Gender is perhaps the most pervasive, fundamental, and universally accepted way we separate and categorize human beings. Yet in recent years, U.S. courts and administrative state agencies have confronted a growing challenge from individuals demanding to have their gender reclassified. Transgender people create a profound category crisis for social institutions built on the idea that biological sex is both immutable and dichotomous. During the past four decades, the central legal question shifted from how to allocate specific individuals to categories to (...) the permeability of gender categories themselves. This analysis of 38 judicial gender determinations provides a glimpse of the literal construction of the gender order and of the ways institutions gender individuals. It also provides powerful evidence that cultural anxieties about reproduction and the heterosexual, conjugal family underscore institutional efforts to manage the uncertainty of postmodern gender identities. This article investigates the often cited and dismissed, but rarely examined, relationship between legalizing same-sex marriage and polygamy. Employing a comparative historical analysis of U.S. and South African jurisprudence, ideology, and cultural politics, we examine efforts to expand, restrict, and regulate the gender and number of legally recognized conjugal bonds. South African family jurisprudence grants legal recognition to both same-sex marriage and polygyny, while the United States prohibits and resists both. However, social and material conditions make it easier to practice (...) family diversity in the U.S. than in South Africa. Our analysis of the very different histories of polygamy and same-sex marriage in the two societies suggests the centrality of racial politics to marriage regimes, yielding paradoxical narratives about the implications of legal same-sex marriage for the future of polygamy and sexual democracy. If there is a slippery marital slope, we argue, it does not tilt in a singular or expected direction. (shrink)

Good agricultural practices certification schemes have been promoted to enhance agricultural sustainability. This study seeks to explain the adoption of GAP certification schemes through an analysis of the role of personal values in guiding such choice. It is a departure from approaches taken in previous studies in the area. Through the laddering interview technique of means-end chain analysis, a hierarchical value map was systematically schematized to illustrate the relationship between adoption of GAP, outcomes, and personal values driving the choice. The (...) personal values identified in this study cluster under the headings of “better life”, “religious responsibility”, “healthy life”, and “responsible farmer”. Amongst these, the main evidence pointed to the desire to have “better life” through the enhanced financial position that is perceived to arise as a consequence of GAP adoption as being of primary importance. These findings suggest that, while profit is not the sole end driver of adoptive behavior, GAP certification schemes have to be seen as lucrative and to enhance the goals of achieving core personal values. Other empirical information in this study also has significant policy implications. It is a key finding of this paper that effective promotions of GAP should be tailored and targeted at specific segments of the farmer population. (shrink)

Child assent is recommended in addition to parental consent when enrolling children in clinical research; however, appreciation and relevance ascribed to these concepts vary in different contexts, and information on attitudes towards storage of biological samples for future research is limited, especially in developing countries. We assessed caregivers’ understanding and appreciation of consent and assent procedures, and their attitudes towards use of stored blood samples for future research prior to enrolling a child in clinical research. A total of 17 in-depth (...) interviews were conducted with primary caregivers of children at enrolment or on the immediate follow-up date. All caregivers recalled significant amount information from the study information sheet and were able to appropriately link such information to the consent process. While all participants confirmed information received prior to blood sampling as adequate, a few noted that the purpose was not sufficiently well communicated. Caregivers felt children were cognitively vulnerable, and prone to decisions that were not necessarily in their best interest. Nearly all caregivers felt it was their right and responsibility to overrule objections from their ward’s regarding enrolment into specific study or receipt of a therapeutic procedure. There were no objections or concerns regarding use of stored biological samples for future research purposes. There is thus, a need to improve understanding of caregivers on the information provided during the informed consent process. Context-specific studies on the age of assent in specific populations are needed. (shrink)

