La ingeniería constitucional de Sartori plantea la necesidad analizar la edificación de instituciones jurídico-políticas a través de una técnica de incentivos y castigos. El presente trabajo indaga la existencia o no de incentivos para dirigir la facultad del control disciplinario por parte de la Procuraduría General de la Nación contra el presidente y sus ministros como consecuencia de un poder legislativo pasivo en esa actividad debido a un régimen presidencialista que mezcla las agendas del Congreso y el Presidente. El presente trabajo estudió la relación entre el derecho a la identidad en toda su esfera y la prohibición del anonimato de donantes de gametos en la aplicación de técnicas de reproducción humana asistida. La metodología se desarrolló desde un enfoque cualitativo, se utilizaron los métodos inductivo-deductivo, dogmático, histórico-lógico, comparativo y analítico-sintético, la técnica aplicada fue la revisión bibliográfica de ley, doctrina y jurisprudencia. Como conclusión se estableció la vulneración de derechos al inexistir una ley que regule el anonimato de (...) donantes. Adicionalmente se sugiere que, el Estado ecuatoriano cuente con una normativa completa, rígida y sobre todo garantista de los derechos de los intervinientes en las técnicas de reproducción humana asistida, de manera especial a las personas nacidas a través de gametos donados. En la ciudad de Medellín se hace uso de herramientas y dispositivos, en el marco de la llamada Gestión Social, para ejecutar importantes obras para el llamado desarrollo urbano, que bien pueden configurar una “Gestión social del despojo”, en el marco de una “Planeación institucional de la miseria y el desarraigo”, generando víctimas ya no del conflicto armado sino del desarrollo. Es necesario problematizar esta suerte de modelo de desarrollo urbano, su gestión e implementación.

This article investigates the impact of the adoption of International Financial Reporting Standards (IFRS) on the comparability, quality, and efficiency of financial reporting, both in public administration and in emerging markets. Through a quantitative approach, data from various public institutions and emerging market companies that have adopted IFRS in recent years were analyzed. The results indicate a significant improvement in the comparability and quality of financial reports, although accounting efficiency varies depending on the degree of implementation and administrative modernization in (...) the countries. It is concluded that the adoption of IFRS has an overall positive effect, but its total impact depends on the institutional capacity of countries. (shrink)

O objetivo geral deste artigo se concentra em abordar, a partir de uma abordagem holística, as implicações éticas relacionadas ao uso da Inteligência Artificial, doravante IA, na geração de conteúdos acadêmicos. Três elementos-chave são abordados neste artigo: um estado da arte sobre as IA de maior demanda no âmbito acadêmico atual; as implicações éticas vinculadas ao plágio, à originalidade e à fraude; e, por fim, a caracterização das ferramentas de monitoramento de conteúdos acadêmicos gerados por IA. A pesquisa se enquadra (...) dentro de uma abordagem qualitativa, cuja fonte de coleta de informações é documental e, quanto ao nível ou grau de conhecimento gerado, trata-se de uma pesquisa descritiva. A principal conclusão a que esta pesquisa chega consiste em alertar para os benefícios das ferramentas de inteligência artificial na otimização de tarefas acadêmicas e de pesquisa, mas também advertir sobre as implicações éticas desfavoráveis que o uso dessas ferramentas pode acarretar quando não utilizadas de forma responsável, especialmente no campo da pesquisa acadêmica. Existem muitas ferramentas de inteligência artificial que podem auxiliar o pesquisador na realização de tarefas como coleta, sistematização e análise de dados e informações, revisão da escrita, citações e referências, entre outras; porém, também há o risco de perda de originalidade na pesquisa. This article aims to analyze feminist strategies against digital violence and their relation to performative forms of social justice. Based on new feminist materialisms (Coole & Frost, 2010; Souza, 2019), the article shows how female bodies are at the crossroads in our digital society. On the one hand, they are a target of digital violence because of their political activities, while on the other hand feminist protesters are opening new political possibilities for mobilization. By conducting a digital ethnography with two (...) social collectives located in Mexico City – Luchadoras and Laboratorio de Interconectividades – I argue that embodying and politicizing technologies are strategies to mobilize the body as a political, critical and material category, which reveals a renewed feminist agency in hacking the hegemonic meanings of digital technology and resignifying its materiality in order to politicize it. Furthermore, I argue that based on the body as material category, innovative forms of social justice for feminist collectives emerge. These strategies are related to the critical questioning of technologies to repoliticize digital violence, to render visible the memories and affectations in women’s bodies, as well as to mobilize a new feminist positioning called hackfeminist self-defense. All in all, this article seeks to contribute to understanding the broader issue of feminist politics performing social justice in the digital era. (shrink)

