In this article, I engage with Derrida’s deconstructive reading of theories of performativity in order to analyse Max Weber’s sovereignty–legitimacy paradigm. First, I highlight an essential articulation between legitimacy and sovereign ipseity (understood, beyond the sole example of State sovereignty, as the autopositioned power-to-be-oneself). Second, I identify a more originary force of legitimation, which remains foreign to the order of performative ipseity because it is the condition for both its position and its deconstruction. This suggests an essential fallibility of (...) the performative, which implies a ‘mystical’ legitimacy and a paradoxical, divisible and self-differential representation of sovereignty. The structural differentiality of legitimacy and sovereignty signifies an irreducible coloniality of law and language, but also suggests the possibility of an unconditional resistance located in the radical interpretability of the law, beyond determined representations of powers, dominations, sovereignties or resistances. This reflection is triggered by a reading of Cynthia Weber’s theory of ‘performative states’, describing sovereignty under the form of an impossible ontology, which leads me to elaborate the notion of legitimation-to-come as a non-ontological ‘concept’: this notion of unconditional legitimacy, beyond sovereignty, binds beliefs and phantasms to the unpresentable force of the event. Pursuing the efforts of scholars such as Rob Walker and Cynthia Weber, I sketch the implications of this archi-performative legitimacy regarding the methodological protocols of International Relations and sociology, in view of elucidating the persistent ontological presuppositions of these disciplines. In the literature on scientific explanation two types of pluralism are very common. The first concerns the distinction between explanations of singular facts and explanations of laws: there is a consensus that they have a different structure. The second concerns the distinction between causal explanations and uni.cation explanations: most people agree that both are useful and that their structure is different. In this article we argue for pluralism within the area of causal explanations: we claim that the structure of a (...) causal explanation depends on the causal structure of the relevant fragment of the world and on the interests of the explainer. Incommensurability of scientific theories, as conceived by Thomas Kuhnand Paul Feyerabend, is thought to be a major or even insurmountable obstacletothe empirical comparison of these theories. I examine this problem in light ofaconcrete case from the history of experimental biology, namely the oxidativephosphorylation controversy in biochemistry (ca. 1961-1977). After a briefhistorical exposition, I show that the two main competing theories which werethe subject of the ox-phos controversy instantiate some of the characteristicfeatures of incommensurable theories, namely translation failure,non-corresponding predictions, and different (...) claims about what kinds ofentitiesexist in the world. By examining how the controversy was eventually resolved, Ithen show that at least this pair of incommensurable theories couldneverthelessbe empirically compared. (shrink)

This paper proposes a basic revision of the understanding of teleology in biological sciences. Since Kant, it has become customary to view purposiveness in organisms as a bias added by the observer; the recent notion of teleonomy expresses well this as-if character of natural purposes. In recent developments in science, however, notions such as self-organization (or complex systems) and the autopoiesis viewpoint, have displaced emergence and circular self-production as central features of life. Contrary to an often superficial reading, Kant gives (...) a multi-faceted account of the living, and anticipates this modern reading of the organism, even introducing the term self-organization for the first time. Our re-reading of Kant in this light is strengthened by a group of philosophers of biology, with Hans Jonas as the central figure, who put back on center stage an organism-centered view of the living, an autonomous center of concern capable of providing an interior perspective. Thus, what is present in nuce in Kant, finds a convergent development from this current of philosophy of biology and the scientific ideas around autopoeisis, two independent but parallel developments culminating in the 1970s. Instead of viewing meaning or value as artifacts or illusions, both agree on a new understanding of a form of immanent teleology as truly biological features, inevitably intertwined with the self-establishment of an identity which is the living process. Paraconsistent logic makes it possible to study inconsistent theories in a coherent way. From its modern start in the mid-20th century, paraconsistency was intended for use in mathematics, providing a rigorous framework for describing abstract objects and structures where some contradictions are allowed, without collapse into incoherence. Over the past decades, this initiative has evolved into an area of non-classical mathematics known as inconsistent or paraconsistent mathematics. This Element provides a selective introductory survey of this research program, distinguishing between `moderate' (...) and `radical' approaches. Para isso, é necessário que se caminhe para além da fronteira erigida na tradição, a qual liga o conceito de Reconhecimento à dialética do senhor e do escravo na Fenomenologia. Dado que os trabalhos de Honneth se fundam nos escritos (...) do jovem Hegel, anteriores a esta, é possível ir além de tais fronteiras. A conexão de Reconhecimento e Liberdade torna-se possível por meio da tentativa de reatualização da Filosofia do Direito honnethiana, a qual tem por objeto lançar as bases de uma teoria da justiça. In response to those who have argued the Internet is amoral at best, and an instrument for immorality at worst, we show that the net can provide a forum for genuine ethical engagement and distinctive forms of wrongdoing. Without deriving the moral value of the Internet from its interface with the non-virtual world and in contrast to presentations of the net as an anarchic utopia or as an unethical or amoral dystopia, we apply a substantive moral test to a selection (...) of online examples and ask can the net accommodate resistance to oppression that is necessary, though not sufficient, for justice? More precisely, we will ask whether Gandhian non-violent action is available to Cyberpunks? (shrink)

