Legal and ethical issues involved in group work are reviewed and discussed. Variations in different professional ethics codes are discussed. Recommendations for consideration by group leaders are made.

Conducting or overseeing research in correctional settings requires knowledge of specific federal rules and regulations designed to protect the rights of individuals in incarceration. To investigate the extent to which relevant groups possess this knowledge, using a 10-item questionnaire, we surveyed 885 IRB prisoner representatives, IRB members and chairs with and without experience reviewing HIV/AIDS correctional protocols, and researchers with and without correctional HIV/AIDS research experience. Across all groups, respondents answered 4.5 of the items correctly. Individuals who have overseen or (...) conducted correctional research had the highest scores; however, even these groups responded correctly only to slightly more than half of the items. These findings emphasize the need for ongoing training in federal guidelines governing correctional research, particularly for those individuals who are embarking on this type of research. (shrink)

Mission-oriented climate change research is often unverifiable. Therefore, many stakeholders look to peer-reviewed climate change research for trustworthy information about deeply uncertain and impactful phenomena. This is because peer-review signals that research has been vetted for scientific standards like reproducibility and replicability. Here we evaluate the transparency of research methodologies in mission-oriented computational climate research. We find that only five percent of our sample meets the minimal standard of fully open data and code required for reproducibility and replicability. The widespread (...) lack of minimal openness standards in peer-reviewed climate change research jeopardizes scientific credibility and risks poor societal outcomes as we manage growing climate risks. Current orthodoxy takes representation to be essential to computation. However, a philosophical account of computation that does not appeal to representation would be useful, given the difficulties involved in successfully theorizing representation. Piccinini's recent mechanistic account of computation proposes to do just that: it couches computation in terms of what certain mechanisms do without requiring the manipulation or processing of representations whatsoever (Piccinini 2015). Most crucially, mechanisms must process medium-independent vehicles. There are two ways to understand what "medium-independence" means on (...) this account; however, on either understanding, the account fails. Either too many things end up being counted as computational, or purportedly natural computations (e.g., neural computations) cannot be counted at all. In the end, illustrating this failure sheds some light on the way to revise the orthodoxy in the hope of a better account of computation. (shrink)

Background and AimsEnd-of-life discussions can be difficult for seriously ill adolescents and young adults. Researchers aimed to determine whether completing Voicing My CHOiCES —a research-informed advance care planning guide—increased communication with family, friends, or health care providers, and to evaluate the experience of those with whom VMC was shared.MethodsFamily, friends, or HCPs who the AYAs had shared their completed VMC with were administered structured interviews to assess their perception of the ACP discussion, changes in their relationship, conversation quality, and whether (...) the discussion prompted changes in care. Open-ended responses underwent thematic analysis.ResultsOne-month post-completion, 65.1% of AYA had shared VMC completion with a family member, 22.6% with a friend, and 8.9% with an HCP. Among a sample of respondents, family and friends reported a positive change in their relationship with the AYA. Participant descriptions of the experience fell into five themes: positive experience, difficult experience, appreciated a guide to facilitate discussion, provided relief, and created worry/anxiety. Only 1 HCP noted a treatment change. Family, friends, and HCP did not think the AYA would have discussed EoL preferences without completing VMC.ConclusionsVMC has potential to enhance communication about ACP between AYA and their family and friends, though less frequently with HCPs. Participants reported a positive change in their relationship with the AYA after discussing VMC, and described experiencing the conversation as favorable, even when also emotionally difficult. When faced with a dilemma between believing what is supported by an impartial assessment of the evidence (e.g., that one's friend is guilty of a crime) and believing what would better fulfill a moral obligation (e.g., that the friend is innocent), people often believe in line with the latter. But is this how people think beliefs ought to be formed? We addressed this question across three studies and found that, across a diverse set of everyday situations, people treat moral considerations (...) as legitimate grounds for believing propositions that are unsupported by objective, evidence-based reasoning. We further document two ways in which moral considerations affect how people evaluate others' beliefs. First, the moral value of a belief affects the evidential threshold required to believe, such that morally beneficial beliefs demand less evidence than morally risky beliefs. Second, people sometimes treat the moral value of a belief as an independent justification for belief, and on that basis, sometimes prescribe evidentially poor beliefs to others. Together these results show that, in the folk ethics of belief, morality can justify and demand motivated reasoning. (shrink)

