This chapter explores the tension between public health protection and the freedom of commercial expression from a Commonwealth Caribbean perspective, using Barbados and Jamaica as case studies. First, it assesses the scope of the right to freedom of expression. Second, it discusses the extent to which public health protection may be invoked to restrict the right. The authors conclude that Commonwealth Caribbean states can justifiably restrict commercial speech about tobacco products and unhealthy food and beverages.

This article reflects on the problem of false belief produced by the integrated psychological and algorithmic landscape humans now inhabit. Following the work of scholars such as Lee McIntyre (Post-Truth, MIT Press, 2018) or Cailin O’Connor and James Weatherall (The Misinformation Age: How False Beliefs Spread, Yale University Press, 2019) it combines recent discussions of fake news, post-truth, and science denialism across the disciplines of political science, computer science, sociology, psychology, and the history and philosophy of science that variously address (...) the ineffectiveness, in a digital era, of countering individual falsehoods with facts. Truth and falsehood, it argues, rather than being seen as properties or conditions attached to individual instances of content, should now be seen as collective, performative, and above all persuasive phenomena. They should be practically evaluated as networked systems and mechanisms of sharing in which individually targeted actions are combining with structural tendencies (both human and mechanical) in unprecedented ways. For example, the persuasive agency of apparent consensus (clicks, likes, bots, trolls) is newly important in a fractured environment that only appears to be, but is no longer ‘public’; the control of narratives, labels, and associations is a live, time-sensitive issue, a continuous contest, or ongoing cusp. Taking a social approach to truth yields observations of new relevance; from how current strategies of negative cohesion, blame, and enemy-creation depend crucially on binary ways of constructing the world, to how the offer of identity/community powerfully cooperates with the structural tendencies of algorithm-driven advertiser platforms towards polarisation. Remedies for these machine-learned and psychological tendencies lie in end-user education. So the Arts and Humanities, whether via comparisons with previous historical periods, or via principles of critical thinking and active reading, offer crucial resources to help counter what since 1997 silicon valley executives and scholars have called ‘persuasive technology’ (Fogg in Persuasive Technology: Using Computers to Change What we Think and Do, Morgan Kaufmann, 2003; Hamari et al. (eds) in Persuasive Technology, Springer International Publishing, 2014; Harris in How a Handful of Tech Companies Control Billions of Minds Every Day, 2017; Lanier in Who Owns the Future? Simon & Schuster, 2014 and Ten Arguments for Deleting your Social Media Accounts Right Now, Picador, 2019). The article proposes a paradigm shift in public understandings of this new social environment: from a culture of discovery, where what matters is what exists or is in fact the case, to a culture of iteration, where what matters is what gets repeated. It further examines the events as a moment where (...) subjects were able to escape the life-narratives imposed upon them by the State. Born in 1925, Châtelet was founding member of the University of Vincennes, Paris VIII’s experimental department of philosophy alongside Michel Foucault in the aftermath of the 1968 student protests. (...) In 1983, he would establish the Collège Internationale de Philosophie in Paris along with other prominent philosophers, an institution that in Alessandra Campana’s words, is at “the forefront of militant and engaged critical thinking,” in which it has sought to “relocate philosophy at the intersection of science, politics, psychoanalysis, art and literature, jurisprudence, and economy.” Châtelet’s association with radical educational institutions and the interdisciplinarity of research undertaken at the latter both point to what can be understood to be the essence of his philosophical project: that the history of philosophy is also a politics of philosophy. La Grèce Classique, La Raison, L’État, which was first published in 1978 and appears here in translation for the first time under the title Classical Greece, Reason, and the State, is exemplary in this regard, providing a powerful critique of the history of philosophy and its purported Greek origins. As Deleuze argues, Châtelet reveals that “Athens was not the advent of an eternal reason, but the singular event of a provisional rationalisation. In this view, the essence of classical philosophy cannot be extended to the contemporary era—neither in its original form, or in a revised form that has been modified and updated across the passage of time. Therefore, by politicising philosophy and its history, Châtelet’s work also shows philosophy to be indicative of a particular cultural moment, rather than as an the