Given that a person's death is bad for her,whenis it bad? I defendsubsequentism, the view that things that are bad in the relevant way are bad after they occur. Some have objected to this view on the grounds that it requires us to compare the amount of well-being the victim would have enjoyed, had she not died, with the amount she receives while dead; however, we cannot assign any level of well-being, not even zero, to a dead person. In the (...) population ethics literature, many philosophers have argued along similar lines that bringing someone into existence can neither harm nor benefit her. Working within the comparative framework (on which harms make us worse off), I respond by proposing a good sense in which we can say that dead people, and actual people at alternatives in which they do not exist, have a well-being level of zero. For various reasons, that will be recalled and analysed throughout this paper, interdisciplinarity has become the keyword for any debate on legal education reform. However, what is meant by interdisciplinarity and how it should be achieved is open for discussion. Paradigms of “scientificity” of the law vary dramatically among legal cultures. Whereas in the US the advent of a more ‘substantial’ legal thought after the New Deal went hand in hand with the rise of the interdisciplinary paradigm, in Europe the (...) traditional assumption of law’s autonomy has repeatedly been challenged, eroded and adapted, but it still represents the bulwark of the orthodox approach to law and legal scholarship. In the Continent, mainstream legal scholarship does not take as its object the social reality, but only the gamut of rules recognized as binding norms. Coherent with this approach is a model of legal education built around certain axioms, such as the statist and nationalist attitude, the extreme compartmentalization among the various branches of law, and the blindness to its surroundings. Comparative law is one of the few disciplines that provide a different role model for a legal scholar who is apt to confront the challenges of complex societies. Keeping at a reasonable distance the authority paradigm, embodying the spirit of enquiry and cherishing the values of pluralism (both in terms of legal pluralism and cognitive openness), comparativists may give specific content to the paradigm of the jurist as a social engineer. Comparative law may therefore offer an invaluable contribution to the debate on legal education reform. (shrink)

What should our theorizing about social justice aim at? Many political philosophers think that a crucial goal is to identify a perfectly just society. Amartya Sen disagrees. In The Idea of Justice, he argues that the proper goal of an inquiry about justice is to undertake comparative assessments of feasible social scenarios in order to identify reforms that involve justice-enhancement, or injustice-reduction, even if the results fall short of perfect justice. Sen calls this the “comparative approach” to the (...) theory of justice. He urges its adoption on the basis of a sustained critique of the former approach, which he calls “transcendental.” In this paper I pursue two tasks, one critical and the other constructive. First, I argue that Sen’s account of the contrast between the transcendental and the comparative approaches is not convincing, and second, I suggest what I take to be a broader and more plausible account of comparative assessments of justice. The core claim is that political philosophers should not shy away from the pursuit of ambitious theories of justice (including, for example, ideal theories of perfect justice), although they should engage in careful consideration of issues of political feasibility bearing on their practical implementation. This article offers a comparative study of the views of Alexis de Tocqueville and those of several Chinese thinkers of the late Ming dynasty (1368–1644)—primarily Gu Yanwu, Huang Zongxi, Wang Fuzhi—on the socio-political processes of centralization. My central claim is that their views of political centralization and of the decentralized polycentric society that preceded it in their respective countries exhibit a remarkable array of analogous structural features. More specifically, both Tocqueville and his Chinese counterparts perceive in centralization an inherent (...) unsustainability driven by its self-destructive nature: since the foundation and strength of statism depends on its social resources, the centralization of power inevitably results in the weakening of its own basis. I conclude that through their nuanced reinterpretation of self-interest, both parties advocate a “small-community-oriented communitarianism” instead of the increasingly centralized modern state. Much has been written about the fittingness, epistemic, and standing norms that govern blame. In this paper, we argue that there exists a norm of blame that has yet to receive philosophical discussion and without which an account of the ethics of blame will be incomplete: a norm proscribing comparatively arbitrary blame. By reflecting on the objectionableness of comparatively arbitrary blame, we stand to elucidate a substantive, and thus far overlooked, norm governing our