The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. In this article we explore the ethical issues raised by permitting patients to pay for participation (P4) in clinical trials, and discuss whether there are any categorical objections to this practice. We address key considerations concerning payment for participation in trials, including patient autonomy, risk/benefit and justice, taking account of two previous critiques of the ethics of P4. Nuestro ensayo se centra en la condición filosófica de los cínicos antiguos, sobre todo en referencia a Diógenes de Sínope. De ellos queremos rescatar su ética y estética, su condición de asumir la filosofía como un estilo de vida y su permanente cuestionamiento a la moral establecida dentro de la polis griega. No menos importante es presentar el tema de su sexualidad, su postura filosófica ante el dolor humano y su ataque a los convencionalismos. Se consideraron médicos del alma, permaneciendo (...) como una escuela inclasificable a lo largo de la historia de la filosofía. Presentamos su concepción del cuido de sí en tanto un apartarse de los demás, es decir, estableciendo un cuido contra los demás, sin obviar al otro sino enfrentándolo a su ignorancia. En su momento fueron llamados revolucionarios de la ética por su actitud insobornable frente a sus principios de autonomía y autosuficiencia. (shrink)

Ethical questions about information and communications technologies have been debated since World War II. Western democracies have had more than 50 years of experience in addressing and organising the ethical, social and legal aspects of scientific and technological developments. However, this expertise, tradition and experience are not enough to manage the most urgent ethical and social issues and contemporary challenges involving ICT. A systematic and institutional organisation of social values in the context of modern ICT tools is needed.This paper focuses (...) on four major areas: developing a specific approach to ethical issues raised by ICT; describing in more detail the age-related digital divide in Europe; identifying technology trends and emerging challenges; and defining the legal framework for inclusion of senior citizens in the digital society. The paper then concludes with a summary of its key points on the basis of which it makes three proposals as a contribution to efforts aimed at overcoming the exclusion of senior citizens from today's Information Society. In this paper, we will survey the different uses of the term algorithm in contemporary legal practice. We will argue that the concept of algorithm currently exhibits a substantial degree of open texture, co-determined by the open texture of the concept of algorithm itself and by the open texture inherent to legal discourse. We will substantiate our argument by virtue of a case study, in which we analyze a recent jurisprudential case where the first and second-degree judges have carved-out contrasting (...) notions of algorithm. We will see that, thanks to our analysis of the open texture of the notion of algorithm in legal language, we can make sense of the different decisions taken by the judges as different contextually-determined sharpenings of the concept of algorithm. Finally, we will draw some general conclusions concerning the use of technical terms in legal instruments that address new technologies, such as the EU AI Act. (shrink)

