Organi zaduzeni za sprovodjenje zakona u Srbiji se mogu okarakterisati kao camera opskura: neprozirnost preovladava. Ovo ne uliva mnogo poverenja javnosti: istrazivanja koja su sprovele ili narucile UN otkrila su da se samo doktorima i politicarima manje veruje nego sudijama i tuziteljima. Korupcija predstavlja prekrsaj koji se veoma retko prijavljuje, buduci da zrtve imaju osecaj da vlast ne mari za korupciju - zasto je onda prijavljivati? Obimna statisticka analiza slucajeva korupcije koje su obradili tuzilastvo i sudovi pokazala je da se (...) metafora camera obskura mora preraditi: pored toga sto su neprozirne, institucije zaduzene za sprovodjenje zakona se ponasaju kao proizvoljna kutija. Antikorupcijska politika se ne moze razaznati niti u tuzilastvu, niti pak u sudstvu. Ishodi sudskog sistema u pogledu gonjenja i kaznjavanja su izgleda statisticki slucajni. Kvalitativna analiza najozbiljnijih slucajeva korupcije pokazala je u kolikoj meri se oni takodje pojavljuju u svim slojevima drustva. Po pitanju ovih slucajeva drzava nije reagova na zalbe koje su joj upucivale sopstvene institucije. Vlast je bila troma i po pitanju drugih problema. Uprkos strategiji za borbu protiv korupcije, uputno je pitati da li vlast zaista brine. (shrink)

In the age of Big Data, companies and governments are increasingly using algorithms to inform hiring decisions, employee management, policing, credit scoring, insurance pricing, and many more aspects of our lives. Artificial intelligence systems can help us make evidence-driven, efficient decisions, but can also confront us with unjustified, discriminatory decisions wrongly assumed to be accurate because they are made automatically and quantitatively. It is becoming evident that these technological developments are consequential to people’s fundamental human rights. Despite increasing attention to (...) these urgent challenges in recent years, technical solutions to these complex socio-ethical problems are often developed without empirical study of societal context and the critical input of societal stakeholders who are impacted by the technology. On the other hand, calls for more ethically and socially aware AI often fail to provide answers for how to proceed beyond stressing the importance of transparency, explainability, and fairness. Bridging these socio-technical gaps and the deep divide between abstract value language and design requirements is essential to facilitate nuanced, context-dependent design choices that will support moral and social values. In this paper, we bridge this divide through the framework of Design for Values, drawing on methodologies of Value Sensitive Design and Participatory Design to present a roadmap for proactively engaging societal stakeholders to translate fundamental human rights into context-dependent design requirements through a structured, inclusive, and transparent process. A growing body of research can be found in which roboticists are designing for reciprocity as a key construct for successful human–robot interaction (HRI). Given the centrality of reciprocity as a component for our moral lives (for moral development and maintaining the just society), this paper confronts the possibility of what things would look like if the benchmark to achieve perceived reciprocity were accomplished. Through an analysis of the value of reciprocity from the care ethics tradition the richness of reciprocity (...) as an inherent value is revealed: on the micro-level, as mutual care for immediate care givers, and on the macro-level, as foundational for a just society. Taking this understanding of reciprocity into consideration, it becomes clear that HRI cannot achieve this bidirectional value of reciprocity; a robot must deceive users into believing it is capable of reciprocating to humans or is deserving of reciprocation from humans. Moreover, on the macro-level, designing social robots for reciprocity threatens the ability and willingness to reciprocate to human care workers across society. Because of these concerns, I suggest re-thinking the goals of reciprocity in social robotics. Designing for reciprocity in social robotics should be dedicated to the design of robots to enhance the ability to mutually care for those that provide us with care, as opposed to designing for reciprocity between human and robot. In this paper a corporate social responsibility audit is developed following the underlying methodology of the quality award/excellence models. Firstly the extent to which the quality awards already incorporate the development of social responsibility is examined by looking at the Malcolm Baldrige National Quality Award and the European Quality Award. It will be shown that the quality awards do not yet include ethical aspects in relation to social responsibility. Both a clear definition of social responsibility and an improved audit instrument (...) are required. A definition and an audit instrument are developed which stimulate movement in that direction and help organisations to reflect on their position in relation to social responsibility. (shrink)

