This paper elaborates on administrative sorting, a threat to internal validity that has been overlooked in the regression discontinuity (RD) literature. Variation in treatment assignment near the threshold may still not be as good as random even when individuals are unable to precisely manipulate the running variable. This can be the case when administrative procedures, beyond individuals’ control and knowledge, affect their position near the threshold non-randomly. If administrative sorting is not recognized it can be mistaken as manipulation, preventing fixing (...) the running variable and leading to discarding viable RD research designs. (shrink)

We reply to Artiga and Martinez’s claim according to which the organizational account of cross-generation functions implies a backward looking interpretation of etiology, just as standard etiological theories of function do. We argue that Artiga and Martinez’s claim stems from a fundamental misunderstanding about the notion of “closure”, on which the organizational account relies. In particular, they incorrectly assume that the system, which is relevant for ascribing cross-generation organizational function, is the lineage. In contrast, we recall that organizational closure refers (...) to a relational description of a network of mutual dependencies, abstracted from time, in which production relations are irrelevant. From an organizational perspective, ascribing a function to an entity means locating it in the abstract system that realizes closure. In particular, the position of each entity within the relational system conveys an etiological explanation of its existence, because of its dependence on the effects exerted by other entities subject to closure. Because of the abstract relational nature of closure, we maintain that the organizational account of functions does not endorse a backward looking interpretation of etiology. As a consequence, it does not fall prey of epiphenomenalism. (shrink)

Badain Jaran is a desert, more than 19,000 square miles of endless openness, with innumerable sand dunes up to 1,600 feet tall and mysterious salt-water lakes. It is part of the Alashan desert, south-west to the Gobi in the Inner Mogolia province of China. A place that has been discovered by American scientists on satellite images in the 1980s only that miraculously has been kept hidden to most people since. Two competing accounts of value incomparability have been put forward in the recent literature. According to the standard account, developed most famously by Joseph Raz, ‘incomparability’ means determinate failure of the three classic value relations ( better than , worse than , and equally good ): two value-bearers are incomparable with respect to a value V if and only if (i) it is false that x is better than y with respect to V , (ii) it is false that x (...) is worse than y with respect to V and (iii) it is false that x and y are equally good with respect to V . Most philosophers have followed Raz in adopting this account of incomparability. Recently, however, John Broome has advocated an alternative view, on which value incomparability is explained in terms of vagueness or indeterminacy . In this paper I aim to further Broome’s view in two ways. Firstly, I want to supply independent reasons for thinking that the phenomenon of value incomparability is indeed a matter of the indeterminacy inherent in our comparative predicates. Secondly, I attempt to defend Broome’s account by warding off several objections that worry him, due mainly to Erik Carlson and Ruth Chang. (shrink)

El artículo aborda la cuestión de la contribución de los sentimientos a la “conformación” y a la “revelación” de la identidad personal desde la perspectiva de la fenomenología husserliana. Para ello se parte de una breve descripción de qué entiende Edmund Husserl por “sentimientos” señalando el error de considerar esta esfera como una esfera homogénea. La distinción fundamental que cruza la misma es la existente entre sensaciones afectivas y actos afectivos. Manuscritos inéditos de Husserl a los que el autor ha (...) tenido acceso amplían esta distinción y profundizan en los diversos tipos de intencionalidad afectiva. Una vez ofrecida una visión de conjunto sobre la concepción husserliana de los sentimientos, se analiza la contribución de éstos – entendidos en uno u otro sentido – a la conformación de los distintos, por así decir, “niveles” de identidad personal. De este modo, se reconstruye una suerte de “arqueología” de la identidad personal que va desde lo que Husserl denomina “fluyente presente viviente” hasta lo que en este trabajo se llama “identidad personal en sentido eminente”. The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

To consider that the nature of forgiveness consists in its healing effects on the forgiver overlooks the distinction between the nature of forgiveness and the question about its desirable effects. What I suggest is that the curing effect of forgiveness is an indirectly intended consequence of forgiveness. To forgive mywrongdoer only because this is the way to gain inner peace or to “heal my soul” shows a somewhat utilitarian view on forgiveness. By forgiving the wrongdoer, thevictim extends an attitude of (...) authentic goodwill toward the offender as a person. However, the one who forgives does not extend this attitude toward the action theoffender performed. We can strongly oppose wrong behavior without opposing wrongdoers as persons. (shrink)

The objective of our research is to examine the diverse methods of judicial interpretation, taking off from that established in Article 4 of the Venezuelan Civil Code. We attempt to explain what and how to interpret using the exegetic method of interpretation through an exhaustive analysis of the article, in agreement with Article 22 of the Penal Process Organic Code. Emphasis is placed on the classical methods of legal interpretation: grammatical, logical-systematic, and historical-comparative, among others.

