Background: The traditional approach to resolving ethics concerns may not address underlying organisational issues involved in the evolution of these concerns. This represents a missed opportunity to improve quality of care “upstream”. The purpose of this study was to understand better which organisational issues may contribute to ethics concerns. Methods: Directed content analysis was used to review ethics consultation notes from an academic children’s hospital from 1996 to 2006 (N = 71). The analysis utilised 18 categories of organisational issues derived (...) and modified from published quality improvement protocols. Results: Organisational issues were identified in 68 of the 71 (96%) ethics consult notes across a range of patient settings and reasons for consultation. Thirteen of the 18 categories of organisational issues were identified and there was a median of two organisational issues per consult note. The most frequently identified organisational issues were informal organisational culture (eg, collective practices and approaches to situations with ethical dimensions that are not guided by policy), policies and procedures (eg, staff knows policy and/or procedural guidelines for an ethical concern but do not follow it) and communication (eg, communication about critical information, orders, or hand-offs repeatedly does not occur among services). Conclusions: Organisational issues contribute to ethical concerns that result in clinical ethics consults. Identifying and addressing organisational issues such as informal culture and communication may help decrease the recurrence of future similar ethics concerns. (shrink)

Clinical biobanks processing data of participants in the European Union fall under the scope of the General Data Protection Regulation, which among others includes requirements for consent. These requirements are further specified by the Article 29 Working Party —an EU advisory body currently known as the European Data Protection Board. Unfortunately, their guidance is cause for some confusion. While the GDPR allows participants to give broad consent for research when specific research purposes are still unknown, the WP29 guidelines suggest that (...) additional consent for specific uses should be obtained in addition to broad consent when this becomes applicable. This discrepancy elicits the question whether clinical biobanks can fail the requirement of consent if they obtain broad consent, but not a specific consent for each biomedical study. We analysed this discrepancy within the framework of contextual integrity, in order to describe the context-relative informational norms that govern information flows in clinical biobanks. However, our analysis demonstrates that there is no uniform set of norms that can be applied to all clinical biobanks. As such, neither the GDPR nor the WP29 guidance can act as a “one size fits all” approach to all clinical biobanks. Rather, differences between clinical biobanks—especially regarding the scientific aims and patient populations—make the case for context-relative norms that determine the appropriate type of consent. A number of authors have drawn attention to the contributions to geology of Robert Hooke, and it has been pointed out that in several ways his ideas were more advanced than those of Steno, who is sometimes taken to be the founder of geology as a scientific discipline. Moreover, it has been argued that in a number of instances Hooke should receive the credit for ideas which are usually believed to have originated in the work of James Hutton. This recognition (...) of the significance of Hooke's work is regarded by the present writer as being well founded. But, by contrast, the relationship between Hooke's geological ideas and his views on the proper methods for conducting scientific enquiries has been largely overlooked, and his views on the methodology of science, as revealed in his Posthumous works, have received little discussion. Moreover, on one of the few occasions on which they were discussed, by William Whewell, they were belittled. Whewell regarded Hooke's methodological contribution as merely ‘an attempt to adapt the Novum organon to the age which succeeded its publication’, 5 and he implied that the ‘same imperfections’ were to be found in the writings of both Hooke and Bacon. The influence of Bacon is, to be sure, most obvious in Hooke's general philosophy. Nevertheless, it will be argued that Hooke had a much clearer idea than did Bacon of the importance of so-called ‘hypothetico-deductive’ methods in science, and that in many ways his methodological views represent a significant advance on those of Bacon. Ethical guidelines for conducting clinical trials have historically been based on a perceived therapeutic obligation to treat and benefit the patient-participants. The origins of this ethical framework can be traced to the Hippocratic oath originally written to guide doctors in caring for their patients, where the overriding moral obligation of doctors is strictly to do what is best for the individual patient, irrespective of other social considerations. In contrast, although medicine focuses on the health of the person, public health is (...) concerned with the health of the entire population, and thus, public health ethics is founded on the societal responsibility to protect and promote the health of the population as a whole. From a public health perspective, research ethics should be guided by giving due consideration to the risks and benefits to society in addition to the individual research participants. On the basis of a duty to protect the population as a whole, a fiduciary obligation to realise the social value of the research and the moral responsibility to distribute the benefits and burdens of research fairly across society, how a public health perspective on research ethics results in fundamental re-assessments of the proper course of action for two salient topical issues in research ethics is shown: stopping trials early for reasons of efficacy and the conduct of research on less expensive yet less effective interventions. The following article is a response to the position paper of the Hastings Center, “Ethical Challenges of Chronic Illness”, a product of their three year project on Ethics and Chronic Care. The authors of this paper, three prominent bioethicists, Daniel Callahan, Arthur Caplan, and Bruce Jennings, argue that there should be a different ethic for acute and chronic care. In pressing this distinction they provide philosophical grounds for limiting medical care for the elderly and chronically ill. We give a critical (...) survey of their position and reject it as well as any attempt to characterize the physician-patient relationship as a commercial contract. We emphasize, as central features of good medical practice, a commitment to be the patient's agent and a determination to acquire and be guided by knowledge. These commitments may sometimes conflict with efforts to have the physician serve as an instrument of social and economic policies limiting medical care. (shrink)

