What are the main features that influence our attribution of moral responsibility? It is widely accepted that there are various factors which strongly influence our moral judgments, such as the agent’s intentions, the consequences of the action, the causal involvement of the agent, and the agent’s freedom and ability to do otherwise. In this paper, we argue that this picture is incomplete: We argue that social roles are an additional key factor that is radically underestimated in the extant literature. This paper investigates the relevance of social roles and hierarchies for the attribution of blame and causation in five culturally different countries, namely China, Germany, Poland, the United Arabic Emirates, and the United States of America. We demonstrate that in all these countries, hierarchical differences between the social roles occupied by two agents and associated differences in duties to care for others affect how these two agents are morally and causally judged when they make a decision together. Agents higher in (...) a hierarchy are attributed more blame and considered more causally responsible for an action’s consequences. We also demonstrate that the degree of this effect depends on culture-specific differences in how hierarchies are conceived. (shrink)

In this paper, we call for a new approach to the psychology of free will attribution. While past research in experimental philosophy and psychology has mostly been focused on reasoning- based judgment (“the courtroom approach”), we argue that like agency and mindedness, free will can also be experienced perceptually (“the perceptual approach”). We further propose a new model of free will attribution—the agency model—according to which the experience of free will is elicited by the perceptual cues that prompt the attribution (...) of agency. Our recapitulation of the work by Howe et al. is a clear approval of the passages in which the talent concept is critically questioned. On the other hand, Howe et al. must themselves come to terms with most of the accusations they place at the door of talent researchers. The evidence they present to support the experience concept is lacking with respect to current theoretical and methodological standards.

In this dialogue, Mileva and Albert start to talk about physics and its subject matter, the physical. They end up in a situation that permits causal dependence between separate ontological domains. In this possible world, they continue talking. First, they Socratically agree that the physical is physical and only physical. Then, they call the physical an ontologically homogeneous domain. They then generalise the principle that the physical is causally unaffected by anything non-physical, into the principle that ontologically homogeneous domains (...) do not cause ontologically homogeneous domains. From a modern point of view talking about black hole singularities, they continue discussing the Chandrasekhar limit and the collapse of the physical laws as we know them. Mileva carries a burden and Albert stands up and carries it with her. The burden is an implication of the generalised principle. Relying on parsimony, only ontologically homogeneous domains are forbidden to cause ontologically homogeneous domains. This leaves the door open for ontologically heterogeneous domains to cause ontologically homogeneous domains. Also relying on parsimony, only ontologically homogeneous domains are forbidden to be caused by ontologically homogeneous domains and this allows ontologically heterogeneous domains to be caused by ontologically homogeneous domains. Ontologically heterogeneous domains, thus, are allowed to causally link ontologically homogeneous domains. Albert realises that the mathematical could qualify as an ontologically homogeneous domain and that the theoretical difficulties that are foreseen beyond the Chandrasekhar limit could be addressed by expanding physics into a context that contains also an ontologically heterogeneous domain. The theoretical difficulties beyond the Chandrasekhar limit would be due to an emergent mathematical-physical domain. Mileva concludes that Albert’s theory is not faulty but regional. A global theory would have to include the explanation of the mathematical-physical. (shrink)

This book pieces together the jigsaw puzzle of Einstein's journey to discovering the special theory of relativity. Between 1902 and 1905, Einstein sat in the Patent Office and may have made calculations on old pieces of paper that were once patent drafts. One can imagine Einstein trying to hide from his boss, writing notes on small sheets of paper, and, according to reports, seeing to it that the small sheets of paper on which he was writing would vanish into his (...) desk-drawer as soon as he heard footsteps approaching his door. He probably discarded many pieces of papers and calculations and flung them in the waste paper basket in the Patent Office. The end result was that Einstein published nothing regarding the special theory of relativity prior to 1905. For many years before 1905, he had been intensely concerned with the topic; in fact, he was busily working on the problem for seven or eight years prior to 1905. Unfortunately, there are no surviving notebooks and manuscripts, no notes and papers or other primary sources from this critical period to provide any information about the crucial steps that led Einstein to his great discovery. In May 1905, Henri Poincare sent three letters to Hendrik Lorentz at the same time that Einstein wrote his famous May 1905 letter to Conrad Habicht, promising him four works, of which the fourth one, Relativity, was a rough draft at that point. In the May 1905 letters to Lorentz, Poincare presented the basic equations of his 1905 "Dynamics of the Electron", meaning that, at this point, Poincare and Einstein both had drafts of papers relating to the principle of relativity. The book discusses Einstein's and Poincare's creativity and the process by which their ideas developed. The book also explores the misunderstandings and paradoxes apparent in the theory of relativity, and unravels the subtleties and creativity of Einstein. (shrink)

