This article examines how efforts at legal legibility acquisition by gender diverse litigants result in problematic (e.g., narratives counter to self-identity) and, at times, erroneous discourses on sex and gender that homogenize the litigants themselves. When gender diverse persons approach the court with a rights claim, the narrative they present must necessarily limit itself to a normative discourse that the court may understand and, therefore, engage with. Consequently, the everyday lived experiences of gender diverse persons are often deliberately erased from (...) the narrative as litigants mould themselves into the pre-existing normative legal categories of gender and sex. As a result of such mechanisms, the article finds that gender diverse litigants face epistemic injustice in the courts as their legal legibility is constructed within a constraining gender binary paradigm of judicial discourse. The article explores the trajectory of transgender rights in India, through an analysis of case law prior to and post the landmark NALSA decision, to understand how the approach to transgender rights and identities has been shaped by and shapes, in turn, normative conceptions of gender. The article argues for the incorporation of temporal pluralism into the law that would allow courts to hear gender diverse litigant accounts premised on contemporary gender diversity beyond the binary (rather than incontestable prior understandings based in past precedent), which would better account for such social injustices. This paper discusses a central idea of our everyday life—human actions and the role of luck in the moral life. The aim of this paper is to formulate and discuss the problem of moral luck, thereby dealing with the question: ‘what is the status or role of luck in the moral life of an individual?’ Bernard Williams and Thomas Nagel highlight the juxtaposition of the two contradictory terms: ‘Luck’ and ‘Morality’ and used the term ‘moral luck’ which inculcates the view (...) that the factor of luck or fortune can affect the moral worth of an individual. In this context, the paper is specifically concerned with the philosophical problem of moral luck which raises a conceptual tension between morality and responsibility by emphasizing that moral assessment, evaluation and justification of human actions are all subjected to luck. Further, in the light of this philosophical problem, the paper also attempts to postulate a possible moral framework with an aim to analyse and conceptually map the status of the juxtaposition of luck and morality. This paper shall make an attempt to critically reflect on the conceptualization of emotions in the Indian Philosophical systems. To bring out the insight, the paper is divided into three main sections. The first section of the paper entitled ‘The Body-Emotions-Mind Complex and the Question of Self: Understanding the Dualistic Tradition’ will make an analysis of emotions and the mind-body complex vis-à-vis the question of self or consciousness in Indian Philosophy with special reference to the study of Advaita Vedānta and (...) the philosophical position of Upaniṣadic teachings. It will also incorporate the Nyāya account of emotions in the Indian philosophical system. The second section of the paper is entitled as ‘Triguṇa and the Emotional Experience: A Perspective in Sāṃkhya Philosophy’. It will reflect on the systematic presentation of Sāṃkhya philosophical system on account of its relation between the two ontological realities — puruṣa and prakṛti. It is this prakṛti which is constituted of the three guṇas — sattva, rajas and tamas; and therefore is the embodied self having its association with emotions. The third section of the paper entitled ‘Understanding Religious Emotions: Towards a Positive Representation of Emotions in Indian Philosophy’ will make an attempt to critically reflect on the necessary shift required in conceptualizing emotions in the Indian Philosophical systems. That is to say, from a negative connotation of emotions to a more significant positive account of emotions in human-spiritual life. This necessary shift will be directed towards the understanding of Religious Emotions — faith and devotion which can serve as a guiding principle to justify the soteriological approach of Indian Philosophy, i.e. towards pure consciousness. Although Indic perspectives toward nature are now well documented, climate engineering discussions seem to still lack the views from Indic or other non‐Western sources. In this article, I will apply some of the Hindu and Jain concepts such as karma, nonviolence (Ahiṃsā ), humility (Vinaya ), and renunciation (Saṃnyāsa ) to analyze the two primary climate geoengineering strategies of solar radiation management (SRM) and carbon dioxide removal (CDR). I suggest that Indic philosophical and religious traditions such as Hinduism, Buddhism, (...) and Jainism offer ethical concepts to call for humility in all acts of climate engineering leading to a favoring of CDR over SRM and a favoring of lifestyle changes (particularly vegetarianism) over both. I demonstrate these concepts by introducing the five great elements from the Hindu philosophy, two Hindu legends from Hindu mythology, the Indic ethical ideas of karma, renunciation, and humility, and the moral authority of Gandhi. On the life and philosophy of Kundakunda, 2nd century exponent of Jainism.

