In several jurisdictions, sex offenders may be offered chemical castration as an alternative to further incarceration. In some, agreement to chemical castration may be made a formal condition of parole or release. In others, refusal to undergo chemical castration can increase the likelihood of further incarceration though no formal link is made between the two. Offering chemical castration as an alternative to further incarceration is often said to be partially coercive, thus rendering the offender’s consent invalid. The dominant response to (...) this objection has been to argue that any coercion present in such cases is compatible with valid consent. In this article, we take a different tack, arguing that, even if consent would not be valid, offering chemical castration will often be supported by the very considerations that underpin concerns about consent: considerations of autonomy. Visual Agnosia is a comprehensive and up-to-date review of disorders of higher vision that relates these disorders to current conceptions of higher vision from cognitive science, illuminating both the neuropsychological disorders and the nature of normal visual object recognition.Brain damage can lead to selective problems with visual perception, including visual agnosia the inability to recognize objects even though elementary visual functions remain unimpaired. Such disorders are relatively rare, yet they provide a window onto how the normal brain might accomplish the (...) complex task of vision. Visual Agnosia reviews a century of case studies of higher-level visual deficits following brain damage, places them in the general context of current neuroscience, and draws relevant conclusions about the organization of normal visual processing. Highly portable and accessible MRI technology will allow researchers to conduct field-based MRI research in community settings. Previous guidance for researchers working with fixed MRI does not address the novel ethical, legal, and societal issues (ELSI) of portable MRI (pMRI). Our interdisciplinary Working Group (WG) previously identified 15 core ELSI challenges associated with pMRI research and recommended solutions. In Chinese films with intangible cultural heritage themes, female images are an indispensable presence. Particularly, several renowned female hero figures derived from folklore literature, such as Liu Sanjie, Ashima, and Hua Mulan, stand out as symbols of both traditional Chinese heroines and the cultural zeitgeist. This paper utilizes Roland Barthes' semiotic theory to analyze the characteristics of these three representative intangible cultural heritage-themed folk literature films. By employing text analysis methods, it examines the elements of costume, dialogue, setting, and plot (...) in these films. These symbolic elements elucidate the development of female characters and cultural transformations, revealing how traditional culture is represented and transmitted in modern media. The paper also explores the crucial role and value of women in the preservation and inheritance of intangible cultural heritage, offering suggestions for better shaping the images of female heroes in intangible cultural heritage-themed films. The authors of Beziau and Franceschetto work with logics that have the property of not satisfying any of the formulations of the principle of non contradiction, Béziau and Franceschetto also analyze, among the three-valued logics, which of these logics satisfy this property. They prove that there exist only four of such logics, but only two of them are worthwhile to study. The language of these logics does not consider implication as a connective. However, the enrichment of a language with an (...) implication connective leads us to more interesting systems, therefore we look for one implication for these logics and we study further properties that the logics obtain when this connective is added to these systems. This article compares the strategies between nine museums in Ecuador, Spain and Peru to address the educommunication activities developed as a result of the 2020 pandemic. Focused on content analysis, the research takes into account the activity of their web pages and the interaction on their social networks. The results show that in Spain informative and informative actions prevailed, while Ecuador and Peru focused on cultural and educational ones. Genuine Paraconsistent logics \ and \ were defined in 2016 by Béziau et al, including only three logical connectives, namely, negation disjunction and conjunction. Afterwards in 2017 Hernández-Tello et al, provide implications for both logics and define the logics \ and \. In this work we continue the study of these logics, providing sound and complete Hilbert-type axiomatic systems for each logic. We prove among other properties that \ and \ satisfy a restricted version of the Substitution Theorem, and that (...) both of them are maximal with respect to Classical Propositional Logic. Restrictive border protection policies directed toward managing the flow of refugees coming into neoliberal democracies (and out of failing nation-states) are a defining feature of contemporary politics. In this book, Verónica Tello analyses how contemporary artists-such as Tania Bruguera, Isaac Julien, Rosemary Laing, Dinh Q. Lé, Dierk Schmidt, Hito Steyerl, Lyndell Brown and Charles Green-negotiate their diverse subject positions while addressing and taking part in the production of images associated with refugee experiences and histories. Tello argues that their practices, which (...) manifest across a range of contexts including Cuba, the United States, Australia and Europe, represent an emergent, global paradigm of contemporary art, 'counter-memorial aesthetics'. Counter-Memorial Aesthetics, Tello argues, is characterized by its conjunction of heterogeneous signifiers and voices of many times and places, generating an