It has been claimed that the intentional stance is necessary to individuate behavioral traits. This thesis, while clearly false, points to two interesting sets of problems concerning biological explanations of behavior: The first is a general in the philosophy of science: the theory-ladenness of observation. The second problem concerns the principles of trait individuation, which is a general problem in philosophy of biology. After discussing some alternatives, I show that one way of individuating the behavioral traits of an organism is (...) by a special use of the concept of biological function, as understood in an enriched causal role (not selected effect) sense. On this view, a behavioral trait is essentially a special kind of regularity, namely a regularity that is produced by some regulatory mechanism. Regulatory mechanisms always require goal states, which can only be provided by functional considerations. As an example from actual (as opposed to folk) science, I examine the case of social behavior in nematodes. I show that the attempt to explain this phenomenon actually transformed it. This supports the view that scientific explanation does not explain an explanandum phenomenon that is given prior to the explanation; rather, the explanandum is changed by the explanation. This means that there could be a plurality of stances that have some heuristic value initially, but which will be abandoned in favor of a functional characterization eventually. (shrink)

A multitude of techno-natures emerge through discourses and practices of the new technosciences. While some philosophers and science studies scholars argue that model organisms and artefacts are getting more and more disembodied and decontextualised in the laboratory, I want to show how ontic dimensions of model organisms and artefacts are made invisible as well as visible in different practices of technosciences like Artificial Life and robotics.This analysis opens up possibilities for an understanding of how ontic dimensions of non-human actors are (...) made visible and invisible in technoscientific practices. At the same time it allows the development of a concept of nonhuman actors beyond reifying, velontriquist practices of representation as well as a critical intervention in the co-construction of our technoculture. BackgroundTranscranial magnetic stimulation (TMS) is an FDA approved treatment for major depression, migraine, obsessive compulsive disorder, and smoking addiction. TMS has gained popular media support, but media coverage and commercial reporting of TMS services may be contributing to the landscape of ethical issues.MethodsWe explore the differences between the academic and print media literature portrayals of TMS to evaluate their ethical impact for the public. We performed a comprehensive literature review using PubMed and NexisUni databases to evaluate the literature available on (...) TMS from 2014 to 2019. Our sample consisted of 1632 academic articles and 468 print media articles for a total of 2100 articles. We then coded each article for seven specific top-level codes: (1) type of source, (2) year of publication, (3) purpose of TMS application, (4) age of subjects, (5) population, (6) overall tone, and (7) specification of TMS parameters. We also made some additional notes of the TMS parameters where specified and the breakdown of mental health applications.ResultsOur results indicated several discrepancies between the academic and the print media reporting about TMS technology, particularly with regards to tone and specificity. Namely, the academic sample was largely neutral and specific about the parameters under which TMS was being applied, while the print media sample was heavily optimistic and presented the application of TMS with far less specificity. There was some convergence between the two samples, such as the focus of both on therapy as the predominant TMS application.ConclusionsWe call upon the academic community to increase scrutiny of TMS services in order to ensure that people’s knowledge of health technologies is not unduly influenced by sensational claims and a general lack of adequate information. This article addresses ethical issues in conducting randomized clinical trials with youth. Ethical considerations that occur prior to treatment, during treatment, and following treatment are reviewed. Recommendations, based on empirical evidence and clinical experience, are offered for conducting ethical treatment research with youth and future directions for carrying out research on the ethics of conducting RCTs with youth are offered.

Based on Davenport’s (1998) social audit, we examined six firms’ corporate social responsibility activities within the beer industry in an effort to identify and compare these firms’ industry social standing. The results have implications in our understanding and assessment of corporate citizenship practices both within and across business industry groups.

This article is about scriptural reasoning, a relatively new trend in philosophical theology, and more specifically about the possibility of including Confucianism in this endeavor. Scriptural reasoning is an explicitly normative endeavor arguably claiming value at three different levels: a better understanding of one's own scriptural tradition, increased wisdom through inter-faith dialogue and redemption for all humanity The question whether Confucianism could be participating in scriptural reasoning may accordingly be answered differently relative to these three normative levels To approximate an (...) answer, I proceed by subjecting the notion of a "Confucian scripture" to a conceptual analysis based on the English word "scripture" and based on the Chinese character jing, which is frequently said to be the classical Chinese equivalent of English "scripture." The conceptual analysis will allow for some comparative observations and will prepare the ground for a critical assessment of the possibility of including Confucianism within practices of scriptural reasoning. This book contains a selection of the papers presented at the Logic, Reasoning and Rationality 2010 conference in Ghent. The conference aimed at stimulating the use of formal frameworks to explicate concrete cases of human reasoning, and conversely, to challenge scholars in formal studies by presenting them with interesting new cases of actual reasoning. According to the members of the Wiener Kreis, there was a strong connection between logic, reasoning, and rationality and that human reasoning is rational in so far (...) as it is based on logic. Later, this belief came under attack and logic was deemed inadequate to explicate actual cases of human reasoning. Today, there is a growing interest in reconnecting logic, reasoning and rationality. A central motor for this change was the development of non-classical logics and non-classical formal frameworks. The book contains contributions in various non-classical formal frameworks, case studies that enhance our apprehension of concrete reasoning patterns, and studies of the philosophical implications for our understanding of the notions of rationality.