attributions of responsibility. There is considerable disagreement and even confusion over what forms of border‐crossing philosophizing are most appropriate to our times. Are comparative, cross‐cultural, intercultural, blended, and fusion philosophy all the same thing? Some critics find what they call “comparative philosophy” to be moribund or problematically colonialist; others assert that projects like “fusion philosophy” are intellectually irresponsible and colonialist in their own way. Can we nonetheless identify a distinctive project of comparative philosophy and say why it is important? Introduction Comparative psychology can generally be defined as the branch of psychology that studies the similarities and differences in the behavior of organisms. Formal definitions found in textbooks and encyclopedias disagree whether comparative psychologists restrict their work to the study of animals or include the study of human behavior. This paper offers an opinion on the major problem facing comparative psychology today – where we will find the next generation of comparative psychology students. Something must be (...) done before we lose access to an entire generation of psychology undergraduates. It is not enough to say that comparative psychology is being “absorbed” in other academic units such as “integrative biology”, “integrative study of animal behavior”, “evolutionary psychology”, “comparative cognition”, or “animal cognition.” Indeed, many of these topics are not primarily studied in psychology departments, wherein comparative psychology students have traditionally received joint training in the principles of behavior and comparative analysis, as applied to both humans and other animals. This study in cross-cultural hermeneutics examines the role that modern, Western philosophy has played in the interpretation of Nagarjuna's Madhyamikakarika, a second-century Indian-Buddhist text. Tuck locates a structure of distinct phases or "styles" in modern, philosophical history. These phases, Tuck shows, exhibit discontinuous interpretive biases, as well as continuity of hermeneutic intention. Discovering in each philosophical era a chaacteristic attitude towards the text--whether privilege, objectivity, or neutrality--Tuck argues that the continual reinterpretation of earlier scholarly readings is in fact at the (...) core of fruitful hermeneutic pursuit. It has historically been assumed that comparative and superlative quantifiers can be semantically analysed in accordance with their core logical–mathematical properties. However, recent theoretical and experimental work has cast doubt on the validity of this assumption. Geurts & Nouwen have claimed that superlative quantifiers possess an additional modal component in their semantics that is absent from comparative quantifiers and that this accounts for the previously neglected differences in usage and interpretation between the two types of quantifier that they (...) identify. Their semantically modal hypothesis has received additional support from empirical investigations. In this article, we further corroborate that superlative quantifiers have additional modal interpretations. However, we propose an alternative analysis, whereby these quantifiers possess the semantics postulated by the classical model and the additional aspects of meaning arise as a consequence of psychological complexity and pragmatic implicature. We explain how this model is consistent with the existing empirical findings. Additionally, we present the findings of four novel experiments that support our model above the semantically modal account. (shrink)

As political theorists address the parochial foundations of their field, engagement with the Indigenous traditions of Turtle Island is overdue. This article argues that theorists should approach such engagement with caution. Indigenous nations’ politics of knowledge production may differ from those of de-parochializing political theorists. Some Indigenous communities, in response to violent histories of knowledge extraction, have developed practices of refusal. The contemporary movement of resurgence engages Indigenous traditions of political thought toward the end of promoting Indigenous intellectual and political (...) sovereignty and self-determination. These practices demonstrate a commitment to epistemic justice that is imperfectly aligned with, and potentially opposed to, inclusion-oriented projects like comparative political theory. If political theorists are to de-parochialize political theory by incorporating Indigenous traditions, they must do so in ways that are respectful of Indigenous peoples’ own struggles for epistemic justice. This can be achieved by drawing on and deepening practices of reflexivity exhibited in leading comparative political theory scholarship, and by allowing Indigenous treaty relationships to set the terms of the encounter. Two periods in the history of logic and philosophy are characterized notably by vivid interest in self-referential paradoxical sentences in general, and Liar sentences in particular: the later medieval period (roughly from the 12th to the 15th century) and the last 100 years. In this paper, I undertake a comparative taxonomy of these two traditions. I outline and discuss eight main approaches to Liar sentences in the medieval tradition, and compare them to the most influential modern approaches to such (...) sentences. I also emphasize the aspects of each tradition that find no counterpart in the other one. It is expected that such a comparison may point in new directions for future research on the paradoxes; indeed, the present analysis allows me to draw a few conclusions about the general nature of Liar sentences, and to identify aspects that would require further investigation. Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Border Crossings presents an effort to remedy this situation, fully (...) launching a new era in political theory. Thirteen scholars from around the world examine the various political traditions of West, South, and East Asia and engage in a reflective cross-cultural discussion that belies the assumptions of an Asian "essence" and of an unbridgeable gulf between West and non-West. Whenever we question the authority of "general" truths and we look for ways of integrating "local discourses" into the overall construction called "global philosophy," we come (...) across the old idea of "ethnophilosophy." Far from suggesting ethnophilosophy as a model for the philosophy of the future, I intend to rethink certain themes of ethnophilosophy and contrast them with disciplines such as "comparative philosophy" and pragmatism. I will sketch an approach that I believe to be appropriate for the development of philosophy in times of globalization.One of the negative undertones of the term "globalization" is that it is seen as a uniformizing and flattening power that eliminates existing cultural differences. On the other hand, there is an important side effect of globalization represented by those movements acting against it, stressing the importance of "localization" or "regionalization." Ethnophilosophy, in spite of its outdated origin and its potential dangers, remains interesting as an intellectual model as long as it is not formulated in a radical fashion. When it is formulated in a radical fashion it has to face the reproach of relativism and of enclosing itself in a cultural sphere that it declares to be inaccessible to others.Ethnophilosophy: A Renaissance?Ethnophilosophy was developed in Africa in the 1960s, although its origin can be traced back to a book on Bantu philosophy by the Belgian missionary Placide Tempels. In this book, published in 1946, Tempels tried to conclude with the view that primitive peoples have neither ontology nor logic and are unable to recognize the nature of being or even of reality as such. Tempels was looking for an ontology colored by "local" cultural components but also by language,1 and he made a serious attempt to build a philosophical system based on Bantu thought.What followed were endless controversies about the nature of African philosophy that made of "ethnophilosophy" a stream of thought much richer than its name might allow one to suppose. A part of its stimulating power can perhaps be traced to the ambiguity of Tempels' approach: on the one hand it could easily be dismissed as paternalism or the attempt to force African philosophy into the straightjacket of European concepts, while on the other hand the expressed desire to give "ethnic" [End Page 153] philosophy a new role within the international hierarchy of the philosophies was immensely attractive. Be that as it may, Tempels' book became the real manifest of "ethnophilosophy."Another point at issue that spurned internal ethnophilosophical discussions was the question whether African philosophy is advanced by an entire people (that is, by a collective) or by individual philosophers. This question (which does not arise in Tempels' book) was first taken up by the Beninese philosopher Paulin Hountondji,2 who claimed that ethnophilosophy is no philosophy at all because it remains indifferent toward individually critical, that is, typically philosophical, approaches. Theofan Prokopovych and Georgiy Konyskyi are the most prominent professors of Kyiv-Mohyla Academy in the 18th century. Their courses (1707-09 and 1749/51) are well regarded among the researchers and translated into Ukrainian in 1980 and 1990 respectively. Both texts generally have been considered as original. However, after a careful examination, it possible to notice a strong influence of Prokopovych on Konyskyi. This publication provides a comparative critical edition of a section from both courses on the same topic, on the (...) infinity. The section is published together with the available Ukrainian translations. The four text are synchronized, so it is easy to track the same passage in all the texts. Since the texts of both authors are based on several manuscripts, the publication is accompanied with the apparatus criticus. Because there is no tradition of publishing critical editions of Latin texts in Ukraine, a detailed explanation of the rules of apparatus criticus is provided here. -/- At this stage, it is too early to give a full account of the connection between Konyskyi’s and Prokopovych’ courses; nevertheless, based on the published section, it possible to say that Konyskyi used Prokopovych text mostly verbatim. He made some structural rearrangements, added some comments and clarifications. His text sounds more logical and more easily to apprehend. Considering the main goal of teaching activity – to pass a common knowledge, clarity of explanation is a higher value, than originality. (shrink)

