This paper reports the results of a workshop held in January 2013 to begin the process of establishing standards for e-learning programmes in the ethics of research involving human participants that could serve as the basis of their evaluation by individuals and groups who want to use, recommend or accredit such programmes. The standards that were drafted at the workshop cover the following topics: designer/provider qualifications, learning goals, learning objectives, content, methods, assessment of participants and assessment of the course. Where a person is unable to make medical decisions for themselves, law and practice allows others to make decisions on their behalf. This is common at the end of a person’s life where decision-making capacity is often lost. A further, and separate, decision that is often considered at the time of death (and often preceding death) is whether the person wanted to act as an organ or tissue donor. However, in some jurisdictions, the lawful decision-maker for the donation decision (the (...) ‘donation decision-maker’) is different from the person who was granted decision-making authority for medical decisions during the person’s life. To date, little attention has been given in the literature to the ethical concerns and practical problems that arise where this shift in legal authority occurs. Such a change in decision-making authority is particularly problematic where premortem measures are suggested to maximise the chances of a successful organ donation. This paper examines this shift in decision-making authority and discusses the legal, ethical and practical implications of such frameworks. (shrink)

Le patriarcat au singulier est une construction mythique permise aujourd’hui par la concision et la répétition du message numérique. L’heure est plus que jamais à l’opposition binaire des catégories et à la concurrence entre mouvements. Le mouvement #MeToo a été lancé en 2007 par une femme noire devenue vice-présidente de la fondation Girls for Gender Equity. Il s’agit de construire une communauté de plaignantes, un groupe d’assujetties au binarisme genré, au modelé médiatique des visages de stars, et d’entonner une véritable (...) ode aux méfaits du patriarcat, ce à quoi contribue également le témoignage de Vanessa Springora. Si la reprise de la recherche philosophique demande aujourd'hui à être menée d'une manière radicale, il ne suffit pas de compléter une philosophie déjà existante en y intégrant certains problèmes actuels. En effet, c'est l'esprit lui-même qui a été comme cassé. Le primat de la négation est allé si loin que l'intelligence, dans son fondement, dans sa relation même avec l'être, est véritablement brisée. Aussi est-il nécessaire de redécouvrir en premier lieu le point de départ de toute démarche philosophique, au-delà (...) de cette rupture. Chacun aujourd'hui doit s'interroger sur ce qu'il est comme personne humaine. Dépassant les idéologies pour retrouver le réalisme d'une authentique recherche de la vérité, il doit redécouvrir, à partir de ses propres expériences, ce qui donne à sa vie un sens. (shrink)

The Oyapock River has been the border between France and Brazil since the Treaty of Bern came to resolve a centuries-old dispute between the two states. Only populated by indigenous communities and a few adventurers, the two banks of the river are untouched by any lasting colonial and national settlement before the second half of the 19th century. Penal colonization is the formula adopted by the two states to fill the "void" of a border to be formalized. In this paper, we build upon Bruno Latour’s political writings to address the current impasse regarding algorithms in public life. We assert that the increasing difficulties at governing algorithms—be they qualified as “machine learning,” “big data,” or “artificial intelligence”—can be related to their current ontological thinness: deriving from constricted views on theoretical practices, algorithms’ standard definition as problem-solving computerized methods provides poor grips for affective dissensions. We then emphasize on the role historical and ethnographic studies of algorithms can potentially play (...) in the politicization of algorithms. By both digging into the genealogy of algorithms’ constricted definition and by making their contemporary constitutive relationships more visible, both historical and ethnographic studies can contribute to vascularizing algorithms and making them objects of enlarged disputes. We conclude by giving a flavor of the political potential of the vascularization efforts we call for, using materials from an ethnographic study conducted in a computer science laboratory. (shrink)

Some recent developments in Artificial Intelligence—especially the use of machine learning systems, trained on big data sets and deployed in socially significant and ethically weighty contexts—have led to a number of calls for “transparency”. This paper explores the epistemological and ethical dimensions of that concept, as well as surveying and taxonomising the variety of ways in which it has been invoked in recent discussions. Whilst “outward” forms of transparency may be straightforwardly achieved, what I call “functional” transparency about the inner (...) workings of a system is, in many cases, much harder to attain. In those situations, I argue that contestability may be a possible, acceptable, and useful alternative so that even if we cannot understand how a system came up with a particular output, we at least have the means to challenge it. In this article, we describe a hitherto undocumented fallacy-in the sense of a mistake in reasoning-constituted by a negativity bias in the way that people attribute motives to others. We call this the "worst-motive fallacy," and we conducted two experiments to investigate it. In Experiment 1, participants expected protagonists in a variety of fictional vignettes to pursue courses of action that satisfy the protagonists' worst motive, and furthermore, participants significantly expected the protagonist to pursue a worse course of action than (...) they would prefer themselves. Experiment 2 was a preregistered attempted replication of Experiment 1, including a bigger range of vignettes; the first effect was not replicated for the new vignettes tested but was for the original set. Also, we once again found that participants expected protagonists to be more likely than they were themselves to pursue courses of action that they considered morally bad. We discuss the worst-motive fallacy's relation to other well-known biases as well as its possible evolutionary origins and its ethical consequences. (shrink)

