The realization of dwindling fossil fuel supplies and their adverse environmental impacts has accelerated research and development activities in the domain of renewable energy sources and technologies. Global energy demand is expected to rise during the next few decades, and the majority of today's energy is based on fossil fuels. Alternative energy sources and technologies can play a vital role in lowering or eliminating our reliance on fossil fuels. However, such a transition will require a large investment and will not (...) be reversible. The benefits of hydrogen and other liquid fuels as transportation fuels are not marginal, but the real urgency in greenhouse gas reductions and fossil fuel replacement should not be translated into an energy infrastructure based on unsustainable sources in the long run. It is wise to examine each option thoroughly and objectively now and discard those with little potential so our focus and effort may be placed elsewhere. (shrink)

What is a logical constant? The question is addressed in the tradition of Tarski's definition of logical operations as operations which are invariant under permutation. The paper introduces a general setting in which invariance criteria for logical operations can be compared and argues for invariance under potential isomorphism as the most natural characterization of logical operations.

The purpose of this book is to highlight Carl Stumpf's contributions to philosophy and to assess some of the aspects of his work. This book brings together several specialists of Stumpf and the school of Franz Brentano, and includes fourteen original studies (in English and German) on the various aspects of Stumpf's philosophy, and some of his unpublished writings. This book is divided into four sections, and also includes a general introduction on the reception and actuality of Stumpf's philosophy. The (...) first section examines the historical sources of his philosophy, the second examines some of the central themes of his work and the third examines his relationship to other philosophers. The fourth section consists of notes taken by Husserl during Stumpf's lectures on metaphysics in Halle, Stumpf's introduction to the edition of his correspondence with Brentano, which he prepared in 1929, and some important letters pertaining to this correspondence. The purpose of this study is to examine the meaning and value of the criticism that Stumpf address to Husserl's phenomenology in Ideas I. My presentation is divided into four parts: I briefly describe the relationship between Stumpf and the young Husserl during his stay in Halle (1886-1901); then I will comment Stumpf's remarks on the definition of Husserl's phenomenology as descriptive psychology in his Logical Investigations; in the third part, I examine Husserl's notice in section 86 of Ideas I (...) where he compares his own terminology to that of Stumpf; finally I comment on Stumpf's criticism of Husserl's phenomenology in his last book Erkenntnislehre. This paper examines Kant's accounts of friendship and marriage, and argues for what can be called an ideal of “moral marriage” based on Kant's notion of moral friendship. After explaining why Kant values friendship so highly, it gives an account of the ways in which marriage falls far short, according to Kant, of what friendship has to offer. The paper then argues that many of Kant's reasons for finding marriage morally impoverished compared with friendship are wrong‐headed. The paper further argues (...) that a few of Kant's views about friendship are false. The main point is that, when we slightly revise Kant's account of friendship and jettison Kant's misguided notions about marriage, we see that marriages can aspire to much of the same moral richness as friendships. Finally, the paper argues that this friendship model of marriage does not obscure the important ways in which marriages and friendships differ. (shrink)

This paper is about the topic of psychologism in the work of Kazimierz Twardowski and my aim is to revisit this important issue in light of recent publications from, and on Twardowski’s works. I will first examine the genesis of psychologism in the young Twardowski’s work; secondly, I will examine Twardowski’s picture theory of meaning and Husserl’s criticism in Logical Investigations; the third part is about Twardowski’s recognition and criticism of his psychologism in his lectures on the psychology of thinking; (...) the fourth and fifth parts provide an overview of Twardowski’s paper “Actions and Products” while the sixth part addresses the psychologism issue in the last part of this paper through the delineation of psychology and the humanities. I shall conclude this study with a brief assessment of Twardowski’s solution to psychologism. (shrink)

