Individuals discovered to have engaged in serial plagiarism in philosophy are few, but the academic publishers falling victim to them are many. Some of the most respected publishing houses in philosophy have recently dealt with the problem of having published plagiarized material. The various responses by these publishers to an instance of serial plagiarism, one that involves forty-three articles and book chapters, provides a real-time snapshot of the practices for correcting the scholarly record. The analysis offered in this article yields (...) a twofold conclusion: first, there is relatively little uniformity among publishers in philosophy for responding to plagiarism; and second, in comparison with the natural sciences the discipline of philosophy often falls short of the accepted practices for correcting the scholarly record. The article considers only public, documented cases of academic plagiarism in philosophy and makes no new allegations of plagiarism. (shrink)

The aim of the current article is to analyze the concept of tragic cases and its different implications based on Manuel Atienza, one of the jurists who specially addressed the issue, and on Robert Alexy, whose work is one of the main references in contemporary Legal Philosophy. According to parameters exposed by Alexy (correctness, rationality, legal argumentation, human rights), some of Atienza’s central assertions about tragic cases (lack of correct answer, legal rationality limitation, option for the lesser evil) are herein (...) demonstrated as inadmissible. Based on Alexy’s work, it is possible to justify the opposite conclusion about tragic cases, i.e., cases where there is more than one correct answer and these answers are opposed to each other. In “Philosophy in the age of science,” a review of J. Beale’s and I. J. Kidd’s edited volume, _Wittgenstein and scientism_, by Mariam Thalos, Chon Tejedor was mistakenly referred to as he, rather than she.

This paper offers an unorthodox appraisal of empirical research bearing on the question of the low representation of women in philosophy. It contends that fashionable views in the profession concerning implicit bias and stereotype threat are weakly supported, that philosophers often fail to report the empirical work responsibly, and that the standards for evidence are set very low—so long as you take a certain viewpoint.

The Tractatus revolves around the connection between two central topics – the preconditions of symbolic representation and the nature of logic-cum-philosophy. Proper philosophy is an activity, namely of revealing the hidden structures that allow language to represent reality by way of logical analysis. At the same time the main purpose of such logical analysis consists in revealing metaphysical statements to be nonsensical. In the subsequent development of analytic philosophy, these two ideas parted company. The positive aim of revealing the logical (...) form of sentences resulted in a program closely associated with Davidson, namely a theory of meaning for natural languages that yields metaphysical corollaries. The negative aim of overcoming metaphysics ushered in the activity of dissolving conceptual confusions through conceptual rather than logical analysis, propelled by the later Wittgenstein. My presentation pursues these historical lines of influence. But the ultimate aim is a substantive one, namely to establish whether the two projects can be kept apart. With the later Wittgenstein, I criticize the claim that formal calculi constitute the hidden structure of natural languages. But I also contend that the hope of engaging in anti-metaphysical dialectic without relying on logico-conceptual analysis of some kind falls prey to a “myth of mere method”. (shrink)

It demonstrates that the correction of the scholarly literature for plagiarism is not a task for editors and publishers alone; each member of the research community has an indispensable role in maintaining the integrity of the published literature in the aftermath of plagiarism. If untreated, academic plagiarism damages the integrity of the scholarly record, corrupts the surrounding academic enterprise, and creates inefficiencies across all levels (...) of knowledge production. Fully in accord with the Aristotelian confidence in things that are probable (even if not really likely to happen in the near future), the essay anticipates an interplanetary critique against geocentric ways of thinking peculiar to most humans on Earth: Japanese, Chinese, English, Germans, Russians, etc. who insist on using expressions like sunset and sunrise and thus heavily offend the feelings of anyone coming from planets that do not enjoy Earth’s proximity to the Sun. One of the most controversial aspects of legal philosophy concerns the justification of specific punishments for particular criminal violations. Surprisingly, there has not been any attempt to arrive systematically at any conclusive formula for deriving correct punishments. This article aspires to fulfil this urgent need. I shall examine (1) retributive, (2) consequentialist, (3) reformative, and (4) deterrent punishments in an attempt to derive general equations. It is my wish that by contributing a general formula for each theory we might have (...) a new perspective for comparison. This article finds that the contestability of ascertaining the most appropriate punishment for a criminal is in large part a product of the unstable foundations each penal theory rests on. In addition, almost every variety of penal theories relies on assumptions about criminal culpability, grounded in implicit intentionality. Thus, the contestability of choosing correct punishments to ‘fit’ different crimes is primarily dependent upon the best judgement of judicial officers, not on empirical ‘facts’. (shrink)

