For the first time in print, this article reports passages from John Rawls’s graduate papers and annotations on books and manuscripts from his personal library. The analysis of this material shows the historical inaccuracy of the widespread assumption that Rawls’s philosophy owes very little to American pragmatism. Peirce’s notion of truth, as well as the holistic critique of pragmatism thatMortonWhite began in the late 1940s, prove significant at the very beginning of Rawls’s philosophical enterprise. In the light of this material, (...) it might be argued that Rawls’s elaboration of ‘reflective equilibrium’ started at least in part as an attempt to overcome the pending problems of pragmatism. As duas personagens não têm em comum somente o fato de serem consideradas adúlteras — sem que isso possa ser comprovado nas respectivas narrativas —, mas um todo ficcional que nos leva a essa relação.

We attempt to justify the use of synthetic biology in response to the climate crisis, based on the premise that it is impossible to avert runaway climate change without sequestering sufficient greenhouse gases (GHG), which could only become possible through Negative Emissions Technologies (NETs). Then, moving from a consequentialist standpoint, we acquiesce to how the consequences of using NETs through synthetic biology are preferable to the catastrophic consequences of runaway climate change. Scientific evidence and scientific values under risk and uncertainty are strictly connected from the point of view of Peirce’s pragmaticism. In addition, economy and statistics play a key role in both choosing and testing hypotheses. Hence we may show also the connection between the methodology of the economy of research and statistical frequentism, both originating from pragmaticism. The connection is drawn by the regulative principles of synechism, tychism and uberty. These principles are values that have both epistemic and non-epistemic dimension. (...) They concern both the decisions to test a hypothesis as well as inductive risk. The validity of this result stems from the values cost–benefit analysis imposes on scientific inquiry. Values associated with the economy of research are important not only in the pre-test phases of generating hypotheses but also when hypotheses are effectively tested. Peirce took these economic considerations to leave room for an interpretation of probability which is not only a frequentist and propensity-theoretic but also a conceptualist one referring to degrees of belief. We show that this leeway nonetheless agrees with the theory of the economy of scientific methods. (shrink)

Anticipation is one of the main goals of new governance models, such as Responsible Research and Innovation. However, there is not a single mode of anticipation in this model. Two approaches can be addressed within the RRI framework: a socio-empirical one, which tends to underline the role of the democratic processes, aimed at identifying values on which governance needs to be anchored ; and a normative one, which stresses the role of EU goals as ‘normative anchor points’ in governance. These (...) two approaches also address two different models of anticipation: one based on the construction of shared pathways for reflexivity on the purposes of innovation, the other based on the progressive implementation of constitutional goals in risk assessment and management tools. However, both can be deemed partially unsatisfactory from the standpoint of human rights since one puts individual rights in the middle of the ‘values lottery’ where any participatory process ultimately leads; the other can be inadequate since fundamental rights are balanced alongside other goals and thus can be sacrificed, exposing the system to possible adverse court decisions. The normative framework of human rights can help to counterbalance both models aimed at maximising inclusion and those aimed at pursuing constitutional normative principles at the basis of technologically advanced societies, strengthening their dimension of anticipation according to a rights-based perspective. Lowe claims that having knowledge of the essence of an object is a precondition for thinking about it. Lowe supports this claim with roughly the following argument: you cannot think about something unless you know what you are thinking about; and to know what it is that you are thinking about just is to know its essence. I will argue that this line of reasoning fails because of an equivocation in the expression ‘what a thing is’, which can be used (...) to indicate the essence of the thing but also, more commonly, some description of that thing which is useful in the context to identify it. I will then consider some possible variations of the argument, both in its premises and in its conclusion, and I will argue that they either fail to produce a sound argument or they weaken the conclusion too much to preserve the philosophical interest of the result. In this paper, I focus on the concept of intuition in Schelling’s philosophy. More specifically, I show how Schelling attributes to intuition an ontological value by essentially relating it to freedom and primal Being. Indeed, for Schelling intuition is both the main instrument of philosophy and the highest product of freedom, by which we attain the so-called “God’s-eye point of view” and concretely grasp things in their immediate existence. That is, through intuition it is possible to grasp the absolute and (...) original unity of the principles, namely of being and thought, subject and object and freedom and necessity. Accordingly, I argue that Schelling’s conception of intuition, rather being a merely theoretical speculation, is aimed at demonstrating the immanent nature of Being, which is one of the key points in Schelling’s philosophy. This is an exploratory paper whose aim is to investigate the potentialities of bilattice theory for an adequate definition of the deduction apparatus for multi-valued logic. We argue that bilattice theory enables us to obtain a nice extension of the graded approach to fuzzy logic. To give an example, a completeness theorem for a logic based on Boolean algebras is proved.