Wellbeing describes how good life is for the person living it. Wellbeing comes in degrees. Subjective theories of wellbeing maintain that for objects or states of affairs to benefit us, we need to have a positive attitude towards these objects or states of affairs: the Resonance Constraint. In this article, we investigate to what extent subjectivism can plausibly account for degrees of wellbeing. There is a vast literature on whether preference-satisfaction theory – one particular subjective theory – can account for (...) degrees of wellbeing. This is generally taken to be problematic. However, other subjective theories – namely, desire-satisfaction, judgment- and value-fulfillment theories – do not suffer from the same difficulties. We introduce two models of degrees of wellbeing a subjectivist can employ: the Relative and the Absolute Model, and defend the claim that both models face difficulties. In particular, we argue that a subjectivist theory should describe instances of depression as instances of low degrees of wellbeing. We also argue that a reduction of desires may sometimes improve one’s degree of wellbeing, an idea we call the Epicurean Intuition. We then argue that the Relative Model fails to account for the disbenefit of certain types of depression, while the Absolute Model fails to meet a central commitment of subjectivism – the Resonance Constraint – and is unable to accommodate the Epicurean Intuition. The upshot of the paper is that subjectivist theories cannot account for degrees of well-being in a plausible way. (shrink)

What is empiricism? There can be no authoritative answer to any such question. A historian of philosophy can at best try to call what is common to philosophers who either identified themselves, or have traditionally been identified, as empiricists. But what has set those philosophers apart from others, and especially from those whom they criticized, may not be captured in common views or doctrines. The historian may, in trying to fix the label, rely tacitly on a view of what philosophical (...) positions are and how they are to be identified. Finally, it is typical of philosophers who decide to range themselves under some pre-existing banner ("empiricism", "pragmatism", "phenomenology") to change the very philosophy they take on, as much as did their historical heroes in their day. I will here try to give a sustained argument about what empiricism cannot be, and then enter upon a tentative exploration of what it should be (taken to be). (shrink)

Since Kripke, philosophers have distinguished a priori true statements from necessarily true ones. A statement is a priori true if its truth can be established before experience, and necessarily true if it could not have been false according to logical or metaphysical laws. This distinction can be captured formally using two-dimensional semantics. There is a natural way to extend the notions of apriority and necessity so they can also apply to questions. Questions either can or cannot be resolved before experience, (...) and either are or are not about necessary facts. Classical two-dimensionalism has no account of question meanings, so it has to be combined with a framework for question semantics in order to capture these observations. It is shown in [14] how two-dimensional semantics can be combined with inquisitive semantics, in which questions are analyzed in terms of information. The present paper investigates the logic of two-dimensional inquisitive semantics, and provides a complete proof system. (shrink)

This paper resolves some puzzles regarding Spinoza’s appropriations and rejections of various aspects of Bacon’s methodology, and uses these solutions to resolve some long-standing puzzles concerning Spinoza’s modus operandi in the TTP. We argue first that, appearances to contrary, Spinoza takes a consistent line in his assessment of Bacon’s epistemic approach. We argue that Spinoza follows Bacon in grounding his overall epistemic method in a “historiola mentis” (a brief account or history of the mind), and that differences between Spinoza’s and (...) Bacon’s respective historiola mentis can explain Spinoza’s embrace of this inductive method for his interpretation of Scripture in the TTP, as well as his general abandonment of Bacon’s inductive method in the metaphysical investigation of the Ethics. In short, we argue that the “historiola mentis” constructed by Bacon depicts the intellect as an error-prone faculty that needs be continuously restrained by observation and experimentation—a depiction which motivates Bacon’s reformed inductive empiricism. Spinoza accepts this depiction in regard to a subset of the mind’s ideas—the ideas of the imagination, and hence sees the inductive method as suitable for interpreting Scripture. But contra Bacon, Spinoza’s “historiola mentis” also shows that the human mind includes a subset of ideas that yield true, certain knowledge of things “infinite” and sub specie aeternitatis. Spinoza finds these “intellectual” ideas to be quite useful for systematic metaphysics, but of limited use for interpreting historical texts like Scripture. (shrink)