Far from the interpretation of Leon Battista Alberti as a prototype of the "universal man", GARIN has analyzed the contradictory nature of Alberti's thought. In fact, in the extensive and versatile work of the Genoese humanist two opposite visions of man and the world coexist: one believes in the power of reason, the other acknowledges the absurdity of life. It is in Momus and the Intercenales that this "somber Alberti" is present. In these texts the appeal to a simulated life is addressed through a form of laughter that demystifies the human ideal of the early Italian Renaissance. (shrink)

One of the central limitations of sensory substitution devices (SSDs) is their inability to reproduce the non-sensory feelings that are normally associated with visual experiences, especially hedonic and aesthetic responses. This limitation is sometimes reported to cause SSD users frustration. To make matters worse, it is unclear that improvements in acuity, bandwidth, or training will resolve the issue. Yet, if SSDs are to actually reproduce visual experience in its fullness, it seems that the reproduction of non-sensory feelings will be of (...) some importance. We offer a novel solution. Researchers can produce hedonic and aesthetic responses by eliciting these feelings artificially, pairing distal objects that should be pleasurable to pleasurable stimulus outputs from the SSD. We outline two strategies for accomplishing this: first, by means of a prefixed, hardwired, association of pleasant distal objects to pleasant stimulus outputs from the SSD; second, by means of a flexible, feedback-based association which creates associations based on a subject-directed matching of distal objects to patterns of stimuli from the SSD which the subject takes to have the corresponding hedonic properties. We evaluate some problems with both strategies, and we argue that the feedback-based strategy is more promising. Researchers can use this strategy to help the blind, allowing them to take pleasure in the objects they perceive using SSDs. (shrink)