Previous research has identified several factors (such as remuneration, workload, negative perceptions of criminal defendants) which may lead to a barrister not acting in the defendant's best interests, when advising on plea or engaging in plea bargaining. This article applies aspects of the principal – agent problem to the relationship between defence barristers and defendants in England and Wales in order to analyse the extent to which incentives can align the interests of the agent (the barrister) with those of the (...) principal (the defendant) in order to prevent moral hazard caused by the agent's competing interests. Coercive, material and moral incentives are considered, and the role of the solicitor and the significance of the barrister's reputation are also discussed. It is argued that none of the forms of incentive which would traditionally reduce the risk of moral hazard do so to any great extent in the barrister – defendant relationship, and that this is due in part to the complexity of the overlapping principal – agent dynamics within which the barrister – defendant relationship lies. On Domination and its Denial This article explains how corporate management and shareholders gradually succeeded in introducing new modes of domination designed to counter the wave of worker insubordination in the post-1968 period. It shows how the systematic individualisation of the management of wage-earners, placed in a situation of mutual competition, the pressures exerted on them through the procedures of individualised objectives and permanent evaluation, and the orchestration of the objective and subjective contingency of workers, transformed the conditions of wage-employment. (...) From a condition which could be inscribed by those subjected to it within a horizon of collective resistance, domination came to be experienced as a plight of personal suffering. Such trends are not however irreversible, insofar as the logic of individualisation and contingency now tends to come into conflict with other factors, such as the attachment of wage-earners to their work. The rich diversity of avian natural history provides exciting possibilities for comparative research aimed at understanding three-dimensional navigation. We propose some hypotheses relating differences in natural history to potential behavioral and neurological adaptations possessed by contrasting bird species. This comparative approach may offer unique insights into some of the important questions raised by Jeffery et al.

In this paper, I argue that a serious philosophical investigation of the domain of the perlocutionary is both possible and desirable, and I show that it possesses a distinctively moral dimension that has so far been overlooked. I start, in Section II, by offering an original characterisation of the distinction between the illocutionary and the perlocutionary derived from the degree of predictability and stability that differentiates their respective effects. In Section III, I argue that, in order to grasp the specificity (...) of the perlocutionary, we must focus on the total speech situation, which I define as conversation. Then, in Section IV, I show that an investigation of the domain of the perlocutionary requires us to draw a conceptual distinction between recognition and acknowledgment. This distinction proves to be crucial, because the success of perlocutions normally depends on something more than what Austin calls the ‘securing of uptake’: the reciprocity condition for illocutions needs to be supplemented, in the case of perlocutions, with an analysis of what I call the ‘grammar of acknowledgment.’ Lastly, in Section V, I elaborate the notion of ‘perlocutionary responsibility,’ a specific form of moral responsibility for the consequences of utterances that are not (entirely) predictable. Cosmopolitics, the concept of a world politics based on shared democratic values, is in an increasingly fragile state.

In this paper, I focus on Luigi Pareyson’s interpretation of Schelling, arguing that it must be read in continuity with Pareyson’s early engagement with the philosophies of Heidegger and Jaspers. Firstly, I argue that Pareyson shapes his existentialism on Jaspers’s and Heidegger’s thoughts, and particularly in relation to that which he considers the fundamental question of philosophy, namely ‘why is there Being rather than nothingness?’ Secondly, I demonstrate how Pareyson reads Schelling’s philosophy in light of his interpretations of Jaspers and (...) Heidegger, i.e., in relation to the ‘fundamental question of philosophy’. Finally, I show how Pareyson’s reading of Schelling is centered on the notion of ‘awe of reason’, and how he defines Schelling as a ‘post-Heideggerian thinker’, since Heidegger’s philosophy allows us to innovatively reinterpret Schelling’s philosophy in an existentialist way. The well-known metaphor on the banality of evil, used by Arendt on the trial of the Nazi hierarch Eichmann in Jerusalem, can also be reviewed in the light of the so-called "affective turn" in the social sciences. Eichmann's tragic obedience to the creators of the Holocaust does not only derive from the renunciation to implement an autonomous thought, in the context of the Nazi system, but also from a deep inability to feel emotions and to develop empathic relationships. This allows (...) a process of identification with the manipulation of emotions and feelings put into practice by the regime and at the same time a process of pathological detachment towards the politically persecuted by the regime itself. This paper presents an enrichment of the Gabbay–Woods schema of Peirce’s 1903 logical form of abduction with illocutionary acts, drawing from logic for pragmatics and its resources to model justified assertions. It analyses the enriched schema and puts it into the perspective of Peirce’s logic and philosophy.