Analog representations come in different types. One distinction is between those representations that have parts that are themselves representations and those that do not (i.e., those for which the Parts Principle is true and those for which it is not). I offer a unified account of analog representation, showing what all types have in common. This account clarifies when the Parts Principle applies and when it does not, thereby illuminating why the Parts Principle is less interesting than one might have (...) thought. Understanding analog representation instead requires understanding the kinds of magnitudes used in a particular representation, and the kinds of variation possible within a representational scheme. Legal theorists have characterized physical evidence of brain dysfunction as a double-edged sword, wherein the very quality that reduces the defendant’s responsibility for his transgression could simultaneously increase motivations to punish him by virtue of his apparently increased dangerousness. However, empirical evidence of this pattern has been elusive, perhaps owing to a heavy reliance on singular measures that fail to distinguish between plural, often competing internal motivations for punishment. The present study employed a test of the theorized double-edge pattern using (...) a novel approach designed to separate such motivations. We asked a large sample of participants (N = 330) to render criminal sentencing judgments under varying conditions of the defendant’s mental health status (Healthy, Neurobiological Disorder, Psychological Disorder) and the disorder’s treatability (Treatable, Untreatable). As predicted, neurobiological evidence simultaneously elicited shorter prison sentences (i.e., mitigating) and longer terms of involuntary hospitalization (i.e., aggravating) than equivalent psychological evidence. However, these effects were not well explained by motivations to restore treatable defendants to health or to protect society from dangerous persons but instead by deontological motivations pertaining to the defendant’s level of deservingness and possible obligation to provide medical care. This is the first study of its kind to quantitatively demonstrate the paradoxical effect of neuroscientific trial evidence and raises implications for how such evidence is presented and evaluated. This paper explores the meaning of dreamless sleep. First, I consider four reasons why we commonly pass over sleep's ontological significance. Second, I compare and contrast death and sleep to show how each is oriented to questions regarding the possibilities of "being-a-whole." In the third and final part, I explore the meaning and implications of "being-toward-sleep," arguing that human existence emerges atop naturally anonymous corporeality (i.e. living being). In sum, I try to show that we can recover an authentic — (...) if somewhat ambiguous — sense of "being-a-whole" only by recognizing the ontological significance of dreamless sleep. (shrink)

The author argues non-human, sentient animals have aggregation-trumping rights by explaining why and how they should be included in the scope of Kantian contractualism. He explains that the beings to whom we owe duties—who can be wronged by our treatment—are all those with the capacity for first-person, subjective experience; i.e., all sentient beings. To determine what duties we owe to such beings, we should reflect on the principles for the general regulation of behavior that could be hypothetically justified to their (...) imaginary perfectly reasonable counterparts; i.e., even though animals actually cannot understand or reflect on the reasons we have for treating them in a particular way, burdening them unjustifiably is wrong to them. The author argues this inclusive contractualist theory can explain all the distinctive moral phenomena that T. M. Scanlon’s approach does and so is a more attractive contractualist moral theory. In this chapter, I consider the largely overlooked influence of E. W. von Tschirnhaus' treatise on method, the Medicina mentis, on Wolff's early philosophical project (in both its conception and execution). As I argue, part of Tschirnhaus' importance for Wolff lies in the use he makes of principles gained from experience as a foundation for the scientific enterprise in the context of his broader philosophical rationalism. I will show that this lesson from Tschirnhaus runs through Wolff's earliest philosophical discussions, and (...) indeed continues to inform his major texts in logic and mathematics just before the publication of the German Metaphysics. In the end, my discussion has the effect of revealing Tschirnhaus to be an exceptionally important influence on Wolff's development, perhaps even as important (or so I suggest) as Leibniz. (shrink)

In an influential paper, Wendy Parker argues that agreement across climate models isn’t a reliable marker of confirmation in the context of cutting-edge climate science. In this paper, I argue that while Parker’s conclusion is generally correct, there is an important class of exceptions. Broadly speaking, agreement is not a reliable marker of confirmation when the hypotheses under consideration are mutually consistent—when, e.g., we’re concerned with overlapping ranges. Since many cutting-edge questions in climate modeling require making distinctions between mutually consistent (...) hypotheses, agreement across models will be generally unreliable in this domain. In cases where we are only concerned with mutually exclusive hypotheses, by contrast, agreement across climate models is plausibly a reliable marker of confirmation. (shrink)

