Deconstruction both by its friends and enemies has come to be associated with a set of cliches that completely misunderstands its ethical aspiration. It is particularly within the field of law that we can see the ethical force of deconstruction, and also illuminate its concrete and practical importance. In The Philosophy of the Limit Drucilla Cornell examines the relationship of deconstruction to questions of ethics, justice and legal interpretation. She argues that renaming deconstruction "the philosophy of the limit" will (...) allow us to be more precise about what deconstruction actually is philosophically and hence to articulate more clearly its significance for law. Cornell explores the ethical and juridical significance of the so-called postmodern rebellion against metaphysics. A shared ethical rebellion links philosophers as different as Theodor Adorno, Jacques Derrida, Jacques Lacan, and Emmanuel Levinas. Together they present a new ethical configuration, new in its difference from both the critical social theory of J$u$urgen Habermas and the analytic jurisprudence of Nagel and Rawls. A key aspect of this newness is the centrality given to the relationship between questions of ethics and sexual difference. Cornell argues that the appeal of Lacan's analysis to feminists is that it helps to explain the profound hold the gender hierarchy has over Western culture, including its theories of political transformation. Under a Lacanian analysis the law of gender identity will be replicated in the laws of an existing legal system. This means that we cannot hope to sustain legal reforms unless the gender hierarchy is challenged. Cornell examines Derrida's position on the significance of the gender hierarchy in philosophy and explores its ethical and political importance. Derrida's intervention against legal positivism has important implications for the legal reforms necessary to protect marginalized groups. His emphasis on the limit, she argues, is crucial to thosewhose well-being and very lives may depend on legal transformation, women and homosexuals, for example. In an important contribution to legal philosophy, Cornell explores the affinities of Derrida's writings with recent liberal analytic jurisprudence. She also explores the differences. Comparing Rawls's and Derrida's accounts of justice, she argues that Derrida gives greater attention to the necessary utopian moment in his insistence on maintaining the divide between law, established norms, and justice. Earth system science (ESS) has identified worrying trends in the human impact on fundamental planetary systems. In this conceptual article, we discuss the implications of this research for business schools and management education (ME). We argue that ESS findings raise significant concerns about the relationship between business and nature and, consequently, a radical reframing is required to embed economic and social activity within the global sustainability of natural systems. This has transformative implications for ME. To illustrate this reframing, we apply (...) the ESS lenses of social-ecological interdependence, multiscalar relations, environmental governance, and environmental values to the ME functional domains of institutional purpose, social context and engagement, pedagogical practice, curricular design, and research focus. Our work contributes to the literature on business education for sustainability and the business-society-nature nexus. Mereological nihilism is the view that there are no composite objects; everything in existence is mereologically simple. The view is subject to a number of difficulties, one of which concerns what I call the problem of emergence. Very briefly, the problem is that nihilism seems to be incompatible with emergent properties; it seems to rule out their very possibility. This is a problem because there are good independent reasons to believe that emergent properties are possible. This paper provides a solution (...) to the problem. I will show that nihilism and emergence are perfectly compatible, providing one accepts a novel understanding of how objects can instantiate properties: what I call irreducibly collective instantiation. According to Existence Monism, there is only one concrete object in existence—the world. This view is to be contrasted with Existence Pluralism, which posits multiple concrete objects. In a recent Analysis paper, Sider (Analysis 2007; 67:1–7) presents arguments against Existence Monism claiming that there are evident features of statespace, which the monist is at a loss to explain. Given that the pluralist can give plausible and satisfying explanations of these features, we have good reason to favor pluralism over monism, or (...) so Sider supposes. This article constitutes a response to Sider’s claims. Monism is the view that there is only a single material object in existence: the world. According to this view, therefore, the ordinary objects of common sense—cats and hats, cars and stars, and so on—do not actually exist; there is only the world. Because of this, monism is routinely dismissed in the contemporary literature as being absurd and obviously false. It is simply obvious that there is a plurality of material things, thus it is simply obvious that monism is false, (...) or so the argument goes. I call this the common sense argument against monism and in this paper I offer a response. I argue that providing the monist can make his view consistent with the appearance that there is a multiplicity of material things, then it is not rationally acceptable to reject monism solely on the basis of that appearance. Through an appeal to a particular type of property—distributional properties—I sketch out a plausible story of how monism is perfectly consistent with the appearance of plurality, and thus nullify the common sense argument. There may be any number of arguments that serve to undermine monism, but the common sense argument is not one of them. Monism deserves to be taken more seriously than that. (shrink)