Robert Pippin's new book, The Culmination, examines Heidegger's reading and critique of Kant and Hegel. Since Pippin is perhaps best known as one of the most influential contemporary advocates for the importance of engaging with the difficult work of Hegel in particular, it will no doubt surprise quite a few of his readers that, on some fundamental points, the book concludes that “Heidegger is right” (p. xi). In the present piece, I explore some intriguing issues that Pippin's book raises. Although (...) the disagreement between his principal parties is obviously central to his discussion, my main focus is on a possible point of important agreement that that discussion also opens up, in light of which Heidegger might be fruitfully interpreted as pursuing a variant of a Kantian/Hegelian project, though this will also lead me to make a number of critical points about Pippin's reading of Heidegger: although there are grounds for thinking that Pippin's Heidegger does subscribe to such a project, some of the considerations that Pippin advances in arguing that “Heidegger is right” sit uncomfortably—it seems to me—with that project. This paper investigates the nature and foundation of duties to oneself in Kant's moral theory. Duties to oneself embody the requirement of the formula of humanity that agents respect rational nature in them-selves as well as in others. So understood, duties to oneself are not subject to the sorts of conceptual objections often raised against duties to oneself; nor do these duties support objections that Kant's moral theory is overly demanding or produces agents who are preoccupied with their own virtue. This paper explores two models using which we might understand Heidegger's notion of ‘Eigentlichkeit’. Although typically translated as ‘authenticity’, a more literal construal of this term would be ‘ownness’ or ‘ownedness’; and in addition to the paper's exegetical value, it also develops two interestingly different understandings of what it is to have a judgment of one's own. The first model understands Heideggerian authenticity as the owning of what I call a ‘standpoint’. Although this model provides an understanding of a number (...) of key features of authenticity, it also invites an important objection—which I call ‘the closure objection’—that can be found in, for example, the work of Steven Galt Crowell and Tony Fisher. Although I argue that this objection can be met, the response for which it calls reveals that the feat of authenticity as understood through the standpoint model rests upon a further feat, and one which may itself have a stronger claim to be identified with Heideggerian authenticity. I develop this thought, introducing what I call the ‘all-things-considered judgment model’ of authenticity, the basis of which lies in, among other sources, Heidegger's appropriation of themes from Aristotle's discussion of phronesis. I explain the exegetical benefits of adopting this model and consider some objections that it invites, before closing with a discussion of how the two models understand the notion of ‘a judgment of one's own’. Franz Brentano’s impact on the philosophy of his time and on 20th-century philosophy is considerable. The “sharp dialectician” (Freud) and “genial master” (Husserl) influenced philosophers of various allegiances, being acknowledged not only as the “grandfather of phenomenology” (Ryle) but also as an analytic philosopher “in the best sense of this term” (Chisholm). The fourteen new essays gathered together in this volume give an insight in three core issues of Brentano’s philosophy: consciousness (sect.1), intentionality (sect. 2) and ontology and metaphysics (sect. (...) 3). Two further sections of the volume deal with the posterity of his philoso¬phy: in section 4, the legacy of his account of sense perception and feeling is discussed, while the history of Brentano’s unpublished manuscripts is discussed in section 5. This section also presents an edition of a manuscript from 1899 on relations, along with the letters from Brentano to Marty which discuss this manuscript. Some Kantian ethicists, myself included, have been trying to show how, contrary to popular belief, Kant makes an important place in his moral theory for emotions–especially love and sympathy. This paper confronts claims of Kant that seem to endorse an absence of sympathetic emotions. I analyze Kant’s accounts of different sorts of emotions (“affects,” “passions,” and “feelings”), and different sorts of emotional coolness (“apathy,” “self-mastery,” and “cold-bloodedness”). I focus on the particular way that Kant praises apathy, as “sublime,” in order (...) to argue that his praise of extreme emotional self-control is not incompatible with, but rather complementary to, his praise of sympathy. This article addresses the recent reception of Franz Brentano's writings on consciousness. I am particularly interested in the connection established between Brentano's theory of consciousness and higher-order theories of consciousness and, more specifically, the theory proposed by David Rosenthal. My working hypothesis is that despite the many similarities that can be established with Rosenthal's philosophy of mind, Brentano's theory of consciousness differs in many respects from higher-order theories of consciousness and avoids most of the criticisms generally directed to them. This (...) article is divided into eight parts. The first two sections expound the basic outline of Rosenthal's theory, and the third summarizes the principal objections that Rosenthal addresses to Brentano, which I, then, examine in sections 4 and 5. In sections 6 and 7, I discuss Brentano's principle of the unity of consciousness, and in section 8, I consider the scope of the changes that Brentano brings to his theory of consciousness in his later writings, which follow the 1874 publication of Psychology. I then draw the conclusion that Brentano's theory rests on a view of intransitive and intrinsic self-consciousness. (shrink)

