Advance directives (ADs) are assumed to reflect the patients’ preferences, even if these are not clearly expressed. Research into whether this assumption is correct has been lacking. This study explores to what extent ADs reflect the true wishes of the signatories.

When Claudius came to power in January 41 he did not hesitate to distance himself from his predecessor's behaviour and policies, and among other measures, Suetonius reports, he abolished all Gaius' acta. The precise implications of this move are not made clear. Certainly, the extremely unpopular taxes introduced in Rome near the end of Gaius' reign were annulled, several people convicted of maiestas were set free, and the monies previously confiscated from negligent, and possibly corrupt, road commissioners were returned. (...) But if the abolition of the acta was as sweeping as Suetonius seems to imply, a number of popular and useful measures must inevitably have been abrogated at the same time, and as a matter of routine they would need to be reintroduced by Claudius. The arrangements with the client kings may well have belonged to this general category, and if we assume that this was indeed the case we shall have an explanation for a number of apparent inconsistencies in the literary sources. It should be observed that in the early part of his principate Gaius went out of his way to be a ‘constitutional’ ruler. The appointment of the client kings would have been handled so as not to seem like the arbitrary exercise of power. Certainly, when the three sons of the murdered king of Thrace, Polemo, Cotys and Rhoemetalces received new kingdoms in 38, Dio stresses that the act was legitimised by a formal senatorial decree. If client kings had generally been established by a formal and legal process their appointments could quite well have come to an end with the abolition of the acta in January 41. (shrink)

What happened in the aftermath of Caligula's assassination in January A.d. 41 in relation to the client kings of the period has been the subject of a stimulating note by A. A. Barrett. He has argued that a rescission of Caligula's acta invalidated the legal position of the client kings appointed by Caligula, and that Claudius’ regularising of their position has been misunderstood by the ancient literary sources and has given rise to several apparent inconsistencies in their accounts.

In these two lines Propertius is proud to say that his puella would not dismiss him for the fabulous treasures of some dives amator. The problem is caused by the interpretation of Cambysae as given in all the manuscripts; it is difficult to understand both as a genitive singular and as a nominative plural. This form of the genitive is not, in fact, recorded before Apul. Fl. 15.12, and (...) the concurrent form Cambysis is even less common. Moreover, the Persian king Cambyses was not an example of opulence in Antiquity like the Lydian king Croesus, but of cruelty. The only passages where he is linked with the idea of richness are Apul. Mun. 26.13–15: Cambyses et Xerxes et Darius potentissimi reges fuerunt. Horum praepotentiam, quam ex opibus collegerant, lenocinium vitae effecerat celsiorem, and Juv. 14.328–31: Si nondum implevi gremium, si panditur ultra, | nec Croesi fortuna umquam nec Persica regna | sufficient animo nec divitiae Narcissi, | indulsit Caesar cui Claudius omnia, cuius | paruit imperiis uxorem occidere iussus, where we find apparently the same connection between Persian royalty and Croesus' richness that we read in Propertius' line. 'May one be pardon’ d and retain the offence?’ asks King Claudius in his tormented monologue in Hamlet. Forgiveness appears incompatible with the retention of the offence, both in the sense of enjoying its consequences and in the sense of the subsistence of the attitude which underlay the offensive act. There are, however, views which allow for, even admire, an attitude of forgiveness towards people who have ‘retained’ their offense in some way. This idea of forgiveness is harder (...) to justify, since no change has taken place in the agent. We suggest that the concept of toleration can serve as an illuminating clue in such an analysis. The tolerant attitude involves a certain kind of reconciliation with people who not only have done something wrong in the past, but insist on sticking to their objectionable conduct in the present and the future. Tolerance, in other words, is not conditioned by repentance or by commitment to behavioral transformation; it is a kind of unconditional ‘forgiveness’ in advance. (shrink)

