We reply to Artiga and Martinez’s claim according to which the organizational account of cross-generation functions implies a backward looking interpretation of etiology, just as standard etiological theories of function do. We argue that Artiga and Martinez’s claim stems from a fundamental misunderstanding about the notion of “closure”, on which the organizational account relies. In particular, they incorrectly assume that the system, which is relevant for ascribing cross-generation organizational function, is the lineage. In contrast, we recall that organizational closure refers (...) to a relational description of a network of mutual dependencies, abstracted from time, in which production relations are irrelevant. From an organizational perspective, ascribing a function to an entity means locating it in the abstract system that realizes closure. In particular, the position of each entity within the relational system conveys an etiological explanation of its existence, because of its dependence on the effects exerted by other entities subject to closure. Because of the abstract relational nature of closure, we maintain that the organizational account of functions does not endorse a backward looking interpretation of etiology. As a consequence, it does not fall prey of epiphenomenalism. (shrink)

The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

Two competing accounts of value incomparability have been put forward in the recent literature. According to the standard account, developed most famously by Joseph Raz, ‘incomparability’ means determinate failure of the three classic value relations ( better than , worse than , and equally good ): two value-bearers are incomparable with respect to a value V if and only if (i) it is false that x is better than y with respect to V , (ii) it is false that x (...) is worse than y with respect to V and (iii) it is false that x and y are equally good with respect to V . Most philosophers have followed Raz in adopting this account of incomparability. Recently, however, John Broome has advocated an alternative view, on which value incomparability is explained in terms of vagueness or indeterminacy . In this paper I aim to further Broome’s view in two ways. Firstly, I want to supply independent reasons for thinking that the phenomenon of value incomparability is indeed a matter of the indeterminacy inherent in our comparative predicates. Secondly, I attempt to defend Broome’s account by warding off several objections that worry him, due mainly to Erik Carlson and Ruth Chang. (shrink)

The purpose of this article is to analyze the significance of the absence of the problem of living body in Heidegger's analytic of Dasein. In order to evaluate the occurrences of the problem of the body in Being and Time, I also refer to the context of some of Heidegger's later work where there is to be found a sketch of an ontological investigation of the living body. I analyze then in detail the scarce occurrences of body in the fundamental (...) ontology, showing finally that the lack of a proper phenomenological examination of living body generates a series of conceptual difficulties for the problem of Dasein's death, precisely when the issue of dead body is at stake. Agroecology has been criticized for being more labor-intensive than other more industrialized forms of agriculture. We challenge the assertion that labor input in agriculture has to be generally minimized and argue that besides quantity of work one should also consider the quality of work involved in farming. Early assessments on work quality condemned the deskilling of the rural workforce, whereas later criticisms have concentrated around issues related to fair trade and food sovereignty. We bring into the discussion the concept of (...) contributive justice to welcome the added labor-intensity of agroecological farming. Contributive justice demands a work environment where people are stimulated to develop skills and learn to be productive. It also suggests a fairer distribution of meaningful work and tedious tasks. Building on the notion of contributive justice we explore which capabilities and types of social relationships are sustainably promoted and reinforced by agroecological farming practices. We argue that agroecological principles encourage a reconceptualization of farm work. Farmers are continuously stimulated to develop skills and acquire valuable experiential knowledge on local ecosystems and agricultural techniques. Further, generalized ecological studies recognize the significance of the farmer’s observations on natural resources management. This contributes to the development of a number of capabilities and leads to more bargaining power, facilitating self-determination. Hereby farm work is made more attractive to a younger generation, which is an essential factor for safeguarding the continuity of family farms. (shrink)

There is an essentialist view that requires one to specify the set of necessary and sufficient properties of the things that exist when establishing definitions. The endorsement of essentialism for definitions in economics has been largely motivated by the Taxonomic Tower of Babel (TTB), which encompasses two intellectual fears. The fear of scientific aphasia is the fear that scientific progress is hampered because economists do not agree on the definitions they use. The fear of nihilism refers to the fear of (...) the advent of an unmanageable proliferation of definitions of the same term. We advocate the abandonment of essentialism by offering three arguments. First, essentialism seems impracticable in economics because essences are either mostly unavailable or useless. Second, the TTB, rather than a bug, is a feature of economics. Third, the TTB does not necessarily display the negative implications presumably associated with its existence. (shrink)