[Frank Ebersole is a philosopher] "whose contribution to philosophy... is the greatest of anyone this [the 20th] century, especially in the areas of philosophy of language, theory of knowledge, and perception." from Wittgenstein, Empiricism, and Language by John W. Cook (Oxford University Press, 1999). Language and Perception has nine chapters: seven that address philosophical problems about language and two (chapters 2 and 9) that are more metaphilosophical The metaphilosophical chapters discuss philosophical pictures and some of Frank Ebersole's basic ideas about (...) philosophy. The other seven essays let you participate in his unique struggles to come to terms with such questions as: What is the meaning of a word? Isn't Wittgenstein's idea that things called by the same name have family resemblances significantly flawed? Does language determine what we perceive? Does a thing's being red cause it to look red (the causal theory of perception)? Must the action of speaking be analyzed into simpler actions such as making sounds? Can a bodily movement be part of an action? Is fatalism implied by "what one might say" about the future? Are "natural-kind" words like proper names? are they rigid designators? This and its companion volume, Meaning and Saying, are not just other philosophy books about the philosophy of language. In both books Ebersole, by carefully using examples, convincingly shows that the problems are the products of philosophical pictures. The examples also make the pictures less compelling. How the Second Edition Differs from the First Edition This edition differs from the first edition (University Press of America, 1979) in several ways. Education reveals itself as an area of priority use of the basic vocabulary of society, and at the same time that is why in the education it is best field to start correcting and refining this vocabulary. The war aims to radically reconsider social values, to abandon unjustified compromises, and the proper way to do this is to correct the names. At one time, with the help of naming, people recorded important characteristics of the world, categorized and classified them, set (...) appropriate markers for vital phenomena and processes. This is reflected, in particular, in the biblical myth of Adam, who gave names to living beings. The Chinese philosopher Confucius had explained and conceptualized the situation of name rectification as a necessary procedure to which society should periodically turn. However, one should not wait until a war or other deep social crisis necessitates the rectification of names – the correction of names should be carried out constantly, as a routine procedure, as an element of the application of critical thinking. However, in contrast to the traditional view of critical thinking, the correction of names also requires faith – to establish those values that are not subject to critical review. In times of war, it is faith in Victory. Correction of names has its bearer – a new generation, whose values were formed by participation in the war. Russia’s current war against Ukraine largely reproduces the value disposition of the Southern Confederate war against the North in the United States in 1861-1865 – important lessons from the war can be learned from this. One of the most important tasks is to properly name evil as evil, to oppose the unanimous public outrage at the desire of the strong to establish themselves at the expense of the weak. The naming of evil as evil opens up the possibility of establishing good as a force, of discovering the economic, political, and military advantages of moral right. (shrink)

In turn, Hegelrsquo;s philosophy is taken as a development of this approach that overcomes the limitations of Kantrsquo;s formal approach. Hegelrsquo;s major contribution to Kantrsquo;s revolutionary transformation of the task of philosophy is, it is argued, his recognitive conception of lsquo;spiritrsquo;. Hardback, $80.00.From the 1970s until his tragic death in 2007, Michael Frede was one of the most prominent scholars in ancient Greek philosophy, with landmark contributions to the study of Aristotle and of Hellenistic thought in particular. This (...) volume contains his theoretical reflections on the work of historians of philosophy. The main part of the book reproduces with minor corrections the previously unpublished text of the Nellie Wallace Lectures that Frede gave in 1989–90 in Oxford (1–135). Then come three papers that he published on pretty much the same topic between 1987 and 1992 (137–88). Jonathan Barnes's postface, finally, launches an exciting discussion of Frede's proposals by raising a number of questions and critical remarks about them (189–230).Frede's main claim throughout the book is that there is, and should be, a distinctively historical approach to the history of philosophy that has not yet been sufficiently recognized as such in the academic world. This is not to say that he considers more philosophical approaches to be illegitimate. His point is that we have to be clear about the distinction and what it involves in terms of requirements and methods. What Frede calls the "historical history of philosophy" is thus contrasted by him with two varieties of philosophical approaches. One of them he identifies as the "philosophical history of philosophy." It consists in retrospectively studying the past of philosophy as a kind of maturation toward some more recent doctrinal stage, as Aristotle or Hegel saliently did with their respective predecessors. Koan Zen is a philosophical practice that bears a strong family resemblance to Wittgenstein's approach to philosophy. In this paper I hope to show that this resemblance is especially evident when we compare the Zen method of koan with Wittgenstein's suggestion, towards the end of his Tractatus, about what would constitute the only correct method in philosophy. Both koan Zen and Wittgenstein's method set limits to the reach of philosophical discourse. Each rules metaphysical speculation out of bounds. Neither, however, represents (...) a rejection of the metaphysical. Where Wittgenstein enjoins silence in the face of the unsayable, a silence that allows the metaphysical to show itself, koan Zen calls for concrete demonstrations of that which cannot be captured in rational discourse. I attempt to illustrate this through discussion of a number of koans that serve as reminders that the philosopher (and Zen master) should say nothing except what can be said. (shrink)