Over the past years, the intersubjective dimension of psychotic disorders, including schizophrenia, has gained increasing phenomenological attention. Psychopathologists and philosophers have developed ideas on how the social aspects of psychotic symptoms and experiences could be understood, in particular in their relation to the ipseity disturbance model, namely the idea that schizophrenia is essentially a disorder of the minimal self. This commentary is a response to Contextual Integrity as a General Conceptual Tool for Evaluating Technological Change by Elizabeth O’Neill (Philosophy & Technology (2022)). It argues that while contextual integrity (CI) might be an useful addition to the toolkit of approaches for ethical technology assessment, a CI approach might not be able to uncover all morally relevant impacts of technological change. Moreover, the inherent conservatism of a CI approach might be problematic in cases in which we encounter new kinds of (...) morally problematic situations, such as climate change, or when technology reinforces historically grown injustices. There are two dominant trends in the humanitarian care of 2019: the ‘technologizing of care’ and the centrality of the humanitarian principles. The concern, however, is that these two trends may conflict with one another. Faced with the growing use of drones in the humanitarian space there is need for ethical reflection to understand if this technology undermines humanitarian care. In the humanitarian space, few agree over the value of drone deployment; one school of thought believes drones can provide a (...) utility serving those in need while another believes the large scale deployment of drones will exacerbate the already prevalent issues facing humanitarian aid providers. We suggest in this paper that the strength of the humanitarian principles approach to answer questions of aid provision can be complimented by a technology-facing approach, namely that of robot ethics. We have shown that for humanitarian actors we ought to be concerned with the risks of a loss of contextualization and de-skilling. For the beneficiary, we raise three concerns associated with the threat to the principle of humanity for this group: a loss of dignity by reducing human-to-human interactions; a threat to dignity through a lack of informational transparency; and, a threat to dignity by failing to account for the physiological and behavioral impacts of the drone on human actors. Although we acknowledge the obstacles associated with understanding the physiological and behavioral impacts we insist that the moral acceptability and desirability of drones in humanitarian contexts is dependent on the findings from such studies and that tailored ethical guidelines for drone deployment in humanitarian action be created to reflect the results of such studies. ### ­ In Who shall go first? A multicriteria approach to patient selection for first clinical trials of cardiac xenotransplantation, Kögel et al recommend the inclusion of patients who (1) have a (high) medical need for an allograft, (2) have the capacity to benefit from a xenograft, (3) have a ‘real’ choice between enrolment in a first-in-human clinical trial and an alternative life-sustaining treatment option and (4) have no clear record of previous non-compliance.1 As the authors discuss, patient selection must (...) promote the goal of gaining reliable and valid knowledge about the risks and benefits of cardiac xenotransplantation. While the four criteria outlined above certainly promote this goal, we argue it is crucial to add a fifth criterion emphasising the need to include diverse populations, particularly regarding sex, age, ethnicity and socioeconomic background.i In this commentary, we present two arguments for our claim and discuss the impact of neglecting diversity from the first trials on. ### The scientific rationale for including diverse populations First, including diverse populations in the first clinical trials of cardiac xenotransplantation enhances the scientific value of the data by assessing safety and efficacy among various populations. On Anscombe's view, intentional actions are characterized by a specific type of knowledge (practical knowledge) possessed by the agents that perform them. Recently, interest in Anscombean action theory has been renewed. Sarah Paul argues that Anscombean action theory faces a serious problem: It fails to discriminate between an action’s intended aim or purpose and its foreseen side effects. Since Anscombeans conceive practical knowledge as the formal cause of intentional actions, Paul dubs this a problem of “deviant formal causation.” In this (...) paper I will show that Anscombean action theory can escape Paul’s critique by employing a sufficiently developed conception of practical knowledge. It will turn out that Anscombeans can precisely capture the difference between intended aim and foreseen side effect in terms of differences in the agent’s knowledge. (shrink)