Modern political power has two branches: the sovereign and the biopolitical. With the former, the state makes laws, with the latter, it governs. Of the two branches of modern power, the sovereign and the biopolitical, this essay attempts to thematise only the latter, trying in particular to emphasise the de-subjectifying effects of biopolitical rationality and focusing on the three levels of biopolitical rationality: its economistic matrix, its epidemiological apparatus, and its ideological order. By briefly analysing these three levels, or registers, (...) of biopower’s effectiveness we might understand certain characteristics of the ‘mental health’ construct and of the role that it has in our societies. La versión estadística del concepto de naturaleza humana sigue siendo un concepto central en muchas ramas de las ciencias humanas. La clave del concepto es que existe un núcleo de fenotipos específicos que caracteriza a las especies biológicas, incluyendo la nuestra. Llamo a esta perspectiva esencialismo estadístico. Voy a sugerir que la tipicidad y la uniformidad fenotípica se consideran supuestos legítimos en muchas ciencias humanas, ya que el desarrollo biológico se interpreta como un proceso inherentemente conservador que utiliza sólo recursos (...) endógenos, mientras que la evolución se interpreta como un proceso de normalización que destruye la variación fenotípica. Llamo a esta visión perspectiva homeostática. Voy a criticar la perspectiva homeostática presentando argumentos apoyados en consideraciones teóricas y empíricas. En particular, voy a destacar dos prejuicios anacrónicos que se encuentran en el corazón de la perspectiva homeostática: en primer lugar, su visión monomórfica de las especies, así como su visión monoorganísmica y monogenómica del organismo; en segundo lugar, su compromiso con una visión causal endógena del desarrollo. Finalmente voy a argumentar que el esencialismo estadístico es problemático porque respalda los mismos prejuicios monistas y endógenos que caracterizan la perspectiva homeostática. Parafraseando a Margulis y Sagan, los científicos pueden engañarse fácilmente al descuidar la investigación sobre la diversidad humana y la plasticidad del desarrollo. A statistical version of the concept of human nature remains a major foundational concept in many branches of the human sciences. The kernel of the concept is that there exists a core of species-specific phenotypes that characterises biological species, including ours. I call this view statistical essentialism. I will suggest that phenotypic typicality and uniformity are considered legitimate assumptions in many human sciences because biological development is interpreted as an inherently conservative process utilising only endogenous developmental resources, while evolution is interpreted as a normalizing process destroying phenotypic variation. I call this view homeostatic perspective. I will criticise the homeostatic perspective by presenting arguments supported by both theoretical considerations and empirical evidence. In particular, I will emphasise two anachronistic biases at the heart of the homeostatic perspective: first, its mono-morphic view of species as well as mono-organismic and mono-genomic view of the organism; secondly, its commitment to an endogenous view of developmental causation. I will finally argue that statistical essentialism is problematic because it endorses the same monistic and endogenous prejudices characterising the homeostatic perspective. Paraphrasing Margulis and Sagan, human scientists can easily fool themselves by neglecting research on human diversity and developmental plasticity. (shrink)

The philosophical literature that tackles foundational questions about normativity often appeals to normative reasons—or considerations that count in favor of or against actions—and their interaction. The interaction between normative reasons is usually made sense of by appealing to the metaphor of (normative) weight scales. This paper substitutes an argumentation-theoretic model for this metaphor. The upshot is a general and precise model that is faithful to the philosophical ideas.

L’argomento che si intende sviluppare nel presente intervento è quello del rapporto di reciprocità tra amore e conoscenza nella riflessione mistica di Riccardo di San Vittore, autore di alcune delle pagine più belle sulla dignità conoscitiva dell’amore nella filosofia medievale. Si metterà a fuoco come la prospettiva mistica e il linguaggio metaforico descrivano un preciso percorso conoscitivo nel quale il soggetto si assimila all’oggetto conosciuto in una dinamica che, analogicamente, riprende la relazione tra amante e amato. In particolare, assumendo come (...) note le riflessioni di Riccardo circa la contemplazione, avanzate nei libri quarto e quinto del _De arca mystica_, ci si volgerà all’approfondimento della _dimensione trinitaria_, trattata sia nello scritto sopra citato, in quanto oggetto dell’ultimo tipo di contemplazione, sia, e soprattutto, nel _De Trinitate_, in quanto _fonte e figura_ dell’amore e, dunque, del suo rapporto con la dimensione conoscitiva. The topic that we intend to develop in this essay is the relationship between love and knowledge in the mystical reflection of Richard of Saint Victor, author of some of the most significant pages on the cognitive dignity of love in medieval philosophy. It will focus on mystical perspective and metaphorical language and how these dimensions describe a precise cognitive strategy in which the subject is assimilated to the known object in a dynamic that takes up the relationship between lover and loved one. In particular, taking as notes the reflections of Richard about contemplation, advanced in the fourth and fifth books of _De arca mystica_, we will turn to the deepening of the Trinitarian dimension as an object of the last type of contemplation, both, and above all, in the _De Trinitate_, as a source and figure of love and, therefore, of its relationship with the cognitive dimension. An attempt will be made to clarify the Richard’s view of the reciprocity of love and knowledge and, subsequently, it will be shown how the _form _ of this relationship is the Trinitarian life. The article tries to reconstruct the Wirkungsgeschichte of the De pace fidei and it focuses on some fundamental moments of its fate. Nicholas of Cusa was one of the first not just to recognize other religions' value, but also to individuate a source of richness in religious pluralism. His work had fortune since the years after its draft, the 1453, known and quoted by Eimerico da Campo, Giovanni of Segovia, Juan de Torquemada and Pope Pius II. The debate, alive and (...) still open, around the possible influence of the work to Italian humanistic context is reconstructed, in particular about Pico and Ficino. Trusted traces of reception of the work can be individuated in France, in authors like Bodin and Postel. Finally the article is focused on modern fate of the work in Germany: beyond the cultural contest into reception and translation had done, the work analyze the reception by the German philosopher Lessing and on his comparison with Cusanian ideas about the vision of tolerance elaborated by the last one. Previous research has found that news coverage on immigration is often biased in negative ways and that it inspires the formation of negative attitudes towards immigrants. However, academic research about this link between news consumption and attitudes towards immigrants among adolescents remains limited. The current study aims to test this association from a media-exposure and intergroup-contact perspective using survey data from 875 adolescents in Flanders, Belgium. The findings show that only television news consumption, thus no other types of news consumption, (...) was associated with adolescents’ attitudes towards immigrants. Intergroup contact within the friend group, outside the school context, was linked to more positive attitudes. This study nuances earlier findings that news consumption predicts attitudes towards immigrants. Implications for future research are discussed. (shrink)