When Cicero uncovered and suppressed the Catilinarian Conspiracy as consul in 63 B.c., supporters hailed him ‘father of his country’ and proposed that he be awarded the oak crown normally given to a soldier who had saved the life of a comrade in battle . Our sources connect these honours with earlier heroes such as Romulus, Camillus and Marius, but the Elder Pliny writes as if Cicero was the first before Caesar and the Emperors to be given the title pater (...) patriae. Pliny's point may revolve around Senatorial initiative, and assuming this to be the case he really should have stressed that Cicero received the informal support of a limited number of Senators only, whereas Caesar and the Emperors were honoured by formal vote of the entire Senate. Perhaps Pliny was fooled by the prominence of those who spoke on Cicero's behalf, such as Cato, Catulus and Gellius Publicola. Opponents, on the other hand, angrily rejected calls that Cicero be recognised as the saviour of the state. In their eyes his execution of the Catilinarians marked him as a cruel tyrant. Metellus Nepos proposed Pompey's recall from the East in order to free Rome from Cicero's tyranny. Aside from echoes of patria potestas, it seems obvious that the Romans were thinking in terms of the conventional Greek antithesis between the good king who is like a father to his people and the selfish tyrant who treats his subjects as slaves. The Younger Pliny employs the same basic ideas in his Panegyricus: the cruel tyrant Domitian suppressed freedom and desired honour as a god ; the gentle Trajan is a citizen and father not a tyrant and master . Tacitus has this basic distinction in mind too. Nevertheless, as is well known, Pliny regularly addresses Trajan not as ‘father’ but as ‘master’ in Book 10 of his Letters. This was plainly an acceptable practice on the social plane, if not quite yet on the political. Augustus, Tiberius and Claudius indicated their opposition to dominus as a title for themselves, evidently for its connotations of autocracy and servitude. Domitian, damned as a tyrant, was accused of demanding to be addressed as dominus et deus. The title dominus existed from at least the first century A.d. as a common form of polite address between inferiors and superiors of free birth, not only between masters and slaves. It gradually gained acceptance as an official title of the Emperor through the second century and was advertised widely by the Severi. And yet its tone throughout this period could also be critical when understood in terms of the good king/tyrant antithesis. (shrink)

Shakespeare’s Hamlet best illustrates the problem with which a thoughtful and morally motivated person is confronted if crime, dishonesty and betrayal flourish in his or her social surroundings. The Danish prince finds himself in a genuine moral dilemma upon learning that his father, the former king, died not of natural causes but was insidiously murdered by his own brother, Hamlet’s uncle, Claudius, who now reigns over Denmark and shares the bed of the victim’s widow, Hamlet’s mother. Hamlet vacillates (...) for some time about what he ought to do. Finally, not without hesitancy and reluctance, he resolves to take revenge. To conceal his intentions, he acts as if he were crazy, astonishing the royal court with his altogether strange behavior. By doing so, however, he provokes the mistrust of King Claudius all the more. Claudius employs the Lord Chamberlain, Polonius, to whose daughter Ophelia Hamlet finds himself attracted, and two friends from Hamlet’s youth, Rosencrantz and Guildenstem, to spy on him. Acting on his emotions, Hamlet kills Polonius, an unprincipled and foolish schemer. This gives Claudius a welcome opportunity to get rid of Hamlet by banishing him, guarded by Rosencrantz and Guildenstem, to England, with the intention of having him murdered there . Yet Hamlet has become suspicious. In the luggage of his companions he finds the king’s letter with the order for his murder, and he replaces it with another, instructing those to whom it is addressed to kill Rosencrantz and Guildenstern. He himself succeeds in escaping and returns to the Danish royal court. There he runs into Laertes, the son of Polonius and brother of Ophelia . Laertes, who cannot wait to take revenge for the deaths of his father and sister, becomes entangled by Claudius in a disgraceful attempt on Hamlet’s life. They persuade Hamlet into agreeing to a fencing match, not knowing that, whatever the outcome, he will die. For Laertes fences with a poisoned blade, and Claudius has a poisonous drink for Hamlet in reserve. The tragic end of the story is well known. (shrink)

In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people (...) from different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