Dynamic body feedback is used in dance movement therapy, with the aim to facilitate emotional expression and a change of emotional state through movement and dance for individuals with psychosocial or psychiatric complaints. It has been demonstrated that moving in a specific way can evoke and regulate related emotions. The current study aimed to investigate the effects of executing a unique set of kinetic movement elements on an individual mover’s experience of happiness. A specific sequence consisting of movement elements that (...) recent studies have related to the feeling of happiness was created and used in a series of conditions. To achieve a more realistic reflection of DMT practice, the study incorporated the interpersonal dimension between the dance movement therapist and the client, and the impact of this interbodily feedback on the emotional state of the client. This quantitative study was conducted in a within-subject design. Five male and 20 female participants participated in three conditions: a solo executed movement sequence, a movement sequence executed with a DMTh who attuned and mirrored the movements, and a solo executed movement sequence not associated with feelings of happiness. Participants were only informed about the movements and not the feelings that may be provoked by these movements. The effects on individuals were measured using the Positive and Negative Affect Schedule and visual analog scales. Results showed that a specific movement sequence based on movement elements associated with happiness executed with a DMTh can significantly enhance the corresponding affective state. An additional finding of this study indicated that facilitating expressed emotion through movement elements that are not associated with happiness can enhance feelings such as empowerment, pride, and determination, which are experienced as part of positive affect. The results show the impact of specific full-body movement elements on the emotional state and the support outcome of DMT on emotion regulation. (shrink)

This paper examines the prevalence of the ideal of “independence” in intellectual disability care in the Netherlands. It responds to a number of scholars who have interrogated this ideal through the lens of Michel Foucault’s vocabulary of governmentality. Such analyses hold that the goal of “becoming independent” subjects people with intellectual disabilities to various constraints and limitations that ensure their continued oppression. As a result, these authors contend, the commitment to the ideal of “independence” – the “ethic of autonomy” – (...) actually threatens to become an obstacle to flourishing in the group home. This paper offers an alternative analysis. It does so by drawing on a case study taken from an ethnographic study on group home life in the Netherlands. Briefly put, the disagreement stems from differing conceptualizations of moral life. Put in the vocabulary of moral anthropologist Cheryl Mattingly, the authors propose to approach the group home more from a “first-person” perspective rather than chiefly from a “third-person” perspective. They then draw on Mattingly to cast the group home as a “moral laboratory” in which the ethic of autonomy is not just reproduced but also enacted, and in which the terms of (in)dependence constantly get renegotiated in practice. What emerges is not only a new perspective on the workings of the “ethic of autonomy” in the group home, but also an argument about the possible limitations of the vocabulary of governmentality for analysing care practices. In this paper, we explain why the antecedent of a biscuit conditional is relevant to its consequent by extending Douvenʼs evidential support theory of conditionals making use of utilities. By this extension, we can also explain why a biscuit conditional gives rise to the inference that the consequence is (most likely) true. Finally, we account for the intuition that (indicative) biscuit sentences are false when the antecedent is false and allow for counterfactual biscuits.

The Clifford of my title is W. K. Clifford, who is perhaps best known as the exponent of a certain ethic of belief – an ethic of belief that he was probably the first to formulate explicitly and which no one has defended with greater eloquence or moral fervor. In the lecture called, appropriately enough, ‘The Ethics of Belief,’ Clifford summarized his ethic in a single, memorable sentence: ‘It is wrong always, everywhere, and for any one, to believe anything upon (...) insufficient evidence’. It will be convenient for us to have a name for this ethical thesis. I will call it ‘ethical evidentialism’ – ‘evidentialism’ for short. (shrink)

ABSTRACTI contextualize and interpret the distinction in Hobbes’ Leviathan between the capacities of the sovereign and show its importance for contemporary debates on the nature of Hobbesian sovereignty. Hobbes distinguishes between actions the sovereign does on personal title, and actions he undertakes in a political capacity. I argue that, like royalists defending King Charles I before and during the English civil war, he maintains that the highest magistrate is sovereign in both his natural and political capacities because the capacities are (...) inseparable, though district. This position goes back to the treatment of Calvin’s Case by Francis Bacon and Edward Coke and has further precedents in medieval English constitutional thought. An important reason for Hobbes to include this doctrine in Leviathan, I suggest, is to provide a response to parliamentarians who employed the sovereign’s multiple capacities to justify armed resistance against the king. I show the relevance of this contextualization by intervening in two recent debates, regarding the possibility of constitutionalist limitations on the actions of the Hobbesian sovereign and regarding whether sovereignty is held by the commonwealth or by the person of the sovereign. The Introduction provides an assessment of Theophrastus' contribution to Peripatetic thought on the principles of being.