Thick terms and concepts, such as honesty and cruelty, are at the heart of a variety of debates in philosophy of language and metaethics. Central to these debates is the question of how the descriptive and evaluative components of thick concepts are related and whether they can be separated from each other. So far, no empirical data on how thick terms are used in ordinary language has been collected to inform these debates. In this paper, we present the first empirical (...) study, designed to investigate whether the evaluative component of thick concepts is communicated as part of the semantic meaning or by means of conversational implicatures. While neither the semantic nor the pragmatic view can fully account for the use of thick terms in ordinary language, our results do favour the semanticist interpretation: the evaluation of a thick concept is only slightly easier to cancel than semantically entailed content. We further discovered a polarity effect, demonstrating that how easily an evaluation can be cancelled depends on whether the thick term is of positive or negative polarity. (shrink)

It has recently been argued that normative considerations play an important role in causal cognition. For instance, when an agent violates a moral rule and thereby produces a negative outcome, she will be judged to be much more of a cause of the outcome, compared to someone who performed the same action but did not violate a norm. While there is a substantial amount of evidence reporting these effects, it is still a matter of debate how this evidence is to (...) be interpreted. In this paper, we engage with the three most influential classes of explanations, namely, (a) the Norm‐Sensitive Cognitive Process View, (b) the Normative Concept View, and (c) the Pragmatics View. We will outline how these theories explain the empirical results and in what ways they differ. We conclude with a reflection on how well these strategies do overall and what questions they still leave unanswered. (shrink)

How evaluative are legal texts? Do legal scholars and jurists speak a more descriptive or perhaps a more evaluative language? In this paper, we present the results of a corpus study in which we examined the use of evaluative language in both the legal domain as well as public discourse. For this purpose, we created two corpora. Our legal professional corpus is based on court opinions from the U.S. Courts of Appeals. We compared this professional corpus to a public corpus, (...) which is based on blog discussions on the internet forum Reddit. While many linguistic phenomena can give insights into evaluativity, we investigated the use of a wide selection of evaluative adjectives (more specifically, thick adjectives) to gain a more comprehensive picture of the degree of evaluativity in the legal domain. Our analysis shows that legal professionals use thick terms less evaluatively than laypeople, which suggests that legal texts are less evaluative than ordinary discussions. This result, more generally, supports the philosophical idea that thick concepts may vary in their evaluative intensity. (shrink)