Two rotational bands have been identified and characterized in the proton-magic N = Z + 1 nucleus Ni-57. These bands complete the systematics of well-and superdeformed rotational bands in the light nickel isotopes starting from doubly magic Ni-56 to Ni-60. High-spin states in Ni-57 have been produced in the fusion-evaporation reaction Si-28(S-32, 2p1n)Ni-57 and studied with the gamma-ray detection array GAMMASPHERE operated in conjunction with detectors for evaporated light charged particles and neutrons. The features of the rotational bands in Ni-57 (...) are compared to those of neighbouring isotopes and interpreted by means of configuration-dependent cranked Nilsson-Strutinsky calculations. The two observed high-spin bands are considered signature partners and assigned to configurations with one 1g(9/2) proton and one 1g(9/2) neutron, resulting in an unambiguous understanding of the energetically favoured signature alpha = -1/2 band but a somewhat less satisfactory description of the signature alpha = +1/2 band. This essay offers a critique of the culture of specio-vocationalism in American higher education by first drawing on Edmund Husserl’s conception of “world” and connecting this notion to education conceived as a “world-disclosing” activity. The essay will then give an account of how the trends of vocationalization and specialization manifest themselves in contemporary university culture, and how they work together to “de-world” the lives of our students and deprive them of possibilities that are part of what it means to be (...) human. After showing how this impoverishment undermines the world-disclosing function of higher education, the essay will then suggest one way to counter this “de-worlding of world”: the teaching of the situated finitude of the human condition by reminding our students that our knowledge or sense of the world is always only partial. It is this realization that has the potential of placing our students once again before the vastness of the world in wonder and curiosity. In this realization they will gain a better sense of the world as a distant horizon still to be explored in all of its inexhaustible complexity and meaning. At the same time, coming to grips with their own ignorance will imbue them with an intellectual humility that will shield them not only from their own finitude, but the finitude of others as well. The characteristics of inductivist historiography of science, as practised by earlier scientist/historians, and Whig historiography, as practised by earlier political historians, are described, according to the accounts of Agassi and Butterfield. It is suggested that the writings of Geikie on the history of geology allow us to characterize him as a Whig/inductivist historian of science who formulated anachronistic judgements. It is further suggested that his writings have had a considerable long-term effect on interpretations of the history of geology. The character (...) of Geikie's historiography is related to his social, political and religious views, his historicism, and his romantic enthusiasm for Nature. His methodological pronouncements are examined: he believed that the present is the key to the past, and also that the past is the key to the present. He was an empiricist and inductivist. These epistemological and methodological views impinged on his historiography of science. If one attempts to criticize Geikie's historiography, though one may try to judge his work according to the norms of his own day and age, historical anachronism cannot be avoided entirely and one may oneself be charged with acting ‘Whiggishly’. Historians of science, in the process of professionalization, have accepted the historiographical norms of general historians , but in so doing have inherited a problem that arises whenever they contemplate earlier historical writings. It is suggested that there may be more room for Whiggish historiography of science than is presently deemed acceptable. Alternatively, one may wish to draw a careful distinction between science and its meta-discipline, the historiography of science. Whig historiography conflates the two, and the work of Geikie provides a good illustration of this. (shrink)

In contemporary medical ethics health is rarely acknowledged to be an ethical obligation. This oversight is due to the preoccupation of most bioethicists with a rationalist, contract model for ethics in which moral obligation is limited to truth-telling and promise-keeping. Such an ethics is poorly suited to medicine because it fails to appreciate that medicine's basis as a moral enterprise is oriented towards health values. A naturalistic model for medical ethics is proposed which builds upon biological and medical values. This (...) perspective clarifies ethical obligations to ourselves and to others for life and health. It provides a normative framework for the doctor-patient relationship within which to formulate medical advice and by which to evaluate patient choice. (shrink)

In this paper I ask whether in Aristotle's metaphysical system the form of a non-living sensible substance, such as the form of this house, is or is not universal. I argue that his position as it stands is self-contradictory, and then try to give some account of the pressures that led to this central contradiction in Aristotle's metaphysical thought.