In the recent literature, it has been shown that the wave function in the de Broglie–Bohm theory can be regarded as a new kind of field, i.e., a "multi-field", in three-dimensional space. In this paper, I argue that the natural framework for the multi-field is the original second-order Bohm’s theory. In this context, it is possible: i) to construe the multi-field as a real-valued scalar field; ii) to explain the physical interaction between the multi-field and the Bohmian particles; and iii) (...) to clarify the status of the energy-momentum conservation and the dynamics of the theory. El objetivo de este ensayo es aclarar el sentido de filosofía según el filósofo italiano Giovanni Piana. Más allá de ser una búsqueda de algo que se quiere saber o de un saber hacer, la filo-sofía es una actividad teórica que nace de un estado de confusión. La tarea del filósofo es en-tonces aquella de orientarse en esta confusión, tratando alcanzar la claridad. La propuesta me-todológica de Piana parte entonces de una aclaración conceptual que determina el trabajo del filósofo y (...) para la cual se vuelve necesario el aporte de la fenomenología. Justo a partir de es-tas bases se desarrolla la propuesta filosófica de Giovanni Piana conocida como “estructura-lismo fenomenológico”. A pesar de que todo acto de experiencia posee una manera peculiar de estructurar el material (perceptivo, imaginativo o memorativo), el planteamiento de Piana pone la percepción como experiencia fundamental para un análisis genético que llegue a la aclaración conceptual de la esfera de la lógica. In this paper, we contend that there are two ways of arguing, namely sincere and insincere arguing. We draw such a distinction, based on the felicity conditions of the complex speech act of arguing as modelled in van Eemeren and Grootendorst’s pragma-dialectical approach. We introduce a conversa-tional setting, which contains a speech act of arguing that does not count as in-sincere arguing, while being a sui gene-ris form of sincere arguing. We desig-nate it as “cooperative inquiry”. Finally, we show that (...) argument evaluation plays a key role in determining whether an in-stance of arguing counts as either argu-ing sincerely or insincerely. Résumé: Dans cet article, nous affir-mons qu’il existe deux manières d’argu-menter, à savoir l’argumentation sincère et l’argumentation non sincère. Nous établissons une telle distinction, basée sur les conditions de félicité de l’acte de parole complexe consistant à argu-menter, tel que modélisé dans l’ap-proche pragma-dialectique de van Eemeren et Grootendorst. Nous intro-duisons un cadre conversationnel, qui contient un acte de parole d'argumenta-tion qui n'est pas considéré comme une argumentation non sincère, tout en étant une forme sui generis d'argumentation sincère. Nous la désignons comme « enquête coopérative ». Enfin, nous montrons que l’évaluation des argu-ments joue un rôle clé pour déterminer si un cas d’argumentation compte comme une argumentation sincère ou non. (shrink)