A partir de un estudio de la “arqueología de los medios” en la producción de imaginarios artísticos, el interés por recuperar de las páginas de la Revista Moderna de México el cuento “En el lago Pátzcuaro” de Rubén M. Campos es mostrar la forma cómo impactó el ferrocarril en la producción de relatos artísticos en el afán de relatar la experiencia poética del viaje a través del territorio nacional. El ferrocarril, como un artefacto productor de miradas, traería consigo un proceso (...) de transformación estética para la producción de reproducciones visuales en la prensa literaria del entresiglos mexicano. Específicamente interesa mostrar este relato como un ejemplo de cómo las tecnologías de la mirada –fotografía e ilustraciones– posibilitan la aparición de propuestas híbridas de representación de la experiencia del viaje, aspecto que aparece ligado al desarrollo del ferrocarril como medio de comunicación y transporte. The increased prevalence of advanced‐stage chronic diseases has augmented the need for palliative care teams. In Colombia, although the legislation promotes palliative care development, people still die without receiving management from a palliative care team. In addition, judiciary regulations regarding euthanasia have generated public confusion and ethical conflicts among members of the palliative care teams. Therefore, this study aimed to perform a bioethical reflection on the relationship between palliative care and euthanasia supported by data on euthanasia requests in a palliative (...) care program. This reflection is based on retrospective and descriptive observational data, collected in two highly complex hospitals in Bogotá, Colombia. A total of 50 euthanasia requests were identified, of which 62% met the defined criteria, 16% did not, and 22% were not considered by the interdisciplinary committee for the right to die with dignity due to early death. All patients were treated and followed up by a palliative care team until their death. This study considered that palliative care could be a complement management for patients requesting euthanasia based on their experience by supporting the decision‐making, alleviating suffering, and providing emotional support in the last days of life. A humane and respectful treatment of patients by the staff has inspired the creation of the Department of Humanism and Bioethics at the University Hospital of Fundación Santa Fe de Bogotá which not only has met, but even surpassed established goals. Since 2013, the Department has developed different activities that have made it possible to respond more ethically to the daily needs of patients and to strengthen other humanization processes. Currently, the Department of Humanism and Bioethics addresses five lines of (...) work: a continuing education program, an assistance advisory program, support, and strengthening of existing committees, support for the activities of our institutional humanization program and research activities. Ofrecemos un análisis de los aspectos ontoepistemológicos de los debates actuales sobre el cuerpo sexogenerizado en Argentina. Con herramientas teóricas de la fenomenología feminista, la epistemología feminista y los nuevos materialismos feministas analizamos, por un lado, la manera en que el Estado argentino comprende el cuerpo sexogenerizado y, por el otro, una serie de afirmaciones en los discursos transexcluyentes que conflictúan estas discusiones. Buscamos despejar el terreno conceptual del debate feminista para determinar qué posturas nos permiten avanzar y cuáles nos (...) hacen retroceder. Concluimos que, mientras que las nociones en la ley de identidad de género están amparadas por el conocimiento feminista actual, los discursos transexcluyentes que cuestionan su contenido representan un marco de comprensión ontoepistemológico patriarcal. La obtención de alimentos sanos y seguros requiere de técnicas de conservación inocuas para el consumidor y para el me­dio ambiente, entre las que se destaca la bioconservación. A su ca­tálogo de compuestos naturales o microorganismos, utilizados de forma habitual, la bioconservación ha incorporado recientemente los bacteriófagos y las proteínas fágicas con actividad lítica. La utilización de fagos y endolisinas en el biocontrol ofrece importantes ventajas frente a otros sistemas de conserva­ción tradicionales. Entre dichas ventajas destacan su inocuidad, especificidad y (...) versatilidad. Por otra parte, la acuciante necesidad de reducir el uso de antibióticos en la cadena alimentaria ha impul­sado la investigación basada en estos antimicrobianos con el fin de aplicarlos en producción primaria. Sin embargo, y a pesar de la gran eficacia ya demostrada en múltiples sectores, la falta de legislación de la Unión Europea sobre el uso de bacteriófa­gos junto con la necesidad de ser aceptados por los consumidores, son factores que están afectando negativamente a su implantación como bioconservantes. En este contexto, este artículo recoge los últimos resultados relacionados con este tipo de antimicrobianos en la industria agro-alimentaria, y resume los puntos clave para entender las posibilidades reales de su aplicación ante los nuevos requisitos asociados con una producción sostenible tanto desde una perspectiva económica como ambiental. Este artículo analiza “Contéstame, Baila mi danza”, la antología de seis poetas norteamericanas que tradujera y publicara Diana Bellesi en 1984. El objetivo es comprender las implicancias políticas, artísiticas e ideológicas de la misma. La antología editada por Bellesi incluye poemas de las autoras estadounidenses Muriel Rukeyser, Denise Levertov, June Jordan, Diane Di Prima, Adrienne Rich, Irena Klepfisz, y un ensayo de Barbara Deming. El volumen mostró al público hispanohablante algunas de las escritoras más relevantes del siglo XX, que (...) en algunos casos no habían sido traducidas antes al español. Bellesi considera que las seis autoras que seleccionó comparten el espíritu rebelde, un lenguaje potente, una historia común, pero sobre todo, sus voces de mujeres. Esta ponencia se propone leer la antología como un diálogo político, artístico y de género entre la poeta-traductora argentina y sus seis pares norteamericanas. A través de la lectura de la Intro-ducción, las notas de presentación de las escritoras, y las traducciones propiamente dichas, la labor de investigación busca demostrar la importancia de la traducción literaria como un programa artístico e ideológico que resulta en un fructífero diálogo entre las lenguas y las culturas. Alfred Mele presents an influential argument for incompatibilism which compares an agent, Ernie, whose life has been carefully planned by the goddess Diana, to normal deterministic agents. The argument suggests both that Ernie is not free, and that there is no relevant difference between him and normal deterministic agents in respect of free will. In this paper, I suggest that what drives our judgement that Ernie is not free in the Diana case is that his actions are merely (...) an extension of Diana's—he is akin to a tool, which she uses solely for her own purposes, and his behaviour occurs only because of the interest Diana takes in its occurring. This contrasts with normal deterministic universes, in which normal agents are not such tools. (shrink)

