This book is a selection of articles by David Zilberman, a prolific author, whose tragic untimely death did not allow to finish many of his undertakings. Zilberman’s work represents a fresh word in the way of philosophizing or philosophy-building and the technique of modal methodology. This book comprises of thirteen independent articles that are not related by content. The point of thematic convergence of these articles is the way they reflect the new way of methodological thinking through the application (...) and benefits of modalization or modal methodology that unfolds unbound possibilities of philosophic elaborations. By shifting constantly from one position to another, Zilberman disclosed the antinomicity of all types of thought. Such an approach led him to outline for the first time his major attempt to start creating not "systems" but "sums" of philosophies so that the philosophical activity would be able to re-emerge on the slopes of such "sums." The book can be used as a starting point of a discussion, especially in study of philosophy. We imagine it can be used in undergraduate classes on World Philosophies or Intercultural Philosophy courses. With that, it can serve as a useful resource for adding intercultural elements into Western-centered courses. (shrink)

This essay explains the inescapability of moral demands. I deny that the individual has genuine reason to comply with these demands only if she has desires that would be served by doing so. Rather, the learning of moral reasons helps to shape and channel self- and other-interested motivations so as to facilitate and promote social cooperation. This shaping happens through the “embedding” of reasons in the intentional objects of motivational propensities. The dominance of the instrumental conception of reason, according to (...) which reasons must be based in desires of the individual, has made it harder to recognize that reasons shape desires. I attempt to undermine this dominance by arguing that the concept of a self that extends over time is constructed to meet the demands of social cooperation. Prudential reasons to act on behalf of the persisting self's desires are often taken to constitute the paradigm of reasons based on desires of the individual. But such reasons, along with the very concept of the persisting self, are constructed to promote human cooperation and to shape the individual's desires. (shrink)

Christopher Boorse is very skeptical of there being a pathocentric internal morality of medicine. Boorse argues that doctors have always engaged in activities other than healing, and so no internal morality of medicine can provide objections to euthanasia, contraception, sterilization, and other practices not aimed at fighting pathologies. Objections to these activities have to come from outside of medicine. I first argue that Boorse fails to appreciate that such widespread practices are compatible with medicine being essentially pathocentric. Then I contend (...) that the pathocentric essence, properly understood, does not prohibit physicians from engaging in actions that are not aimed at combating pathologies, but rather supports an internal morality of medicine that allows medical providers to refuse without penalty to engage in practices that promote pathologies. Friendship was an important topic for classical philosophers; the analysis, Value, And duties of friendship all received considerable attention. But friendship has been a relatively dormant topic among more recent philosophers. This paper (a) presents an analysis of friendship and explains its core elements, (b) discusses several different models for explaining the value of friendship, And (c) argues that there are special duties of friendship and that these aren't based solely on utilitarian considerations.

In this collection, Stations on the Journey of Inquiry, David Burrell launches a revolutionary reinterpretation of how any inquiry proceeds, boldly critiquing presumptuous theories of knowledge, language, and ethics. While his later publications, Analogy and Philosophical Language (1973) and Aquinas: God and Action (1979), elucidate Aquinas's linguistic theology, these early writings show what often escapes articulation: how one comes to understanding and "takes" a judgment. With renewed interest in philosophy of language by postmodern thinkers as well as in the wake of Mulhall's Stanton Lectures on Wittgenstein and "Grammatical Thomism," the publication of these formative writings proves timely for the academy at large. Federal and state laws create a tightly controlled system for distribution of those drugs that have recognized value in therapy, but also have the potential for abuse. The challenges pharmacists face in keeping controlled substances within the closed system are many and complex. Drug abusers and drug dealers have at times seen pharmacists as easy marks for access to abusable drugs. Unfortunately, pharmacists often find themselves in a game with criminals, who use both sophisticated and dangerous methods of inducing pharmacists (...) to divert controlled substances. The effects of this problem on the health-care system have been judicially noted:The frequency of these crimes has terrorized the community of dispensing pharmacists. Some pharmacists have ceased to carry drugs that are highly desired on the black market, although this interferes with their patients’ ability to obtain necessary medicine. The view defended is one sense externalist on the relation between moral reasons and motivation: A's having a moral reason to do X does not necessarily imply that A has a motivation that would support A's doing X via some appropriate deliberative route. However, it is in another sense externalist in holding that there are the kind of moral reasons there are only if the relevant motivational capacities are generally present in human beings, if not in all individuals. The process (...) of socialization is an attempt to embed the recognition of what we have moral reason to do in the intentional content of one's feelings. E.g., learning that about others' suffering embeds their suffering as a reason to help in the intentional content of incipient compassionate feelings. This endows the reason with motivational efficacy while conferring further direction to the feelings in ways that shape us for social cooperation. (shrink)