Many sentences can be interpreted both as a metaphor and as a literal claim, depending on the context. The aim of this paper is to show that there are discourse-based systematic constraints on the identification of an utterance as metaphorical, literal, or both (as in the case of twice-apt metaphors), from a normative point of view. We claim that the key is contextual coherence. In order to substantiate this claim, we introduce a novel notion of context as a rich and (...) heterogeneous body of information, including previous discourse, elements coming from the surroundings of the utterance, background information, and Questions Under Discussion (QUD) issued from these three sources. We then define contextual coherence as a relation between what we call the minimal paraphrase of the metaphor and the context, and argue that for an interpretation to be coherent two conditions must be met. First, the minimal paraphrase must address some question in the QUD stack. Second, it must be externally consistent, i.e. consistent with the available contextual information. Finally, we argue that an approach based on contextual coherence is better suited to deal with twice-true and twice-apt metaphors than traditional approaches based on semantic deviance or pragmatic lack of fit. The Anthropocene is seen by many scholars across the sciences and the humanities as a tool for political action. Yet the validation process for this term appears to be extremely conservative. According to geologists’ leading efforts to formalize the term, signals need to petrify in stratigraphic sequences in order to become candidates to mark the start of the Anthropocene. I argue that this emphasis results from a fossilized view of becoming, where time is seen as a punctuated accumulation of solid (...) surfaces that are accessible only in retrospect. I show that this petrified view of change relates to a tendency to divorce earth and sky, which currently divides the practices of humanities scholars and geologists, as well as those of earth system scientists and stratigraphers collaborating on the formalization of the Anthropocene. Challenging this tendency, I conclude, requires opening up earth’s history to the more-than-solid flows of environmental change. (shrink)

Our most current experience of violence is not predominantly violence “given in the flesh,” but violence given through the mediation of the image. The phenomenon of real violence is therefore modified through the imagistic experience, involving first of all its emotional, embodied and intersubjective dimensions. How is the emotion constituted in the face of depicted violence, in contrast to the lived experience of real violence? Is the intersubjectivity modified when violence appears pictorially? What specific embodied dimensions are particularly engaged when (...) violence is lived as an image, and not as a real phenomenon? The phenomenon of imagistic violence can also be understood in contrast with the experience of violence lived in phantasy, memory, or dreaming. Also, since each type of image puts into play certain possibilities of depicting violence, making possible various subjective experiences of violence, it crucial to explore how this experience fundamentally depends on the type of image by which the phenomenon of violence is depicted, be it painting, photography, fiction film, documentary or media image. Student performance and its evaluation remain a serious challenge for education systems. Frequently, the recording and processing of students’ scores in a specific curriculum have several flaws for various reasons. In this context, the absence of data from some of the student scores undermines the efficiency of any future analysis carried out in order to reach conclusions. When this is the case, missing data imputation algorithms are needed. These algorithms are capable of substituting, with a high level of accuracy, the (...) missing data for predicted values. This research presents the hybridization of an algorithm previously proposed by the authors called adaptive assignation algorithm, with a well-known technique called multivariate imputation by chained equations. During the second half of the twentieth century, economics exported its logic - utility maximization - to the analysis of several human activities or realities: a tendency that has been called "economic imperialism". This book explores the concept termed by John Davis as "reverse imperialism", whereby economics has been seen in recent years to have taken in elements from other disciplines. Agroecology has been criticized for being more labor-intensive than other more industrialized forms of agriculture. We challenge the assertion that labor input in agriculture has to be generally minimized and argue that besides quantity of work one should also consider the quality of work involved in farming. Early assessments on work quality condemned the deskilling of the rural workforce, whereas later criticisms have concentrated around issues related to fair trade and food sovereignty. We bring into the discussion the concept of (...) contributive justice to welcome the added labor-intensity of agroecological farming. Contributive justice demands a work environment where people are stimulated to develop skills and learn to be productive. It also suggests a fairer distribution of meaningful work and tedious tasks. Building on the notion of contributive justice we explore which capabilities and types of social relationships are sustainably promoted and reinforced by agroecological farming practices. We argue that agroecological principles encourage a reconceptualization of farm work. Farmers are continuously stimulated to develop skills and acquire valuable experiential knowledge on local ecosystems and agricultural techniques. Further, generalized ecological studies recognize the significance of the farmer’s observations on natural resources management. This contributes to the development of a number of capabilities and leads to more bargaining power, facilitating self-determination. Hereby farm work is made more attractive to a younger generation, which is an essential factor for safeguarding the continuity of family farms. (shrink)