The following proposal explores and discusses the potential of Cartography as a methodological path in the development of research in Mathematics Education aimed at working with different groups that, in many cases, in addition to finding themselves in various situations of vulnerability and social neglect – taken in their potentiality of life –, are not necessarily linked to formal or informal academic training spaces, such as schools or universities. To this end, we begin with a general presentation of the doctoral (...) research carried out by five members of the research group Coletivo Cronopies+ (cronopiando.org) and, in addition, we invite the participants of the session to visit the first Hip Hop House in Brazil in Diadema/SP, which constitutes one of the settings that make up the fieldwork of one of the research projects presented. The research we share involves working with a Hip Hop cultural center in Piracicaba/São Paulo (SP), a Guarani-Kaiowá indigenous village in Coronel Sapucaia/Mato Grosso do Sul (MS), a traveling school in a Landless Workers’ Movement camp in Porecatu/Paraná (PR), a rural settlement school in Nova União/Rondônia (RO) and three collectives that operate with gender in the region of Rio Claro/SP. The construction of this proposal is methodologically based on Cartography, since the discussion aims to produce the field of this research and we propose “fieldwork”. (shrink)

Ethical concerns are motivating the search for alternative methods to obtain pluripotent stem cells without destroying human embryos. The supporters of these methods stress the importance of ensuring that the biological entities used in these alternative methods are not “disabled or sick human embryos.” In this article the authors argue that biological entities bearing anomalies or alterations that directly inhibit the appearance of neural activity (DIANA anomalies) share the moral status of human organisms fulfilling the clinical criteria for brain (...) death. El objetivo de este artículo es aportar elementos para construir una compresión de las menores en el sistema de justicia penal que atienda a las discriminaciones específ icas de las que son objeto y que tenga en cuenta los elementos particulares que se dan con relación a las infractoras más jóvenes. En la primera parte del artículo, se indica como la historia ha invisibilizado a las niñas y sus experiencias. El análisis histórico evidencia cómo el control ha constituido un elemento (...) clave en la construcción y percepción de la identidad femenina, particularmente a través de los procesos de socialización de las niñas, cargados de estereotipos y expectativas de lo que se espera de una buena mujer. La segunda parte muestra como la identidad de género atraviesa el sistema de justicia juvenil, que reprodu- ce y amplif ica los sexismos y discriminaciones que las niñas sufren en otros ámbitos. Y por último, se exponen los principales aportes de la criminología feminista, con el fin de comprender la experiencia de las menores en la justicia juvenil. (shrink)

Este artículo considera el tema de las tecnologías de representación de las ruralidades queer en el cine. Las autoras llevan a cabo un análisis pormenorizado de la representación de las disidencias sexuales y de género sostenidas en y a través de espacialidades rurales tomando como objeto de estudio tres piezas fílmicas producidas en el estado español durante las últimas dos décadas, a saber, Ander (2009), 80 Egunean (2010) y Elisa y Marcela (2018). A manera de conclusión, el artículo muestra (...) las tensiones entre dos marcos interpretativos desde los que afrontar los ensamblajes en que se relacionan las ruralidades y las disidencias sexuales y de género. Estos son el enfoque de las ruralidades urbanas que produce epistemologías de carácter identitariamente fuerte, y el enfoque de las ruralidades queer que permite leer las representaciones tomadas en cuenta como figuraciones posidentitarias y subversivas de la disidencia. Judith Butler’s 2021 essay “Bodies That Still Matter” offers a compressed rehearsal of themes and moves that are developed in more detail in their 2020 book, The Force of Nonviolence: An Ethico-Political Bind. In both projects, Butler spotlights the term feminicidio as an instructive indicator of brutality and violence against feminized individuals, including trans women. Feminicidio exemplifies the violence of “unequal grievability” that Butler’s recent work seeks to overcome; therefore, in particular relation to their recent work on nonviolence, Butler insists (...) that the horror of feminicidio should be closely linked to analysis that mobilizes against the full social force of the crimes. Following the work of Montserrat Sagot, Butler calls for analysis that links the brutality of the killings with a structure of social domination and terror. Additionally, Butler introduces questions for further exploration about representation, social organization, and the relation of sexual terror to domination, extermination, or a general theory of sexuality and violence. In this article, I make a start on the set of questions that come along with the term feminicidio in the work of some of its key theorists such as Diana Russell, Marcela Lagarde, Monserrat Sagot, and Alicia Schmidt Camacho. Here, in support of Butler’s claim that feminicidio should be analyzed in ways that mobilize comprehensive resistance, this article (1) defends Lagarde’s definition of feminicidio as an institutionalized crime, especially against Russell’s objection; (2) develops Sagot’s analysis of femicide in relation to Achille Mbembe’s concept of necropolitics, (3) considers Schmidt Camacho’s critique of the term in the context of maquiladora labor in Mexico, and (4) excavates the salience of Foucault’s concept of biopower as an important model for Butler’s analysis. Finally, this article (5) argues that Butler’s work challenges nonviolence researchers to expand their interest and understanding of grieving as a form of resistance. (shrink)