Marc Richir é, sem dúvida, um dos leitores mais profundos e atentos dos textos de Edmund Husserl. A capacidade deste autor para entrar em diálogo com o filósofo alemão, cujo valor, mas igualmente as limitações soube reconhecer, coloca‑o no centro do discurso filosófico da segunda metade do século XX e até hoje. O vigoroso caminho fenomenológico de Richir começa durante os anos 80, quando as obras do filósofo começam a tomar forma de um discurso denso e articulado em torno dos (...) níveis arquitetónicos que estão atrás e por debaixo da experiência natural e intersubjetiva do mundo. De entre as possíveis objeções a Husserl, devemos reconhecer, segundo Richir, o paradoxo que gera o próprio conceito de fenómeno, ao qual o filósofo belga trata de tentar chegar mediante uma nova e mais radical forma de époché. Desde aí, abre‑se um horizonte de investigação novo, feito de uma fenomenalização considerada no seu aparecer instantâneo e intermitente, em nome do qual o filósofo deve estar disposto a renunciar à presença do eu constituinte enquanto condição da toda a experiência e conhecimento. Entre os temas que compõem o universo richiriano está aquele que se dirige à investigação dos conteúdos mínimos da experiência que se organizam antes da conceptualização. Retomando o conceito merleau‑pontyano de Wesen selvagem durante os anos 90, Richir coloca o espaço no centro do seu discurso e, em particular, a forma na qual este se encontra intimamente misturado com o tempo na constituição do mundo dos fenómenos. O modo como chegamos a introduzir‑nos no mundo como seres que sabem e conhecem não pode entender‑se sem as noções husserlianas de corpo vivido e intersubjetividade. Richir falará, então, da matriz arcaica da chôra, a partir da qual, mediante um certo tipo peculiar de esquematismo, se gerará a primeira fenomenalização do mundo que é reflexo da relação originária entre mãe e filho. A Leiblichkeit será então o pinto de dissensão, o lugar de um espaço transicional, interfático, que subjaz a toda a espacialização. (shrink)