It departs from the ‘normal’ evolution of the affairs foreseen by economic theory. It makes the claim for new theoretical explanations. It surprises the economic agents that try to ascertain what kind of phenomenon they are facing in order to decide the appropriate actions to undertake. There is an essentialist view that requires one to specify the set of necessary and sufficient properties of the things that exist when establishing definitions. The endorsement of essentialism for definitions in economics has been largely motivated by the Taxonomic Tower of Babel (TTB), which encompasses two intellectual fears. The fear of scientific aphasia is the fear that scientific progress is hampered because economists do not agree on the definitions they use. The fear of nihilism refers to the fear of (...) the advent of an unmanageable proliferation of definitions of the same term. We advocate the abandonment of essentialism by offering three arguments. First, essentialism seems impracticable in economics because essences are either mostly unavailable or useless. Second, the TTB, rather than a bug, is a feature of economics. Third, the TTB does not necessarily display the negative implications presumably associated with its existence. (shrink)

In this paper a tentative explanation of the competence of argumentation from an evolutionary point of view is offered. Because in contemporary argumentation theory and the informal logic approach the evolutionary perspective has been neglected, this paper gives an initial overview on the matter with the hope that core aspects of the argumentative faculty—such as argumentative normativity, the function of arguments, or fallacious moves, among others—can be seen differently afterwards. In order to specify the proposal, the main concepts considered are (...) the notion of collective intentionality, cooperation, reputation, niche construction and, of course, basic evolutionary terms. Cet article défend l’idée que l’on peut distinguer quatre niveaux d’analyse au sein des sciences sociales (y compris l’économie) – à savoir, a) un niveau descriptif statistique, b) un niveau explicatif causal, c) un niveau explicatif téléologique, et d) un niveau téléologique prescriptif. Généralement, les sciences sociales ne considèrent que les niveaux a) et b). L’exclusion du niveau c) peut conduire à considérer comme des « anomalies » certains comportements qui ne sont pas compatibles avec des théories comme celle du (...) choix rationnel ou celle de l’utilité espérée – à savoir, des théories qui adoptent une attitude dite de « rationalité instrumentale ». Inclure le niveau c) dans la réflexion implique de considérer la « rationalité pratique » et cela rend ces anomalies « raisonnables ». L’article prend pour cadre théorique la notion de causalité et la téléologie d’Aristote. La première section introduit ces notions, tandis que la deuxième section explore les points de vue contemporains sur la causalité et la téléologie. La troisième section introduit des arguments pour établir la légitimité de l’usage des valeurs en sciences sociales. Cette étape est nécessaire, car les causes finales des explications téléologiques dans le domaine des choses humaines sont bien, en définitive, des valeurs. Ces discussions ouvrent la voie à l’introduction, dans la quatrième et dernière section, des quatre niveaux analytiques susmentionnés. Plus précisément, dans le cas de l’économie, cette discussion se fonde sur la classification des disciplines économiques chez Carl Menger. (shrink)