state, philosophy, and the tyranny of the logos · isolated discipline cut off from the influences of material life. He establishes a form of ‘rational empiricism’ for conducting a history of political philosophy that rejects universality for potentiality. Said otherwise, his work is indicative of what might be called the poststructuralist critique of historical narrative surrounding the canon of western thought, a critique that Michael Hardt rightfully argues “has problematised the foundations of philosophical and political thought.” However, Châtelet has made important contributions to the poststructuralist approach to theorising the western tradition that remain novel and insightful to a contemporary audience, rather than simply being one of many to problematise philosophy’s purported foundations. There are three potential problems with using virtue theory to develop an environmental ethic. First, Aristotelian virtue theory is ratiocentric. Later philosophers have objected that Aristotle’s preference for reason creates a distorted picture of the human good. Overvaluing reason might well bias virtue theory against the value of non-rational beings. Second, virtue theory is egocentric. Hence, it is suited to developing a conception of the good life, but it is not suited to considering obligations to others. Third, virtue theory is (...) notoriously bad at providing rules and procedures for resolving ethical questions about particular circumstances. But environmentalists need procedures for determining which of several conflicting values is most important. Virtue theory is not action guiding. I respond to each of these problems. I show that virtue theory is uniquely suited to answering ethical questions about nonhuman animals and the environment. (shrink)

Hamlet in Purgatory is both more and less than literary criticism of Shakespeare's most haunting and most critically belabored play. Greenblatt has captured an evolving culture of belief which informs the play and goes far beyond source studies (...) or the history of ideas. He assays to show how the Medieval doctrine of Purgatory and the rejection of it by Protestant Reformers shaped the structure of Hamlet and the world of Hamlet's spiritual agony.Central to the argument is the notion that the rejection of Purgatory, and ritual practices associated with the doctrine, threatened to disrupt community and sever the relations between the living and the dead. Thus, the senior Hamlet's plea to "Remember me" takes precedence over his injunction to revenge; traditional preoccupations of Hamlet criticism become secondary to the concern for spiritual community which Reformation doctrine threatened. The exegesis is scholarly and the prose is engaging, yet the book suffers from the new historicist tendency to become absorbed more with context than with criticism and to assume too readily the relevance of the context to the criticism. Put another way, Greenblatt, like other new historicists, is not always rigorous in his inferences.Greenblatt warns that his book "requires a certain hermeneutical patience, a willingness to suspend direct literary analysis, in order to examine more thoroughly what has been treated as mere background for the canonical work of art" (p. 5). Although the book culminates in a description of the migration of discarded religious ritual into the theater, and a thoughtful commentary on Hamlet, Greenblatt cautions that "... for the book to work properly, the reader should understand literary analysis, and specifically the analysis of Hamlet, to be suspended in another sense as well, that is, distributed in tiny, almost invisible particles throughout my account" (p. 5). Amen. The caveats are essential for anyone who might expect an "interpretation" of Hamlet. Rather, Greenblatt has evoked the conflict of enduring beliefs and Reformist critiques which animated Shakespeare's imagination and Hamlet's suffering.Hermeneutical patience certainly is demanded of the reader, because more than half of the book presents commentaries on the doctrine of Purgatory from the late Middle Ages to the early seventeenth century. Greenblatt begins with Simon Fish's 1529 "Supplication for the Beggars," (p. 15) an anti-purgatorial (and anti-clerical) tract addressed to Henry VIII. Fish argued that the doctrine of Purgatory is at the heart of ecclesiastical corruption and is a danger to the state, because the fear that the doctrine can generate enables the clergy to extort enormous wealth in the form of "suffrages," donations for trentals, anniversary Masses, and other perpetual penitential memorials on behalf of the dead. Fish's argument is double: its theological burden is that Purgatory is a non-scriptural superstition; its rhetoric is that it is an abuse of the [End Page 364] poor and a danger to the economic solvency of the kingdom. Fish invokes both doctrinal error and political danger; this is thus an excellent tract to begin the elucidation of the complexity of Reformist objections to Purgatory in sixteenth-century England. Greenblatt adds that other Reformers saw Purgatory as a poetic creation, a fable, and therefore a