Ethics review committees have become a common institution in English-speaking research communities, and are now increasingly being adopted in a variety of research environments. In light of existing debates on the aptness of ethics review boards for assessing research work in the social sciences, this article investigates the ways in which researchers navigate issues of research ethics in the absence of a formal review procedure or of an ethics review board. Through the analysis of qualitative and quantitative data, the article (...) questions the overall utility of ethics review boards. Highlighting the importance of space for sharing, the authors argue for the development of a new type of structure that takes into account researchers’ ‘ethos of responsibility’ as an adequate ethical compass for research in the social sciences. We introduce a sequent system which is Gentzen algebraisable with orthomodular lattices as equivalent algebraic semantics, and therefore can be viewed as a calculus for orthomodular quantum logic. Its sequents are pairs of non-associative structures, formed via a structural connective whose algebraic interpretation is the Sasaki product on the left-hand side and its De Morgan dual on the right-hand side. This paper aims to perform a multi-level analysis of the Irish public discourse on Covid-19. Despite widespread agreement that Ireland’s response was rapid and effective, the country’s journey through the pandemic has been no easy ride. In order to contain the virus, the Government’s emergency legislation imposed draconian measures including the detention and isolation of people deemed to be even “a potential source of infection” and a significant extension of An Garda Síochána’s power of arrest. In April 2020, journalists John (...) Waters and Gemma O’Doherty initiated judicial review proceedings before the High Court to challenge such legislation, which they defined as unconstitutional, “disproportionate” and based on “fraudulent science”. The proceedings attracted widespread media coverage in what soon became a debate on the legitimacy of emergency legislation and the notion of ‘fake news’ itself. After a brief survey of the legislative background to Ireland’s Covid response, the argumentative strategy is analysed through which the High Court eventually dismissed Mr Waters and Ms O’Doherty’s challenge. Focusing on the process of justification of the judicial decision, the paper provides a descriptive account of the argument structure of the Court’s decision. This sheds light on the pattern of multiple argumentation through which the Court interpreted relevant norms in the Constitution and at once re-established the primacy of “facts” informing political decision-making at a time of national emergency. The paper explains why the de Broglie–Bohm theory reduces to Newtonian mechanics in the macroscopic classical limit. The quantum-to-classical transition is based on three steps: (i) interaction with the environment produces effectively factorized states, leading to the formation of _effective wave functions_ and hence _decoherence_; (ii) the effective wave functions selected by the environment—the pointer states of decoherence theory—will be well-localized wave packets, typically Gaussian states; (iii) the quantum potential of a Gaussian state becomes negligible under standard classicality conditions; therefore, (...) the effective wave function will move according to Newtonian mechanics in the correct classical limit. As a result, a Bohmian system in interaction with the environment will be described by an effective Gaussian state and—when the system is macroscopic—it will move according to Newtonian mechanics. This article focuses on one of the main authors of medieval philosophy, Peter Abelard. It re-proposes the importance of the moral themes that involve aspects not only of anthropology, but also of ontology, which have not yet been thoroughly studied. For this revaluation of Abelard’s work, the study considers the ethics of relations from two aspects: one objective, God and his will, and the other subjective, man and his consciousness.

This article studies sixteenth-century discussions on the origin of the soul and reappraises a confessional divide that scholarship has identified within these discussions. Historians have claimed that while Catholic and Calvinist authors defended the idea that individual human souls were created by God ex nihilo (creationism), Lutherans argued that human souls were propagated through the seed of the parents, ex traduce (traducianism). This study demonstrates that, while several Lutherans did defend traducianism, this opinion was not required by their faith, and (...) the very fathers of the Lutheran faith, Martin Luther and Philip Melanchthon, refused to express any dogmatic conclusions on the topic. This article shows, then, both that sixteenth-century Lutherans held a number of different opinions on the origin of the soul and how traducianism became linked to – and sometimes part of – Lutheranism through polemical exchanges. This essay provides an overview of the working mechanisms of abductive reasoning and discusses the possible applications of this logic tool in comparative law research. Indeed, abductive reasoning pertains to the role of explanatory reasoning in formulating hypotheses and, as commonly utilised in contemporary literature of social sciences, in verifying those ideas. Comparative thinking is a logic process of the human mind that employs a particular set of logic and epistemic tools to manage and process data. Arguing that comparative law (...) has not conceptualised a precise and consistent method but only a set of practical guidelines to guide the research process of scholars, this study claims that observation of socio-legal phenomena and theory formation are not only inherently linked in comparative law research but also already theory-driven through an abductive logic process. In this sense, the scholar of comparative law does not rely exclusively on the logic instruments of the traditional legal practitioner but can deepen the potentialities of an abductive logic of discovery and justification already scrutinised by the other human and social sciences. While it is not desirable for the science of comparative law to adopt a single rigid method for research but to maintain a methodological flexibility open to interdisciplinarity, it must question the logic of discovery and justification of its results in a manner similar to that of the other social sciences of which it is a full member. Accordingly, it is assumed that the logic set of tools of comparative law can be enriched by developing the potentialities of the structure of abductive reasoning. (shrink)

