Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die (...) Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. It is the purpose of the book to consider how religious beliefs and cultic rituals were given expression in the world of the Greek citizen - the functions performed by the religious personnel, and the place that religion occupied in individual, (...) social and political life. The chapters cover first ritual and then myth, rooting the account in the practices of the classical city while also taking seriously the world of the imagination. For this edition the bibliography has been substantially revised to meet the needs of a mainly student, English-speaking readership. In the Preussen contra Reich case of 1932, Carl Schmitt’s theories on equal chance and law in extreme conditions are interpreted and applied in a court of law, firstly by Schmitt himself, then, going contrary to Schmitt’s interpretation, by Dr. Arnold Brecht and Dr. Hans Peters. This paper will first present the basis of the two theories from Schmitt’s “Legality and Legitimacy,” namely, equal chance and the need for extraordinary measures. Then this paper will focus on (...) the diverging legal interpretations of these two theories, as presented in court by different legal theorists. These divergent interpretations of “equal chance” and “law in extreme conditions,” as presented in the aforementioned case, have yet to reach an international readership, as the case itself has never been fully translated into English. Finally, this paper will question the practical application of the two theories in the reality of the empirical world, which in turn question the relationship between any parliamentary legislative system and law. In 19th Century Transkei, crowds would gather to watch whole herds of cattle charging over several kilometres in the popular sport of uleqo. This sport became untenable due to environmental conditions and colonial responses to those conditions. Horses replaced cattle in the racing tradition and uleqo was effectively relegated to a footnote in the history of the area. This article draws together the few remaining descriptions of uleqo in the Eastern Cape. It does so to ask two main questions: what (...) can we learn about uleqo's exclusion? And, what might including the remnants of uleqo offer? In answering these two questions this article will draw upon the idea of an 'artefact, which is simultaneously a remnant and a defect in an image. Here, 'artefact' is used also to refer to archival fragments, and to the distortions that ignoring them may have produced. By focusing on uleqo, it is argued, we can appreciate some neglected ways in which the people of the now-Eastern Cape altered their daily practices in response to the colonial project. (shrink)

SummaryThis paper analyses the revival of Pliny's Naturalis historia within the scientific culture of the late eighteenth and early nineteenth centuries, focusing on a French effort to produce an edition with annotations by scientists and scholars. Between the Renaissance and the early eighteenth century, the Naturalis historia had declined in scientific importance. Increasingly, it was relegated to the humanities, as we demonstrate with a review of editions. For a variety of reasons, however, scientific interest in the Naturalis historia grew in (...) the second half of the eighteenth century. Epitomizing this interest was a plan for a scientifically annotated, Latin-French edition of the Naturalis historia. Initially coordinated by the French governmental minister Malesherbes in the 1750s, the edition was imperfectly realized by Poinsinet a few decades later. It was intended to rival two of the period's other distinguished multi-volume books of knowledge, Diderot and D'Alembert's Encyclopédie and Buffon's Histoire naturelle, to which we compare it. Besides narrating the scientific revival of the Historia naturalis during this period, we examine its causes and the factors contributing to its end in the first half of the nineteenth century. This book starts from a first general observation: there are very diverse ways to frame and convey scientific knowledge in texts. It then analyzes texts on mathematics, astronomy, medicine and life sciences, produced in various parts of the globe and in different time periods, and examines the reasons behind the segmentation of texts and the consequences of such textual divisions. How can historians and philosophers of science approach this diversity, and what is at stake in dealing with it? The book (...) addresses these questions, adopting a specific approach to do so. In order to shed light on the diversity of organizational patterns and rhetorical strategies in scientific texts, and to question the rationale behind the choices made to present such texts in one particular way, it focuses on the issue of text segmentation, offering answers to questions such as: What was the meaning of segmenting texts into paragraphs, chapters, sections and clusters? Was segmentation used to delimit self-contained units, or to mark breaks in the physical appearance of a text in order to aid reading and memorizing, or to cope with the constraints of the material supports? In politics, we often observe stasis when, at first sight, no reason exists for such policy blockades. In contrast., we sometimes see policy change when one would expect blockades resulting from veto points or countervailing majorities. How can we explain these contradictory results concerning policy stability? In order to solve this theoretical puzzle, we develop an agent-based model (ABM). We combine established models of veto player theory (Tsebelis 2002: Ganghof-Bräuninger 2006) with the findings of political sociology and party competition. By (...) aggregating previous party-level findings, we show that dynamic representation (Stimson et. al. 1995) provides an additional mechanism that can explain these macro-level outcomes. Parties behaving responsively to their electorate do not automatically guarantee perfect responsivity on the party system level. Further, if opposition parties also fear punishment by the electorate for government inaction, the opposition behaves more accommodatingly than previous approaches have predicted. (shrink)

The aim of this study was to highlight the analysis and the interpretations of the Muslim scholars over the Christian doctrine of the Trinity, emphasizing the relationship between the Christianity and Islam over this concept. The study adopted a comparative and phenomenological approach to study the doctrine of Trinity as it required a comparison of the Christian ideology with the Islamic. The use of the inductive method further helped n collecting and examining scientific material from its sources and analyzing them (...) in the light of the religious texts like the Bible, the Quran and the Sunnah. The study constantly referred to the Quran, and the Sunnah to build the foundation for all criticism of this doctrine. The study revealed that the views and opinions of the Muslim scholars aimed primarily to clarify the doctrine of the Trinity. They unanimously refuted this doctrine of Trinity as having neither any monotheistic meaning nor any authenticity in religious terms. The study concludes that neither the Quran nor the Bible allowed doctrines such as the Trinity to be practiced and believed in. All the Muslim scholars selected for this study denied and exposed the falsehood of the doctrine of Trinity and refuted it logically, calling on people to abandon and cease believing in it. These findings clarified that Jesus was a human prophet sent by Allah and ascribing him the status of a god is against the monotheistic belief of both Islam and Christianity. (shrink)

