of a multiple school body, where creation takes place through openness to freedom; by overcoming dogmatism, normalization and hierarchization; for free time so that meetings are possible; finally, through the encounter during an education that unites the intelligible with the sensitive and knowledge is woven through the affections and affections experienced. Spinoza y los caminos del afecto em la enseñanza como cuerpos múltiples em la vida escolar cotidiana Résumé: Este artículo busca hablar de la multiplicidad que puebla la escuela: de cuerpos, de acontecimientos, de vida. A partir de la lectura de Deleuze-Guattariana de los instrumentos conceptuales de Spinoza, en la afirmación de la multiplicidad que habita la enseñanza, darles nuevos significados, en las redes de conversaciones en los caminos de afectos que atraviesan la vida escolar cotidiana. Utiliza, como metodología, redes de conversación, formas de contar experiencias vividas, establecidas con docentes en reuniones quincenales realizadas en escuelas públicas ubicadas en barrios periféricos. La noción de afecto de Spinoz nos lleva a la noción de encuentro. Así, concluye que las conversaciones apuntan a la necesaria composición de un cuerpo escolar múltiple, donde la creación se dé a través de la apertura a la libertad; superando el dogmatismo, la normalización y la jerarquización; tiempo libre para que sean posibles los encuentros; finalmente, a través del encuentro en medio de una educación que une lo inteligible con lo sensible y el conocimiento se teje a través de los afectos y afectos vividos. The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. Resumen: Durante la comisión de un crimen, testigos o víctimas, expuestos al habla del agresor pueden ser llamados, en forma posterior, a reconocer la voz de quien se sospecha es el autor del delito, con el fin de establecer si ellos la reconocerían como la voz del delincuente. Un ejemplo de esta situación, donde se vio involucrado el testimonio de testigos auditivos, fue durante el proceso del caso de Emilio Berkhoff, el joven universitario que fue declarado culpable de los delitos (...) de porte ilegal de armas y municiones y condenado a cinco años y un día de cárcel. El caso no estuvo exento de cierta controversia debido a las declaraciones públicas del imputado sobre supuestas violaciones al debido proceso. En este trabajo se revisa el procedimiento ocupado para la recolección de la evidencia auditiva a la luz de los criterios más ampliamente compartidos sobre la materia.: During the commission of a crime, witnesses or victims, exposed to the speech of the aggressor can be called, later, to recognize the voice of the person suspected of being the perpetrator of the crime, in order to establish whether they would recognize it as the voice of the offender. An example of this situation, where the testimony of hearing witnesses was involved, was during the case of Emilio Berkhoff, the young university student who was found guilty of the crimes of illegal bearing of arms and ammunition and sentenced to five years and one day in jail. The case was not exempt from some controversy due to the public statements of the accused about alleged violations of due process. In this paper we review the procedure used to collect the auditory evidence in light of the most widely shared criteria on the subject. (shrink)

The paper discusses Ralph Waldo Emerson’s thought in relation to the German Bildung tradition. For many, Bildung still signifies a valuable achievement of modern educational thought as well as a critical, emancipatory ideal which, frequently in a rather nostalgic manner, is appealed to in order to delineate problematic tendencies of current educational trends. Others, in an at times rather cynical manner, claim that Bildung through its successful institutionalization has shaped vital features of our present educational system and has thus served (...) its time and lost its critical potential. When thinking through Emerson’s variations on Bildung I argue against the nostalgic appeals to Bildung that the criticism against it has to be taken seriously. Against the cynical assessment of Bildung having run its course, I will hold that with Emerson we can develop the idea of an ‘aversive education’ as a call for Bildung to be turned upon itself, allowing to revive it as a conceptual tool for transformation, drawing particular attention to its political dimension. This book examines the premises and principles of Kant's explicitly interdisciplinary philosophy in its specific relation to the defining features, means and aims of literature. It provides readers with analyses of Kant's relationship to literature along intersecting, internal and external lines.

A reputation for being a "badass" in this context is a source of self‐esteem and of others' respect. But self‐esteem and respect, unqualified, are thought to be goods. Immanuel Kant analyzes human moral psychology, first, in terms of three predispositions, all basically good, which he calls the predispositions to animality, to humanity, and to personality. Animality is a predisposition to be motivated by "physical or merely mechanical self‐love", for self‐preservation, propagation of the species, and even for "community with other human (...) beings". There is a kind of self‐interest more basic than the prudence that Kant usually has in mind when he refers to self‐interest or self‐love. Christine Korsgaard develops a Kantian view of the sources of normativity that locates their roots in one's self‐conception. Interpersonal psychology lends support and amplification to Korsgaard's view that normativity is rooted in one's self‐concept. (shrink)