The article is about a theme in part neglected in part controversial of the interpretation of sources of Nicholas of Cusa thought: the platonic work and more specifically the dialogue Parmenides. The author examines the whole Cusanus’ work, annotations to platonic work included. In particular the article underlines a platonic presence in Nicholas of Cusa thought, directly come from the reading of Parmenides. Later the author focalizes his attention on Nicholas of Cusa dialogue de non aliud, getting to argue the (...) thesis that Cusanus had directly known different platonic dialogues and in specific the Parmenides and he deeply understood it, however he followed mostly Proclus’ interpretation of dialogue and platonic thought. In the second part, the article reconstructs the critics that Nicholas of Cusa moves to Plato, specifically when he ascribes to God a way of acting by necessity and not beeing able to catch the trinity of the One. The author proves philologically and speculatively how Nicholas of Cusa elaborates his own conception of the One by a critique dialogue with Plato and Proclus’ positions, making an original afterthought of the neoplatonic tradition. The core of Nicholas of Cusa conception is the idea of the One or God as freedom, freedom thought as the essence, not a mere divine attribute. Nicholas of Cusa elaborates his own freedom of the One conception by a double dimension: related to both world’s creation and trinitarian genesis of Himself. In the Nicholas of Cusa vision, Trinity and freedom contribute to define the essence itself of the One, even though Cusanus does not never forget the Deus absconditus is transcendent than itself Deus revelatus. Accord to Cusanus God as infinite is beyond One itself and Trinity itself. (shrink)

RESUMENEl desarrollo embriológico es un fenómeno que ha inspirado la especulación filosófica desde temprano en la historia del pensamiento. Desde los tiempos de Aristóteles dos modelos conceptuales antitéticos se han utilizado tradicionalmente para comprender la embriogénesis: o el embrión posee ya una forma o estructura, o ésta se forma de nuevo en cada generación. Nuestro objetivo en este artículo es mostrar que el contraste entre la posición preformacionista y epigenética persiste a pesar de los formidables avances teóricos y experimentales de (...) la biología del desarrollo contemporánea. El preformacionismo y la epigénesis han perfeccionado constantemente sus posiciones en el curso de la historia con el fin de responder a los retos conceptuales de la época. Este continuo proceso de transformación ha dado lugar a una convergencia parcial entre las dos posiciones. Sin embargo, vamos a argumentar que, a pesar de los esfuerzos por conciliar ambas posturas, esta antinomia, que se erige como una de las más fundamentales de la biología, no será fácil de superar. ABSTRACTThe process of development of the embryo has inspired philosophical speculation since the advent of Western thought. Since the time of Aristotle two antithetical conceptual models have traditionally been used to understand embryogenesis: either form or structure is preformed in the embryo or it is newly formed with each generation. Our aim in this article is to show that the contrast between the pre-formationist and epigenetic positions persists despite the formidable theoretical and experimental advances of contemporary developmental biology. Pre-formationism and epigenesis have constantly refined their positions in the course of history in order to answer the conceptual challenges of each epoch. This process of continuous transformation has resulted in a partial convergence of the two positions. However, we shall argue that, despite the partial successes of this process of continuous convergence, one of the most fundamental antinomies in biology persists. (shrink)

El artículo analiza la herencia viquiana en el pensamiento moderno, en particular en el pensamiento moderno italiano. A partir de una periodización de esta herencia, según la cual el XIX es el siglo del Vico filósofo de la historia, el XX corresponde al Vico filósofo del lenguaje y el XXI pone en relieve al pensador del cuerpo y se reconoce en el “universale fantastico” (universal fantástico) el legado más relevante del pensamiento viquiano. It is generally argued that if the wave-function in the de Broglie–Bohm theory is a physical field, it must be a field in configuration space. Nevertheless, it is possible to interpret the wave-function as a multi-field in three-dimensional space. This approach hasn’t received the attention yet it really deserves. The aim of this paper is threefold: first, we show that the wave-function is naturally and straightforwardly construed as a multi-field; second, we show why this interpretation is superior to other interpretations (...) discussed in the literature; third, we clarify common misconceptions.