In Kant’s moral theory, we do not have duties to animals, though we have duties with regard to them. I reconstruct Kant’s arguments for several types of duties with regard to animals and show that Kant’s theory imposes far more robust requirements on our treatment of animals than one would expect. Kant’s duties regarding animals are perfect and imperfect; they are primarily but not exclusively duties to oneself; and they condemn not merely cruelty to animals for its own sake, but (...) also, such things as killing them for food when our health does not require it and ingratitude to service animals. Central to understanding these duties is appreciating Kant’s concern for our morally useful emotions, for it is primarily because of the effect that cruelty to animals has on our sympathetic emotions—which greatly help us treat other rational beings appropriately—that we have duties not to be cruel to animals. Yet cruelty and callousness toward animals are not problematic only because they may weaken some of our morally useful emotions. Cruelty and callousness toward animals are problematic also because they oppose our morally useful emotions; these emotions, as part of the perfection of our nature, should be honored, supported, and furthered, unless there are compelling reasons not to do so in particular cases. Denys Turner is a philosopher who holds a chair in Cambridge's Faculty of Divinity. In this erudite and entertaining lecture he explores the conditions for the belief that God does not exist. According to Turner, the first challenge lies in acknowledging the question 'Does God exist?' to be a valid one. Once the question is established, various things follow, each one making it harder to maintain 'atheism' as a credible or interesting position. Turner boxes atheists into a philosophical corner, showing (...) how the belief that something has come of nothing is itself an acknowledgement of God's existence. Enlisting the help of thinkers as diverse as Aquinas, Kant, Wittgenstein, Nicholas Lash and John Milbank, Turner's witty and provocative piece will be of interest to anyone engaged in religious enquiry who has wondered about the nature and status of atheism as a defendable intellectual position in our age. In this paper, I explicate Kant’s theory of virtue and situate it within the context of theories of virtue before Kant (such as Aristotle, Hobbes, and Hume) and after Kant (such as Schiller and Schopenhauer). I explore Kant’s notions of virtue as a disposition to do one’s duty out of respect for the moral law, as moral strength in non-holy wills, as the moral disposition in conflict, and as moral self-constraint based on inner freedom. I distinguish between Kant’s notions of (...) virtue and of the good will. I discuss Kant’s duties of virtue (and so particular virtues and vices), the relationships between virtue and happiness and virtue and the emotions, and Kant’s criticisms of his predecessors’ views of virtue. I close with a discussion of Kant and contemporary virtue ethics. Although the paper reflects my own interpretation of Kant, it strives less to argue for a particular thesis about Kant on virtue than to illuminate important aspects of Kant’s theory of virtue. My aim in this study is to show that the philosophical program elaborated by Brentano in his Psychology is largely indebted to the research conducted by Brentano on British empiricism and Comte's positive philosophy at Würzburg. This research represents the starting point of, and backdrop to, the project for philosophy as science, which is at the heart of his Psychology, and sheds new light on the philosophical stakes of many debates he leads in that work. Furthermore, Brentano's research informs us (...) about his philosophical preoccupations during the Würzburg period, and simultaneously provide us with a new perspective on the evolution of his thought from his habilitation at Würzburg in 1866 to his arrival in Vienna in 1874. In this study, I propose to examine some of the factors that motivated Brentano's interest in Comte's philosophy and to evaluate the influence that the latter exerted on Brentano's thought during the Würzburg period and beyond. The work of Hubert Dreyfus interweaves productively ideas from, among others, Heidegger and Wittgenstein. A central element in Dreyfus' hugely influential interpretation of the former is the proposal that, if we are to—in some sense—'make sense' of intentionality, then we must recognize what Dreyfus calls the 'background'. Though Dreyfus has, over the years, put the notion of the 'background' to a variety of philosophical uses,1 considerations familiar from the literature inspired by Wittgenstein's reflections on rule-following have played an important role (...) in motivating the case for believing that we need to recognize the 'background' and thus also in identifying precisely what it is about the intentional that supposedly needs to be 'made sense of'. Dreyfus argues that what he calls 'representationalism' will land us with an unstoppable 'regress of rules'. In this paper, I first argue that there are actually two different arguments that Dreyfus invokes; I then go on to evaluate quite how, in the light of the problems that those arguments reveal, our position might be thought to be improved by our recognizing the 'background'. Given that various philosophical positions designed to deal with these problems have emerged within the Wittgensteinian literature, an obvious question to ask is whether the position that Dreyfus would have us adopt is essentially one of those positions. If it isn't, then how does it