Owing to the adverse impact of the COVID-19 pandemic on world economies, it is expected that information flows between commodities and uncertainties have been transformed. Accordingly, the resulting twisted risk among commodities and related uncertainties is presumed to rise during stressed market conditions. Therefore, investors feel pressured to find safe haven investments during the pandemic. For this reason, we model a mixture of asymmetric and non-linear bi-directional causality between global commodities and uncertainties at different frequencies through the information flow theory. (...) Consequently, we utilise the complete ensemble empirical mode decomposition with adaptive noise and the Rényi effective transfer entropy techniques to establish the dynamic flow of information. The intrinsic mode functions from the CEEMDAN are carefully extracted into multi-frequencies through cluster analysis to reconstruct the series into high, medium, and low frequencies in addition to the residue. We utilise daily data from December 31st, 2019, to March 31st, 2021, to provide insights into the COVID-19 pandemic. The correlation coefficients and variances demonstrate that the high frequency which measures the short-term dynamics is the dominant frequency, suggesting short-lived market fluctuations relative to real economic growth for institutional investors. Moreover, outcomes from the multi-frequency entropy indicate a negative bi-directional causality of information flow between global commodities and uncertainties, especially in the long term. Generally, the findings present pertinent inferences for portfolio diversification, policy decisions, and risk management schemes for global commodities and markets volatilities. We, therefore, advocate that market volatilities act as effective hedges for global commodities, and they clearly act as balancing assets rather than substitutes in the long-term dynamics of the COVID-19 pandemic. Investors who delayed in investing within financial markets of commodities and market volatilities are likely to minimise their portfolio risks. (shrink)

Most philosophical discussion of the particle concept that is afforded by quantum field theory has focused on free systems. This paper is devoted to a systematic investigation of whether the particle concept for free systems can be extended to interacting systems. The possible methods of accomplishing this are considered and all are found unsatisfactory. Therefore, an interacting system cannot be interpreted in terms of particles. As a consequence, quantum field theory does not support the inclusion of particles in our ontology. (...) In contrast to much of the recent discussion on the particle concept derived from quantum field theory, this argument does not rely on the assumption that a particulate entity be localizable. Further arguments are offered in defence of the position that the variant of quantum field theory (QFT) that should be subject to interpretation and foundational analysis is axiomatic quantum field theory. I argue that the successful application of renormalization group (RG) methods within alternative formulations of QFT illuminates the empirical content of QFT, but not the theoretical content. RG methods corroborate the point of view that QFT is a case of the underdetermination of theory by empirical evidence. I also urge (...) caution in extrapolating interpretive conclusions about QFT from the application of RG methods in other contexts (e.g., condensed matter physics). Quantum field theory (QFT) presents a genuine example of the underdetermination of theory by empirical evidence. There are variants of QFT—for example, the standard textbook formulation and the rigorous axiomatic formulation—that are empirically indistinguishable yet support different interpretations. This case is of particular interest to philosophers of physics because, before the philosophical work of interpreting QFT can proceed, the question of which variant should be subject to interpretation must be settled. New arguments are offered for basing the interpretation of QFT (...) on a rigorous axiomatic variant of the theory. Analogies between classical statistical mechanics and quantum field theory played a pivotal role in the development of renormalization group methods for application in the two theories. This paper focuses on the analogies that informed the application of RG methods in QFT by Kenneth Wilson and collaborators in the early 1970's. The central task that is accomplished is the identification and analysis of the analogical mappings employed. The conclusion is that the analogies in this case study are formal analogies, and not (...) physical analogies. That is, the analogical mappings relate elements of the models that play formally analogous roles and that have substantially different physical interpretations. Unlike other cases of the use of analogies in physics, the analogical mappings do not preserve causal structure. The conclusion that the analogies in this case are purely formal carries important implications for the interpretation of QFT, and poses challenges for philosophical accounts of analogical reasoning and arguments in defence of scientific realism. Analysis of the interpretation of the cutoffs is presented as an illustrative example of how physical disanalogies block the exportation of physical interpretations from from statistical mechanics to QFT. A final implication is that the application of RG methods in QFT supports non-causal explanations, but in a different manner than in statistical mechanics. (shrink)