Turing’s famous 1936 paper “On computable numbers, with an application to the Entscheidungsproblem” defines a computable real number and uses Cantor’s diagonal argument to exhibit an uncomputable real. Roughly speaking, a computable real is one that one can calculate digit by digit, that there is an algorithm for approximating as closely as one may wish. All the reals one normally encounters in analysis are computable, like π, √2 and e. But they are much scarcer than the uncomputable reals because, as (...) Turing points out, the computable reals are countable, whilst the uncomputable reals have the power of the continuum. Furthermore, any countable set of reals has measure zero, so the computable reals have measure zero. In other words, if one picks a real at random in the unit interval with uniform probability distribution, the probability of obtaining an uncomputable real is unity. One may obtain a computable real, but that is in- finitely improbable. But how about individual examples of uncomputable reals? Symmetry-based inferences have permeated many discussions in philosophy of physics and metaphysics of science. It is claimed that symmetries in our physical theories would allow us to draw metaphysical conclusions about the world, a view that I call ‘symmetry inferentialism’. This paper is critical to this view. I claim that (a) it assumes a philosophically questionable characterization of the relevant validity domain of physical symmetries, and (b) it overlooks a distinction between two opposing ways through which relevant physical symmetries become (...) established. My conclusion is that symmetry inferentialism loses persuasive force when these two points are taken into consideration. (shrink)

The ‘value-free ideal’ has been called into question for several reasons. It does not include “epistemic values”—viewed as characteristic of ‘good science’—and rejects the so-called ‘contextual’, ‘non-cognitive’ or ‘non-epistemic’ values—all of them personal, moral, or political values. This paper analyzes a possible complementary argument about the dubitable validity of the value-free ideal, specifically focusing on social sciences, with a two-fold strategy. First, it will consider that values are natural facts in a broad or ‘liberal naturalist’ sense and, thus, a legitimate (...) part of those sciences. Second, the paper will not reject the value-free ideal; rather, it will construe this ideal in a special way, not casting values aside in sciences, but bringing them to the table and rationally discussing them. Today’s predominant naturalistic view has tended to ‘naturalize’ values by looking for physicalist explanations for them—a move resisted by defenders of normativism in social sciences. At the same time, a contending ‘liberal naturalist’ stream has emerged, claiming that not all natural entities can be explained by the methods and concepts of physical sciences, and favors a non-materialist naturalism which includes mind, consciousness, meaning and value as fundamental parts of nature that cannot be reduced to matter. Hence, it may be posited that non-epistemic values could be ‘naturally’ included in the field of human sciences. (shrink)

Apuleius’ generation was caught in the passage from philosophic monotheism to that form of imperial henotheism whose aim was to counteract the tension between philosophy and popular religiosity. It can be affirmed that terminology, vocabulary and especially the motive of discreetness and the prudence in the use of defining syntagmatic expressions are a common fact of Medioplatonism. Author’s attitude is that of a philosopher resorting to the mystic cults, plainly aware of their value and, not the last of the things, (...) of the worship responsibilities devolving on a deliberate attachment. The prudence characterizing the discourse on the ineffable nature of the divinity dwells rather on the meaning and requirement of Platonic mysteries, as they were translated and interpreted by Medioplatonism, in its semi-literal manner, current that Apuleius joined on a base of a certain familiarity from a stylistic and thematic point of view. This paper is addressing Husserl’s critique of psychologism in order to gain a better understanding of an up to date phenomenological research. Staring with Maurice Merleau-Ponty, phenomenology became more and more interested in how psychoanalytic theory can contribute to its findings. The latest phenomenological research reflects this growing interest in psychoanalysis. I will demonstrate in this paper that Husserl’s critique of psychologism enables this interest and that the psychoanalytic theory offers the same critique in response. Thus, the ego problem leading (...) to the deadlock of intersubjectivity, represent one of the common grounds phenomenology and psychoanalysis can meet. In this respect I will use the works of Marc Richir and Jacques Lacan. Emphasizing Marc Richir’s conception of language as phenomenon and the twist he gives to the concept of perceptive phantasia introduced by Husserl in 1918, I will consider the concept of unconscious as a way to solve the intersubjectivity dilemma. Se ilustra con las siguientes relaciones: entre la cosmovisión propia dei sistema de Aristóteles y su noción de economía, entre la matriz racionalista moderna y la economía clásica y neoclásica, a través del uso de analogías físicas y biologicas, y entre algunas posturas recientes y una vision post-moderna del (...) mundo. Se busca fomentar una actitud crítica frente a las teorías e insistir en la necesidadde buscar siempre el camino epistemológico y metodológico adecuado al objeto de estudio.This paper tries to show the bridges between world visions (in a broad sense) and economic theories, through their underlying epistemological positions. The following relations are brought up: between Aristotle’s world vision and his concept of economics, between the modern rationalist frame and classical and neoclassical economics by the postulation of analogies from physics and biology, and finally between post-modern world vision and some current perspectives. The aim of the paper is to stress on the need of maintaining a critical position toward theories and also always looking for an adequate epistemological and methodological way. (shrink)