Green bioethics is an area of research and scholarship that examines the impact of healthcare practices and policies on the environment and emphasises environmental values, such as ecological sustainability and stewardship. Some green bioethicists have argued that healthcare providers should inform patients about the environmental impacts of treatments and advocate for options that minimise adverse impacts. While disclosure of information pertaining to the environmental impacts of treatments could facilitate autonomous decision-making and strengthen the patient–provider relationship in situations where patients have (...) clearly expressed environmental concerns, it may have the opposite effect in other situations if makes patients feel like they are being judged or manipulated. We argue, therefore, that there is not a generalisable duty to disclose environmental impact information to all patients during the consent process. Providers who practice green bioethics should focus on advocating for system-level changes in healthcare financing, organisation and delivery and use discretion when bringing up environmental concerns in their encounters with patients. This paper discusses the economic, legal, moral, and political difficulties in developing drugs for the developing world. It argues that large, global pharmaceutical companies have social responsibilities to the developing world, and that they may exercise these responsibilities by investing in research and development related to diseases that affect developing nations, offering discounts on drug prices, and initiating drug giveaways. However, these social responsibilities are not absolute requirements and may be balanced against other obligations and commitments in light of economic, (...) social, legal, political, and other conditions. How a company decides to exercise its social responsibilities to the developing world depends on the prospects for a reasonable profit and the prospects for a productive business environment. Developing nations can either help or hinder the pharmaceutical industry’s efforts to exercise social responsibility through various policies and practices. To insure that companies can make a reasonable profit, developing nations should honor pharmaceutical product patents and adhere to international intellectual property treaties, such as the Trade‐Related Aspects of Intellectual Property Rights agreement. To insure the companies have a good business environment, developing nations should try to promote the rule of law, ethical business practices, stable currencies, reliable banking systems, free and open markets, democracy, and other conditions conducive to business. Overall, this paper advocates for reciprocity and cooperation between pharmaceutical companies and developing nations to address the problem of developing drugs for the developing world. In pursuing this cooperative approach, developing nations may use a variety of other techniques to encourage pharmaceutical companies to act responsibly, such as subsidizing pharmaceutical research, helping to design and implement research protocols, providing a guaranteed market, and bulk buying. The growing interest in Africa as well as concerns about negative deviant behaviors and ethnic structures necessitates examination of the effect of ethnic expectations on behavior of employees. In this study we leverage insight from ethnos oblige theory to propose that centralization of ethnic norms moderates the relationship between benevolence expectations and negative deviant behavior. Using a cross-sectional design and data from two countries as well as moderation and cross-cultural analytic techniques, we find support for three-way interactions where the relationship (...) between benevolence and negative deviant behavior is moderated by centralization and culture. We discuss the implications of the findings which support the dynamic perspective of management in Africa. (shrink)

Most people do not think to observe geology from the sidewalks of a major city, but all David B. Williams has to do is look at building stone in any urban center to find a range of rocks equal to any assembled by plate tectonics. In Stories in Stone, he takes you on explorations to find 3.5-billion-year-old rock that looks like swirled pink-and-black taffy, a gas station made of petrified wood, and a Florida fort that has withstood three hundred (...) years of attacks and hurricanes, despite being made of a stone that has the consistency of a granola bar. Although managing fairness is a critical concern for organizations, not all managers are predisposed to enact high levels of fairness. Emerging empirical evidence suggests that personality characteristics can be an important antecedent of managers’ fair behavior. However, relatively little attention has been devoted to understand how to promote fairness among managers who are naturally predisposed to engage in lower levels of fairness. Building upon self-awareness theory, we argue that increasing managers’ self-awareness can motivate managers with low trait empathy to engage (...) in greater levels of justice. We test the interactive effects of trait empathy and state self-awareness using an experimental study in which individuals were asked to communicate negative news. In support of our hypothesis, our results indicate that increasing self-awareness through self-focusing situations can help promote interactional justice when communicating negative news for individuals with low trait empathy. The theoretical and practical implications of these findings are discussed. (shrink)

