In the January 2002 issue of Studies in Philosophy and Education, Erevelles (Voices of Silence) argues that recent debates over a means of communication known as facilitated communication reveal a tendency by virtually all discussions to ``uphold traditional notions of autonomy.'' While agreeing with Erevelles' basic critique concerning the societal dominance of the notion that independent agency resides in the individual, the author points out that Erevelles' case would be considerably more compelling, and also more sympathetic to the struggles of (...) people with disabilities who use facilitation to communicate, were her analysis to include a detailed accounting of the ``evidence'' that objectivists find inconvenient and not worth mentioning. In redefining logic, philosophers need to go back to the Aristotelian roots of the subject, to expand the boundaries of the subject to include informal logic and to give up false oppositions between informal and formal logic.

Use of argumentation methods applied to legal reasoning is a relatively new field of study. The book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. This paper attempts to synthesize the Winchian stress on constitutive rules with the Marxian stress on material relationships by developing the concept of emergently material social relations. Such relationships, it is argued, arise from the constitutive rules that constitute a group's way of life. Although such relationships thus are derivative from the conscious rule-following behavior of actors, nevertheless they have an objective existence independent of actors' specific awareness. It is argued that such material relations are an important mechanism beyond the (...) cultural rules through which our behavior is constrained, enabled, and motivated. Yet the Winchian tradition in general and contemporary structuration theory in particular have tended to peripheralize the notion of material relations, treating them largely as epiphenomenal abstractions. This, it is argued, is a mistake and the source of an important lacuna in structuration theory. In particular, because structuration theory decenters the actor, conflates the distinction between regulative and constitutive rules, and peripheralizes social relations, it lacks an adequate explanation of motivation, as symptomized by its inordinate appeal to the unconscious. The concept of emergently material social relations overcomes this problem and offers a reintegration of the Marxian and the Winchian traditions. (shrink)

In this paper it is shown how plausible reasoning of the kind illustrated in the ancient Greek example of the weak and strong man can be analyzed and evaluated using a procedure in which the pro evidence is weighed against the con evidence using formal, computational argumentation tools. It is shown by means of this famous example how plausible reasoning is based on an audience’s recognition of situations of a type they are familiar with as normal and comprehensible in their (...) shared common knowledge. The paper extends previous work on this example by using three new multiagent argumentation schemes closely related to the scheme for argument from negative consequences. (shrink)

The aim of this paper is to make it clear how and why begging the question should be seen as a pragmatic fallacy which can only be properly evaluated in a context of dialogue. Included in the paper is a review of the contemporary literature on begging the question that shows the gradual emergence over the past twenty years or so of the dialectical conception of this fallacy. In this paper, I try to make a bundle theory of objects consistentwith a temporal parts theory of object persistence. To that end,I propose that such bundles are made up of tropes includingthe co-instantiation relation.

This article seeks to answer why there are two different versions of Meno’s Paradox. I argue that the dilemma contained in Socrates’s version is a pre-existing puzzle, familiar to both Meno and Socrates before their discussion. The two versions of the paradox are thus different because Meno’s version is a mistaken attempt to remember the puzzle contained in Socrates’s version. Although Meno’s version is a mistaken attempt to state Socrates’s version, it is a philosophically richer puzzle that makes three interesting (...) points about inquiry and recognition. After arguing that Socrates’s version is unsound and that Meno’s version is an attempt to recollect or remember it, I analyze Meno’s version in detail. In closing, I consider the relationship between the notion of recognition, which figures prominently in Meno’s version, and the theory of recollection, suggesting that the latter may have arisen as an attempt to explain the origin of moral intuitions. This article considers what can be learned regarding the ethical acceptability of intrusive interventions intended to halt the spread of infectious disease (‘Infection Control’ measures) from existing ethical discussion of intrusive interventions used to prevent criminal conduct (‘Crime Control’ measures). The main body of the article identifies and briefly describes six objections that have been advanced against Crime Control, and considers how these might apply to Infection Control. The final section then draws out some more general lessons from the foregoing (...) analysis for the ethical acceptability of different kinds of Infection Control. (shrink)

Tomando a análise do príncipe novo e as longas referências à oposição entre as noções de Virtù e de Fortuna, que constam principalmente da obra Política e História, pretendemos mostrar por que a leitura de Althusser do filósofo florentino nos remete a uma discussão contemporânea da filosofia política acerca dos fundamentos do poder e da própria filosofia. Values intersect with science in three primary ways. First, there are values, particularly epistemic values, which guide scientific research itself. Second, the scientific enterprise is always embedded in some particular culture and values enter science through its individual practitioners, whether consciously or not. Finally, values emerge from science, both as a product and process, and may be redistributed more broadly in the culture or society. Also, scientific discoveries may pose new social challenges about values, though the values themselves may be (...) conventional. Some philosophers have argued that we do not hear sounds as located in the environment. Others have objected that this straightforwardly contradicts the phenomenology of auditory experience. And from this they draw metaphysical conclusions about the nature of sounds—that they are events or properties of vibrating surfaces rather than waves or sensations. I argue that there is a minimal, but recognizable, notion of audition to which this phenomenal objection does not apply. While this notion doesn’t correspond to our ordinary notion (...) of auditory experience, it does—in conjunction with our lack of an uncontroversial individuation of the senses and recent interest in distinctively multisensory features of perceptual experiences—raise the possibility of more expansive notions of audition, including some that do plausibly count as corresponding to our everyday notion of audition, that lack the spatial phenomenology cited in the objection. Until this possibility is ruled out, the phenomenal objection and metaphysical conclusions drawn from it remain inconclusive. (shrink)