differ? There is surely a variety of ways in which such a comparison might be carried out and what I offer is only one. I argue that if, through a recognition of the 'background', we are thought to have acquired solutions to those problems, then it's not at all clear that the supposed solutions that emerge work. So I explore instead the possibility that that recognition forms part of an attempt to 'dissolve' those problems. In order to bring some clarity to that possibility I consider a number of different ways in which Dreyfus' proposals might be interpreted by drawing on ideas set out by John McDowell (and I suggest that his view of one of the 'regress' arguments is anticipated by Heidegger himself). I then identify and assess some of the consequences of adopting such McDowellian readings. My sense is that Dreyfus is on the side of the angels, so to speak. But if what is right in his proposals is to become clear, and if he is to be spared some obvious objections that those proposals may elicit, we need to be clear about just what kind of contribution those proposals are meant to make. In pursuing that clarity, I am attempting to follow through on the comparison of Wittgensteinian and Heideggerian ideas that Dreyfus and his supporters have initiated: what has yet to be clarified is how and why recognizing the 'background' will allow us to 'cope better' with the puzzles in the rule-following literature that they have cited in making a case for the need to recognize the 'background'. Ultimately, I will argue that assessing this matter may require a yet broader comparison of Wittgensteinian and Heideggerian themes, one which raises questions about what we take 'doing ontology' and 'doing phenomenology' to be. Heidegger discusses Aristotle’s concept of ‘phronêsis’ at length at crucial junctures in the development of his concept of ‘authenticity’; and there is a widely-held suspicion that that development is indebted to those discussions. The present paper examines that suspicion in the light of an apparent tension in Aristotle’s texts between understanding phronêsis as a perceptual capacity and understanding it as a deliberative capacity. Bronwyn Finnigan has argued that some influential, recent Heideggerian scholarship on this topic emphasises the perceptual and downplays (...) the deliberative, and there is evidence in Heidegger’s texts that might suggest he does too. The present paper, however, offers an alternative to this perceptually-focused reading, which I call ‘the all-things-considered judgment reading’. It understands the exercise of phronêsis, and the authenticity which Heidegger models upon it, as deliberative feats, accommodates the evidence thought to support the perceptually-focused reading, and avoids philosophical objections that the latter reading invites. Europeans seeking to understand tribal arts face obvious problems of comprehending the histories, values, and ideas of vastly remote cultures. In this respect the issues faced in understanding tribal art (or folk art, primitive art, traditional art, third or fourth-world art — none of these designations is ideal) are not much different from those encountered in trying to comprehend the distant art of “our own” culture, for instance, the art of medieval Europe. But in the case of tribal or so-called (...) primitive art, there are special complications. First, objects of tribal art are sometimes so strange to us that we cannot tell immediately whether they are intended to be works of art (or some local analogue of what we would call art) at all.1An African head-rest I once came across had an odd, extravagant extrusion which made the whole piece reminiscent of Arp. It seemed to my baffled, ignorant eyes to be much more than a mere head-rest, but I couldn’t tell what more it was supposed to be. Maybe that extension on the side of the object had some purely utilitarian function, acting as a handle, or perhaps it was a natural part of the original block of wood, left there merely because it looked nice to the eye of the carver. Though the head-rest seemed beautiful, I still don’t know if I was admiring as an essentially expressive object some simple item of practical use, or something that combined expression and utility. How do we reconcile Husserl’s repeated criticism of Mach’s phenomenalism almost everywhere in his work with the leading role that Husserl seems to attribute to Mach in the genesis of his own phenomenology? To answer this question, we shall examine, first, the narrow relation that Husserl establishes between his phenomenological method and Mach’s descriptivism. Second, we shall examine two aspects of Husserl’s criticism of Mach: the first concerns phenomenalism and Mach’s doctrine of elements, while the second concerns the principle of (...) economy of thought, which Husserl closely associates with a form of psychologism in his Logical Investigations . Our working hypothesis is that the apparent contradictory comments of Husserl regarding Mach’s positivism can be partially explained by the double status he confers to his own phenomenology—as a philosophical program radically opposed to positivism, and as a method akin to Mach’s descriptivism. This paper situates abortion in the context of women’s duties to themselves. I argue that Kant’s fundamental moral requirement to respect oneself as a rational being, combined with Kant’s view of our animal nature, form the basis for a view of pregnancy and abortion that focuses