experimental, non-teleological approach to the construction of contemporary history, which also takes into account the complex, disorienting spatial affects of globalization. Spanning performance art, experimental 'history painting', aftermath photography and video installation, counter-memorial aesthetics bring to the fore, Tello argues, how contemporary refugee flows and related traumatic events critically challenge and conflict with many existing, tired if not also stubborn notions of national identity, borders, history and memory. Building on the writings of such thinkers as Michel Foucault and Jacques Rancière, this book offers a useful concept of 'counter-memory' for the twenty-first century. It shows how counter-memorial aesthetics is not only central to the nexus of contemporary art and refugee histories but also how it can offer a way of being critically present with many other, often interrelated, global crises in the contemporary era. When cognitive neuropsychologists make inferences about the functional architecture of the normal mind from selective cognitive impairments they generally assume that the effects of brain damage are local, that is, that the nondamaged components of the architecture continue to function as they did before the damage. This assumption follows from the view that the components of the functional architecture are modular, in the sense of being informationally encapsulated. In this target article it is argued that this “locality” assumption is probably (...) not correct in general. Inferences about the functional architecture can nevertheless be made from neuropsychological data with an alternative set of assumptions, according to which human information processing is graded, distributed, and interactive. These claims are supported by three examples of neuropsychological dissociations and a comparison of the inferences obtained from these impairments with and without the locality assumption. The three dissociations are: selective impairments in knowledge of living things, disengagment of visual attention, and overt face recognition. In all three cases, the neuropsychological phenomena lead to more plausible inferences about the normal functional architecture when the locality assumption is abandoned. Also discussed are the relations between the locality assumption in neuropsychology and broader issues, including Fodor's modularity hypothesis and the choice between top-down and bottom-up research approaches. One of the reasons why moral enhancement may be controversial, is because the advantages of moral enhancement may fall upon society rather than on those who are enhanced. If directed at individuals with certain counter-moral traits it may have direct societal benefits by lowering immoral behavior and increasing public safety, but it is not directly clear if this also benefits the individual in question. In this paper, we will discuss what we consider to be moral enhancement, how different means may (...) be used to achieve it and whether the means we employ to reach moral enhancement matter morally. Are certain means to achieve moral enhancement wrong in themselves? Are certain means to achieve moral enhancement better than others, and if so, why? More specifically, we will investigate whether the difference between direct and indirect moral enhancement matters morally. Is it the case that indirect means are morally preferable to direct means of moral enhancement and can we indeed pinpoint relevant intrinsic, moral differences between both? We argue that the distinction between direct and indirect means is indeed morally relevant, but only insofar as it tracks an underlying distinction between active and passive interventions. Although passive interventions can be ethical provided specific safeguards are put in place, these interventions exhibit a greater potential to compromise autonomy and disrupt identity. (shrink)

Este texto busca ahondar en algunos de los ejes que articulan la discusión filosófica sobre la noción de archivo. Dicha discusión se ha subsumido en el denominado “ archival turn ” que recorrería el campo de estudios de las humanidades y las ciencias sociales durante las últimas tres décadas. Sin embargo, en este trabajo mostraremos que la reflexión filosófica previa, llevada a cabo por autores como Walter Benjamin, Michel Foucault y Jacques Derrida, entre otros, transforma el sentido convencional de la (...) noción de archivo en el transcurso del siglo XX, hasta el punto de volver paradójico el propio diagnóstico sobre el actual giro del archivo. A partir de aquí, el texto propone ahondar en cuatro dimensiones que atraviesan, de un modo u otro, la discusión filosófica sobre el archivo: 1) el carácter inorgánico latente en todo archivo; 2) el desbordamiento del lugar del archivo, 3) el vínculo del archivo con una economía general de poder, y 4) el problema del acceso al archivo. El análisis de estas cuatro dimensiones, derivadas de su problematización filosófica, nos obliga a sostener el carácter irresoluble de la propia cuestión del archivo y, al mismo tiempo, el ineludible vínculo entre sus aspectos teóricos y políticos. This article analyzes the challenges of education in the rural Andean context of Peru, highlighting the crucial role of the leadership of principals and teachers. To achieve this, an inductive qualitative documentary research approach was used, based on inquiries supported by hermeneutical analysis. Despite limitations in training in educational management and action, successful school leaders are distinguished by their concern for teachers' job satisfaction, generating high performance expectations, and promoting school achievements to the public. community. Teaching performance is essential in (...) this context, not only for imparting knowledge, but also for acting as a bridge between the educational institution and the community. Pedagogical processes, framed in