This paper defends an inferential conception of scientific representation. It approaches the notion of representation in a deflationary spirit, and minimally characterizes the concept as it appears in science by means of two necessary conditions: its essential directionality and its capacity to allow surrogate reasoning and inference. The conception is defended by showing that it successfully meets the objections that make its competitors, such as isomorphism and similarity, untenable. In addition the inferential conception captures the objectivity of the cognitive representations (...) used by science, it sheds light on their truth and completeness, and it explains the source of the analogy between scientific and artistic modes of representation. Holobionts are symbiotic assemblages composed by a host plus its microbiome. The status of holobionts as individuals has recently been a subject of continuous controversy, which has given rise to two main positions: on the one hand, holobiont advocates argue that holobionts are biological individuals; on the other, holobiont detractors argue that they are just mere chimeras or ecological communities, but not individuals. Both parties in the dispute develop their arguments from the framework of the philosophy of biology, in terms (...) of what it takes for a “conglomerate” to be considered an interesting individual from a biological point of view. However, the debates about holobiont individuality have important ontological implications that have remained vaguely explored from a metaphysical framework. The purpose of this paper is to cover that gap by presenting a metaphysical approach to holobionts individuality. Drawing upon a conception of natural selection that puts the focus on the transgenerational recurrence of the traits and that supports the thesis that holobionts are units of selection, we argue that holobionts bear emergent traits and exert downward powers over the entities that compose them. In this vein, we argue, a reasonable argument can be made for conceiving holobionts as emergent biological individuals. (shrink)

Given one conception of biological individuality (evolutionary, physiological, etc.), can a holobiont – that is the host + its symbiotic (mutualistic, commensalist and parasitic) microbiome – be simultaneously a biological individual and an ecological community? Herein, we support this possibility by arguing that the notion of biological individuality is part‐dependent. In our account, the individuality of a biological ensemble should not only be determined by the conception of biological individuality in use, but also by the biological characteristics of the part (...) of the ensemble under investigation. In the specific case of holobionts, evaluations of their individuality should be made either host‐relative or microbe‐relative. We support the claim that biological individuality is part‐dependent by drawing upon recent empirical evidence regarding the physiology of hosts and microbes, and the recent characterization of the ‘demibiont’. Our account shows that contemporary disagreements about the individuality of the holobiont derive from an incorrect understanding of the ontology of biological individuality. We show that collaboration between philosophers and biologists can be very fruitful in attempts to solve some contemporary biological debates. (shrink)