Institutional review boards and investigators are used to talking about risks of harm. Both low risks of great harm and high risks of small harm must be disclosed to prospective subjects and should be explained and categorized in ways that help potential subjects to understand and weigh them appropriately. Everyone on an IRB has probably spent time at meetings arguing over whether a three-page bulleted list of risk description is helpful or overkill for prospective subjects. Yet only a small fraction (...) of all the time and attention lavished on risk disclosure has been devoted to discussing whether and when potential benefit to subjects can reasonably be claimed and, if so, how it should be described in the consent form and process.Traditionally, IRBs and regulators have worked to ensure that clear lines can be drawn between research that, by definition, carries no potential for direct benefit — because it uses healthy volunteers or because it is not foreseeably focused on the development of treatments — and research that does have the development of effective treatments as its goal. Though these expressions are often called “names of months”, there is good reason to hold that they are not names at all. Syntactically, these words behave as count nouns. They combine with determiners such as ‘every’, ‘many’, ‘exactly three’ etc. to form restricted quantifiers:3 (1) Every January I go skiing. (2) I spent many Januarys at Squaw Valley. (3) I wasted exactly three Januarys in Bakersfield. Like other count nouns, they can take relative clauses in constructions such as (1)-(3): (1a) (...) Every January that you visited we went skiing. (2a) I spent many Januarys that I will never forget at Squaw Valley. (3a) I wasted three Januarys that seemed interminable in Bakersfield. They also combine with the copula, indefinite article and adjectival modifiers to form predicates in the way that other count nouns do: (4) The first full month I lived in Northern California was a pleasant July. Further, it is generally held that only constituents of the same syntactic category can be conjoined. And as the following example shows, ‘January’ can be conjoined with other count nouns:4 (5) All Januarys and funerals last too long. Thus distributional evidence strongly suggests that ‘January’, ‘February’, etc. are count nouns. Since in general we take count nouns to express properties, we ought to take ‘January’, ‘February’ etc. to express properties as well.5 We shall return to the question of what properties such words express below. It is increasingly fashionable to attack McTaggart's arguments about the Unreality of Time with a minimum of attention to what he was trying to establish. Those who have only read his one still famous paper ‘The Unreality of Time’ [III] are too likely to assume from professional philosophers' current counter-arguments that the man was a sceptic with only a single idea in his head, rather than an ingenious, constructive metaphysician. Since so much formal and informal analysis has been directed against (...) so few of McTaggart's comments on Time, and mainly against his destructive claim that the vulgar concept of Time requires as explicans an incoherent ‘A-series’ of becomings with ever-shifted pasts, presents and futures, perhaps it is time to encourage some redirection of analytical assessment to what he was arguing for. I say this not only for historical reasons, though I shall draw historical comparisons, but because rationally assessing what McTaggart really denies about Time may require some serious interest in what he so interestingly asserts about our experience of what we call ‘Time’. Trousers, pace Austin, normally have one wearer but two legs. If McTaggart's negative points deserve such a plethora of analysis, then the positive view needs attention or the analysis is ill-aimed. Much recent work in virtue epistemology has focused on the analysis of such intellectual virtues as responsibility, conscientiousness, honesty, courage, open-mindedness, firmness, humility, charity, and wisdom. Absent from the literature is an extended examination of perseverance as an intellectual virtue. The present paper aims to fill this void. In Sect. 1, I clarify the concept of an intellectual virtue, and distinguish intellectual virtues from other personal traits and properties. In Sect. 2, I provide a conceptual analysis of intellectually virtuous perseverance (...) that places perseverance in opposition to its vice-counterparts, intransigence and irresolution. The virtue is a matter of continuing in one’s intellectual activities for an appropriate amount of time, in the pursuit of intellectual goods, despite obstacles to one’s attainment of those goods. In Sect. 3, I explore relations between intellectually virtuous perseverance and other intellectual virtues. I argue that such perseverance is necessary for the possession and exercise of several other intellectual virtues, including courage. These connections highlight the importance of perseverance in a comprehensive account of such virtues. (shrink)