To handle the problems arising from brain transplants, the constitution theorist must admit an additional level of constitution between the organism and the person. To resolve (...) the problems posed by the two kinds of conjoined twins, the constitution theorist must accept that constitution is not always a one-to-one relationship. RESUME: La théorie constitutionnelle de l’identité personnelle de Lynne Baker soulève certains problèmes qui deviennent évidents lorsque l’on considère des expériences de pensée sur des transplantations de cerveaux et deux genres de cas rares de jumeaux conjoints — du premier cas paraît s’ensuivre qu’il y a deux personnes pour un seul organisme alors que du deuxième découle qu’une seule personne existe dans deux organismes. Afin d’expliquer les problèmes qui surviennent avec les transplantations de cerveaux, le théoricien de la constitution doit admettre un niveau de constitution intermédiaire entre l’organisme et la personne. Pour résoudre les problèmes que posent les cas de jumeaux conjoints, le théoricien de la constitution doit accepter que la relation de constitution ne se réalise pas toujours entre deux termes. The precautionary principle holds that we should not allow scientific uncertainty to prevent us from taking precautionary measures in response to potential threats that are irreversible and potentially disastrous. Critics of the principle claim that it deters progress and development, is excessively risk-aversive and is unscientific. This paper argues that the principle can be scientific provided that the threats addressed by the principle are plausible threats, and the precautionary measures adopted are reasonable. The paper also argues that one may use (...) epistemic criteria, such as consistency, coherence and explanatory power, to determine whether a threat is plausible, and that one may use practical considerations, such as effectiveness, proportionality, cost-effectiveness, realism and consistency, to determine whether a response to a threat is reasonable. Earl Conee has argued that the metaphysics of personal identity is irrelevant to the morality of abortion. He claims that doing all the substantial work in abortion arguments are moral principles and they garner no support from rival metaphysics theories. Conee argues that not only can both immaterialist and materialist theories of the self posit our origins at fertilization, but positing such a beginning doesn’t even have any significant impact on the permissibility of abortion. We argue that this thesis is (...) wrong on both accounts. We do so, in part, by relying on a hylomorphic rather than a Cartesian conception of the soul. There are good reasons for believing such a soul theory can favor an earlier origin than the leading materialist accounts. We also show that the theological metaphysics of hylomorphism provide greater support for a pro-life position than the Cartesian position Conee discusses. However, we argue that even on a materialistic account of personal identity, metaphysics has substantial bearing upon the morality of early abortions. (shrink)

Do citizens of any modern state have a general duty to acknowledge its authority to determine for them, for action guiding purposes, whether certain kinds of conduct are morally permissible, required, or forbidden? That is, is there a duty to obey the law? Moral Contractualism, I contend, entails that citizens of a liberal democratic state have such a duty. ;Treating others morally often requires agents to act collectively, but even agents who accept the moral necessity of collective action will sometimes (...) disagree over the specification of the ends to be achieved, and the means for doing so. I argue that a liberal democratic state can justifiably claim the authority to resolve such disagreements, which it does mainly by enacting and applying laws. Obedience to democratic laws expresses respect for others' autonomy. ;In defending these claims, particular attention is paid to the problem posed by disagreement over the design of democratic decision procedures, conflicts between democratically enacted laws and individual rights, and conflicts of rights. Civil disobedience, conscientious objection, and over-inclusive laws are also addressed. (shrink)

Differing from the Freudian position, this paper takes the view that a girl's early closeness to her mother gives her an initial advantage in forming sex identification. This is soon overcome, however, by the many cultural privileges and the prestige offered males. Boys must shift from an initial identification with mother, but get cultural rewards for the new role. 4 hypotheses generated from this position tended to be supported by the research findings reviewed.