directive leadership, are fundamental for teacher professional development and the improvement of learning. This literature review focused on effective teaching strategies for children with Attention Deficit Hyperactivity Disorder (ADHD) in classrooms where English as a Foreign Language (EFL) is taught, which is undoubtedly a novel and crucial issue that demands immediate attention. This review not only concentrates on identifying the teaching strategies used for students with ADHD but also delves into and considers different teaching approaches and inclusive education adaptations for students with ADHD. The impact of this review might be significant for educators, (...) parents, and stakeholders alike since it could provide valuable recommendations and knowledge based on the evidence gathered. This would lead to developing more effective, efficient, and inclusive teaching strategies or mechanisms for students with ADHD. Programs aimed at teacher training could also benefit from the findings of this review, contributing to the general support and improving the academic experience of students with ADHD in foreign language learning environments. Personhood is a foundational concept in ethics, yet defining criteria have been elusive. In this article we summarize attempts to define personhood in psychological and neurological terms and conclude that none manage to be both specific and non-arbitrary. We propose that this is because the concept does not correspond to any real category of objects in the world. Rather, it is the product of an evolved brain system that develops innately and projects itself automatically and irrepressibly onto the world whenever (...) triggered by stimulus features such as a human-like face, body, or contingent patterns of behavior. We review the evidence for the existence of an autonomous person network in the brain and discuss its implications for the field of ethics and for the implicit morality of everyday behavior. El objetivo de este artículo es analizar la emergencia reciente del discurso político-corporativo en torno a la noción de smart city, describiendo el vínculo entre las tecnologías digitales que conforman su infraestructura básica y las relaciones de poder que subyacen a sus modos de aplicación y gestión en el espacio urbano. Adoptamos el enfoque analítico de los estudios de gubernamentalidad, pues esta perspectiva crítica de las racionalidades de gobierno sobre las conductas de la población considera tanto los dispositivos de control (...) como los procesos de subjetivación y resistencia que atraviesan a las nuevas formas de gobierno smart-neoliberal de la vida urbana. El análisis de las estrategias gubernamentales de las smart cities mostrará que sus apuestas de gobierno en las ciudades consisten principalmente en la programación de las dinámicas urbanas. De ese modo, apuntaremos a una necesaria reflexión sobre las disputas tecnológico-políticas que surgen en el corazón de las llamadas ciudades inteligentes, tensionando así tanto sus premisas como sus prácticas de gestión de la población asociadas a las tecnologías digitales. En el presente estudio analizaremos la expresión del conflicto en el lenguaje, donde la lucha palabra-letra impregna la teoría agónica del lenguaje y marca la trascendencia sobre la relación historia-intrahistoria. Asimismo, presentaremos la dimensión creadora del lenguaje, relevante desde el Unamuno contemplativo, y el papel desempeñado por el diálo go a la hora de expresar los dos poíos del conflicto, agónico y contem plativo.

Resumen:Por un lado, el trabajo pretende mostrar de qué modo el “tono” de Arendt en sus trabajos académicos, tal y como lo señalara Scholem en una de sus misivas críticas a la autora, lejos de ser frívolo o burlón (como se apuntaba en esa crítica) produce una brecha perturbadora, por la cual los lectores y las lectoras de Hannah Arendt pueden desvelar hipocresías y actuar con una nueva responsabilidad. Por otro lado, el artículo señala diversos conceptos filosóficos, algunos ya sometidos (...) a investigación por Arendt, que en sí mismos presentan la fuerza de crear un mundo y unos seres humanos, con la energía teórica y real necesaria como para transformarlos: “pensar”, “actuar”, “amar”, son algunos de ellos. Este artículo tiene por objeto presentar algunas notas reflexivas y descriptivas del desarrollo teórico que hemos realizado sobre el enfoque de las epistemologías de las política educativa en tanto se convierte en una herramienta para llevar a cabo la reflexividad epistemológica sobre la investigación en política educacional. Y puede emplearse tanto como vigilancia epistemológica del propio proceso de investigación como para el meta-análisis de las investigaciones, ingresando de algún modo en lo que hemos denominado el campo de los estudios epistemológicos (...) en política educacional y cuyo continente son las ciencias sociales y políticas. Considerando que la complejidad social y política de la realidad educativa conllevan a construir nuevas miradas epistemológicas y por tanto a cuestionar el objeto de estudio de la política educacional. En este trabajo, se presentan y analizan, a modo de debate ciertas problemáticas inherentes a la elección de los investigadores al momento de definir el eje epistemológico de su investigación: pregunta o hipótesis. Durante mucho tiempo se ha considerado que estos componentes deben estar presentes simultáneamente en un proyecto de investigación, cuando en realidad pertenecen a lógicas diversas. Aquí planteamos la necesidad de reflexionar sobre ejes epistemológicos distintos y a la vez potentes para iniciar una investigación. Pero la co-presencia de (...) ambos ejes en la investigación le quita solidez y consistencia epistemológica a un proyecto de investigación, dado que la racionalidad subyacente con que se construye cada uno de estos ejes difiere entre sí.This paper presents and analyses by way of