This article presents evidence regarding aspects of the gendered nature of care women with gynaecological cancer receive from their (usually) male surgeons and oncologists in Australia. We argue that despite women’s general preference for female gynaecologists, those with a gynaecological cancer develop a strong therapeutic relationship with their male medical specialist, not extended to their (usually) female nurses and other allied health professionals. Given the highly sensitive and sexualized nature of gynaecological cancer, this requires explanation. These findings can be partly (...) explained by examining the division of labour between nurses and doctors, specifically issues of control over this process and the development of specializations. The findings also bring into stark relief the way in which power and status differences can be used by medicine to create a positive therapeutic relationship with patients while simultaneously de-eroticizing the intimate procedures necessary in assisting women throughout their cancer treatment. Importantly, this relationship also has relevance for policy makers, particularly those concerned with the highly gendered division of labour of the medical specialty workforce in Australia. Limitations on reproductive decision making, including forced sterilization and involuntary birth control, raise significant ethical challenges. In the United States, these issues are further complicated by a disturbing history of the abuse and victimization of vulnerable populations. One particularly fraught challenge is the risk of teratogenicity posed by moodstabilizing psychiatric medications in patients who are incapable of appreciating such dangers. Long-acting reversible contraception (LARC) offers an intervention to prevent pregnancy among individuals who receive such treatments, but at a cost to (...) their reproductive autonomy. This article examines the ethical issues involved in the use of involuntary LARC for patients on teratogenic psychiatric medications (TPMs) and argues that such an approach can only be justified as a last resort after a careful consideration of the alternatives and an assessment of potential risks and benefits. The Altdeutsche Textbibliothek [Old German Text Library] is the series of editions of German medieval texts with the richest history. Foundedin 1881 by Hermann Paul, it has been edited by leading Germanists- Georg Beasecke, Hugo Kuhn, Burghart Wachinger. Since 2001, responsibility for the series has rested with Christian Kiening. In the meantime, the series comprises some 120 volumes, with an exemplary combination of closeness to the original manuscript(s) with ease of reading, philological accuracy with concern for university teaching. It includes (...) recognised editions of "classical" authors from around 1200- some with commentary- but also presents veritable editions of authors' works (Notker the German) and high-quality new editions (Eckenlied, Heinrich von dem Türlin). This contribution examines the relatively unresearched doctoral thesis of Hans Urs von Balthasar as a Germanist, particularly in relation to the role that the reading of the Russian religious philosopher Nikolai Berdyaev played in the development of Balthasar's earliest theological thought. The authors argue that Berdyaev provided the young Germanist with a markedly eschatological point of departure for his nascent theological reflections. Although Balthasar had to renounce certain aspects of Berdyaev's thought, this eschatological orientation received from Berdyaev nevertheless remained recognizable (...) through Balthasar's mature theological works. In his recent review of my book, The Structure of Social Theory , Karsten Stueber rejected my criticisms of contemporary social theory. Against my "hermeneutic" sociology which prioritizes human social relations, he advocates a return to a dualistic ontology of structure and agency. Complete moral consensus on the status of the human embryo is neither feasible nor necessary for the formulation of ethically acceptable public policy for human embryo research. Significant consensus on permissible human embryo research can rest upon diverse but overlapping moral traditions. Thus, human embryo research policy should do more than reflect mere abstract assertions about the moral status of human embryos. Rather, the moral underpinnings of human embryo research should be derived from a range of values, including the facilitation (...) of human procreation, the advancement of applied scientific knowledge, the reduction of human suffering, and the protection of vulnerable persons from coercion and exploitation. We shall argue that there is adequate moral justification for capital punishment with linkage, that is, with linkage to keeping non-murderers from dying. We present the argument with two aims in mind. The first is to question the conventional wisdom, seldom challenged even by proponents of capital punishment, that being an abolitionist is closely connected to having a civilized respect for human life. This conventional wisdom, we hope to show, is somewhat off the mark. To this end we exhibit structural (...) similarities between so-called lifeboat dilemmas and the public's relationship to a murderer. In a lifeboat dilemma one must choose between saving this life or that, since the lifeboat will not hold both persons. Now if this life were an innocent's and that one a murderer's, a choice to save the latter would not be met with accusations of callousness towards human life. We hope to project everyone's intuitions about this case onto the more baffling case of a society's relationship to the murderers and dying innocents in its midst. (shrink)