They are the objectiv correlates of judgements and they have an existence independent of propositions and of acts of judging. Their form is "the being-b of A". States of affairs have different properties. One of the most important is that they are bearers of ontological modalities. In this respect the analysis of the different classes of modalities needs to be (...) completed for ontological investigations which make clear the several types of essences and the laws which are grounded in these essences. This article begins by pointing out the difficulties involved by the insertion of freedom in economics: It poses epistemological problems that are not satisfactorily solved by the standard theories. The article suggests that the Aristotelian epistemological frame of practical rationality may be an apt position from which one can deal with freedom in economics. Aristotle's concepts of society and economics are first introduced. The role of virtues in achieving economic coordination is exposed. Then the corresponding concept of practical science is (...) described, showing its main characteristics and how they fit in with traditional political economy. The concept of value neutrality receives special attention in the article: A reinterpretation of the meaning of it is proposed. The article concludes that Aristotle's broad concepts of practical reason and science leave room for a more comprehensive notion of economics. (shrink)

Some mutual funds not only apply the usual asset management and custodial fees, but also front loads and redemption fees as a kind of ‘toll charge’ payable on entering and/or leaving the fund. The aim of this work is to examine the implications of the different loads and fees applied to mutual fund investors in the Spanish market. The results show that there is a relationship between the various charges and fees. The fact that load fund companies charge higher management (...) and custody fees proves the potential of the fund companies to impose higher fees on a segment of the clientele. The investors in load funds, which tend to be large in number of shareholders and belonging to banks and savings banks, are small investors who show a low cost sensitivity. A lower level of financial sophistication may be the reason for the apparent lower price awareness. The problem is that the investors in load funds are not financially compensated for the extra cost represented by the front‐load and redemption fees. The only beneficiary seems to be the financial institution itself. On this view, the survival of load funds seems to depend on the lack of financial sophistication of their clientele, combined with market inefficiencies. It is worth asking about the ethics of a situation of market segmentation that allows managing institutions to benefit from the segment of the least sophisticated investors. (shrink)

Our main concern in this paper is the semantics of predicates of personal taste. However, in order to see these predicates in the right perspective, we had to broaden the scope to the wider class of relative gradable adjectives. We present an analysis of the meaning of these adjectives in the framework of update semantics. In this framework the meaning of a sentence is not identified with its truth conditions, but with its impact on people’s intentional states. In this respect, (...) an important characteristic of relative gradable adjectives is the interplay between their evaluative features and people’s expectations. The dynamic set-up also makes it possible to model the interpretation of a relative gradable adjective without supposing that the context always supplies a ‘cut-off’ point determining its application, and to deal in a pragmatic way with situations in which the Sorites paradox arises. Esto es tanto más cierto en nuestro país, habitado por (...) una suerte de magdaleniense o pre-Tartessos lleno de cacharritos con iconos, llamadas, avisos, avatares, tamagotchies, móviles y juegos online integrados sin la menor discrepancia sobre una capa de rituales del año de la polka, fetiches, incienso, lágrimas, sangre, joyas, ofrendas, sacrificios, reliquias de miembros de santos y matriarcas fenicio-neolíticas devenidas madres de Cristo al tiempo que supporters del equipo de fútbol local. El ultrarracionalismo se presenta como un nuevo método y movimiento filosófico cuya voluntad es afrontar los desafíos del futuro sin dejar de hacer justicia a esta auténtica marejada de lo grotesco.