Sam po sebi, Mediteran se predstavlja kao jedna opća imenica takvog opsega da predstavlja rod u kojem je velik dio opće europske kulture uvijek jedna od njegovih vrsta. No, ipak, riječ je o dojmu koji ne može težiti precizno utvrđenoj konstataciji već jednoj općoj opservaciji koja samo pokazuje da zamisao o zahvaćanju u smisao Mediterana kao nasljeđa ili suvremenosti predstavlja jedan ogroman, ali nikad dokraja dovršen (...) posao.Kao opće i široko obuhvatno ime, mediteranski prostor, onaj virtualni i onaj stvarni, otvorio je prostor mnogim iznimnim osobnostima. koje ukazuju na pojedinačni značaj svake od njih. Neizbježno, one ne mogu u kontekstu mediteranskog prostora predstavljati više od pojedinačnog slučaja koji nikad ne može obuhvatiti cjelokupni doseg pojma mediteranskog. Ali ono što mogu jest obznaniti one vlastite dosege koji ukazuju na vrijednost onoga što im je u mediteranskom prostoru otvoreno da misle, stvaraju i žive. U kontekstu Mediterana tu je uvijek prisutna jedna dimenzija napetosti između općeg i pojedinačnog, između napora da se izrazi duh vremena i nasljeđa, vlastito slaganje i neslaganje s njim, ali i promišljanje koje može probiti duh danog. Jedan od takvih filozofskih i umjetničkih osobnosti jest Albert Camus. Kao jedna od danas gotovo zaboravljenih figura mišljenja i umjetnosti, njegovo propitivanje humaniteta u djelima kao što su Mit o Sizifu i Pobunjeni čovjek svojevremeno su ostavili dubok trag iza sebe. Iako on nije napisao svoje pismo o humanizmu kao što je to učinio Heidegger , njegovo se djelo čini kao poseban slučaj jednog općeg govora o humanizmu suprotstavljen i zasigurno najpoznatijem intelektualcu svog doba, Jeanu Paulu Sartreu, intelektualnom hegemonu onoga doba. Postoji iskušenje da se Camusa u toj konstelaciji dovede u vezu s, recimo, stoicizmom, no time bismo promašili bit u odgovaranju na pitanje koliko bi njegov humanizam imao snage biti suvremeni humanizam, a koliko nova tehnika interpretiranja istog. Stoga mi je namjera propitati, suvremenu mogućnost tvorbi Camusovih promišljanja o povijesti, humanizmu, politici i umjetnosti, kao i danas uočljivi pomak u odnosu na prijašnje dosege u propitivanju etičnosti, politike i umjetnosti na mediteranskom prostoru.The cultural, philosophical, historical and artistic heritage of the Mediterranean is a measureless universe of processes, information, syntheses and imaginations. In itself, the Mediterranean portrays a general noun of such scope that it represents a kind in which a large part of general European culture is always but one of its sub varieties. However, this is but an impression, which cannot aspire to become a precisely verifiable or verified statement, or a general observation, which only demonstrates that the idea of penetrating the meaning of the Mediterranean as a heritage or contemporaneity represents an enormous yet never fully completed task.The Mediterranean space – both the virtual and actual – as a general and widely inclusive toponym has opened its doors to countless exceptional individuals, who point to the particular significance of each. Inevitably, within the context of the Mediterranean space they cannot exemplify more than a particular case that can never embrace the range of the Mediterranean concept as a whole. Yet, what they can do is disclose their own reaches that point to the value of that which is open to them in the Mediterranean realm to be thought, created and lived. A dimension of tension between the general and the particular, between the effort to express thespirit of time and heritage, one’s agreement and disagreement with it, as well as one’s reflections capable of penetrating the spirit of the given – are invariably present within the context of the Mediterranean. One such philosophical and artistic individual is Albert Camus. As one of the almost forgotten figures of thought and art today, his questioning humanity in The Myth of Sisyphus and The Rebel once left a profound trace. Although he never wrote a letter on humanism as Heidegger did , his work appears to be a special case of a general speech on humanism opposed to even surely the most famed intellectual of his time, Jean-Paul Sartre, the intellectual hegemon of his time. Within this constellation one can easily be tempted to compare Camus with, for example, Stoicism, but by doing so one would fail to answer the question of whether his humanism has the strength to be a contemporary humanism or just a novel interpretation technique of the same. This paper intends to examine the contemporary possibilities of constructing Camus’s reflections on history, humanism, politics and art, as well as the today distinct shift in relation to the earlier reaches of the studies into ethicality, politics and art within the space of the Mediterranean. Since its inception, quantum mechanics has faced a series of “mysteries” that emerge from it if we consider this scientific theory from a realistic point of view. In the early development of the theory, scientists like Albert Einstein noticed the consequences of accepting a theory like this, which allow phenomena such as non-locality. This led a part of the scientific community to believe that quantum mechanics was an incomplete theory, since there should be variables that might explain those “disturbing” (...) phenomena such as the correlation between entangled particles.Different interpretations of quantum mechanics have been proposed that have tried to reveal or explain the reality underlying its formalism. One of those interpretations is the “Transactional Interpretation” of quantum mechanics, advocated mainly by physicist John G. Cramer. According to this interpretation, quantum events are understood as causal interactions between delayed waves traveling forward in time and advanced waves traveling backward in time. This interpretation opens the door to accept a model of causation to the past or retrocausation.Authors like Phil Dowe or Huw Price have shown a favorable attitude toward the model of retrocausation because it seems to be capable of effectively solve some of the most disturbing features derived from quantum mechanics. Despite the intuitive cost is rather high, retrocausation is one of the possible interpretations for the results of the correlation between entangled particles to provide us with an explanatory framework with some interesting advantages.In this paper we explore such advantages, as the retrocausation gives us a generalizable explanatory model for all cases of this type and assumes processes and entities that are not only in the field of speculation but allow certain possibilities of testing. Also, we will rescue the importance of not-predictive explanatory models as has been the case in other fields of natural sciences, provided that those model do not be ad hoc due to restrictions that prevent its application to any case. Presents a guide to the basics of quantum mechanics and measurement.