The new concept of embodied cognition theories has been enthusiastically studied by the cognitive sciences, by as well as such disparate disciplines as philosophy, anthropology, neuroscience, and robotics. Embodiment theory provides the framework for ongoing discussions on the linkage between “low” cognitive processes as perception and “high” cognition as language processing and comprehension, respectively. This review gives an overview along the lines of argumentation in the ongoing debate on the embodiment of language and employs an ALE meta-analysis to illustrate and (...) weigh previous findings. The collected evidence on the somatotopic activation of motor areas, abstract and concrete word processing, as well as from reported patient and timing studies emphasizes the important role of sensorimotor areas in language processing and supports the hypothesis that the motor system is activated during language comprehension. The consensus view among philosophers of physics is that relativistic quantum field theory does not describe particles. That is, according to QFT, particles are not fundamental entities. How is this negative conclusion compatible with the positive role that the particle notion plays in particle physics? The first part of this chapter lays out multiple lines of negative argument that all conclude that QFT cannot be given a particle interpretation. These arguments probe the properties of the `particles' in standard formulations of (...) QFT and the limited applicability of `particle' representations. The second part of the chapter surveys proposals for non-fundamental roles that the particle concept plays in particle physics. The conclusion suggests directions for future philosophical research. Following the experimental discovery of the Higgs boson, physicists explained the discovery to the public by appealing to analogies with condensed matter physics. The historical root of these analogies is the analogies to models of superconductivity that inspired the introduction of spontaneous symmetry breaking into particle physics in the early 1960s. We offer a historical and philosophical analysis of the analogies between the Higgs model of the electroweak interaction and the Ginsburg-Landau and Bardeen-Cooper-Schrieffer models of superconductivity, respectively. The conclusion of (...) our analysis is that both sets of analogies are purely formal in virtue of the fact that they are accompanied by substantial physical disanalogies. In particular, the formal analogies do not map the temporal, causal, or modal structures of SSB in superconductivity to temporal, causal, or modal structures in the Higgs model. These substantial physical disanalogies mean that analogies to models of superconductivity cannot supply the basis for the physical interpretation of EW SSB; however, an appreciation of the contrast between the physical interpretations of SSB in superconductivity and the Higgs model does help to clarify some foundational issues. Unlike SSB in superconductivity, SSB in the Higgs sector of the Standard Model is neither a temporal nor a causal process. We discuss the implications for the `eating' metaphor for mass gain in the Higgs model. Furthermore, the distinction between the phenomenological GL model and the dynamical BCS model does not carry over to EW models, which clarifies the desiderata for so-called `dynamical' models of EW SSB. Finally, the development of the Higgs model is an illuminating case study for philosophers of science because it illustrates how purely formal analogies can play a fruitful heuristic role in physics. BackgroundInstitutions of higher learning are persistently struggling with issues of academic dishonesty such as plagiarism, despite the availability of university policies and guidelines for upholding academic integrity.MethodologyThis was a descriptive qualitative study conducted on 37 students of a Healthcare Ethics course at an Australian tertiary institution from February 2016 to October 2018. The purpose of the study was to explore the reasons for plagiarism detected the TurnitinR plagiarism checking software and extensive review of manuscripts. The interviews were conducted in private (...) rooms and in strict confidence. Thematic analysis was manually done.ResultsFour major themes namely, lack of interest; pressure of time with competing priorities; lack of understanding of the policy on academic honesty, and “the determined students” were identified. Sub themes under lack of interest were lack of preparation and effort, low self-efficacy, poor studying techniques, and convenience of internet sources. Under pressure of time, the subthemes were, misplaced priorities, procrastination, high workloads, poor planning, competing interests, and the perception of availability of time at the start of the semester. Regarding lack of understanding of the policy on academic honesty, the subthemes identified were, lake of awareness of plagiarism, lack of awareness of acceptable similarity, conflicting messages from tutors and confusion with high school learning. The determined students were those that either made all effort to reduce plagiarism but still remained high, used the another language at home other than English, had poor paraphrasing techniques or lacked resources for English language editing.ConclusionThere are varied and diverse reasons for plagiarism. There is a need to systematically reinforce and educate students on issues pertaining to academic dishonesty and their associated implications. (shrink)

