This paper responds to the commentaries from Stacy Carter and Alan Cribb. We pick up on two main themes in our response. First, we reflect on how the process of setting standards for empirical bioethics research entails drawing boundaries around what research counts as empirical bioethics research, and we discuss whether the standards agreed in the consensus process draw these boundaries correctly. Second, we expand on the discussion in the original paper of the role and significance of the concept of (...) ‘integrating’ empirical methods and ethical argument as a standard for research practice within empirical bioethics. Central to Elements is an assay of the attributional union properties and relations have with their subjects, a topic historically left metaphorical. The work critiques eight Aristotelian assumptions concerning attribute dependence and ‘inherence’, per se subjects, attributes as agent-organizers, and unity-by-a-shared-one. Groups of these assumptions are seen to yield contradiction, vicious regress, or other problems. This analysis, joined with insights from an assay of ubiquitous structure, motivate ten theses explicating attribution and its primary ontic status. The theses detail: attributes proper (...) as individuated instances, structure as instance-generated facts and their two forms of composition, the conditioning role and universal nature of instances’ component intensions, the primacy of attribute instances for generating all forms of composition and complex entities, and identity and indiscernibility criteria for the latter. Principal is the insight that attribution is intension-determined combinatorial agency. It is its systematizing implications that provide solutions to classic problems, e.g., Composition, Individuation, and Universals, and in net generate a comprehensive one-category structuralist ontology. Background In the last years, there has been an increase in publication of systematic reviews of normative literature or of normative information in bioethics. The aim of a systematic review is to search, select, analyse and synthesise literature in a transparent and systematic way in order to provide a comprehensive and unbiased overview of the information sought, predominantly as a basis for informed decision-making in health care. Traditionally, one part of the procedure when conducting a systematic review is an appraisal (...) of the quality of the literature that could be included. Main text However, while there are established methods and standards for appraising e.g. clinical studies or other empirical research, quality appraisal of normative literature in the context of a systematic review is still rather a conundrum – not only is it unclear how it could or should be done, but also the question whether it necessarily must be done is not settled yet. Based on a pragmatic definition of “normative literature” as well as on a typology of different types of systematic reviews of normative literature/information, this paper identifies and critically discusses three possible strategies of conducting quality appraisal. Conclusions The paper will argue that none of the three strategies is able to provide a general and satisfying solution to the problems associated with quality appraisal of normative literature/information. Still, the discussion of the three strategies allows outlining minimal conditions that elaborated strategies have to meet in future, and facilitates sketching a theoretically and practically promising strategy. Structure or system is a ubiquitous and indispensable feature of all our experience and theory, and requires an ontological analysis. The essays collected in this volume provide an account of structure founded upon the proper analysis of polyadic relations as the irreducible and defining elements of structure. Following from an analysis of ontic predication there is given a number of principles delineating realist instance ontology, together with a critique of both nominalistic trope theory and modern revivals of Aristotle's instance ontology (...) of the Categories. It is shown how the resulting theory of facts can, via "horizontal" and "vertical" composition, account for all the hierarchical structuring of our experience and theory, and, importantly, how this can rest upon an atomic ontic level composed of only dependent ontic predicates. The latter is a desideratum for the proposed "Structural Realism" ontology for micro-physics where at its lowest level the physical is said to be totally relational/structural. Nullified is the classic and insidious assumption that dependent entities presuppose a class of independent substrata or "substances," and with this any pressure to admit "bare particulars" and intensionless relations or "ties." The logic inherent in realist instance ontology--termed "PPL"--is formalized in detail and given a consistency proof. Demonstrated is the logic's power to distinguish legitimate from illegitimate impredicative definitions, and in this how it provides a general solution to the classic self-referential paradoxes. PPL corresponds to Gdel's programmatic "Theory of Concepts." The last essay, not previously published, provides a detailed differentiation of identity from indiscernibility, preliminary to which is given an explanation of in what sense a predicate logic presupposes an ontology of predication. The principles needed for the differentiation have the significant implication (e.g., for the foundations of mathematics) of implying an infinity of logical entities, viz., instances of the identity relation. The concept of “translational bioethics” has received considerable attention in recent years. Most publications draw an analogy to translational medicine and describe bioethical research that aims at implementing and evaluating ethical interventions. However, current accounts of translational bioethics are often rather vague and seem to differ with regard to conceptual and methodological assumptions. It is not clear and scarcely analyzed what exactly “translation” in the field of bioethics means, in particular regarding goals and processes so that it is justified to (...) appeal to translational medicine. In this article, we thus explore possible analogies and disanalogies between translational medicine and translational bioethics to establish whether the often occurring reference to concepts of translational medicine in the field of bioethics can be justified by substantial analogies. We will first provide an account of different models of translational medicine. In a second step, we will propose an analytic definition that explicitly articulates the essential characteristics of “translational research” irrespective of the research field (i.e., biomedicine, bioethics). Subsequently, we will explore whether and in how far general characteristics and phases of translational research in medicine can be applied to translational research in bioethics. Based on our analyses, we will come to the skeptical conclusion that at present there are considerable conceptual disanalogies and unsolved conceptual problems that disallow using “translational bioethics” in a meaningful analogy to respective accounts in biomedicine. Nevertheless, we will demonstrate that some insights gained by the conceptual accounts of translational medicine can contribute to advance current research activities in bioethics. (shrink)