Moral case deliberation (MCD) is a specific form of clinical ethics, aiming to stimulate ethical reflection in daily practice in order to improve the quality of care. This article focuses on the implementation of MCD in nursing homes and the questions how and where to organize MCD. The purpose of this study was to evaluate one way of organizing MCD in two Dutch nursing homes. In both of these nursing homes the MCD groups had a heterogeneous composition and were organized (...) apart from existing institutional communication structures. As part of a naturalistic evaluation, systematic observations, interviews and focus groups were completed. The findings indicate that the heterogeneous composition and MCD meetings separate from existing structures have benefits. However, the participants also reported negative experiences. This gives rise to the question whether a mixed MCD group which meets separately is an effective way to embed MCD as an instrument for reflection on moral issues in daily practice. We conclude that there is no single answer to that question. In the end, the two implementation strategies (i.e. within existing communication structures and a mixed MCD group) can be complementary to each other. (shrink)

In this article, I argue that law has two oftenneglected functions: the expressive and thecommunicative functions. They are especially importantfor legislation on moral issues, such as biomedicalethics and anti-discrimination law. The communicativefunction of law is a complex one: law may create anormative framework, a vocabulary to structurenormative discussions, as well as institutions andprocedures that promote further discussion. Theexpressive function of law is at stake when itexpresses which fundamental standards, which valuesare regarded as important. As many Western countries emerged from initial periods of lockdown in spring 2020, they had brought COVID-19 infection rates down significantly. This was followed, however, with more drastic second and third waves of viral spread, which many of these same countries are struggling to bring under control, even with the implementation of further periods of lockdown. Could this have been prevented by policymakers? We revisit two strategies that were focus of much discussion during the early stages of the pandemic, and (...) which were implemented in several Western countries, albeit in a weakened form. These strategies both proceed by targeting certain segments of the population, while allowing others to go about their lives unhindered. The first suggests selectively isolating those that would most likely suffer severe adverse effects if infected – in particular the elderly. The second involves identifying and quarantining those who are likely to be infected through a contact tracing app that would centrally store users’ information. We suggest that both strategies showed promise in preventing the need for further lockdowns, albeit in a significantly more stringent form than anything that was implemented in Western countries. We then proceed to an ethical evaluation of these more stringent policies. We contend that selective isolation strategies face severe ethical problems due to its discriminatory nature, while the ethical issues with a more aggressive contact tracing regime can be mitigated. This analysis has implications for how to respond effectively and ethically to future pandemics, and perhaps contains lessons on how to successfully emerge from our current predicament. (shrink)

I show how scoring rules, interpreted as measuring the inaccuracy of a set of degrees of belief, may be exploited to construct confirmation measures as used in Bayesian confirmation theory. I construct two confirmation measures from two particular standard scoring rules. One of these measures is genuinely new, the second is trivially ordinally equivalent to the difference measure. These two measures are tested against three well-known measures of confirmation in a simple but illuminating case that contains in a natural way (...) the problem of irrelevant conjunction. _Ordo II_ comprises the work that made Erasmus famous, namely the _Adagia_ (Proverbs) some of which were extended into essays. This first volume of the _Adages_ in the Amsterdam edition of the Latin texts of Erasmus gives a general introduction to the _Adages_ in German, as well as a critical edition of the Latin text of the first half of the first thousand _Adages_.