This essay analyzes the concept of public trust in science and offers some guidance for ethicists, scientists, and policymakers who use this idea defend ethical rules or policies pertaining to the conduct of research. While the notion that public trusts science makes sense in the abstract, it may not be sufficiently focused to support the various rules and policies that authors have tried to derive from it, because the public is not a uniform body with a common set of interests. Well-focused arguments that use public trust to support rules or policies for the conduct of research should specify (a) which public is being referred to (e.g. the general public or a specific public, such as a particular community or group); (b) what this public expects from scientists; (c) how the rule or policy will ensure that these expectations are met; and (d) why is it important to meet these expectations. In presenting the fruit of a lifetime of exploration on the part of this theological craftsman of the highest merit, the editor has performed an unparalleled service. For William Hill is a clear and courageous thinker, and one (...) whose selfless editorial duties have perhaps curtailed his own writing over the years. Yet these essays make up for that, and afford younger students of theology a starting point for their reflections beyond the fads of the moment, yet seizing the challenge of contemporary proposals. His grasp of classical and of modern idiom, together with his range of reading, make him a theologians' theologian par excellence. For with his classical mentors he is concerned with conceptual coherence, yet equally anxious to respond to the anthropological perspectives of contemporary theological inquiry. Briefly characterized, the work brings Thomas Aquinas into dialogue with Heidegger and with Whitehead, using each of the latter figures to challenge an earlier " Thomistic" synthesis of the thought of Thomas Aquinas, and highlight dimensions of his theology hitherto left quite implicit. This creative recovery of medieval thought begins with an established interpretation of Aquinas's metaphysical transformation of the neoplatonized Aristotle of Avicenna: his insistence that esse {existing ) precedes essence (or possibility). The identification of God as that One in whom essence and existing are identical sets the stage for Hill's explicitly theological treatment of free persons, by analogy with the " persons " of the divine triunity: " each divine person ' posits ' the others as over and against himself and thereby posits himself in his hypostatic identity. What all this bases itself upon is the understanding that the Christian revelation of freedom as radically constituting personhood enables it to function as a category which surmounts the Greek dichotomizing of reality into contingency and necessity " (117). If the identification of existing with essence in God confronts Heidegger's critique of " ontology," Hill's use of classical trinitarian thought to suggest a fruitful distinction in human creatures between nature and freedom allows him at once to correct the caricature of Aquinas proffered by process theologians as "classical theism," and 521 522 BOOK REVIEWS also to profit by their criticisms of the use of hellenistic categories like impassibility in divinity. "The key... lies in the mystery of freedom. Abstractly, freedom is a property of nature, but its exercise is the pre· rogative of person as the existential instantiation of nature. The person viewed ontologically (as subject of the act of existing) thus determines itself though its nature to be the sort of person it is, viewed psychologi· cally and historically" (127). Finite natures need to negotiate all sorts of causal influences in effecting such a determination of themselves; not so " an infinite nature whose freedom is transcendent." Yet when that One freely determines itself to be source and goal of all, and espe· cially of rational creatures (cf. Summa Theologiae 1.2 Prol.), then " that choice is one of willing to be constituted, personally and so relationally, and in this sense to be determined, by other free beings" (127). So the God who (in Aquinas' idiom) is not "really related" to the world in the sense of enduring (in Hill's words) "passive influx," nonetheless freely relates to intentional creatures in such a way as to be responsive to their freedom. So his response to Moltmann's conten· tion that God suffers " in his very deity " is an explicitly Christological one: "first, that God remains immutable and impassible in his own intrinsic godhead, so that his genuine love for creatures cannot entail suffering within divinity as such; but second, that God does choose to enter personally and relationally into the heart of humankind's suffering in his transcendentally free and loving response to it. God truly suffers... in and through his humanity which is one with the humanity of all men and women" (162). Very few people who read Carl Schneider's The Censor's Hand: The Misregulation of Human-Subject Research will have a neutral opinion of his book. Schneider defends the radical thesis that the system of regulating human subjects research is not just broken but deeply misguided and therefore needs to be abolished. While some researchers who are frustrated with the current regime will welcome Schneider's scathing critiques of institutional review boards and the regulations they enforce, those who view the status quo as a (...) necessary, though perhaps flawed, means of protecting human subjects will recoil from his arguments and conclusions. Schneider rejects reform efforts, such as the proposed revisions to the Common Rule, as likely to be short-lived and ineffective. He argues that professional self-regulation and tort law can do a better job of protecting human subjects and advancing research than government regulation. (shrink)