Researchers in applied ethics, and some areas of bioethics particularly, aim to develop concrete and appropriate recommendations for action in morally relevant real-world situations. When proceeding from more abstract levels of ethical reasoning to such concrete recommendations, however, even with regard to the very same normative principle or norm, it seems possible to develop divergent or even contradictory recommendations for action regarding a certain situation. This may give the impression that such recommendations would be arbitrary and, hence, not well justified. (...) Against this background, we, first, aim at showing that ethical recommendations for action, although being contingent in some sense, are not arbitrary if developed appropriately. For this purpose, we examine two types of contingencies arising in applied ethics reasoning based on recent examples of recommendations for action in the context of the COVID-19 pandemic. In doing so, we refer to a three-step model of ethical reasoning towards recommendations for actions. This, however, leaves open the question of how applied ethics may cope with contingent recommendations for action. Therefore, in a second step, we analyze the role of bridge principles for developing ethically appropriate recommendations for action, i.e., principles which connect normative claims with relevant empirical information to justify certain recommendations for action in a given morally relevant situation. Finally, we discuss some implications for reasoning and reporting in empirically informed ethics. (shrink)

With the prevalence of complementary and alternative medicine (CAM) increasing in western societies, questions of the ethical justification of these alternative health care approaches and practices have to be addressed. In order to evaluate philosophical reasoning on this subject, it is of paramount importance to identify and analyse possible arguments for the ethical justification of CAM considering contemporary biomedical ethics as well as more fundamental philosophical aspects. Moreover, it is vital to provide adequate analytical instruments for this task, such as (...) separating ‘CAM as belief system’, and ‘CAM as practice’, Findings show that beneficence and non-maleficence are central issues for an ethical justification of CAM as practice, while freedom of thought and religion are central to CAM as belief system. Many justification strategies have limitations and qualifications that have to be taken into account. Singularly descriptive premises in an argument often prove to be more problematic than universal ethical principles. Thus, non-ethical issues related to a general philosophical underpinning - e.g. epistemology, semantics, and ontology - are highly relevant for determining a justification strategy, especially when strong metaphysical assumptions are involved. Even if some values are shared with traditional biomedicine, axiological differences have to be considered as well. Further research should be done about specific CAM positions. These could be combined with applied qualitative social research methods. (shrink)

This new translation presents the _Analects_ in a revolutionary new format that, for the first time in any language, distinguishes the original words of the Master from the later sayings of his disciples and their followers, enabling readers to experience China's most influential philosophical work in its true historical, social, and political context.