on women’s agency and moral character without diminishing the importance of their bodies and emotions. The Kantian view of abortion that emerges takes abortion to be morally problematic, but sometimes permissible, and sometimes even required. (...) I first sketch Kant’s account to duties to oneself, highlighting duties to oneself as an animal and moral being. Next, I discuss pregnancy and the challenges it poses to women’s self-preservation, development, and efficacy as rational human agents. I then give my main argument: that abortion is morally problematic because it is antagonistic to an important subset of morally useful emotions that we have self-regarding duties to protect and cultivate. I argue that self-regarding moral considerations ground a rebuttable deliberative presumption against maxims of abortion for inclination-based ends. Finally, I consider three objections to this account of abortion : that it rests on implausible assumptions about the effects of abortion on women’s morally useful sentiments; that it portrays the virtuous agent’s reasoning about abortion as objectionably self-regarding; and that it fails adequately to recognize the moral significance of the fetus as a potential rational being. This chapter explores the notion of an authentic affective life by examining three models of Heideggerian authenticity in light of his remarks on emotion. In addition to the familiar “decisionist model,” the chapter examines what I call the “standpoint model” and the “all things considered judgment model”. Each of these models suggests a distinctive picture of what authenticity in one’s affective life might be, and considering the plausibility of these pictures provides an interesting way to re-consider the plausibility of those (...) models. The chapter argues that authentic affect as the decisionist model understands it requires a level of control over our emotions that is inherently implausible and incompatible with Heidegger’s understanding of them, and that the standpoint model’s understanding of authentic affect requires a uniformity in our emotions which should be rejected on the same grounds. Ultimately, the chapter argues in favor of the AJM on the grounds that its picture of affective authenticity—an openness to the many ways in which my situation matters to me, touches me and moves me whether I like it or not—is both truer to our actual emotional lives and more harmonious with Heidegger’s own understanding of these matters. The purpose of this study is to assess Husserl’s debt to Lotze’s philosophy during the Halle period (1886-1901). I shall first track the sources of Husserl’s knowledge of Lotze’s philosophy during his studies with Brentano in Vienna and then with Stumpf in Halle. I shall then briefly comment on Husserl’s references to Lotze in his early work and research manuscripts for the second volume of his Philosophy of Arithmetic. In the third section, I examine Lotze’s influence on Husserl’s antipsychologistic turn (...) in the mid-1890s. The fourth section is a commentary on Husserl’s manuscript entitled “Microcosmus,” to which he explicitly refers in his Prolegomena, and which he planned to publish as an annex of his Logical Investigations. This work contains a detailed analysis of the third book of Lotze’s 1874 Logic. The last section examines Husserl’s arguments against logical psychologism in his Prolegomena, which I discuss through the lens of Stumpf’s critique of psychologism in his paper “Psychology and theory of knowledge”. I argue that Stumpf’s early works on this topic make it possible to establish a connection between Lotze’s interpretation of Plato’s theory of Ideas and Husserl’s antipsychologism. My hypothesis is that Stumpf’s analyses represent the background of Husserl's critique of logical psychologism in his Logical Investigations. I shall conclude this study by showing that Husserl’s position with respect to Lotze’s philosophy remains basically unchanged after the publication of his Logical Investigations, and that Husserl’s main criticism of Lotze pertains, in the final analysis, to the absence of a theory of intentionality in Lotze’s philosophy. In lieu of an abstract, here is a brief excerpt of the content:META-ONTOLOGY AND META-FICTION by Denis E. B. Pollard Peter van inwagen's attempt to explain the nature of fiction makes use of Quine's program in meta-ontology.1 This program comprises four basic theses: (i) that being is the same as existence, (ii) that being is univocal, (iii) that this univocal sense is best captured, for the purposes of formalization, by die existential quantifier, and (iv) that deciding what to believe (...) about what there is comes to a decision about what theories we should accept. As the aim of formalization is explicitness, then theories should be rendered into canonicalese and their commitments identified through those sentences which are prefaced with the existential quantifier. For Inwagen, as for his mentor Quine, acceptance of theory expressed in this canonical form entails acceptance of the ontology expressed in those quantified sentences. Bringing these considerations to bear on fiction, Inwagen asks, "What are theories about fiction?" and replies that they are "theories that treat stories as having an internal structure" (p. 72). The upshot of this is that such theories contain sentences which, when formally rendered, revead commitments to fictional objects. It is further claimed that such sentences