Very large databases are a major opportunity for science and data analytics is a remarkable new field of investigation in computer science. The effectiveness of these tools is used to support a “philosophy” against the scientific method as developed throughout history. According to this view, computer-discovered correlations should replace understanding and guide prediction and action. Consequently, there will be no need to give scientific meaning to phenomena, by proposing, say, causal relations, since regularities in very large databases are enough: “with (...) enough data, the numbers speak for themselves”. The “end of science” is proclaimed. Using classical results from ergodic theory, Ramsey theory and algorithmic information theory, we show that this “philosophy” is wrong. For example, we prove that very large databases have to contain arbitrary correlations. These correlations appear only due to the size, not the nature, of data. They can be found in “randomly” generated, large enough databases, which—as we will prove—implies that most correlations are spurious. Too much information tends to behave like very little information. The scientific method can be enriched by computer mining in immense databases, but not replaced by it. (shrink)

Injusticia epistémica es una etiqueta conceptual que ha tenido, al menos, un doble rendimiento. Por una parte, el concepto que ha propuesto Miranda Fricker en Injusticia Epistémica ha permitido profundizar en el diálogo filosófico respecto de cómo se generan y justifican las creencias y las pretensiones de conocimiento y, por otra parte, ha permitido en el dominio social nombrar distintas prácticas culturales de abuso, invisibilización, o asimetrías de poder que benefician algunos y deterioran a otros. Ya han pasado quince años (...) desde la publicación del libro de Fricker que permitió tales avances, en la esfera disciplinaria y en la esfera política. El presente volumen, por un lado, intenta celebrar esta importante obra que generó un espacio indiscutido en el terreno filosófico mediante la consideración de sus temas y, por otra parte, intenta contribuir ofreciendo el análisis de problemas reales y contingentes en distintas culturas epistémicas, y de prácticas sociales ancladas en distintos países de Latinoamérica. The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

In contrast to the “normativist” view, “naturalist” theorists claim that the concept of health refers to natural or normal states and propose different characterizations of healthy and diseased conditions that are meant to be objectivist and biologically grounded. In this article, we examine the core concept of these naturalist accounts of disease, i.e., the concept of biological malfunction, and develop a new formulation of the notion of malfunction following the recent organizational approach to functions in the philosophy of biology. We (...) focus on the notions of adaptive regulation and functional presupposition to develop a new conceptual framework that justifies the ascription of malfunctional behaviors to biological systems according to the embodied normativity of biological organizations. We advance a framework for an inferential conception of physical laws, addressing the problem of the application of mathematical structures to the relevant structure of physical domains. Physical laws, we argue, express generalizations that work as rules for deriving physically informative inferences about their target systems, hence guiding us in our interaction with various domains. Our analysis of the application of mathematics to the articulation of physical laws follows a threefold scheme. First, we examine the immersion of the relevant structure (...) of physical domains into mathematical structures. Second, we assess the inferential power of laws resulting from the mathematical formalism employed in the immersion step. And third, we provide a suitable physical interpretation for the extant mathematical structures obtained from the inferential step. We demonstrate that a deflationary, empiricist framework for an inferential conception of physical laws delivers both an understanding of the mathematical character of physical laws, and a way of responding to some of the standard philosophical riddles associated with laws. The Anthropocene is seen by many scholars across the sciences and the humanities as a tool for political action. Yet the validation process for this term appears to be extremely conservative. According to geologists’ leading efforts to formalize the term, signals need to petrify in stratigraphic sequences in order to become candidates to mark the start of the Anthropocene. I argue that this emphasis results from a fossilized view of becoming, where time is seen as a punctuated accumulation of solid (...) surfaces that are accessible only in retrospect. I show that this petrified view of change relates to a tendency to divorce earth and sky, which currently divides the practices of humanities scholars and geologists, as well as those of earth system scientists and stratigraphers collaborating on the formalization of the Anthropocene. Challenging this tendency, I conclude, requires opening up earth’s history to the more-than-solid flows of environmental change. (shrink)