The Higgs model was developed using purely formal analogies to models of superconductivity. This is in contrast to historical case studies such as the development of electromagnetism, which employed physical analogies. As a result, quantum case studies such as the development of the Higgs model carry new lessons for the scientific realism--anti-realism debate. I argue that, by breaking the connection between success and approximate truth, the use of purely formal analogies is a counterexample to two prominent versions of the 'No (...) Miracles' Argument for scientific realism, Psillos' refined explanationist defence of realism and the Argument from History of Science for structural realism. The NMA is undermined, but the success of the Higgs model is not miraculous because there is a naturalistically acceptable explanation for its success that does not invoke approximate truth. I also suggest some possible strategies for adapting to the counterexample for scientific realists who wish to hold on to the NMA in some form. (shrink)

Currently the focus of a heated debate among indigenous peoples, human rights advocates, crop breeders, pharmaceutical companies, conservationists, social scientists, and lawyers, the proposal would allow impoverished people in biologically rich areas to realize an economic return from resources under their care. Monetary compensation could both validate their knowledge and provide them with an equitable reward for sharing it, thereby compensating biological stewardship and encouraging conservation.

This study reports on action research efforts that were aimed at developing institutional arrangements beneficial for soil fertility improvement. Three stages of action research are described and analyzed. We initially began by bringing stakeholders together in a platform to engage in a collaborative design of new arrangements. However, this effort was stymied mainly because conditions conducive for learning and negotiation were lacking. We then proceeded to support experimentation with alternative arrangements initiated by individual landowners and migrant farmers. The implementation of (...) these arrangements too ran into difficulties due to intra-family dynamics and ambiguities regarding land tenure. Further investigations to find out how ambiguities could be tackled revealed that the local actors themselves had taken initiatives towards developing institutional innovations to reduce ambiguities. However, there is still considerable scope for further development of these self-organized innovations. The article ends with a reflection on inter-disciplinary action research, where it is argued that making “mistakes” is an inherent and necessary characteristic in action research that aims to address complex social issues. Combining the theory of international scholars such as Brofenbrenner, Bruner, Donaldson (...) and Freire with practical experience, Doreen Grant indicates the improvements in children’s active learning when parents participate fully in the process of education. Federal funding for abortion was eliminated; no permanent offices that would have advocated for women’s issues were created; and bills supporting domestic violence shelters, support for “displaced homemakers,” and quotas for female-owned businesses were defeated or extremely diluted. In addition, no additional states ratified the Equal Rights Amendment (ERA) and several states rescinded earlier ratification votes. Some of these failures can be attributed to the general loss of feminist momentum and the emergence of a conservative backlash in the late 1970s. Anti-ERA organizing fueled the rise of a conservative “family values” movement that would shape social policies for more than a generation, and neoliberal economic conservatives were challenging the welfare-state programs that feminists sought to expand. But in Washington, there was an addition challenge —the unreliable support of Carter himself. Despite his promises, Carter felt that by appointing women he had met his commitment to feminists and did little to support feminist policy goals that went beyond eliminating discrimination. This paper makes an important contribution to the history of feminist action by looking in detail at the efforts of Jimmy Carter’s feminist appointees to influence policy. In particular, it discusses the actions of the most visible feminist in the White House, Margaret “Midge” Costanza. Carter named Costanza director of the Office of Public Liaison, a department that was created to manage relations between the White House and citizens’ groups. Her position as the first woman to serve as Assistant to the President, in concert with her gregarious nature and strong support for women’s issues, made Costanza a very visible symbol of affirmative action for Carter. Yet Costanza, like many other high-level feminist appointees, met opposition within the White House when she tried to advance women’s issues. Her persistent advocacy contributed to her marginalization within the White House. Philosophical analysis of spontaneous symmetry breaking (SSB) in particle physics has been hindered by the unavailability of rigorous formulations of models in quantum field theory (QFT). A strategy for addressing this problem is to use the rigorous models that have been constructed for SSB in quantum statistical mechanics (QSM) systems as a basis for drawing analogous conclusions about SSB in QFT. On the basis of an analysis of this strategy as an instance of the application of the same mathematical formalism (...) to different domains and as an instance of drawing analogies between domains, I conclude that certain structural explanations can be exported from QSM to QFT but that causal explanations cannot. Recent case studies have revealed that purely formal analogies have been successfully used as a heuristic in physics. This is at odds with most general philosophical accounts of analogies, which require analogies to be physical in order to be justifiably used. The main goal of this paper is to supply a philosophical account that justifies the use of purely formal analogies in physics. Using Bartha’s (2010) articulation model as a starting point, I offer precise definitions of formal and physical analogies (...) and propose a new submodel of analogical reasoning that accounts for the successful use of purely formal analogies in the development of renormalization group methods for use in particle physics in the early 1970’s (Fraser 2020). Two distinctive features of this new applied mathematics submodel for analogical reasoning are that the conclusion of the argument from analogy includes both an entire model (and not only a hypothesis or a prediction) and the construction procedure for this model. A third important difference from arguments from physical analogy is that only the prima facie plausibility of the conclusion is established, and not stronger types of plausibility associated with confirmation. The use of purely formal analogies is justified because they are suited to supporting conclusions of this sort. Formulating a general philosophical account of analogies that covers purely formal analogies also serves two additional purposes: (1) to highlight the features of this case that are novel in the context of examples of analogies traditionally considered by philosophers and (2) to establish that physicists should not automatically dismiss purely formal analogies when evaluating heuristics for the development of new models. ObjectivesTo investigate the views of Human Research Ethics Committee (HREC) members and of researchers concerning the human research ethics review process in Australia.To examine whether there are differences between views of researchers and HREC members.Design and settingRegistrants at the NHMRC Ethics in Human Research Conference held in Canberra in May 2005 were surveyed by anonymous questionnaire comprising 14 questionnaire items and background demographic questions.ResultsOf the 407 registrants, 252 completed the questionnaire (62% response rate). Respondents comprised 219 (87%) HREC members or (...) administrators, and 33 (13%) researchers who were not HREC members. Researchers generally had a less positive attitude to the HREC process than did HREC members. Researchers were less likely to believe that HRECs: make clear and reasonable decisions in an acceptable timeframe; provide informal guidance to researchers; and have the necessary expertise to make appropriate decisions. The largest difference related to relations between researchers and HRECs: 82.5% of HREC members thought relations were good, but only 59.3% of researchers held this view. Despite these differences, both HREC members and researchers held the view that the ethics review process in Australia is working well.ConclusionAlthough our study suggests that both HREC members and researchers are satisfied with the process of human research ethics review in Australia, there are areas of concern that merit further investigation. These include the timeliness and clarity of HREC decisions, the methodological expertise available to HRECs and the basis for HREC decisions. (shrink)