Lily was not happy about returning “home.” Agitated, she opened the door to the car, almost before it was stopped, ran to the back of the house, and up the fire escape stairs to the door of her third floor bathroom, as if she was avoiding going through the main living rooms of the house. I called up to her that there was no one at home and she came back down and pushed through the unlocked door. Racing ahead of me, she was already shed of her clothes and in the shower: her self–calming method that she used whenever returning to the house. Thirty minutes later, after three attempts to leave the shower and throwing up in the shower, she dressed and ran back out to our car. I played her favorite music, attempting to calm her anxiety. This transition, from home to “group home,” was increasingly difficult due to recent changes in staff and housemates. Having no one there to greet her was ratcheting up the anxiety level for both of us.When the on–call manager came, Lily was so distraught that I asked for her medications and took her back home with me. Two days later she was calm enough and I was reassured enough to return her to the house. Somehow the house manager made the incident my fault. Perhaps I did react strongly, but on reflection, what triggered the strong reaction in me was the insecurity I felt at finding no one home. It seemed like a breach of trust. Like we were left, abandoned, our plans shattered and at the mercy of fate. Strong emotions for a little mix–up in communications (if that is what it was) but, nevertheless, there it is—how I felt and more to the point how my daughter felt.I relate this story because it illustrates what has changed the most about our lives since Lily left her school and entered the world of adult services: missing is the feeling of trust and security that responsible caring people would keep Lily safe when my husband and I cannot.My 25–year–old daughter Lily has severe autism. She was the most beautiful and easy baby imaginable and appeared to develop normally until she began to lose speech and have night terrors at 15 months of age. She was diagnosed initially with atypical autism, then pervasive developmental disorder not otherwise specified, and finally with autism at age four.From age four to twenty–two, she attended a specialized school for autism where she received age level academics, therapies for speech, and training in self–care and independent living. She did not do well in academics nor did she regain her lost speech. She did learn to care for herself with assistance and, as important, she gained social and behavioral skills and learned to live with others in a social way. Few scholarly writings compare (...) to this discussion ofmimetic rivalry and collective persecution for conveying a sense of the Bible's depths and secrecy, and for deciphering the wisdom inscribed in its images. Yet it is curious that Girard eschews the parables said to be the repositories of scriptural secrets. Both in Things Hidden (189) and in Quand ces choses commenceront (171-172), he distances himself from the parables as conceding too much to the human desire for a mythical God ofretribution. In light of all we have learned from Girard about our traditional misreadings of the Gospel, we might well question even the strongest impressions left by some of its figures. Might the parables' language of apocalyptic vengeance conceal a different revelation, just as an innocent death on a cross should disclose not the bloodlust ofa deity but the violence ofmen? Matthew's Jesus tells a story about a sowerwhose crop was infested by his enemy's weeds, weeds to be uprooted and destroyed at the harvest. And, granted, when Jesus translates the parable for the disciples he describes divine violence at the end ofhistory. The enemy is the devil and the sower is the Son ofMan who sends out his angels to discern the unrighteous ofhumanity and cast them into the furnace. But something does not seem quite right. Isn't Jesus' reduction of his own parable a little too obvious? And is there not John F. Cornell99 something grotesque—or at least simple-minded—about the teacher who warned about dirowing pearls ofwisdom now turning around and broadcasting the solution to one of the great mysteries? If we look closely at the very parable that surrounds the suggestion of "things hidden since the foundation ofthe world," we may see, however, that something is indeed hidden, hidden in the text. And what is hidden there confirms Girard's insight about the dominion ofmimetic rivalry since the world began. The Wheat and Tares is more than amyth ofdivine punishment. It is a parable ofthe essential human malady, a parable ofscandal. What should one do when one's philosophical conclusions run counter to common sense? Bow to the might of ordinary opinion or follow the indiscriminate force of philosophical reason, no matter where it leads? A few strategies have recently been proposed which suggest we needn't have to make this difficult choice at all. According to these views, we can accept the truths of common sense whilst simultaneously endorsing philosophical views with which they seem to conflict. We can, for instance, accept it (...) as true that the Taj Mahal is in India, whilst also eliminating the Taj Mahal from our ontology. I argue that these strategies generate a new conflict with common sense and thus undercut one of the central motivations that drives them. I also argue for the stronger claim that these kinds of ‘truth-salvaging’ strategy are incapablein principleof reconciling theory with common sense. This does not mean that they must be abandoned, for there may be good independent reasons for endorsing them, but it does eliminate one of their most promising advantages. The upshot of the paper will be two-fold. First, one of the major motivations for endorsing these kinds of strategy will be severely undermined. Secondly, and perhaps more significantly, it will mean that for those who think philosophy should be strictly constrained by common sense, all radical ontological views will effectively be off the table. Neo-liberalism often reduces pluralism to a social fact based on the collapse of the big ideals that once claimed to stand in for the ideal of humanity. Tolerance of inevitable value diversity is all that can be offered by the rationalized modern western state. This understanding of pluralism is completely inadequate in the post colony. Ernst Cassirer offers a philosophical understanding of symbolic plurality that allows us to respect divergent symbolic forms, including myth and religion. This understanding of pluralism opens (...) the space for respect for the customary law and the great indigenous ideals such as uBuntu which has often been denigrated as mythical and thus outdated or, worse yet, not law at all. This denigration is inseparable from colonial violence, and demands a process of transculturation as integral to this struggle to transform the new South Africa into a society that lives up to the Constitution’s call for the respect of all of its citizens. This respect can only be done if there are serious economic reforms and a challenge to the hegemonic neo-liberal capitalism. (shrink)

Fredric Jameson is the most challenging American Marxist hermeneutical thinker on the present scene. His ingenious interpretations (prior to accessible translations) of major figures of the Frankfurt School, Russian formalism, French structuralism and poststructuralism as well as of Georg Lukàcs, Jean-Paul Sartre, Louis Althusser, Max Weber and Louis Marin are significant contributions to the intellectual history of twentieth century Marxist and European thought. Jameson's treatments of the development of the novel, the Surrealist movement, of Continental writers such as Honoré de (...) Balzac, Marcel Proust, Alessandro Manzoni, and Robbe Grillet, and of American writers, including Ernest Hemingway, Kenneth Burke and Ursula LeGuin, constitute powerful political readings. Furthermore, his adamantly anti-philosophical form of Marxist hermeneutics puts forward an American Aufhebung of poststructuralism which merits close scrutiny. (shrink)