This book puts forward a new theoretical concept of the juridical act, this concept is not described from the perspective of a specific national legal system, but instead represents the commonalities and ideas that stem from the Western legal tradition. Since the concept is system-independent, it does not rely on national or state laws. The book begins by detailing those characteristics that distinguish juridical acts from the general group of acts. It offers clear distinctions between the different aspects of juridical (...) acts, such as the power and the competence needed in order to perform the act, the fact that juridical acts are constitutive speech acts, and the rules that connect the act with its consequences. In the process, the book dispels much of the haziness currently surrounding juridical acts. Developed with a mix of theory and practice, this new concept is better equipped to deal with modern trends and practices. Further, since the author has freed the idea of the juridical act from the bonds of history and geography, it is also more suited to facilitating a better understanding of and explaining changes in the legal landscape, such as the rise of computer technology. Accordingly, it offers scholars and practitioners alike a valuable new tool for explaining and theorizing about the law. (shrink)

Pioneering researchers claim that telepsychiatry presents the possibility of improving both the quality and quantity of patient care for populations in general as well as for those in rural and remote locations. The prevalence of, and literature on telepsychiatry has increased dramatically in the last decade, covering all aspects of research endeavors. However, little can be found on the topic of ethics in telepsychiatry. Using various clinical scenarios we may provide insight into the moral challenge in telepsychiatry—the lack of in-person (...) contact. The difficulty is to articulate what the significance of in-person contact is and further, its meaning in the therapeutic relationship between the patient and the physician. Using the personalist perspective and related philosophical approaches we may sketch an idea of the patient as person, existentially considered as a relational and bodily human being. By applying Brennan’s model for health technology assessment we may evaluate the morally troubling aspect of telepsychiatry—a lack of in-person contact—on this philosophical sketch of the person. This consideration is crucial when developing policies to guide the use of telepsychiatry in order to maintain the quality of care. (shrink)

La présentation ambiguë de la χώρα dans le Timée a donné lieu à une grande diversité d’interprétations, dont la plupart se sont inspirées de la critique aristotélicienne du discours de Timée. Depuis l’Antiquité, ceux qui ont voulu sauver l’analyse de Platon face aux objections formulées par Aristote se sont servis des notions et des présuppositions que celui‑ci a imposées au débat. Or, il importe d’essayer de dépouiller de ces présupposés la question de la χώρα, en cherchant à identifier les questions (...) que Platon lui‑même s’est posé, et qu’il a voulu résoudre en établissant la notion de χώρα. Vu que, en Tim. 52d‑53b, Platon indique que la χώρα contenait des qualités avant l’intervention démiurgique, il faut accepter que ce réceptacle qui reçoit les éléments n’est pas sans forme et, dès lors, qu’il ne correspond pas à la notion aristotélicienne de la matière. Il s’agit plutôt d’une masse corporelle douée d’une motion déséquilibrée, et dont la nature n’est pas changée lors de l’imposition de la forme. La matérialité de cette masse corporelle ne faisant l’objet d’aucune conceptualisation, ce passage sur la χώρα, comme d’ailleurs l’analyse des éléments en Tim. 53b‑61c, montre que Platon n’a pas élaboré une theorie de la matière. This article aims to present a realistic reading of the parable of the Lost Coin in Q. A realistic reading of the parable focuses on the social realia invoked by the parables, that is, the social realities and practices embedded by any given parable. As will be indicated, available documented papyri can be used to identify the possible social realia invoked by the parables, and this can help the modern reader to identify what is ‘normal’ or ‘abnormal’ in a parable (...) being interpreted. This, in turn, can help the modern reader to come to grips with the probable intended meaning of the parable. In a realistic reading of the Lost Coin, it is argued that two things are important: the price and daily consumption of oil, and the Lost Coin being one of the gendered doublets in Q. Apart from proposing a possible meaning of the Lost Coin, it is also indicated that a realistic reading explains why the seeking of the woman is described as being ἐπιμελῶς [diligent]. (shrink)

Roger Scruton’s ontology of sound is found wanting on two counts. Scruton removes from music the importance of the performer’s manipulating of his instrument. This misconceives the phenomenology of hearing and, as a consequence, impoverishes our understanding of music. I argue that the musician’s manipulations can be heard in the music; and, in a discussion of notions developed by Richard Wollheim and Jerrold Levinson, that these manipulations have psychological reality, and that it is this psychological reality which brings to life (...) the sui generis musical persona of musical expressiveness.