Background The world is urbanizing rapidly; more than half the world’s population now lives in urban areas, leading to significant transition in lifestyles and social behaviours globally. While offering many advantages, urban environments also concentrate health risks and introduce health hazards for the poor. In Bangladesh, although many public policies are directed towards equity and protecting people’s rights, these are not comprehensively and inclusively applied in ways that prioritize the health rights of citizens. The country is thus facing many issues (...) that raise moral and ethical concerns. Methods A narrative literature review was conducted between October 2016 and November 2017 on issues related to social justice, health, and human rights in urban Bangladesh. The key questions discussed here are: i) ethical dilemmas and inclusion of the urban poor to pursue social justice; and ii) the ethical obligations and moral responsibilities of the state and non-state sectors in serving Bangladesh’s urban poor. Using a Rawlsian theory of equality of opportunity to ensure social justice, we identified key health-related ethical issues in the country’s rapidly changing urban landscape, especially among the poor. Results We examined ethical dilemmas in Bangladesh’s health system through the rural–urban divide and the lack of coordination among implementing agencies. The unregulated profusion of the private sector and immoral practices of service providers result in high out-of-pocket expenditures for urban poor, leading to debt and further impoverishment. We also highlight policy and programmatic gaps, as well as entry points for safeguarding the right to health for Bangladeshi citizens. Conclusions The urban health system in Bangladesh needs a reform in which state and non-state actors should work together, understanding and acknowledging their moral responsibilities for improving the health of the urban poor by engaging multiple sectors. The social determinants of health should be taken into account when formulating policies and programs to achieve universal health coverage and ensure social justice for the urban poor in Bangladesh. This essay is conceived as a contribution to the academic debate on the ethical status of mystical traditions with regard to Jain asceticism in particular and—through comparison of Jain with Advaita Vedanta asceticism—to ideologies of radical quietism more generally. For both Jain and Advaita Vedantic ascetic traditions, the material world, and particularly the body, are the primary obstacles to spiritual development. We deal with the social, physical, and environmental implications of such a worldview, rather than with the (...) practice or the phenomenology or the doctrine of mysticism, which we grant to be an accurate reflection of a particular kind of cosmic experience. We address ethical issues, not metaphysical ones. In our discussion of Jain asceticism, we demonstrate that the basic problem (and promise) of quietism, in almost any cultural form, is the shocking realization it can occasion that the Real has absolutely nothing to do with the social or with any sort of ethical action. We argue that Jain asceticism cannot function as an adequate resource for contemporary ethics. Our normative concerns lie exclusively with the adequacy of Jain quietism in supporting a stable global community and a sustainable natural environment. One can be mystical without being ethical, and ethical without being a mystic. We conclude that the truths of quietism are both very profound and profoundly nonethical. (shrink)

This study examines the variations in corporate social orientations across developed and developing countries in the context of a legitimacy threat. Conceptualizing CSO as signals, the author develops and validates a seven-code index of CSO that identifies executive orientations toward multiple stakeholders. Using this index on CEO shareholder letters from the United States, Germany, and India, the author finds that firms signal a multi-stakeholder image toward employees, communities, and environment during good times to enhance their social license to operate, and (...) yet such signals are not carried through during the threat period. This disconnect in signaling in the wake of a legitimacy threat is indicative of decoupling in corporate orientations and exposes the multi-dimensionality of the CSO concept. The appropriate understanding and fast processing of lengthy legal documents are computationally challenging problems. Designing efficient automatic summarization techniques can potentially be the key to deal with such issues. Extractive summarization is one of the most popular approaches for forming summaries out of such lengthy documents, via the process of summary-relevant sentence selection. An efficient application of this approach involves appropriate scoring of sentences, which helps in the identification of more informative and essential sentences from the document. In this work, (...) a novel sentence scoring approach DCESumm is proposed which consists of supervised sentence-level summary relevance prediction, as well as unsupervised clustering-based document-level score enhancement. Experimental results on two legal document summarization datasets, BillSum and Forum of Information Retrieval Evaluation (FIRE), reveal that the proposed approach can achieve significant improvements over the current state-of-the-art approaches. More specifically it achieves ROUGE metric F1-score improvements of (1−6)% and (6−12)% for the BillSum and FIRE test sets respectively. Such impressive summarization results suggest the usefulness of the proposed approach in finding the gist of a lengthy legal document, thereby providing crucial assistance to legal practitioners. This article critically examines the ways in which the trope of prosthesis has been used in recent theory to understand human-technology relationships. Analyzing the trope from a number of angles, including disability, factory labor practices, mass production, and marketing, the author scrutinizes ways in which technologies are simultaneously wounding and enabling in ways for which the prosthesis trope cannot account.