This paper argues that jurisprudential inquiries can be profitably analysed as oriented towards either the explanatory paradigm of discourse or the explanatory paradigm of tradition. The first part of the paper offers a map of the discipline of jurisprudence in accordance with the above two different explanatory orientations. It does so at two levels: 1) ontological ; and 2) epistemological. In the second part the paper, the tension and interaction between the explanatory paradigms of discourse and tradition in the work (...) of five different theorists is considered: 1) Elizabeth Mertz's anthropological linguistics; 2) Nicola Lacey's revision of the relationship between analytical jurisprudence and descriptive sociology; 3) Roger Cotterrell's call for a sociology of legal ideas; 4) Neil MacCormick's concept of law as institutionalised normative order; and 5) Patrick Glenn's notion of a legal tradition. Finally, in the third part, the paper addresses certain implications of the analysis of jurisprudential inquiries by reference to the above two explanatory orientations for comparative and international legal scholarship. The two explanatory orientations are offered as one of many paradigms thanks to which one can recognise the limitations of any one picture of law or legal work. At the metaphilosophical level, the analysis of the paper indicates that there are three options available to jurisprudence, i.e., 1) seek to provide a picture of law or legal work on the basis of one explanatory orientation; 2) maintain pluralism about concepts of law or legal work given their limitations in light of their explanatory orientations; or 3) attempt to combine the elements of both explanatory paradigms in a unified account. The paper argues that insofar as jurisprudence seeks to provide normative resources for responses to certain challenges in the public sphere, it ought to go for option two, namely, for maintaining pluralism about concepts of law and legal work. The robust design and conduct of pragmatic cluster randomised trials may be in tension with the ethical requirement to obtain written informed consent from prospective research participants. In our experience, researchers tend to focus on whether a waiver of consent is appropriate for their studies. However, pragmatic cluster randomised trials raise other important questions that have direct implications for determining when an alteration or waiver of consent is permissible. To assist those involved in the design, conduct and review of pragmatic (...) cluster randomised trials, we outline four critical questions to consider: (1) What is the nature of the intervention being evaluated? (2) Is the choice to use cluster randomisation justified? (3) Can the risk of recruitment bias be addressed? and (4) Is an alteration or waiver of consent appropriately justified? We recommend that researchers and research ethics committees conduct a stepwise analysis of a planned cluster randomised trial using these questions. To illustrate the application of this stepwise analysis, we use three pragmatic cluster randomised trials in the haemodialysis setting as case studies. (shrink)

We show that every infinite computable partial ordering has either an infinite Δ 0 2 chain or an infinite Π 0 2 antichain. Our main result is that this cannot be improved: We construct an infinite computable partial ordering that has neither an infinite Δ 0 2 chain nor an infinite Δ 0 2 antichain.

This paper assesses several prominent recent attacks on the view that epistemic justification is conceptually prior to knowledge. I argue that this view—call it the Received View (RV)—emerges from these attacks unscathed. I start with Timothy Williamson’s two strongest arguments for the claim that all evidence is knowledge (E>K), which impugns RV when combined with the claim that justification depends on evidence. One of Williamson’s arguments assumes a false epistemic closure principle; the other misses some alternative (to E>K) explanations of (...) a putative fact about the evidence a particular subject has. Next, I neutralize each of Jonathan Sutton’s three recent arguments to the conclusion that any justified belief constitutes knowledge. Finally, I consider a recent analysis of justification due to Alexander Bird, according to which justified belief is possible knowledge. I argue that Bird’s analysis delivers neither a sufficient nor (more importantly) a necessary condition for justification. [Word count: 149]. (shrink)

Institutional investors are increasingly becoming active owners through voting their shares and engaging in dialogue with investee companies to improve corporate environmental, social and corporate governance (ESG) performance. This article applies a model of stakeholder salience to the shareholder context, analysing the attributes of power, legitimacy and urgency, to determine the factors that are likely to enhance shareholder salience. It is found that a strong business case and the values of the managers of investee companies are likely to be the (...) most important contributors to shareholder salience. (shrink)