vain imagining. John Donne's "Devotions upon Emergent Occasions" is cited to show that post-Catholic divines believed that purgation must be completed in this life.According to Greenblatt, an unintended consequence for the laity of the rejection of Purgatory is the creation of a radical divide between the living and the dead. If we pray for the dead, they are not as absent from us as if they had passed on to the timeless worlds of Heaven or Hell. In Shankman’s title, however, the phrase is literally appropriate because he forthrightly argues that the classic is, of its nature, (...) something that always exists in quest and tension. The classic is not to be located merely in classical antiquity or in the tastes of a privileged class. Though Shankman grants that these often are associated with the literary classic, he finds the nature of the classic rather in the nature of literature as a state of metaxis or “in-betweenness.” His examinations of classical, neo-classical, and modern works define various aspects of this “in-betweenness,” the state of tension that exists in the truly classic at any point in the history of literature.Although Shankman dismisses Derrida, Foucault, de Man, and others for having mistaken their own destruction of Enlightenment rationalism for a demonstration that rationality is impossible, he is not wildly original. He uses Habermas’s notion of classic literature as enduring and independent of time and Vogelin’s concept of metaxis as foundational for his sprawling, yet lucid, inquiry into the idea of the classic in Homer, Plato, Aristotle, Pindar, Virgil, Dryden, Defoe, Swift, Valery, and others, and in the traditions of the epic, ode, pastoral, and lyric.Fundamental is the view that classic literature has the greatest power to represent human experience. To avoid the hermeneutical conundrum of the subject-object dilemma, Shankman asserts literature to be in “a middle place” from Plato and Aristotle on. He sees a basic agreement between them on how literature stands between the One and the Many. Put negatively, literature is not sparks from the One or compilations of the Many. Rather it is a mediator between these polarities: classic literature accommodates the propositional purity of philosophy to the indeterminacy of thing-reality. Literature is neither an abstract kernelization of truth nor an anthology of the things of experience [End Page 256] but an analogical conjunction of the two extremes—therefore tension, therefore continual quest.Using Plato, especially the Cratylus and the Symposium, and Aristotle, especially the Metaphysics and the Poetics, Shankman describes a rationality that exists in literature that is clearly identified in his chapter on Swift’s Gulliver’s Travels by emphasizing the idea of man as an animal capax rationis. This in itself places man’s literary enterprise in a middle place and Shankman explores its various implications in a variety of works. From this perspective, it is argued that literature must be about something that matters; that pure poetry or reflexive poetry cannot achieve the ambiguity of analogy as the central core that the classic requires. Thus, Plato never rejected poetry—only the debasement of poetry into either the fantastical or literal (or the confusion of the two.)The true classic walks a line between ignorance and knowledge, rhetoric and philosophy, literalism and fantasy, “thing-reality” and “the ideal.” The Aeneid makes a good test case. It is at once a piece of propaganda and a statement of an ideal that is complicated by the duplicity of Aeneas’ abandonment of Dido, the brutality of his killing of Turnus, and his emergence in Book VI from the underworld by the Gate of Ivory (false dreams). That is too bad, because it is also very good and its length is necessary for its double purpose: (...) to reconceptualize the connections between French and English literature in the Middle Ages and to provide sensitive interpretations both of familiar and of ignored Medieval narratives. The doubleness is neatly reciprocal: the readings grow into the revisionist definition of influence, and the notion of influence informs the individual readings.The innovative and persuasive argument that orders the whole book is that the impact of the French tradition has been too narrowly defined. Rather than simply retracing the influence of the classics of French fin amour, like Chrétien, on the corpus of Middle English literature, Calin sinuously argues the influence of Anglo-Norman and thirteenth and fourteenth century Central French works on the literature of the high English Middle Ages. From Anglo-Norman, Calin draws, predictably, on the lais of Marie de France. Less predictably, he draws on Beroul and Thomas of England and on romances like Ipomedon, Amadas et Ydione, and Gui de Warewic. Least predictably, he draws on the tradition of saints’ lives as formative of later Medieval moral narrative. From Central French, he draws, predictably, on the Roman de la Rose. Less predictably, but very convincingly, he draws on material frequently slighted even by French critics: Guillaume de Digulleville, the