Generalizing the notion of a tight almost disjoint family, we introduce the notions of a tight eventually different family of functions in Baire space and a tight eventually different set of permutations of $\omega $. Such sets strengthen maximality, exist under $\mathsf {MA} (\sigma \mathrm {-centered})$ and come with a properness preservation theorem. The notion of tightness also generalizes earlier work on the forcing indestructibility of maximality of families of functions. As a result we compute the cardinals $\mathfrak {a}_e$ and (...) $\mathfrak {a}_p$ in many known models by giving explicit witnesses and therefore obtain the consistency of several constellations of cardinal characteristics of the continuum including $\mathfrak {a}_e = \mathfrak {a}_p = \mathfrak {d} < \mathfrak {a}_T$, $\mathfrak {a}_e = \mathfrak {a}_p < \mathfrak {d} = \mathfrak {a}_T$, $\mathfrak {a}_e = \mathfrak {a}_p =\mathfrak {i} < \mathfrak {u}$, and $\mathfrak {a}_e=\mathfrak {a}_p = \mathfrak {a} < non(\mathcal N) = cof(\mathcal N)$. We also show that there are $\Pi ^1_1$ tight eventually different families and tight eventually different sets of permutations in L thus obtaining the above inequalities alongside $\Pi ^1_1$ witnesses for $\mathfrak {a}_e = \mathfrak {a}_p = \aleph _1$.Moreover, we prove that tight eventually different families are Cohen indestructible and are never analytic. Amalia Holst (1758-1829) has had a rather conflicted reception within the history of feminism. Her Über die Bestimmung des Weibes zur höhern Geistesbildung (On the Vocation of Woman to the Higher Education of the Mind, 1802) is a strident defense of women’s right of access to education; however her case relies on the presuppostion of woman's traditional threefold role as "mother, spouse, and housewife." In this essay, in addition to disclosing new details about Holst's life, I contend that a closer (...) reading of her text reveals a rather more radical project motivating her discussion, and that this helps alleviate concerns about her alleged unoriginality, conservatism, and elitism. Gender discrimination continues to plague organizations. While the advent of the Internet and the digitization of commerce have provided both a mechanism by which goods and services can be exchanged, as well as an efficient way for consumers to voice their opinions about retailers (i.e., via online rating systems), recent work has begun to uncover significant biases that manifest during the review process. In particular, it has been suggested that the gig-economy’s elimination of previously anonymous arm’s-length transactions may re-introduce bias (...) into perceptions of quality. In this work, we build upon research that has identified biases based on ascriptive characteristics in rating systems of ridesharing platforms. In doing so, we conduct an online experiment using a series of factorial vignettes to consider not only willingness to transact but post-transaction perceptions of quality. Findings suggest that female drivers are not penalized ex ante for taking on gender incongruent roles, i.e., driving, and experience no penalty when a rider reports a high-quality experience. However, conditional upon a lower quality experience, there is a disproportionate penalty for female drivers. Strikingly, we also observe that historic high quality does not serve as a buffer against such penalties, as prior literature would suggest. These findings underscore the challenges platforms face in ensuring their participants are being evaluated in a fair and impartial way, and highlight the difficulties present when non-employees (customers) are rating non-employees (drivers) of the firm. In a recent article, Corey Wrenn argues that in order to adequately address injustices done to animals, we ought to think systemically. Her argument stems from a critique of the individualist approach I employ to resolve a moral dilemma faced by animal sanctuaries, who sometimes must harm some animals to help others. But must systemic critiques of injustice be at odds with individualist approaches? In this paper, I respond to Wrenn by showing how individualist approaches that take seriously the (...) notion of group responsibility can be deployed to solve complicated dilemmas that are products of injustice. Contra Wrenn, I argue that to adequately address injustice, acting individually, often within groups, is significantly more important than thinking systemically. (shrink)