Este artículo tiene como objetivo esclarecer la relación entre juicio y deseo en el pensamiento de Gilles Deleuze y destacar la importancia de Spinoza para la resolución de este problema. La concepción negativa del deseo es la base de la cultura y el pensamiento de Occidente; sin embargo, Spinoza nos propone una concepción afirmativa e inmanente. Estos elementos son fundamentales para esclarecer el sentido teórico y práctico de la propuesta de Gilles Deleuze en su obra, donde una concepción afirmativa del (...) deseo le permite proponer la existencia de dos imágenes del pensamiento: una imagen moral, la cual crítica; y, una imagen ética, que restituye, a partir de la teoría de los afectos y la naturaleza de Spinoza, el valor afirmativo del cuerpo y los afectos. Deleuze y Spinoza, así, nos proponen una imagen del pensamiento que sostiene el valor de lo afirmativo sobre lo negativo, es decir, que relieva la producción de lo diferente y lo múltiple sobre la jerarquía de lo idéntico o lo hegemónico. Vilém Flusser’s chiro-phenomenology fills an essential gap in scholarship by expanding and reinterpreting the ontological significance of gestures, focusing on the hand as a crucial site for understanding the embodied nature of human existence. This article explores Flusser’s unique contribution to the phenomenology of the hand, highlighting why his approach is necessary for a fuller understanding of gesture and embodiment. I begin by emphasizing the relevance of the hand in understanding gestures, arguing that phenomenology provides rich resources for this inquiry. (...) Within the phenomenological tradition, two distinct perspectives emerge: Husserl and Merleau-Ponty, who concentrate on the perceptive and kinesthetic dimensions of the hand, and Heidegger and Levinas, who explore its ontological significance, viewing the hand as essential to human existence. I position Flusser within this ontological framework but show how he departs from his predecessors by developing an original manual approach that centers on the ‘gesture of making.’ By analyzing the eleven constitutive moments of this gesture, I demonstrate how Flusser’s chiro-phenomenology views gestures not only as expressive or communicative acts but as fundamental possibilities for human being-in-the-world. His work thus offers a crucial extension of phenomenology’s understanding of the body and action. (shrink)

Symmetry-based inferences have permeated many discussions in philosophy of physics and metaphysics of science. It is claimed that symmetries in our physical theories would allow us to draw metaphysical conclusions about the world, a view that I call ‘symmetry inferentialism’. This paper is critical to this view. I claim that (a) it assumes a philosophically questionable characterization of the relevant validity domain of physical symmetries, and (b) it overlooks a distinction between two opposing ways through which relevant physical symmetries become (...) established. My conclusion is that symmetry inferentialism loses persuasive force when these two points are taken into consideration. (shrink)

Apuleius’ generation was caught in the passage from philosophic monotheism to that form of imperial henotheism whose aim was to counteract the tension between philosophy and popular religiosity. It can be affirmed that terminology, vocabulary and especially the motive of discreetness and the prudence in the use of defining syntagmatic expressions are a common fact of Medioplatonism. Author’s attitude is that of a philosopher resorting to the mystic cults, plainly aware of their value and, not the last of the things, (...) of the worship responsibilities devolving on a deliberate attachment. The prudence characterizing the discourse on the ineffable nature of the divinity dwells rather on the meaning and requirement of Platonic mysteries, as they were translated and interpreted by Medioplatonism, in its semi-literal manner, current that Apuleius joined on a base of a certain familiarity from a stylistic and thematic point of view. This paper is addressing Husserl’s critique of psychologism in order to gain a better understanding of an up to date phenomenological research. Staring with Maurice Merleau-Ponty, phenomenology became more and more interested in how psychoanalytic theory can contribute to its findings. The latest phenomenological research reflects this growing interest in psychoanalysis. I will demonstrate in this paper that Husserl’s critique of psychologism enables this interest and that the psychoanalytic theory offers the same critique in response. Thus, the ego problem leading (...) to the deadlock of intersubjectivity, represent one of the common grounds phenomenology and psychoanalysis can meet. In this respect I will use the works of Marc Richir and Jacques Lacan. Emphasizing Marc Richir’s conception of language as phenomenon and the twist he gives to the concept of perceptive phantasia introduced by Husserl in 1918, I will consider the concept of unconscious as a way to solve the intersubjectivity dilemma. In the philosophy of physics and philosophy of time there is a widely-extended thesis according to which our experience of the passage of time is unreal to the extent that it has no objective grounds in nature as described by our best physical theories. Particularly, as dynamical laws belonging to such theories are temporally symmetric, and they do not distinguish both time directions, the experienced temporal asymmetry turnouts to be illusory. In this paper, I shall argue that we have sound (...) reasons to cast doubts on such thesis. For the one thing, it is not so clear to me to what extent we really have experience of the passage of time. For another thing, it is highly questionable that our dynamical laws are temporally symmetric, and if so, that they were useful to argue against our assumed experience of the passage of time. The objective of our research is to examine the diverse methods of judicial interpretation, taking off from that established in Article 4 of the Venezuelan Civil Code. We attempt to explain what and how to interpret using the exegetic method of interpretation through an exhaustive analysis of the article, in agreement with Article 22 of the Penal Process Organic Code. Emphasis is placed on the classical methods of legal interpretation: grammatical, logical-systematic, and historical-comparative, among others.