Prose Lancelot, Machaut, Froissart, and Chartier. But even more than influence, in the traditional sense, Calin persuasively demonstrates an enlivening intertextuality. He rescues Anglo-Norman classics from their stodgy reputation and late Central French texts from inattention and makes both relevant to the development of the English narrative tradition in court poetry and in popular romance.The power of Calin’s overarching argument depends heavily on the critiques of individual works. Without forgetting Chrétien and the earlier French tradition, he traces in Marie, Beroul, and Thomas, the formation and complication of fin amour which were present and available to English writers. He describes the narrative force of Anglo-Norman saints’ lives on the fictional techniques of English romance. His acute treatment of interlace in the Prose Lancelot reveals the treasure trove that English romancers could draw on, for technique as well as themes. In addition, he shows both how de Digulleville served up the “dream vision” and Machaut and Froissart served up the limited, even bumbling, narrator for fourteenth-century England.It could be argued that Calin’s method of doing very modern or postmodern analyses of early French poetry and prose is misleading. And it is true that some of the readings of French texts seem eccentric. For example, the relentless imposition of Freud on Marie is perplexing even when plausible. Each is well done, but it is sometimes hard to tell which way the winds of theory are blowing and why. While it must be granted that the interpretations of Middle English romances, like Ywain and Gawain, Amis and Amiloun, and William of Palerne, are not profoundly different from what other scholars have come to, there is no denying that embedding them in their French contexts gives them a richness they ordinarily lack. Even more laudable is the way in which influence is elaborated not just as a matter of themes but as a transformation of techniques and even sensibility.My greatest reservation is the treatment of Chaucer, especially “The Franklin’s Tale.” Calin does recognize Chaucer’s debts to the classics (though mostly through the Ovid Moralisé) and to the Italians. Yet Chaucer is the one author for whom the weight of French intertextuality seems less a determinant than a stimulant. Tort claims have been studied for various reasons. Several studies have found that most tort claims are not related to negligent adverse events and most negligent adverse events do not result in tort claims. Several studies have examined the disposition of tort claims to understand the likelihood of payment once a claim has been made. Still others have proposed that tort-claims trend analysis may help administrators target their quality-improvement efforts and identify problems with quality that would not otherwise be captured.In (...) this article, we conduct a tort-claims analysis to explore areas for quality improvement, specifically for patient safety, in the Veterans Health Administration. Patient safety is an increasingly highlighted aspect of health-care delivery. Failure to assure patient safety can result in bad clinical outcomes, additional costs of care, and a negative organizational image. Filing a tort claim is one way for an individual to express concern about an organization. For our analysis, we draw from resolved tort claims in the Veterans Health Administration from fiscal years 1989 to 2000. (shrink)

Generic language (e.g., “tigers have stripes”) leads children to assume that the referenced category (e.g., tigers) is inductively informative and provides a causal explanation for the behavior of individual members. In two preregistered studies with 4- to 7-year-old children (N = 497), we considered the mechanisms underlying these effects by testing how correcting generics might affect the development of these beliefs about novel social and animal kinds (Study 1) and about gender (Study 2). Correcting generics by narrowing their scope to (...) a single individual limited beliefs that the referenced categories could explain what their members would be like while broadening the scope to a superordinate category (Study 2) uniquely limited endorsement of gender norms. Across both studies, correcting generics did not alter beliefs about feature heritability and had mixed effects on inductive inferences, suggesting that additional mechanisms (e.g., causal reasoning about shared features) contribute to the development of full-blown essentialist beliefs. These results help illuminate the mechanisms by which generics lead children to view categories as having rich inductive and causal potential; in particular, they suggest that children interpret generics as signals that speakers in their community view the referenced categories as meaningful kinds that support generalization. The findings also point the way to concrete suggestions for how adults can effectively correct problematic generics (e.g., gender stereotypes) that children may hear in daily life. (shrink)

