This paper will be concerned with the conjunctive interpretation of a family of disjunctive constructions. The relevant conjunctive interpretation, sometimes referred to as a “free choice effect,” (FC) is attested when a disjunctive sentence is embedded under an existential modal operator. I will provide evidence that the relevant generalization extends (with some caveats) to all constructions in which a disjunctive sentence appears under the scope of an existential quantifier, as well as to seemingly unrelated constructions in which conjunction appears under (...) the scope of negation and a universal quantifier. The notion of measurement plays a central role in human cognition. We measure people’s height, the weight of physical objects, the length of stretches of time, or the size of various collections of individuals. Measurements of height, weight, and the like are commonly thought of as mappings between objects and dense scales, while measurements of collections of individuals, as implemented for instance in counting, are assumed to involve discrete scales. It is also commonly assumed that natural language makes use of (...) both types of scales and subsequently distinguishes between two types of measurements. This paper argues against the latter assumption. It argues that natural language semantics treats all measurements uniformly as mappings from objects (individuals or collections of individuals) to dense scales, hence the Universal Density of Measurement (UDM). If the arguments are successful, there are a variety of consequences for semantics and pragmatics, and more generally for the place of the linguistic system within an overall architecture of cognition. Research in nanotechnology has advanced rapidly in recent years. Several researchers, however, warn that there is a paucity of research on the ethical, legal, and social implications of nanotechnology, and they caution that ethical reflections on nanotechnology lag behind this fast developing science. In this article, the authors question this conclusion, pointing out that the predicted concrete ethical issues related to the area of nanotechnology are rather similar to those related to the area of biotechnology and biology that have been (...) considered by ethicists since the 1970s. Hence, a knowledge base has already been acquired from ethical reflections on biotechnology and biology, which may be a good starting point and foundation for a discussion of ethical reflections on nanotechnology. The authors argue that a promising approach is the use of basic ethical principles as a method to analyze ethical issues of nanotechnology. (shrink)

This contribution examines Arrighi’s effort in Adam Smith in Beijing to understand the trajectory of China’s political economy and the effects of that trajectory on the current reforms and changes in China. This article discusses these reforms from the perspective of China’s ’internal’ dynamics and suggests that Arrighi’s argument has been developed without proper reference to China’s complex realities. As an alternative, the contribution proposes a research-agenda that could better account for these realities.

Certain critics, e.g. Manfred Frank and Hans-Herbert Kögler, claim that Hans-Georg Gadamer's philosophical hermeneutics reduces the individual subject to a mere instrument of history and tradition, the latter reproducing themselves through the subject. However, Gadamer also emphasizes the active role of the subject in shaping and creating history and tradition. In this article I argue that the critics mistakenly emphasize a one-sided conception of history. By incorporating both active and passive aspects of the subject, Gadamer's philosophical hermeneutics provides the means (...) by which the individual may be conceived more aptly in an interdependent, dialectical relation to their corresponding historical, cultural, and social context. Management consultants and their moral standards and behaviour have been questioned and caricatured, but it is not sufficiently appreciated that they frequently have to operate in situations which are characterized by ambiguity, ignorance, uncertainty and sensitivity and they cannot always simply apply ethical rules in cooperating with their clients. In addition, more attention should be given to the ethics of the client, and “dual ethics” should be a joint concern. There is ample discussion of MBA self-serving values in the corporate social responsibility literature, and yet empirical studies regarding the corporate manifestations and consequences of those values are scant. In a comprehensive study of major US public corporations, we find that MBA CEOs are more apt than their non-MBA counterparts to engage in short-term strategic expedients such as positive earnings management and suppression of R&D, which in turn are followed by compromised firm market valuations.

Based on a dataset of more than 5,000 contentious collective actions from 1700-2000, this paper examines the relation between popular protest and democratization of the Danish political system. The first wave of protests began in the 1830s and culminated in 1848 with the fall of absolutism and the transition to constitutional monarchy. The next protest wave from 1885 to 1887 arose from the so-called ‘constitutional struggle’ and mobilized hundreds of thousands of ordinary Danes, and contributed to the parliamentarization and nationalization (...) of the political system. The third wave unfolded around the end of World War II, while the hitherto last wave of popular struggle erupted in 1968 with the youth rebellion. The analysis show that ‘democracy’ was the central issue of contention in all four of these protest waves, and support the main thesis that periods of intense interaction between popular protest and the state have had a decisive formative influence on the genesis and further development of Danish democracy. At the provincial council elections of the 13th of October 1985 in Belgium two of the three traditional politie al families made a general progress, namely the socialists and the christian democrats. The liberals had a serious decline in Flanders, but for the greater part this was counterbalanced by the liberal progress in Wallonia. The ecologists also made progress, mostly in the Flemish part of the country. Beside the Flemish liberals, the big losers of these elections were the regional parties, (...) namely the Flemish nationalists and for sure the Walloon Rally who disappeared from the electoral scene. The article examines the compatibility of agonistic democracy and populism as well as their relationship to the idea of constitutionalism. The first part shows that Chantal Mouffe’s recent attempts to reconcile her normative approach of an agonistic pluralism with a populist style of politics are not fully convincing. Although there are undeniable commonalities between an agonistic and a populist understanding of politics – the appreciation of conflict, the rejection of moralistic and juridical modes of conflict resolution etc. – the populist (...) mode of the construction of the people (and the denunciation of political opponents as enemies of the people) risks impeding the transformation of antagonistic into agonistic modes of political contest. The tensions between agonism and populism are especially evident in matters of constitutionalism. This topic is examined in the second part of the article, which provides some ideas for reducing the normative and institutional blind spots of contemporary theories of agonistic democracy. It focuses on elementary principles for an agonistic concept of democratic constitutionalism that differs from the populist view of the relationship between politics and law, especially in respect of its interpretation of the concept of ‘resistibility’ of legal norms. According to the epistemic account of request normativity, a request gives us reasons by revealing normatively relevant information. The information is normative, not the request itself. I raise a new objection to the epistemic account based on situations where we might try to avoid someone requesting something of us. The best explanation of these situations seems to be that we do not want to acquire a new reason to do something. For example, if you know I am going to ask (...) you to read a draft of my paper, you might avoid running into me so as to avoid acquiring a reason to read a draft of my paper. I then argue that the epistemic account can successfully reply to this objection and that in fact the epistemic account does a better job of accounting for cases like this than competing views of the normativity of requests. It is well-known that constructions involving ellipsis share many properties with constructions that involve phonological reduction. The similarity between ECs and PRCs is semantic: the interpretation of both is constrained by the interpretation of an antecedent. Rooth and Tancredi have pointed out that this similarity follows from an independently needed theory of focus.