RésuméDans cet article, j'analyse deux approches du phénomène du geste, tel qu'il est constitué par l'incarnation, l'intersubjectivité, l'affectivité et le langage : tandis que Martin Heidegger affirme que le mouvement corporel humain dans son ensemble doit être compris comme geste par opposition au mouvement spatial des choses, Vilém Flusser intègre sous cette notion une multitude de pratiques et d'activités humaines que le sens commun hésite à appeler gestes. Le dilemme de la phénoménologie du geste consiste dans cette tension entre la (...) concrétude plurielle des apparences gestuelles et la tentation irrépressible d'identifier une couche unitaire qui leur permettrait de tenir ensemble. Our most current experience of violence is not predominantly violence “given in the flesh,” but violence given through the mediation of the image. The phenomenon of real violence is therefore modified through the imagistic experience, involving first of all its emotional, embodied and intersubjective dimensions. How is the emotion constituted in the face of depicted violence, in contrast to the lived experience of real violence? Is the intersubjectivity modified when violence appears pictorially? What specific embodied dimensions are particularly engaged when (...) violence is lived as an image, and not as a real phenomenon? The phenomenon of imagistic violence can also be understood in contrast with the experience of violence lived in phantasy, memory, or dreaming. Also, since each type of image puts into play certain possibilities of depicting violence, making possible various subjective experiences of violence, it crucial to explore how this experience fundamentally depends on the type of image by which the phenomenon of violence is depicted, be it painting, photography, fiction film, documentary or media image. The intellectual property regimes we have currently in place are heavily under attack. One of the points of criticism is the interaction between two elements of article 27 of the Universal Declaration of Human Rights, the widely discussed issue of being able to benefit from scientific progress and the less argued for position of having a right to take part in scientific enterprises. To shine light on the question if we should balance the two elements or prioritize one of them, (...) an exploration will be offered on how benefiting from scientific progress and the ability to participate in the advancement of science relate to securing human capabilities. A different perspective to the question will be gained by identifying the problem as an issue of misrecognition, especially the failure to recognize many willing collaboration partners in scientific research as peers. Lastly, I will argue that cooperative justice requires that if we have an innovation incentive system that disproportionally benefits one particular group, a certain duty to counterbalance this advantage exists when we are relying on mutual cooperation for the recognition of intellectual property rights. In this paper, I critically assess two recent proposals for an interpretation-independent understanding of non-relativistic quantum mechanics: the overlap strategy (Fraser & Vickers, 2022 ) and the textbook account (Egg, 2021 ). My argument has three steps. I first argue that they presume a Quinean-Carnapian meta-ontological framework that yields flat, structureless ontologies. Second, such ontologies are unable to solve the problems that quantum ontologists want to solve. Finally, only structured ontologies are capable of solving the problems that quantum ontologists want (...) to solve. But they require some dose of speculation. In the end, I defend the conservative way to do quantum ontology, which is (and must be) speculative and non-neutral. (shrink)

In this article I discuss the conditions under which sovereign debts are not morally binding for a state. Following an old legal doctrine, I call non-binding debts ‘odious'. I proceed as follows. First, I argue that alternative accounts on the morality of debts are unsatisfactory. The problem these accounts have are that they do not clearly identify the philosophical issues that underlie the notion of odious debts, or that they fail to specify what exactly the immorality of odious debts consists (...) in. Second, I defend the view that a debt is odious when two conditions are satisfied: borrowed funds were used by public officials for purposes for which they were not authorised lenders knew, or should have known, about possible unauthorised uses of those funds. If these two conditions are both satisfied, debts should not be considered debts of the state, but rather personal debts of rulers. In this article I shall defend, against the conventional understanding of the matter, that two coherent and tenable approaches to time reversal can be suitably introduced in standard quantum mechanics: an “orthodox” approach that demands time reversal to be represented in terms of an anti-unitary and anti-linear time-reversal operator, and a “heterodox” approach that represents time reversal in terms of a unitary, linear time-reversal operator. The rationale shall be that the orthodox approach in quantum theories assumes a relationalist metaphysics of (...) time, according to which time reversal is nothing but motion reversal. But, when one shifts gears and turn to a substantivalist metaphysics of time the heterodox approach to time reversal in quantum mechanics comes up in a more natural way. (shrink)