The current studies (N = 255, children ages 4–5 and adults) explore patterns of age‐related continuity and change in conceptual representations of social role categories (e.g., “scientist”). In Study 1, young children's judgments of category membership were shaped by both category labels and category‐normative traits, and the two were dissociable, indicating that even young children's conceptual representations for some social categories have a “dual character.” In Study 2, when labels and traits were contrasted, adults and children based their category‐based induction (...) decisions on category‐normative traits rather than labels. Study 3 confirmed that children reason based on category‐normative traits because they view them as an obligatory part of category membership. In contrast, adults in this study viewed the category‐normative traits as informative on their own (not only as a cue to obligations). How do people gather samples of evidence to learn about the world? Adults often prefer to sample evidence from diverse sources—for example, choosing to test a robin and a turkey to find out if something is true of birds in general. Children below age 9, however, often do not consider sample diversity, instead treating non‐diverse samples (e.g., two robins) and diverse samples as equivalently informative. The current study (N = 247) found that this discontinuity stems from developmental changes in standards (...) for evaluating evidence—younger children chose to learn from samples that best approximate idealized views of what category members are supposed to be like (e.g., the fastest cheetahs), with a gradual shift across age toward samples that cover more within‐category variation (e.g., cheetahs of varying speeds). These findings have implications for the relation between conceptual structure and inductive reasoning, and for the mechanisms underlying inductive reasoning more generally. (shrink)

On its twenty-fifth anniversary, Fides et ratio remains relevant for its bold defense of reason and the complementarity of faith and reason. It describes a philosophy that is not the preserve of academics but the duty of every person. It asserts that philosophy is never contained in one system but is always open to new questions and further insights. St. John Paul defends a philosophy that welcomes pluralism based on the richness of being but rejects a pluralism based on the (...) impossibility of knowing the truth. Reflecting on Fides et ratio, this article describes six ways that theology uses philosophy and offers five lessons for philosophers, i.e., the universal character of philosophy, the complementarity of faith and reason, the necessity and limits of pluralism, the requirements for a philosophy to be consonant with theology, and the current reinvigoration of philosophy in seminaries. This book is an examination of how the law understands human identity and the whole notion of 'human being'. On these two notions the law, usually unconsciously, builds the superstructure of 'human rights'. It explores how the law understands the concept of a human being, and hence a person who is entitled to human rights. This involves a discussion of the legal treatment of those of so-called "marginal personhood" (e.g. high functioning non-human animals; humans of limited intellectual capacity, and fetuses). (...) It also considers how we understand our identity as people, and hence how we fall into different legal categories: such as gender, religion and so on. The law makes a number of huge assumptions about some fundamental issues of human identity and authenticity - for instance that we can talk meaningfully about the entity that we call 'our self'. Until now it has rarely, if ever, identified those assumptions, let alone interrogated them. This failure has led to the law being philosophically dubious and sometimes demonstrably unfit for purpose. Its failure is increasingly hard to cover up. What should happen legally, for instance, when a disease such as dementia eliminates or radically transforms all the characteristics that most people regard as foundational to the 'self'? This book seeks to plug these gaps in the literature. (shrink)

In issue 6.1 of the Journal of Scottish Philosophy, James Van Cleve describes Thomas Reid's understanding of double vision and then presents a challenge to his direct realism found in works of David Hume based on double vision. The challenge is as follows: When we press one eye with a finger, we immediately perceive all the objects to become double, and one half of them to be remov'd from their common and natural position. But as we do not attribute a (...) continu'd existence to both these perceptions, and as they are both of the same nature, we clearly perceive, that all our perceptions [i.e., all the things we perceive] are dependent on our organs, and the disposition of our nerves and animal spirits. The Scottish Enlightenment provided the fledgling United States of America and its emerging universities with a philosophical orientation. For a hundred years or more, Scottish philosophers were both taught and emulated by professors at Princeton, Harvard and Yale, as well as newly founded colleges stretching from Rhode Island to Texas.