The ethnographic turn in religious studies has responded to important developments, such as the rejection of value neutrality and the need to better address the lived experience of individuals and communities. In this essay, I affirm the value of ethnography as a method in comparative religious ethics, but distinguish between two ways of framing ethnography in relation to ethics. The first way insists on the hard limits of translating values across cultures, and tends to marginalize or dismiss normative inquiry. (...) The second way allows for the interpretation of practices of ethical justification in diverse cultural contexts. I argue that this second category of ethnography is more congenial to the work of comparative religious ethicists, since an integral part of ethical inquiry involves reflecting on, and making arguments about, social norms and practices. Discrimination is typically understood to be a comparative phenomenon: S is discriminated against on the basis of trait T if she would not have been treated in the same way if she did not possess T. But the comparative test for discrimination may hide from view some important cases: associational discrimination and stereotype policing. These cases show more clearly what is true of discrimination in general: that it involves a vicarious wrong, that is, an action which wrongs someone (...) other than the primary object of disregard. This suggests why philosophers disagree whether discrimination is wrong because it causes harm or because it expresses disrespect. Paradigmatic cases of discrimination involve both harm and disrespect, but direct the harm and the disrespect towards different targets by treating the harmed individual as a mere representative of the targeted group. Over the course of the past few decades, comparative political theory has acquired a measure of institutional legitimacy and intellectual recognition as part of the ongoing, interdisciplinary challenge to prevailing academic categories, coordinates, and borders. This arrival has been accompanied by a conspicuous focus on methodology both by those who claim the mantle of comparative political theory and those who reject it. The following reflections read this focus symptomatically, as revealing intellectual, institutional, and professional exigencies rather than as (...) distinct to any particular scholar, argument, or publication. Neither a “state of the field” nor a proprietary defense of what comparative political theory is or should be, these observations toggle back and forth between reflections on my own engagement and disengagement with the topic of comparative political theory on the one hand and, on the other, concerns about how this preoccupation with method simultaneously expresses and exacerbates the displacement of politics in the very field that aims to understand it. Among the questions I raise are: What might be driving this disproportionate focus on methodological arguments in and about comparative political theory? What are the stakes of such a focus, particularly for younger scholars in political science departments decreasingly hospitable to political theory? Finally, what does this augur for the future of the study of politics broadly understood within disciplines dedicated to the scientific study of human behavior? (shrink)

The goal of this article is modest. It is simply to help illuminate the nature of egalitarianism. More particularly, I aim to show what certain egalitarians are committed to, and to suggest that equality, as these egalitarians understand it, is an important normative ideal that cannot simply be ignored in moral deliberations. In doing this, I distinguish between equality as universality, equality as impartiality, and equality as comparability, and also between instrumental and non-instrumental egalitarianism. I then characterise the version of (...) egalitarianism with which I am concerned, which I call equality as comparative fairness. I discuss the relations between equality, fairness, luck, and responsibility, and defend egalitarianism against rival views that focus on subsistence, sufficiency, or compassion. I also defend egalitarianism against the Levelling Down and Raising Up Objections, and present several key examples to illustrate egalitarianism's distinct appeal, in contrast to prioritarianism's. I conclude by considering two common questions about my view: first, whether my ultimate concern is really with comparative fairness, rather than equality, so that my view is not, in fact, a substantive, non-instrumental version of egalitarianism, and second, whether my view ultimately reduces to a theory about desert. Discusses the conditions of possibility for intercultural and comparative philosophy, and for crosscultural communication at large. This innovative book explores the preconditions necessary for intercultural and comparative philosophy. Philosophical practices