We investigate the way physical laws objectively refer to the entities they are about. Laws of mathematical physics do not refer directly to the “real world” but to an ideal specific domain of objects, which we term “scope”. In order to find out which real objects physical laws deal with, reference to the scope is not sufficient. We need in addition the search for domains to which laws apply — i. e. “empirical domains”— in order to establish their reference to (...) the “real world”. It is just in such empirical domains that we are able to discover the real entities physical laws objectively refer to. “Physical reality” turns out to be not something “given” but rather something “to come out” of the very process of scientific inquiry. A personal view is presented of how metaphysics and ontology stand at the beginning of the twenty-first century, in the light of developments during the twentieth. It is argued that realist metaphysics, with serious ontology at its heart, has a promising future, provided that its adherents devote some time and effort to countering the influences of both its critics and its false friends.

I have stressed here and elsewhere that perspective cannot and need not claim to represent the world "as we see it." The perceptual constancies which make us underrate the degree of objective diminutions with distance, it turns out, constitute only one of the factors refuting this claim. The selectivity of vision can now be seen to be another. There are many ways of "seeing the world," but obviously the claim would have to relate to the "snapshot vision" of the stationary (...) single eye. To ask, as it has so often been asked, whether this eye sees the world in the form of a hollow sphere or of a projection plane makes little sense, for it sees neither. The one point in focus can hardly be said to be either curved or flat, and the remainder of the field of vision is too indistinct to permit a decision. True, we can shift the point of focus at will, but in doing so we lose the previous perception, and all that remains is its memory. Can we, and do we, compare the exact extension of these changing percepts in scanning a row of columns extended at right angles from the central line of vision—to mention the most recalcitrant of the posers of perspectival theory?1 I very much doubt it. The question refers to the convenient choice of projection planes, not to the experience of vision.· 1. La particolare situazione in cui ci troviamo a pensare e soprattutto a vivere, le nuove domande che le mutate condizioni storico-culturali pongono alla filosofia, possono trovare un modello di risposta se ci si volge indietro a quella particolare stagione della (...) filosofia tedesca che abbraccia i primi tre decenni del Novecento e che fu tragicamente strozzata e azzittita dal nazionalsocialismo. Non si tratta di affermare un ysteron-proteron, sarebbe troppo semplicistico, decisamente acritico e storicamente e filosoficamente inaccettabile. Accade però, nella storia, che dei fermenti non riescano a produrre frutti perché la temperie del tempo non lo permette oppure perché «inattuali», non pienamente adeguati al tempo, e rimangono quindi latenti finché non si verificano le condizioni ottimali per il loro sviluppo, divenendo in tal modo «adeguati » al tempo. Louis Althusser remained until his death in 1990 the most controversial of the “master thinkers” who emerged from the turbulent Parisian intellectual scene of the 1960s. The publication of his bestselling posthumous “autobiography”, L'avenir dure longtemps, has now refueled some of these controversies. Hugely influential, whether lauded or vilified, Althusser occupies a unique place in contemporary philosophy. What is certain is that Althusserian themes and motifs continue to constitute a vital region in materialist thought. The Althusserian Legacy is the first (...) collective attempt to draw up a balance sheet, not on Althusser alone but on the questions that his work helped to bring to the forefront of Marxist theory. The volume brings together work in history, philosophy, economics, sociology, and literary criticism, all of it derived from or significantly inflected by Althusser. Taken together, the essays assess soberly, critically, but always generously, the full extent of his legacy. The volume contains a lengthy interview with Jacques Derrida, a long-time friend and colleague of Althusser at the Ecole Normale in Paris, and concludes with obituaries by Derrida and Gregory Elliott. Perhaps only now, more than a decade after his active intellectual life has come to a close, is it possible to render sound, just judgments on the meaning and significance of this much-debated body of work.