Modern (western) healthcare with its many remarkable innovations has failed to prevent either the pandemic of life style-related diseases now accounting for over 2/3rd of illness and healthcare cost globally, or cure them. Most are preventable and reversible with a change in lifestyle. Since less than 3% of western healthcare budgets are spent on health promotion and disease prevention this is unlikely to change. Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. The study aims to unfold the linguistic strategies employed by the former prime minister of Pakistan Imran Khan in his speech delivered at the 76th session of the United Nations General Assembly in the year 2021. However, the primary objective has been to explore the functions these linguistics strategies performed to convey the target meanings to the global audience. Fairclough 3D model has been employed as the framework of this study. Hence, the population of the study included the multiple speeches (...) delivered by the former prime minister Imran Khan to UNGA throughout his tenure while the researcher selected a particular sample of only one speech given in 2021 through purposive sampling. The findings revealed the constant use of multiple linguistic strategies by the former prime minister to portray the positive image of Pakistan in front of the whole world by highlighting the importance of global peace. The famous pithy aphorisms that Carl Schmitt used to open his major works - 'the sovereign is he who decides on the exception', 'the concept of the state presupposes the concept of the political', etc. - have become a part of the common discourse of contemporary scholarship on politics and the law. The theoretical framework that animates these slogans, however, has remained somewhat opaque. It has often been (...) argued that there is no such framework, that Schmitt was a situational thinker whose works are best understood as interventions in concrete political debates that do not add up to a grand theoretical vision. The existence of neural correlates of consciousness (NCC) is not enough for philosophical purposes. On the other hand, there's more to NCC than meets the sceptic's eye. (I) NCC are useful for a better understanding of conscious experience, for instance: (1) NCC are helpful to explain phenomenological features of consciousness – e.g., dreaming. (2) NCC can account for phenomenological opaque facts – e.g., the temporal structure of consciousness. (3) NCC reveal properties and functions of consciousness which cannot be elucidated either (...) by introspective phenomenology or by psychological experiments alone – e.g., vision. (II) There are crucial problems and shortcomings of NCC: (1) Correlation implies neither causation nor identity. (2) There are limitations of empirical access due to the problem of other minds and the problem of self-deception, and (3) due to the restrictions provided by inter- and intraindividual variations. (4) NCC cannot be catched by neuroscience alone because of the externalistic content of representations. Therefore, NCC are not sufficient for a naturalistic theory of mind, (5) nor are they necessary because of the possibility of multiple realization. (III) Nevertheless, NCC are relevant and important for the mind-body problem: (1) NCC reveal features that are necessary at least for behavioral manifestations of human consciousness. (2) But NCC are compatible with very different proposals for a solution of the mind-body problem. This seems to be both advantageous and detrimental. (3) NCC restrict nomological identity accounts. (4) The investigation of NCC can refute empirical arguments for interactionism as a case study of John Eccles' dualistic proposals will show. (5) The discoveries of NCC cannot establish a naturalistic theory of mind alone, for which, e.g., a principle of supervenience and a further condition – and therefore philosophical arguments – are required. Ethical theories have been largely focused on finding and clarifying certain amoral principles. However fruitful the communication of moral principles for providing orientation in modern society might be, a serious omission has been made in that the problem of implementation is not addressed. Two fundamental question have neither been raised nor answered: Why should self‐interested individuals follow the proposed moral principles in their daily conduct? Are societal institutions of such a design that is in the power of the individuals to (...) follow these moral principles? It is shown in this article that an economic theory of morals does systematically address these two questions and therefore provides a firm basis for discussing the possibilities and boundaries of following the moral principles inherent in the long history of moral philosophy. This chapter addresses the distinction between private and public and the difference between ‘public’ and ‘official’. Drawing on a comparative analysis of Asian cities, it looks at the ways in which the local, the national and the global levels, which serve different, sometimes contrasting, interests, are negotiated and reconciled in the city. The chapter suggests that different forms of reconciliation have brought about an alternative ‘insitutionalisation’ of the public space. Such an institutionalisation is reflected in the access to, and dissemination (...) of, information—e.g., access to the media—and, above all, in the control over the common goods. The public sphere is used to voice discontent, leading to a new definition of the ‘common good’; that is, the inclusion, or non-exclusion, of large sections of the population which, though initially marginal, can become significant in shaping urban politics. Barsalou's theory of perceptual symbol systems is considered from a metacognitive perspective. Two examples are discussed in terms of the proposed perceptual symbol theory. First, recent results in research on feeling-of-knowing judgement are used to argue for a representation of familiarity with input cues. This representation should support implicit memory. Second, the ability of maintaining a theory of other people's beliefs (theory of mind) is considered and it is suggested that a purely simulation-based view is insufficient to explain the available (...) evidence. Both examples characterize areas where Barsalou's theory would benefit from additional detail. (shrink)