Verbal communication leaves room for interpretative disputes. Speakers can argue about what they mean by their words and negotiate their commitments in conversation. This article examines the deniability of implicitly communicated contents and addresses the question of what makes an act of denial seem more or less plausible to the addressee. This paper argues for a broadly dispositionalist approach to the ontology of Bohmian mechanics . It first distinguishes the ‘minimal’ and the ‘causal’ versions of Bohm’s theory, and then briefly reviews some of the claims advanced on behalf of the ‘causal’ version by its proponents. A number of ontological or interpretive accounts of the wave function in BM are then addressed in detail, including configuration space, multi-field, nomological, and dispositional approaches. The main objection to each account is reviewed, namely the (...) ‘problem of perception’, the ‘problem of communication’, the ‘problem of temporal laws’, and the ‘problem of under-determination’. It is then shown that a version of dispositionalism overcomes the under-determination problem while providing neat solutions to the other three problems. A pragmatic argument is thus furnished for the use of dispositions in the interpretation of the theory more generally. The paper ends in a more speculative note by suggesting ways in which a dispositionalist interpretation of the wave function is in addition able to shed light upon some of the claims of the proponents of the causal version of BM. I argue against an account of scientific representation suggested by the semantic, or structuralist, conception of scientific theories. Proponents of this conception often employ the term “model” to refer to bare “structures”, which naturally leads them to attempt to characterize the relation between models and reality as a purely structural one. I argue instead that scientific models are typically “representations”, in the pragmatist sense of the term: they are inherently intended for specific phenomena. Therefore in general scientific models are not (...) (merely) structures. I then explore some consequences of this pragmatist account of representation, and argue that it sheds light upon the distinction between theories and models. I finish by briefly addressing some critical comments due to Bas Van Fraassen. (shrink)

This study tests a model that links stakeholder pressure to the implementation of corporate social responsibility activities and market performance. Stakeholder groups and competitors might exert pressure on companies to implement CSR, which could lead to positive effects on market performance. Using structural equation modeling, the authors find that stakeholders and competitors exert pressure differently. The effect of CSR implementation on market performance is moderated by market dynamism: It affects market performance more in dynamic environments. This Element has two main aims. The first one is an historically informed review of the philosophy of probability. It describes recent historiography, lays out the distinction between subjective and objective notions, and concludes by applying the historical lessons to the main interpretations of probability. The second aim focuses entirely on objective probability, and advances a number of novel theses regarding its role in scientific practice. A distinction is drawn between traditional attempts to interpret chance, and a novel methodological study (...) of its application. A radical form of pluralism is then introduced, advocating a tripartite distinction between propensities, probabilities and frequencies. Finally, a distinction is drawn between two different applications of chance in statistical modelling which, it is argued, vindicates the overall methodological approach. The ensuing conception of objective probability in practice is the 'complex nexus of chance'. (shrink)

: This paper outlines a genuinely pragmatist conception of propensity, and defends it against common objections to the propensity interpretation of probability, prominently Humphreys’ paradox. The paper reviews the paradox and identifies one of its key assumptions, the identity thesis, according to which propensities are probabilities. The identity thesis is also involved in empiricist propensity interpretations deriving from Popper’s influential original proposal, and makes such interpretations untenable. As an alternative, I urge a return to Charles Peirce’s original insights on probabilistic (...) dispositions, and offer a reconstructed version of his pragmatist conception, which rejects the identity thesis. – Correspondence to: msuarez@filos.ucm.es. This paper aims to offer a new argument in defence bacterial species pluralism. To do so, I shall first present the particular issues derived from the conflict between the non-theoretical understanding of species as units of classification and the theoretical comprehension of them as units of evolution. Secondly, I shall justify the necessity of the concept of species for the bacterial world, and show how medicine and endosymbiotic evolutionary theory make use of different concepts of bacterial species due to their (...) distinctive purposes. Finally, I shall show how my argument provides a new source of defence for bacterial pluralism. (shrink)

Despite the promises made by molecular evolutionists since the early 1960s that phylogenies would be readily reconstructed using molecular data, the construction of molecular phylogenies has both retained many methodological problems of the past and brought up new ones of considerable epistemic relevance. The field is driven not only by changes in knowledge about the processes of molecular evolution, but also by an ever-present methodological anxiety manifested in the constant search for an increased objectivity—or in its converse, the avoidance of (...) subjectivity.This paper offers an exhaustive account of the methodological and conceptual difficulties embedded in each of the steps required to elaborate molecular phytogenies. The authors adopt a historical perspective on the field in order to follow the development of practices that seek to increase the objectivity of their methods and representations. These include the adoption and development of explicit criteria for evaluation of evidence, and of procedures associated with methods of statistical inference, quantification and automation. All these are linked to an increasing use of computers in research since the mid 1960s. We will show that the practices of objectivity described are highly dependent on the problems and tools of molecular phylogenetics. (shrink)