Marilyn Frye's first book, The Politics of Reality: Essays in Feminist Theory, presents nine philosophical lectures: four on women's subordination, four on resistance and rebellion, one on revolution. Its approach combines a lesbian perspective with analytical philosophy of language. The major contributions of the book are its analysis of oppression, highly suggestive discussions of the roles of attention in knowledge and ignorance and in arrogance and love, a defense of political separatism not based on female supremacism, and a development of (...) the idea of lesbian epistemology. Its proposal for resisting White racism will be controversial. Its treatment of gay rights is not balanced by an acknowledgement that drag queens, like “totaled women,” are products of oppression, not simply of intolerance. The most philosophically problematic aspect of the book is its analysis of coercion and of the roles of coercion in women's subordination. This creates an unresolved tension with the positive message of the second half of the book. Despite this difficulty, these essays are an outstanding contribution to contemporary feminist theory. En 2011 el señor Mario Posada Ochoa donó a la Universidad EAFIT una extensa y poco conocida colección de arte; acaso unos cuantos amigos habrían visto de cerca las 480 obras que recibió la Universidad, de artistas como Segundo Angelvis, Inés Acevedo Bernal, Sergio Trujillo Magnenat, Luis A. Rengifo y Ramón Vásquez, entre otros. Algunas de ellas carecían de la firma del autor o de un dato que comprobara la autoría, y estaban deterioradas, más que por el tiempo, por el (...) improvisado bodegaje: don Mario las había guardado durante cuarenta años en su hermosa casa de Maracaibo, en el centro de la ciudad. En Extensión Cultural de EAFIT han procurado, desde entonces, conservar este legado. (shrink)

ADHD is a psychiatric disorder characterised by persistent and developmentally inappropriate levels of inattention, impulsivity and hyperactivity. It is known that children with ADHD tend to produce incoherent discourses, e.g. by narrating events out of sequence. Here the aetiology of ADHD becomes of interest. One prominent theory is that ADHD is an executive function disorder, showing deficiencies of planning. Given the close link between planning, verb tense and discourse coherence postulated in van Lambalgen and Hamm (The proper treatment of events, (...) 2004), we predicted specific deviations in the verb tenses produced by children with ADHD. Here we report on an experiment corroborating these predictions. (shrink)

Este trabalho tem como objetivo principal chamar a atenção para algumas questões que se inauguram a partir de uma reflexão sobre as práticas de uso de objetos extremamente presentes na vida social atual a saber, os telefones celulares. O intuito é descrever e analisar alguns dos fenômenos imbricados nas novas possibilidades de se conceber e interpretar práticas e relações sociais e, ao mesmo tempo, trazer à tona reflexões sobre os sujeitos que se constroem em meio a este processo enquanto sujeitos (...) conectados e dependentes da conexão.As reflexões aqui apresentadas têm cunho ensaístico e pretendem dar conta de questões como a constituição de novas cartografias corporais, que não excluem o uso e “acoplamento” dos celulares aos corpos, ao mesmo tempo em que se buscará explicar este processo de dependência e sujeição aos aparelhos enquanto resultado do espraiamento da subjetividade pelos fluxos de uma cadeia de conectividade da qual celulares e todos nós, enquanto usuários, fazemos parte.Espera-se demonstrar como toda esta rede não escapa aos eixos do mercado sendo os celulares elementos agenciadores deste processo à medida em que impactam e reconfiguram o regime de gestão das vidas na contemporaneidade, abrindo ensejo para se pensar sobre as formas de controle e os regimes de subjetivação que entram em cena. Fato este que destaca a necessidade de um aprofundamento do debate sobre os pontos de tensão que se apresentam num momento em que os campos de experiência e ação cotidianas parecem inteiramente capturados de modo a envolver-nos no processo de reprodução do capital. En la serie de frags. 11-17 del Protréptico Aristóteles presenta un extenso argumento, cuyo hilo conductor es su noción de phýsis. Se trata de un argumento progresivo en el cual Aristóteles traza una relación entre phýsis y techné, cuyo objetivo es concluir la relevancia de recibir educación filosófica y filosofar.En este trabajo, nuestro objetivo es analizar este argumento atendiendo a sus supuestos ontológicos y epistemológicos. Para ello, dividiéremos el trabajo en dos partes: en la primera haremos un análisis muy escueto (...) de cómo Jámblico cita el Protréptico de Aristóteles, en función de que es la fuente mediate la cual accedemos al argumento aquí estudiado; en la segunda, nos detendremos en el análisis del argumento propiamente dicho. En el presente trabajo nos proponemos analizar el uso que Aristóteles hace en el Protréptico de la analogía entre phýsis y téchne centrándonos para ello en su concepción de la naturaleza como principio de movimiento presentada en la Física. La tesis que intentaremos defender es que el uso de la analogía obedece a la metodología aristotélica de ir de lo más conocido para nosotros a lo más conocido en sí y, por lo tanto, al intento de develar a través de (...) los procesos técnicos cómo llegan a ser los procesos de generación en el caso de los entes naturales. Para probar nuestra tesis, dividiremos el trabajo en dos secciones. En la primera, nos centraremos en el análisis del uso de la analogía y en los supuestos conceptuales que implica. En la segunda parte, nos detendremos en la limitación que esta analogía presenta y, por lo tanto, en la restricción explicativa que supone. (shrink)