an open debate certain issues inherent to the choice of researchers when defining the epistemological axis of his research: question or hypothesis. It has been long considered that these components must be present simultaneously in a research project, when in fact belong to different epistemological axes. Each one is different and powerful enough to start some research. What if neurofeedback or other types of neurotechnological treatment, by itself or in combination with behavioral treatment, could achieve a successful “rewiring” of the psychopath’s brain? Imagine that such treatments exist and that they provide a better long-term risk-minimizing strategy compared to imprisonment. Would it be ethical to offer such treatments as a condition of probation, parole, or prison release? In this paper, I argue that it can be ethical to offer effective, non-invasive neurotechnological treatments to offenders as a condition (...) of probation, parole, or prison release provided that: the status quo is in no way cruel, inhuman, degrading, or in some other way wrong, the treatment option is in no way cruel, inhuman, degrading, or in some other way wrong, the treatment is in the best interests of the offender, and the offender gives his/her informed consent. Neuroethics has developed rapidly, driven in large part by developments in neuroscience. This article reviews neuroethics from the standpoint of its growing real-world relevance. It opens up with an analysis of the history of neuroscience that suggests the reason for the emergence of neuroethics now, in the early twenty-first century. It proceeds to survey current applications of neuroscience to diverse real-world problems. Published research in the field of neuromarketing is more focused on academic issues, such as the nature of the (...) brain activity underlying consumer behavior and the accuracy of brain-behavior predictions, than it is on the real-world utility of neuromarketing for improving business. Finally, this article concludes with a discussion of the ethical issues raised by these developments, and outlines three general challenges for society in the age of neuroscience. (shrink)

Can the theory and practice of the yogic tradition serve as a challenge to dominant cultural and political norms in the Western world? In this essay I demonstrate that modern yoga is a creature of fabrication, while arguing that yogic norms can simultaneously reinforce and challenge the norms of contemporary Western neoliberal societies. In its current and most common iteration in the West, yoga practice does stand in danger of reinforcing neoliberal constructions of selfhood. However, yoga does contain ample resources (...) for challenging neoliberal subjectivity, but this requires reading the yogic tradition in a particular way, to emphasize certain philosophical elements over others, while directing its practice toward an inward-oriented detachment from material outcomes and desires. Contemporary claims about yoga’s counterhegemonic status often rely on exaggerated notions of its former “purity” and “authenticity,” which belie its invented and retrospectively reconstructed nature. Rather than engaging in these debates about authenticity, scholars and practitioners may productively turn their energies toward enacting a resistant, anti-neoliberal practice of yoga, while remaining self-conscious about the particularity and partiality of the interpretive position on which such a practice is founded. Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. BackgroundConsidering ethical issues in midwifery care is essential for improving the quality of health services and the client's satisfaction. This study aimed to develop and validate the code of ethics for Midwives in Iran (ICEM).Materials and methodsThis was a mixed sequential study that was performed in three phases including a qualitative study, a review, and the content validity assessment. The first phase was a qualitative study with a content analysis approach. The data were collected by conducting in-depth semi-structured individual interviews (...) with 14 midwifery and ethics experts. The purposive sampling method was used to recruit the participants and sampling continued until data saturation. The data were analyzed using the conventional content analysis described by Graneheim and Lundman. Lincoln and Guba’s criteria were used to confirm the trustworthiness of the data. Then, a narrative review of the selected national and international codes of ethics for Midwives was performed to complete the items of the ICEM. For validity assessment, the face and content validity of the items of ICEM was assessed by 15 experts to calculate the content validity ratio (CVR) and index (CVI).ResultsFourteen experts were interviewed in the qualitative phase, and 207 codes were extracted from a content analysis which were categorized into 23 sub-categories and 6 main categories. The extracted codes were considered as the items for ICEM that were completed by a review of the selected national and international code of ethics for Midwives. The content validity and ratio assessment of the items demonstrated an average CVI = 0.92 and CVR = 0.85. Then, the final version of ICEM was developed with 92 items in 6 domains about; 1) "professional Commitments" with 30 items; 2) "providing midwifery services to the client and her companions” with 26 items; 3) “relationship with colleagues" with 11 items; 4) “herself” with 6 items; 5) “education and research” with 8 items; and, 6) “management” with 11 items.ConclusionICEM was prepared with 92 items in six sections that facilitate its use for midwives who are working in the different fields of care, counseling, education, research, and management. In this new version of the ICEM, the items related to recent social-, scientific, and technical improvements were considered for providing ethical midwifery care. (shrink)