can be vehicles of objective truth. Thus Inwagen finds he cannot wholeheartedly dismiss Sarah Gamp as a nonentity. In this respect, his view contrasts with two contemporary accounts, the "reductivist" one which denies Sarah Gamp's existence and her possession of any properties whatever, and the more recent "Meinongian" view which would agree that Sarah Gamp does not exist, but would nonetheless strenuously maintain that she is a nurse, fat, old, and decidedly the worse for drink. Inwagen's Sarah is neither ofthese: pace both these positions, she exists all right, but with properties such as being a theoretical entity of criticism, being a satiric villainess, not being a woman, and not being fond of gin. Inwagen's attempt to steer what seems to be a middle course has yielded, if anything, a more counterintuitive result than either ofthe other views. What is die explanation for this? 244 Denis E. B. Pollard245 To begin with, it is important to note a distinction, which Inwagen himself accepts, between two kinds of sentences. Let us take the following elementary examples: (1) "Sarah Gamp is a nurse," and (2) "Sarah Gamp is a character in a nineteenth-century novel." With specimens like (1), Inwagen sides with the reductivist: such sentences asefalse, and are not about anything. But it is with examples like (2) that ontology becomes a real issue, since sentences of this kind belong to literary theory. Neither authors nor critics who make use of sentences of the first kind are committed to the existence of fictional entities. So far, so good. But what is it that compels such commitment in the second case? Inwagen is sceptical about reductivist analyses which seek to paraphrase such sentences in order to remove any "misleading" implications. Such paraphrases he would regard as at best "messy," and more seriously, unlikely to preserve intuitive meaning without appearing to say that there are fictional characters. Unfortunately, he brushes this aside as a "narrow technical issue" at the very point where rather more argument is needed. However, on the issue of preservation of intuitive meaning, it might well be argued that his contention is somewhat question-begging, suggesting a rather literal reading of (2) above as a straightforward predication superficially akin to (3) "McEnroe is a seeded player in this year's Wimbledon tournament." So by a strange alchemy, the expression "Sarah Gamp" in (2) is accorded a referential status denied to it in (1). Inwagen's Sarah Gamp, in this theoretical disguise, can now literally satisfy predicates like "... is a character in a nineteenth-century novel," but not predicates like "... is a nurse." The parallel being exploited here is that with scientific theory. An ideal gas can satisfy Boyle's Law, but cannot literally be ignited, put into containers, or have an offensive smell. Paul Boghossian has pointed out a ’circularity problem’ for dispositionalist theories of meaning: as a result of the holistic character of belief fixation, one cannot identify someone’s meaning such and such with facts of the form S is disposed to utter P under conditions C, without C involving the semantic and intentional notions that such a theory was to explain. Alex Miller has recently suggested an ’ultra‐sophisticated dispositionalism’ (modelled on David Lewis’s well known version of functionlism) and has argued that (...) this version of dispositionalism escapes Boghossian’s ’circularity problem’. Miller argues, nonetheless, that another of Boghossian’s criticisms of dispositionalism, ’the infinity problem’ still applies to this ’ultra‐sophisticated dispositionalism’: C will still draw upon a potential infinity of mediating background clusters of belief. The present paper argues that the feature that ’the infinity problem’ presents as problematic is a feature of a host of familiar explanations. Our fundamental difficulty in this area is not our inability to understand how a more general model can be applied to a particular domain (the intentional understood as dispositional) but our failure to understand that general model itself (dispositional explanation). This paper explores a variety of kinds of apparent disagreement of which it may be held that they involve failure to disagree in that, at least in some broad sense, the disputants use the same words to express different meanings or concepts. It is argued that it is hard to rebut the claim that some apparent disagreements about personal identity fall into a particular sub-category of this broad type. I conclude both that a "constrained" relativism which I call "quasi-relativism" is (...) appropriate in regard to some central personal-identity debates, and also that, in order to avoid the lamentable conclusion that there is no real disagreement at all in these debates, we should embrace the idea that there is a non-cognitive element in personal identity claims, in virtue of the tight conceptual relations between personal identity claims and value claims of various kinds. O artigo versa sobre considerações acerca do direito natural, destacando primeiramente a iniciativa, datada do final no século XIX, de retomá-lo como seara jurídica, na forma de uma disciplina a ser considerada nos estudos do direito e como parte efetiva do ordenamento jurídico. A seguir, baseando-se em doutrinas típicas do positivismo, serão analisados argumentos contrários à consideração efetiva do direito natural, procurando-se demonstrar sua inconsistência.