On the basis of evidence drawn from the Waste book, Westfall and Nicholas have argued that Newton arrived at his second law of motion by reflecting on the implications of the first law. I analyze another argument in the Waste book which reveals that Newton also arrived at the second law by another very different route. On this route, it is the consideration of the third law and the principle of conservation of motion—and not the first law—that prompts Newton to (...) formulate the second law. The existence of these two routes is significant because each employs a distinct kind of reasoning about forces. Whereas the Nicholas–Westfall route via the principle of inertia bears the mark of Descartes’s influence, the alternative route proceeds from the action–reaction principle, which is widely regarded as an original Newtonian contribution to mechanics. This paper explores the consequences of transhumanism on free will based on the metaphysical aspect of the Botho perspective. Botho is an indigenous philosophy, prominent in Botswana, that expresses the essence of being a person. A human person from the Botho metaphysical point of view embodies material and immaterial aspects. This study seeks to answer the question: “Would certain transhuman changes to the material body affect the human person’s ability to judge and choose and hence the capacity for free will?” (...) According to the Botho perspective, determinism and free will would be compatible in unenhanced human beings. From this viewpoint, human beings are free insofar as they can act in accordance with reason, which is a determined process. This framework will be applied to hypothetically enhanced human beings and argue that transhumanism does not necessarily undermine free will. This study will also show that some forms of biotechnological enhancement could in fact improve free will, while other forms could limit free will without eliminating it. New knowledge will be gained by applying a prominent metaphysical orientation in the Botho worldview, particularly its discussion of determinism and free will, to the debate about enhancements. It will be demonstrated that most Africans, including Batswana, are soft determinists who embrace both determinism and free will so that they are not incompatible and can co-exist. (shrink)