Disability rights (DR) advocates have consistently opposed the legalization of physician-assisted dying (PAD) on the grounds that it wrongly discriminates against the disabled. This chapter distinguishes three variants of this objection. The first and perhaps primary one, based on “soft paternalism,” claims that PAD should not be legalized for the sake of those who might choose it. The second alleges that the laws harm all disabled people by encouraging support for PAD as the cheaper alternative to providing the disabled more (...) social support and protection from discrimination. The third alleges that legalized PAD harms all disabled people by expressing the denigrating message that their lives are less valuable than those of the able. The chapter finds that whatever the merits of the first two objections, DR advocates cannot consistently accept them while maintaining support for a legal right to reject unwanted treatment. It also finds grounds to doubt the cogency of the third objection. (shrink)

The literature on the interplay between geographic communities and organizations has largely ignored the role of individual residents. In adopting a meso-perspective, we examine a potentially vital relationship between corporate conduct and pro-social behavior demanding sacrifice from individuals. Drawing on Weber ), we theorize that organizations in a community legitimize personal social conduct in three ways—by serving as role models, imparting norms and values, and routinizing forms of interaction. We study the relationship between corporate social responsibility behavior by local firms (...) and the social distancing of citizens in US counties during the Covid-19 pandemic, a core ethical outcome. We argue and find that the residents of communities in which firms exhibit higher levels of CSR engaged in more SD during the Covid-19 pandemic. This was true when firms were long-established, isomorphic in their CSR, and major employers and vendors. Moreover, CSR relating to the treatment of employees as well as positive and negative extremes in CSR bore especially strong relationships with SD. Implications are drawn for the study of business ethics, as modeled by CSR, as a force for ethical personal behavior and public health in communities. (shrink)

Abstract. The paper begins by challenging Hart's argument aimed to show that sanctions are not part of the concept of law. It shows that in the "minimal" legal system as understood by Hart, sanctions may be required for keeping the legal system efficacious. I then draw a methodological conclusion from this argument, which challenges the view of Hart (and his followers) that legal philosophy should aim at discovering some general, politically neutral, conceptual truths about law. Instead, the aim should be (...) to discover the values because of which certain things in the world are classified as law and others as non-law. Focusing on those would give us a more insight to the roles law plays in society, as well as more illuminating answers to traditional jurisprudential questions like the status of law in evil regimes. Focusing on Correspondence from the Double-Cassia Studio (Shuanggui xuan chidu 雙桂軒尺牘), a collection of letters by a gentlewoman named Ding Shanyi 丁善儀 (1799–after 1861), this paper examines how elite women in mid-nine- teenth-century China applied epistolary conventions in their social life. Com- pared to other literary collections of individual women in late imperial China, Ding’s letter collection is exceptional in recording the life of its author through the epistolary genre and in revealing the sociopolitical dynamics that underlay elite women’s epistolary (...) gentility. Ding’s letters are indicative of the noticeable concerns shared by gentlewomen in mid-nineteenth-century China and provide specific contexts for understanding some of the epistolary techniques used by lit- erary women to facilitate social networking. This paper uncovers Ding’s life and explores three major themes in her epistolary collection: her responses to crises, concerns about health, and cultivation of friendship. Ding’s letters show how elite women evinced sophistication and erudition in their epistolary composition, which was an important way for them to express themselves and demonstrate their mas- tery of language and rhetorical tradition. This book provides a succinct, student-friendly outline of the principles, approaches, and issues in participant observation. An examination of these basic tenets is important for clarifying the philosophical rationale for conducting participant observation, making important research decisions, and appreciating the strengths and weaknesses of different approaches within the method. Participant observation as a formal means of inquiry is developed in close relation with the competing approaches of reality (ontology), truthfully apprehending reality (epistemology), and formal research (methodology). In this article, I first show the role played by passivity and laziness in Hegel’s philosophy of right. This allows us to better understand Jean-Luc Nancy’s first philosophy which is concerned with the singular plural being, and which was first elaborated in relation with Hegel’s conception of passivity. Finally, since laziness and activity are always intrinsically linked, I end this article with a criticism of what Nancy proposes as an action by analyzing one of his most recent works entitled Que (...) faire?