Imagine you and your friend Pierre agreed on meeting each other at a café, but he does not show up. What is the difference between a friend’s not showing up meeting? and any other person not coming? In some sense, all people who did not come show the same kind of behaviour, but most people would be willing to say that the absence of a friend who you expected to see is different in kind. In this paper, I will spell (...) out this difference by investigating laypeople’s conceptualisation of absences of actions in four experiments. In languages such as German, French, Italian, or Polish, people consider a friend’s not coming an omission. Any other person’s not coming, in contrast, is not considered an omission at all, but just a mere nothing. This use of the term omission differs from the usage in English, where ‘omission’ refers to all kinds of absences. In addition, ‘omission’ is not even an everyday term, but invented by philosophers for the sake of philosophical investigation. In other languages, ‘omission’ is part of an everyday vocabulary. Finally, I will discuss how this folk concept of omission could be made fruitful for philosophical questions. (shrink)

Acts that are considered undesirable standardly violate our expectations. In contrast, acts that count as morally desirable can either meet our expectations or exceed them. The zone in which an act can be morally desirable yet not exceed our expectations is what we call the zone of moral indifference, and it has so far been neglected. In this paper, we show that people can use positive terms in a deflated manner to refer to actions in the zone of moral indifference, (...) whereas negative terms cannot be so interpreted. (shrink)

The omission effect, first described by Spranca and colleagues, has since been extensively studied and repeatedly confirmed. All else being equal, most people judge it to be morally worse to actively bring about a negative event than to passively allow that event to happen. In this paper, we provide new experimental data that challenges previous studies of the omission effect both methodologically and philosophically. We argue that previous studies have failed to control for the equivalence of rules that are violated (...) by actions and omissions. Once equivalent norms are introduced, our results show that the omission effect is eliminated, even if the negative outcome of the behavior is foreseen and intended by the agent. We show that the omission effect does not constitute a basic, moral disposition but occurs exclusively in complex moral situations. Building on these empirical results, we cast doubt onto two influential explanations of the omission effect, the Causal Relevance Hypothesis and the Overgeneralization Hypothesis, and provide a novel explanation of the phenomenon. Furthermore, we discuss various ramifications of the interplay between our understanding of omissions and legal systems. (shrink)

Is it tautological to call an action "wrongful discrimination?" Some philosophers and political theorists answer this question in the affirmative and claim that the term "discrimination" is intrinsically evaluative. Others agree that "discrimination" usually conveys the action’s moral wrongness but claim that the term can be used in a purely descriptive way. In this paper, we present two corpus studies and two experiments designed to test whether the folk concept of discrimination is evaluative. We demonstrate that the term has undergone (...) a historical development and is nowadays no longer used purely descriptively. Further, we show that this evaluation cannot be cancelled without yielding a contradiction. We conclude that the descriptive use of "discriminatory" is a thing of the past. (shrink)

This book empirically investigates the social practice of ascribing moral responsibility to others for the things they failed to do, and it discusses the philosophical relevance of this practice.0In our everyday life, we often blame others for things they failed to do. For instance, we might blame our neighbour for not watering our plants during our vacation. Interestingly, the attribution of blame is typically accompanied by the attribution of causal responsibility. We do not only blame our neighbour for not watering (...) our plants, but we do so because we believe that not watering the plants caused them to dry up and die. In this book, I investigate how we make moral and causal judgments about omissions. I discuss different philosophical perspectives on this matter, and I outline to what extent the actual social practice is in line with philosophical theories. (shrink)