In his article ‘A Cavalry Unit in the Army of Antigonus Monophthalmus: Asthippoi’, N. G. L. Hammond argues that the reading of the manuscript R at Diodorus 19. 29. 2 should be retained and that we should read ⋯π⋯ π⋯σι δ⋯ το⋯ς τε ⋯σθ⋯ππους ⋯νομαζομ⋯νους κα⋯ τοὺς ⋯κ τ⋯ν ἄνω κατοικο⋯ντων ⋯κτακοσιο⋯ς. The readings of F and its copy X, ⋯νθ⋯ππους, and the commonly accepted conjecture of Wesseling ⋯μɸ⋯ππους, should both be abandoned. Hammond's arguments for retaining this reading are that (...) between the variant readings of R and F, R ‘is the more often correct’ ; ⋯σθ⋯ππους, the reading of R, is preferable to F's ⋯νθ⋯ππους on the principle of ‘lectio difficilior’; the ‘difficulty’ of his lectio difficilior is made less by the arguments presented by A. B. Bosworth, 245 ff.), for the restoration at several places in the text of Arrian's Anabasis the word ⋯σθ⋯ταιροι, in place of the editorial emendation of πεζ⋯ταιροι. ‘For just as asthetairoi meant an élite group of Macedonian infantrymen,’ says Hammond, ‘so asthippoi should mean an élite group of Macedonian cavalrymen.’ He then proceeds to examine the passage and its context in an attempt to find confirmation of this proposition and comes to the conclusion that Diodorus' text says that there were 800 cavalrymen, broken into two groups, the asthippoi and ‘the men from the up-country settlers’; these, though having different names, had a close relationship to each other, as is shown by their being brigaded together. Following his derivation of asthetairoi as meaning ‘townsmen-companions’, i.e. companions recruited from the towns of Upper Macedonia, he argues that asthippoi were cavalry recruited from the towns of Upper Macedonia and that τοὺς ⋯κ τ⋯ν ἄνω κατοικο⋯ντων means ‘the sons of settlers in up-country Macedonia’. These 800, says Hammond, were both among Antigonus' best troops and ‘were Macedonians from Europe’. We thus appear, on Hammond's interpretation, to have here a group of 800 Macedonian élite cavalrymen, all of whom were recruited in Upper Macedonia's townships, but of whom some were chosen to be the cavalry-equivalent of the élite ‘townsmen-companions’ by their title of ‘townsmen-cavalry’, whilst the others, similarly recruited – but perhaps of a younger generation? – had no particular distinguishing title beyond ‘sons of settlers in up-country Macedonia’.Now, while it would be exciting to be able to add another one, possibly two Macedonian cavalry units to the Macedonian army of Philip, Alexander and the Successors, there are several aspects of Hammond's arguments that, it seems to me, are less than convincing. Thus, whilst it seems beyond reasonable doubt that ⋯σθ⋯ταιροι should be retained in the text of Arrian, appearing, as it does, six times, this is not an argument that ⋯σθ⋯ππους should be read in Diodorus' text. Both it and F's reading of ⋯νθ⋯ππους are hapax legomena and it is possible that both readings are wrong. But even if we retain ⋯σθ⋯ππους as the correct reading, Hammond's explanation of its meaning is open to objection on several counts. (shrink)

In this article we present a conjecture regarding the biology of subjectivity and feeling, based on biophysical and phenomenological considerations. We propose that feeling, as a subjective phenomenon, would come to life as a process of resistance to variance hypothesized to occur during the unfolding of cognition and behaviours in the wakeful and emoting individual. After showing how the notion of affect, when considered from a biological standpoint, suggests an underlying process of resistance to variance, we discuss how vigilance, emotional (...) arousal and attentional behaviours reflect a dynamics of controlled over-excitation related to cognitive integration and control. This can be described as a form of resistance to variance. We discuss how such a dynamics objectively creates an internal state of tension and affectedness in the system that could be associated with subjective states. Such a dynamics is shaped by the system's need to cope with its own inertia, to engage in intentional behaviours, attend, preserve coherence, grapple with divergent cognitive, emotional and motivational tendencies, and delayed auto-perturbations of the brain-body system. More generally, it is related to the need to respect the hierarchy of the various influences which affect its internal dynamics and organization. (shrink)

In a recent paper I discussed the origin of the concept of the climata in Greek geography, and adduced reasons for attributing the formulation and elaboration of the concept to Hipparchus . The above passage in Strabo was naturally mentioned in the course of the argument, and I drew attention in a footnote to the unsatisfactory nature of the account given by him of the climata. I now propose to examine the passage in more detail.