An ongoing debate in the United States relating to COVID-19 features the purported tension between containing the coronavirus to save lives or opening the economy to sustain livelihoods, with ethical overtones on both sides. Proponents of opening the economy argue that sustaining livelihoods should be prioritized over virus containment, with ethicists asking, “What about the risk to human life?” Defendants of restricting the spread of the virus endorse saving lives through virus containment but contend with the ethical concern “What about (...) people’s livelihoods and individual freedoms?” A commonly held belief is that political ideology drives these differential preferences: liberals are more focused on saving lives, whereas conservatives favor sustaining livelihoods with no additional government intervention in the free-market economy. We examine these lay beliefs among US residents in four studies and find that economic system justification (ESJ), an ideology that defends the prevailing economic system when under threat, is a reliable psychological predictor beyond political ideology. Specifically, compared to those who scored low on ESJ, people who scored high on ESJ judged China as more justified in downplaying the spread of virus to protect its interest in the global free-market economy, supported in-person over online learning, viewed shelter in place as less desirable, and perceived the opening of the Texas economy as more legitimate. We also find that multiple psychological mechanisms might be at work—resistance to market interventions, perceived legitimacy of opening the economy, perceived seriousness of the health crisis, and violation of human rights. Social development organizations increasingly employ artificial intelligence -enabled tools to help team members collaborate effectively and efficiently. These tools are used in various team management tasks and activities. Based on the unified theory of acceptance and use of technology, this study explores various factors influencing employees’ use of AI-enabled tools. The study extends the model in two ways: a) by evaluating the impact of these tools on the employees’ collaboration and b) by exploring the moderating role of AI aversion. Data (...) were collected through an online survey of employees working with AI-enabled tools. The analysis of the research model was conducted using partial least squares, with a two-step model – measurement and structural models of assessment. The results revealed that the antecedent variables, such as effort expectancy, performance expectancy, social influence, and facilitating conditions, are positively associated with using AI-enabled tools, which have a positive relationship with collaboration. It also concluded a significant effect of AI aversion in the relationship between performance expectancy and use of technology. These findings imply that organizations should focus on building an environment to adopt AI-enabled tools while also addressing employees’ concerns about AI. (shrink)

Limiting identification of r.e. indexes for r.e. languages (from a presentation of elements of the language) and limiting identification of programs for computable functions (from a graph of the function) have served as models for investigating the boundaries of learnability. Recently, a new approach to the study of "intrinsic" complexity of identification in the limit has been proposed. This approach, instead of dealing with the resource requirements of the learning algorithm, uses the notion of reducibility from recursion theory to compare (...) and to capture the intuitive difficulty of learning various classes of concepts. Freivalds, Kinber, and Smith have studied this approach for function identification and Jain and Sharma have studied it for language identification. The present paper explores the structure of these reducibilities in the context of language identification. It is shown that there is an infinite hierarchy of language classes that represent learning problems of increasing difficulty. It is also shown that the language classes in this hierarchy are incomparable, under the reductions introduced, to the collection of pattern languages. Richness of the structure of intrinsic complexity is demonstrated by proving that any finite, acyclic, directed graph can be embedded in the reducibility structure. However, it is also established that this structure is not dense. The question of embedding any infinite, acyclic, directed graph is open. (shrink)

In this modern world, a massive amount of data is processed and broadcasted daily. This includes the use of high energy, massive use of memory space, and increased power use. In a few applications, for example, image processing, signal processing, and possession of data signals, etc., the signals included can be viewed as light in a few spaces. The compressive sensing theory could be an appropriate contender to manage these limitations. “Compressive Sensing theory” preserves extremely helpful while signals are sparse (...) or compressible. It very well may be utilized to recoup light or compressive signals with less estimation than customary strategies. Two issues must be addressed by CS: plan of the estimation framework and advancement of a proficient sparse recovery calculation. The essential intention of this work expects to audit a few ideas and utilizations of compressive sensing and to give an overview of the most significant sparse recovery calculations from every class. The system of sevenfold predication of the Jainas, while an invaluable tool in expounding the Jaina doctrine of "non-onesidedness" (Anekāntavāda), has also been criticized for being unsystematic and contradictory. In particular, the fourth predication has been suggested to embrace a kind of irrationality. An analysis is provided here that makes clear the logical basis underlying the seven predications. An interpretation is also offered of the problematic fourth predication that renders the system free from contradiction, and it is suggested that this (...) interpretation best captures the positive spirit of Anekāntavāda. Luxury consumption has grown exponentially across the globe. This growth was fuelled more by the emerging non-Western countries such as India. Consumers in this country are more tech savvy and are a new set of individuals who are totally different from the old, conventional consumers of the Western countries. These new individuals consume luxury to develop their digital self. Unfortunately, this area is not researched in the literature. This article fills this lacuna in extant literature. To address this issue, we (...) comprehensively reviewed the current research from the area of luxury consumption, digital usage, digital self and subsequently developed a conceptual framework. This framework has three stages: individual that has interpersonal, power, symbolic and emotional needs; social dimension that is formulated and develops from the reference groups. Further, individuals develop the ‘we approach’ along with social groups. This approach is associated with strong ties, fortified nods, positive interactions and exclusivity. These elements lead to the development of digital self that provides happiness and pleasure to the individuals in terms of luxury consumption. (shrink)

After being at the periphery for decades, India's proactive engagement with East and Southeast Asia has gradually transformed it into an active participant in Asian regional organizations and multilateral processes. This paper examines early Indian attempts at forging pan-Asian unity and assesses the motivations and impact of its Look East Policy. It evaluates India's changing role towards regional cooperation in South Asia and sub-regional groupings, the impact of domestic politics, and discusses how China has influenced Indian perceptions and strategy towards (...) This paper explores the semantics of a vocative construction that is particularly efficient at coining what I call ‘expressive labels’; these are affect-transmitting expressions that present themselves as apt for identifying their discourse target via speaker affect.