Among the different interpretations of the philosophy of Schelling, there is no doubt that the ones developed by Martin Heidegger and Karl Jaspers played a prominent role within the most recent Schelling scholarship. Both Heidegger and Jaspers focused on Schelling’s discourse on freedom, pointing out the fundamental incompatibility of its key elements, i.e. ‘ground’ and ‘existence’, as well as the fallacious conception of Seynsfuge that emerges from it. Moreover, Heidegger argues that Schelling’s ontology ultimately falls back into traditional metaphysical subjectivism, (...) ignoring the question of Being as such and in fact paving the way to nihilism. Similarly, Jaspers criticizes Schelling’s arbitrary account of the relation between freedom and existential being and his misleading conception of transcendence. However, I argue against Jaspers that Schelling’s discourse on freedom must be read as a philosophy of immanence, which aims at maintaining the concreteness of the concepts and at avoiding any form of transcendence. Consequently, I also argue against Heidegger that not only does Schelling’s discourse successfully show the compatibility of ground and existence, but that Schelling’s understanding of the ‘subject’ does not comply with Heidegger’s notion of ‘metaphysical subjectivism’ and is immune to Heidegger’s criticism. Plus de quarante ans après, la société de surveillance annoncée par Foucault se manifeste à travers des préoccupations sécuritaires croissantes et la quête fantasmatique d'un risque zéro. Les réformes successives de notre droit pénal traduisent une volonté forte de prévenir, voire de prédire, la réalisation des infractions. La surveillance se déploie non seulement dans l'enceinte carcérale mais au-delà des murs. Il s'avère ainsi (...) crucial de relire l'ouvrage de Foucault à la lumière d'une actualité juridique et politique dense, marquée par une progressive prise de conscience de la nécessité d'appréhender les questions pénales et pénitentiaires d'une manière globale et concertée, mais aussi par le caractère limité des avancées concrètes en ce domaine. Ainsi, en mobilisant une pluralité d'approches disciplinaires (du droit à la philosophie, de la science politique à la sociologie et à la psychiatrie), cet ouvrage se propose de mettre les analyses foucaldiennes de la société punitive, du pouvoir disciplinaire, de l'archipel carcéral, de la surveillance généralisée et de la production de la délinquance à l'épreuve de notre présent, à la fois pour en mesurer la portée réelle et pour élaborer un diagnostic original de notre actualité sociale, juridique et politique. The Health Impact Fund (HIF) is a project aimed at expanding access to life-saving drugs worldwide and incentivizing pharmaceutical companies to invest in research and development for neglected diseases. The HIF would invert the existing patent framework by rewarding ideas through their diffusion rather than protecting against this diffusion, by encouraging a collective rather than privatized wealth scheme. The basic idea behind the HIF is the creation of a new competitive market that centers on individuals who, under normal circumstances, exert (...) very little force on the tide of market demand. The HIF does not operate on standard market measures of demand, but instead measures demand as a product of needs, while in conventional market scenarios, private citizens and national welfare states pay for needs. The idea is that the HIF would create a functional, competitive market in which pharmaceutical profit is determined by the actual health impact of each new drug, a measure born from pharmacological and distributive efficacy. In this article, the basic features of and main challenges to the HIF are addressed. (shrink)

In this paper, I argue that the vindicatory/unmasking distinction has so far prevented scholars from grasping a third dimension of genealogical inquiry, one I call possibilising. This dimension has passed unnoticed even though it constitutes a crucial aspect of Foucault’s genealogical project starting from 1978 on. By focusing attention on it, I hope to provide a definitive rebuttal of one of the main criticisms that has been raised against genealogy in general, and Foucauldian genealogy in particular, namely the idea that (...) Foucault’s genealogical project lacks normative grounding and is therefore ultimately incapable of telling us why we should resist and fight against the mechanisms of power it nevertheless reveals in an empirically insightful way. This conclusion, I argue, is mistaken because it conceives of Foucauldian genealogy exclusively as an unmasking or problematising method, whereas I claim that Foucault’s genealogical project possesses a possibilising dimension that provides his work with sui generis normative force. The beliefs involved in the placebo effect are often assumed to be self-fulfilling, that is, the truth of these beliefs would merely require the patient to hold them. Such a view is commonly shared in epistemology. Many epistemologists focused, in fact, on the self-fulfilling nature of these beliefs, which have been investigated because they raise some important counterexamples to Nozick’s “tracking theory of knowledge.” We challenge the self-fulfilling nature of placebo-based beliefs in multi-agent contexts, analyzing their deep epistemological nature and (...) the role of higher-order beliefs involved in the placebo effect. Cet article est une réponse directe à certains critiques du projet de démocratie cosmopolitique, qui insistent sur l’absence de détails sur les acteurs politiques, économiques et sociaux susceptibles d’avoir un intérêt à soutenir ce programme. Nous montrons qu’il existe différentes manières de développer la gouvernance démocratique au niveau mondial, qui sont associées à divers acteurs politiques, économiques et sociaux trouvant leur intérêt dans un projet de ce genre. La démocratie cosmopolitique est donc un projet ouvert dont le but est de (...) rendre la gouvernance mondiale plus responsable, plus transparente et plus légitime. La palette des acteurs et des mesures présentée ici met en avant l’orientation et les choix politiques nécessaires pour faire de ce projet une réalité. (shrink)