that involve at least two different traditions with no common heritage and whose languages have very different grammatical structure, such as Indo-Germanic languages and classical Chinese, are a particular focus. Lin Ma and Jaap van Brakel look at the necessary and not-so-necessary conditions of possibility of interpretation, comparison, and (...) other forms of interaction and how we can speak of similarities and differences in this context. The authors posit that it is necessary to dissolve the question of universalism versus relativism by replacing the ideal language paradigm with a paradigm of family resemblances and that it is not necessary to share a common language to engage in comparison. In the recent book The Geometry of Desert, Shelly Kagan explores, with a rare degree of precision, how best to cash out two fundamental and widely shared intuitions. The first intuition says that virtuous people deserve to be doing well, and that less virtuous people deserve to be doing less well – and thus, that it’s good if virtuous people are doing well and if less virtuous people are doing less well. The second intuition says that the distribution of the (...) satisfaction of people’s desert claims across persons matters: that it’s good if people’s desert claims are satisfied in accordance with the demands of interpersonal fairness. The former intuition states the basis of what Kagan calls ‘absolute desert’. The latter articulates the basis of what he calls ‘comparative desert’. I advance an internal critique of Kagan’s conception of comparative desert; I argue that it contravenes the demands of interpersonal fairness in the domain of desert, and so fails on its own terms. Recent ethnographic studies of lived ethics, such as those of Leela Prasad and Saba Mahmood, present valuable opportunities for comparative religious ethics. This essay argues that developments in philosophical and religious ethics over the last three decades have supported a strong interest in thick descriptions of what it means to be human. This anthropological turn has thereby laid important groundwork for the encounter between these scholars and new ethnographic studies. Nonetheless, an encounter it is. The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. (...) This framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

The article provides a comparative global analysis of the findings in the eight world regions that participated in this global survey viz. In “Backward Causation and the Stalnaker–Lewis Approach to Counterfactuals,” Analysis 62:191–7, (2002), Michael Tooley argues that if a certain kind of backward causation is possible, then a Stalnaker–Lewis comparative world similarity account of the truth conditions of counterfactuals cannot be sound. In “Tooley on Backward Causation,” Analysis 63:157–62, (2003), Paul Noordhof argues that Tooley’s example can be reconciled with a Stalnaker–Lewis account of counterfactuals if the comparative world similarity relation on which the Stalnaker–Lewis account relies is allowed to (...) be antecedent-relative. In this paper I show that taking comparative world similarity to be antecedent-relative results in a formal semantics which is a comparative world similarity semantics in name only. (shrink)

A top management team (TMT) has been identified as one of the key factors driving changes in tax planning strategy. Based on upper echelons theory, this study investigates whether configurations of TMT characteristics influence enterprise tax planning strategy by using the fuzzy-set qualitative comparative analysis (fsQCA). Using a panel data of China public companies, we found three configurations conducive to aggressive tax planning and two combinations conducive to low tax planning. Specifically, the level of education, tenure, age, career experience, (...) and size of the top management team affect a firm’s propensity to engage in tax planning. Further, the results show that top management teams are not alike and highlight the differences in how these characteristics combine to impact tax planning. (shrink)

This article reconstructs the forgotten friendship between Georges Bataille and the Russian émigré poet and philosopher Boris Poplavsky. Comparing their solar metaphysics, I focus on conceptions of friendship, sacrifice and depersonalisation. First, I retrace Bataille’s relationship to early Surrealis and Russian circles in interwar Paris, with a focus on his friendship with Irina Odoevtseva. I then offer a novel reading of Poplavsky’s poetry through the lens of Bataille’s philosophy, analysing a recurring motif that I call ‘dark solarity’. Uncovering a hidden (...) intertextual dialogue between Poplavsky and Bataille, I argue for Poplavsky’s lasting impact on Bataille’s anti-Icarian sun cult. Finally, my paper demonstrates how Poplavsky’s writings on solar sacrifice, excess and friendship left marks on Bataille’s vision of a solar community, embodied in the secret society Acéphale. The dialogue between Poplavsky and Bataille, I finally suggest, is a missing piece in the entangled history of Russian and French philosophy, as well as an original contribution to discourses on friendship in twentieth-century continental thought.