In the recent literature on concepts, two extreme positions concerning animal minds are predominant: the one that animals possess neither concepts nor beliefs, and the one that some animals possess concepts as well as beliefs. A characteristic feature of this controversy is the lack of consensus on the criteria for possessing a concept or having a belief. Addressing this deficit, we propose a new theory of concepts which takes recent case studies of complex animal behavior into account. The main aim (...) of the paper is to present an epistemic theory of concepts and to defend a detailed theory of criteria for having concepts. The distinction between nonconceptual, conceptual, and propositional representations is inherent to this theory. Peirce's Sign Theory, or Semiotic, is an account of signification, representation, reference and meaning. Although sign theories have a long history, Peirce's accounts are distinctive and innovative for their breadth and complexity, and for capturing the importance of interpretation to signification. For Peirce, developing a thoroughgoing theory of signs was a central philosophical and intellectual preoccupation. The importance of semiotic for Peirce is wide ranging. As he himself said, “[…] it has never been in my power to study anything,—mathematics, ethics, (...) metaphysics, gravitation, thermodynamics, optics, chemistry, comparative anatomy, astronomy, psychology, phonetics, economics, the history of science, whist, men and women, wine, metrology, except as a study of semiotic”. (SS 1977, 85–6). Peirce also treated sign theory as central to his work on logic, as the medium for inquiry and the process of scientific discovery, and even as one possible means for 'proving' his pragmatism. Its importance in Peirce's philosophy, then, cannot be underestimated. -/- Across the course of his intellectual life, Peirce continually returned to and developed his ideas about signs and semiotic and there are three broadly delineable accounts: a concise Early Account from the 1860s; a complete and relatively neat Interim Account developed through the 1880s and 1890s and presented in 1903; and his speculative, rambling, and incomplete Final Account developed between 1906 and 1910. The following entry examines these three accounts, and traces the changes that led Peirce to develop earlier accounts and generate new, more complex, sign theories. However, despite these changes, Peirce's ideas on the basic structure of signs and signification remain largely uniform throughout his developments. Scott Sturgeon has recently challenged Pollock’s account of undercutting defeaters. The challenge involves three primary contentions: the account is both too strong and too weak, undercutting defeaters exercise their power to defeat only in conjunction with higher-order beliefs about the basis of the lower-order beliefs whose justification they target, and since rebutting defeaters exercise their power to defeat in isolation, rebutting and undercutting defeaters work in fundamentally different ways. My goal is to reject each of these contentions. I maintain that (...) Sturgeon fails to show that Pollock’s account of undercutting defeaters is either too strong or too weak, his own account of how undercutting defeaters exercise their power to defeat is both too strong and too weak, and his claim that rebutting and undercutting defeaters work in fundamentally different ways is mistaken. Although the index is one of the best known features of Peirce's theory of signs there is little appreciation of Peirce's theory of the index amongst contemporary philosophers of language. Amongst Peirce scholars, the value placed on Peirce's account is greater, but is largely based on Thomas Goudge's paper, "Peirce's Index" (Goudge, 1965). Despite marking a crucial milestone in our comprehension of Peirce's theory, our understanding of indices and indexical reference has grown markedly over the last forty years. Time has (...) now come, then, to develop the work that Goudge began and to provide a full analysis of Peirce's account that makes its value to the philosophy of language clear. Casuistry is a traditional method of interpreting and resolving moral problems. It focuses on the circumstances of particular cases rather than on the application of ethical theories and principles. After a brief history of casuistry, the method is explained and its relation to theory and principles is discussed.

This essay focuses on how casuistry can become a useful technique of practical reasoning for the clinical ethicist or ethics consultant. Casuistry is defined, its relationship to rhetorical reasoning and its interpretation of cases, by employing three terms that, while they are not employed by the classical rhetoricians and casuists, conform, in a general way, to the features of their work. Those terms are (1) morphology, (2) taxonomy, (3) kinetics. The morphology of a case reveals the invariant structure of the (...) particular case whatever its contingent features, and also the invariant forms of argument relevant to any case of the same sort: these invariant features can be called topics. Taxonomy situates the instant case in a series of similar cases, allowing the similarities and differences between an instant case and a paradigm case to dictate the moral judgment about the instant case. This judgment is based, not merely on application of an ethical theory or principle, but upon the way in which circumstances and maxims appear in the morphology of the case itself and in comparison with other cases. Kinetics is an understanding of the way in which one case imparts a kind of moral movement to other cases, that is, different and sometimes unprecedented circumstances may move certain marginal or exceptional cases to the level of paradigm cases. In conclusion, casuistry is the exercise of prudential or practical reasoning in recognition of the relationship between maxims, circumstances and topics, as well as the relationship of paradigms to analogous cases. The literature on ethical decision-making is rooted in a cognitive perspective that emphasizes the role of moral judgment. Recent research in interpersonal dynamics, however, has suggested that ethics revolves around an individual’s perceptions and views of others. We draw from both literatures to propose and empirically examine a contingent model. We theorize that whether the individual relies on cognitions about the ethical issue or perceptions of others depends on the level of social consensus surrounding the issue. We test our hypotheses (...) in three studies. Results suggest that not only does social consensus determine whether an individual relies on ethical cognitions about the issue or perceptions of others, but also that an individual’s view of self is an important moderator in these relationships. Moral philosophers draw an important distinction between two kinds of moral responsibility. An agent can be directly morally responsible, or they can be derivatively morally responsible. Direct moral responsibility, so many believe, presupposes that the agent could have behaved differently. However, in some situations, we hold agents responsible even though they could not have behaved differently, such as when they recklessly cause an accident or do not take adequate precautions to avoid harmful consequences. Moral philosophers typically argue that what we (...) ascribe in these cases is derivative moral responsibility. In this paper, I apply this conceptual distinction to the experimental debate about so-called folk-compatibilism. I argue that experimental philosophers have failed to consider this distinction when designing experiments and interpreting their results. I demonstrate that while compatibilism requires judgments of direct moral responsibility, participants in some of the most influential studies ascribed derivative moral responsibility. For this reason, these studies do not speak in favour of compatibilism at all. (shrink)