In Categorisation in Indian Philosophy: Thinking Inside the Box, Jessica Frazier has brought together an impressive array of scholars who have contributed nine essays, plus an introductory and concluding chapter, both written by her, which collectively provide a most fruitful perspective for examining classical South Asian traditions of thought. Creating categorial frameworks was certainly a prolific activity among the ancient and medieval authors of the darśanas, and indeed these authors drew heavily from pre-scholastic texts and language to build their systems. In the early nineteenth century, France clearly dominated Oriental studies in Europe. A decline of this dominance began with the "Florist" controversy, a debate from 1825 to 1829 over the aims of Oriental scholarship. This clash of methods almost tore the Société Asiatique apart and succeeded in setting Orientalist scholars in France on an exacting, scientific course that eclipsed the Romantic, literary roots out of which their studies had sprung. Ironically, the adoption of this new agenda inhibited the further growth (...) of Oriental studies in France and was indicative of the relative decline of science there. (shrink)

Philosophers are often thought to be in the business of analysing concepts, in particular, concepts taken to be fundamental in human thought and practice: truth, goodness, beauty, knowledge, meaning, rightness, causation, to name just a few. But what can we expect from such analyses? Can we expect a comprehensive account of one concept in terms of one or more others? Can we expect to reduce these kinds of concepts to concepts which are taken to be more fundamental? This study is (...) concerned with a particular approach to conceptual analysis, minimalism, which, in general, offers very modest answers to these questions. Minimalist theories, by and large, hold that the strategy for analysing concepts ought not to go much further than the collection of some rather ordinary, ‘platitudinous’ thoughts about those concepts. Accordingly, minimalist theories do not often encourage ambitious pro jects of giving a comprehensive analysis of one concept in terms of another, where this process encourages the construction of such biconditional claims as ‘X falls under concept F iff X falls under concept G’. Just how far we are to extend our analysis beyond the point of a collection of platitudinous principles is a point of contention between different types of minimalist theories. This study has three main aims. Firstly, it aims to give a taxonomy of minimalist theories. Secondly, it aims to examine in detail the types of minimalist theories pertinent to the study of truth, and propose the best view available. Thirdly, it aims to examine how the minimalist methodology may be extended to other normative concepts, taking the concept of goodness as a case study. (shrink)

Understanding is not of the same kind in all contexts. Children learn the kind of understanding that is appropriate in particular contexts largely through a process of enculturation. This study examines some aspects of 10-year-old children's conceptions of understanding. There was evidence that they had admissible conceptions of understanding in general but may be unable to distinguish unaided between the kinds of understanding that are relevant in different disciplines. The existence of either a maximum or a minimum for a uniformly continuous mapping f of a compact interval into ${\mathbb{R}}$ is established constructively under the hypotheses that f′ is sequentially continuous and f has at most one critical point.

Two classically equivalent, but constructively inequivalent, strict convexity properties of a preference relation are discussed, and conditions given under which the stronger notion is a consequence of the weaker. The last part of the paper introduces uniformly rotund preferences, and shows that uniform rotundity implies strict convexity. Given the strength of Archer's case for a sexual selection account, he is too accommodating of the social roles alternative. We present data on historical changes in violent crime contradicting that perspective, and discuss recent evidence showing how an evolutionary perspective predicts sex similarities and differences responding in a flexible and functional manner to adaptively relevant triggers across different domains.

Regional integration over the past decade has facilitated a huge flow of foreign direct investment (FDI) into Latin America. Less is known, however, about why these newforeign enterprises decided to enter specific markets. This study investigates three recent investments in Costa Rica: two by U.S.-based multinational corporations (MNCs) and another by an MNC based in Spain. The behavior of these MNCs is examined in their initial bargaining and subsequent operations. Through the lens of political economy, this study concludes that Costa (...) Rica’s stable democratic institutions and formalized economic links through multilateral and regional trade and investment accords constitute an advanced factor of comparative advantage that attracted foreign investment to Costa Rica and induced the MNCs to become responsive to host country interests. In contrast to classical natural law theory and traditional individualist liberalism, James Luther Adams develops a version of natural law doctrine grounded in liberal religion.