According to Corey Brettschneider, we can protect freedom of religion and promote equality, by distinguishing religious groups’ claims to freedom of expression and association from their claims to financial and verbal support from the state. I am very sympathetic to this position, which fits well with my own views of democratic rights and duties, and with the importance of recognizing the scope for political choice which democratic politics offers to governments and to citizens. This room for political choice, I (...) believe, is necessary if people are to have any chance of reconciling the conflicting moral and political obligations they are likely to face, however idealized our conception of democracy or morality. Granted that no amount of personal and political choice will ever guarantee that we do not encounter tragic choices, and painfully conflicting moral demands, it is an important feature of democracy – or so I believe – that its rights reflect the importance of mitigating these conflicts so that people are able, as a rule, to act as they ought, so that they do not experience their moral sentiments, beliefs and capacities simply as grounds for recrimination, alienation and despair. I therefore believe that democracies have good reason not to force the consciences of the undemocratic and the intolerant, where it is possible to accommodate such people without threatening the rights of others. However, the fact that I share many of Brettschneider’s intuitions and beliefs does not mean that I share them all. In particular, I find his conception of democracy unduly narrow, and unduly based on a rather idealized conception of the American constitution which is unlikely to appeal to those whose conceptions of democracy are more republican, more socialist, more pragmatic and more international than his. I have explained these worries elsewhere and drawn out some of their implications for his arguments about privacy and judicial review. There is no need to repeat them here. I will also set to one side my worries about his uninflected, overly abstract and rather reified characterization of the State, in the hope that others will discuss this and that, in the end, a more nuanced conception of the State and a more lively appreciation of the conflicting people, institutions, histories and norms which make up most states, will prove consistent with his arguments. Finally, I do not propose to enter into a detailed discussion of the difficulties of Brettschneider’s overly abstract and reified conception of State ‘speech’ and ‘expression’ which, while motivated by the language of American constitutionalism, appears to cover pretty much anything a government might do, from raising and spending taxes, to accepting judicial interpretations of contested constitutional provisions, or to affirmatively pronouncing on the goals that will animate its legislative agenda and its aspirations for citizen’s lives. Again, while I would have wished for a more nuanced and analytical discussion of so central a concept as ‘expression’ and, in particular, expression by ‘the State’, I am uncertain that anything fundamental in Brettschneider’s account of citizen rights and duties would be altered in the process. Instead, then, I want to focus on points in Brettschneider’s argument that intrigue, and sometimes puzzle, me the most and where issues of nuance and clarification might make a substantial difference to our views of equality and religious freedom. Clinical diagnostic medicine is an experimental science based on observation, hypothesis making, and testing. It is an use dynamic process that involves observation and summary, diagnostic conjectures, testing, review, observation and summary, new or revised conjectures, i.e. it is an iterative process. It can then be said that diagnostic hypotheses are also ‘observation-laden’. My aim is to enlarge on the strategies of medical diagnosis as these are meshed in training and clinical experience—that is, to describe the patterns of reasoning used (...) by experienced clinicians under different diagnostic circumstances and how these patterns of inquiry allow further insight into the evaluation and treatment of patients. I do not aim to present a theory and illustrate it with examples; I wish rather am to let a realistic example, similar to actual clinical scenarios, direct the exposition. To this end, I introduce an account of medical diagnosis—briefly comparing and contrasting it to other accounts—in order to focus on discussing the process of diagnosis through a detailed clinical case. This book looks at facets in the history of capitalism from the Enlightenment period, through the emergence of the American Empire in the Pacific, and to the contemporary era of neoliberal globalization. This re-telling of history is done by drawing from the works of E. San Juan, Jr., considered arguably one of the great contemporary cultural and literary critics of our time. In this author's view, San Juan's lifetime of works offer a living documentation of, among others, the history and (...) thought of the modern world highlighted by the rise of capitalism through the contemporary era of neoliberal globalization, and shepherded to its hegemonic status by what stands today as the preeminent empire of the United States. The book underscores the symbiosis between contemporary capitalism as an economic system based on accumulation on the one hand, and the American imperial state on the other, just as it revisits the colonial project that was carried out in capitalism's wake, the violence and subjugation inflicted on its victims, and how this colonial project has morphed into a new form of colonialism maintained and enforced through the rules and institutional mechanisms of what is popularly known as neoliberal globalization that also provides the ideological and legal rationale for the commodification and the ultimate grab of the global commons reminiscent of the classical, albeit cruder, form of colonialism. This paper assesses several prominent recent attacks on the view that epistemic justification is conceptually prior to knowledge. I argue that this view—call it the Received View (RV)—emerges from these attacks unscathed. I start with Timothy Williamson’s two strongest arguments for the claim that all evidence is knowledge (E>K), which impugns RV when combined with the claim that justification depends on evidence. One of Williamson’s arguments assumes a false epistemic closure principle; the other misses some alternative (to E>K) explanations of (...) a putative fact about the evidence a particular subject has. Next, I neutralize each of Jonathan Sutton’s three recent arguments to the conclusion that any justified belief constitutes knowledge. Finally, I consider a recent analysis of justification due to Alexander Bird, according to which justified belief is possible knowledge. I argue that Bird’s analysis delivers neither a sufficient nor (more importantly) a necessary condition for justification. [Word count: 149]. (shrink)