Mercier and Sperber (2011a, 2011b; Mercier, 2011a, 2011b, 2011c, and 2011d) have presented a stimulating and provocative new theory of reasoning: the argumentative theory of reasoning. They maintain that argumentation is a meta-representational module. In their evolutionary view of argumentation, the function of this module would be to regulate the flow of information between interlocutors through persuasiveness on the side of the communicator and epistemic vigilance on the side of the audience. The aim of this paper is to discuss the (...) perspective of the authors in which they conceive this competence as the natural scenario of reflective reasoning. (shrink)

A widespread view in physics holds that the implementation of time reversal in standard quantum mechanics must be given by an anti-unitary operator. In foundations and philosophy of physics, however, there has been some discussion about the conceptual grounds of this orthodoxy, largely relying on either its obviousness or its mathematical-physical virtues. My aim in this paper is to substantively change the traditional structure of the debate by highlighting the philosophical commitments underlying the orthodoxy. I argue that the persuasive force (...) of the orthodoxy can benefit from a relational metaphysics of time and a by-stipulation view on symmetries. Within such philosophical background, I submit, the orthodoxy of time reversal in standard quantum mechanics could find a fertile terrain to lay the groundwork for a more thorough conceptual justification. Our intuition is straightforward: yes, argumentation changes minds. It can’t be otherwise! But many cognitive and discursive habits seem to suggest otherwise. As the literature in the psychology of reasoning incessantly emphasizes, we hardly change our minds (and the minds of others) because a predisposed robust confirmation bias (or myside bias) is at work every time we argue, among other persistent cognitive illusions (Pohl, 2012), heuristics and biases (Santibáñez, 2023). To adequately answer the questions of why and how argumentation changes (...) minds, if at all, this paper frames the problem in an evolutionary perspective. My main thesis is that argumentative competence changes minds because its ultimate goal (Laland et al., 2011; Scott-Phillips, Dickins & West, 2011) is to construct the future to predict more accurately (Suddendorf, Redshaw & Bulley, 2022). This idea converges with some evolutionary analysis of other cognitive skills and cultural inventions. To explain my perspective, I use the distinction between ultimate and proximal goals of a trait, and the cultural background of argumentative competence plays a fundamental role within this distinction. Notre intuition est simple: oui, l’argumentation change les men-talités. Mais de nombreuses habitudes cognitives et discursives suggèrent le contraire. Comme le soulignent sans cesse les écrits sur la psychologie du raisonnement, nous ne changeons guère d’avis parce qu’un biais de con-firmation robuste (ou biais de-mon-côté) prédisposé est à l’oeuvre lorsque nous argumentons. Pour répondre adéquatement aux questions de pour-quoi, comment et si l’argumentation change les mentalités, je pose le prob-lème dans une perspective évolution-niste. Je soutiens que la compétence ar-gumentative change les mentalités parce que son but ultime est de con-struire l’avenir, de prédire avec plus de précision. Cela converge avec les anal-yses évolutionnistes d’autres compé-tences cognitives et inventions cul-turelles. Pour expliquer ma perspec-tive, j’utilise la distinction entre les buts ultimes et proximaux d’un trait. (shrink)

Durante los últimos años se ha producido un proceso migratorio sin precedentes hacia Chile, situación que ha modificado en cierta medida la ecología social, por medio de la introducción de discursos de variadas procedencias dialectales. En esta línea, el trabajo ha descrito el comportamiento discursivo argumental de la ecología de inmigrantes colombianos, peruanos y venezolanos de la Región Metropolitana y de la Región Coquimbo, Chile (Zona Centro Norte). A partir de una entrevista cualitativa estructurada, 160 participantes expresaron su punto de (...) vista frente a una situación de autoimplicación (la pandemia Covid-19); enseguida generaron argumentos justificatorios del punto de vista inicial; y finalmente, generaron la conclusión (_peroratio_) en la forma de una secuencia de discurso. El análisis permitió observar que el esquema de razonamiento sintomático asociado a la generación de argumentos _ad misericordiam_ y de identidad caracteriza específicamente el discurso de los hablantes colombianos, peruanos y venezolanos. Por otra parte, se pudo observar que el empleo de esquema instrumental en la forma de argumento de tipo causal parece ser la vía de resolución de conflictos más amplia para esta ecología discursiva específica.