Un hasard malicieux a fait paraître Totalité et infini en 1961, l'année de la mort de Merleau-Ponty. On se rend maintenant compte que le livre de Lévinas était le signe avant-coureur d'un tournant de la phénoménologie française. Alors que la compréhension de l'être-au-monde chez Sartre et Merleau-Ponty excluait tout recours à une transcendance de type idéaliste ou métaphysique, une orientation toute différente s'est peu à peu affirmée. Se tournant vers " l'inapparent ", la phénoménologie s'est mise en quête d'une manifestation (...) originaire ou de la révélation de l'Autre comme tel, jusqu'à se faire la servante d'un discours plus ou moins explicitement théologique. Le présent essai entend mettre en question les présupposés méthodologiques de ce tournant. A quel prix cette mutation s'est-elle opérée? Quels en sont les enjeux et les limites? Une pensée attentive à toutes les facettes de la phénoménologie ne réserve-t-elle pas d'autres possibles? Structure is central to the realist view of mathematical disciplines with intended interpretations and categoricity is a model-theoretic notion that captures the idea of the determination of structure by theory. By considering the cases of arithmetic and (pure) set theory, I investigate how categoricity results might offer support from within to the realist view. I argue, amongst other things, that second-order quantification is essential to the support the categoricity results provide. In this paper, we examine the extent to which the concept of emergence can be applied to questions about the nature and moral justification of territorial borders. Although the term is used with many different senses in philosophy, the concept of “weak emergence”—advocated by, for example, Sawyer (2002, 2005) and Bedau (1997)—is especially applicable, since it forces a distinction between prediction and explanation that connects with several issues in the dis-cussion of territory. In particular, we argue, weak emergentism about borders (...) allows us to distinguish between (a) using a theory of territory to say where a border should be drawn, and (b) looking at an existing border and saying whether or not it is justified (Miller, 2012; Nine, 2012; Stilz, 2011). Many authors conflate these two factors, or identify them by claiming that having one without the other is in some sense incoherent. But on our account—given the concept of emergence—one might unproblematically be able to have (b) without (a); at the very least, the distinction between these two issues is much more significant than has often been recognised, and more importantly gives us some reason to prefer “statist” as opposed to “cultural” theories of territorial borders. We conclude with some further reflections on related matters concerning, firstly, the apparent causal powers of borders, and secondly, the different ways in which borders are physically implemented (e.g., land vs. water). Locke wrote Draft A of the Essay while collaborating with physician Thomas Sydenham. Sydenham held that we are ignorant of nature's internal workings, cannot decide which natural philosophical theories are true and should therefore rely only upon experience. Draft A repeated Sydenham's views — we cannot understand nature's modus operandi and must rely on experience for our knowledge of the world. Equally, we must be agnostic about natural philosophical theories, mechanism included. Locke was not a mechanist in Draft A. Consequently, (...) Locke's account of substance, first articulated in this Draft and repeated in the Essay, was completely independent of the mechanical philosophy. (shrink)

Qu'un interet renouvele se manifeste aujourd'hui pour la versant epistemologique de l'oeuvre de Gaston Bachelard peut se comprendre au regard de l'histoire contemporaine de la philosophie des sciences. Cette histoire a ete dominee durant la plus grande partie du XXe siecle par une doctrine - celle de l'empirisme (ou positivisme) logique - promue a Vienne a la fin des annees 1920 par une institution originale, le Cercle de Vienne qui publie son manifeste en 1929, et s'organise comme un mouvement a (...) visee universelle et progressiste - celui de la conception scientifique du monde. La tradition francaise de la philosophie des sciences a pris d'entree de jeu un tout autre chemin. Si elle ne les a pas ignorees, elle a refuse de souscrire aux theses majeures du positivisme logique lorsqu'il s'est presente a elle. Elle a toujours lie etroitement philosophie et histoire des sciences. Dans le titre de ce petit livre ecrit durant l'annee universitaire 1967-1968 sous la direction de Georges Canquilhem, Dominique Lecourt a avance l'expression d'epistemologie historique pour signaler, a propos de Gaston Bachelard, cette particularite.
