Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

Two theories dominate the current debate on group agency: functionalism, as endorsed by Bryce Huebner and Brian Epstein, and interpretivism, as defended by Deborah Tollefsen, and Christian List and Philip Pettit. In this paper, I will give a new argument to favour functionalism over interpretivism. I discuss a class of cases which the former, but not the latter, can accommodate. Two features characterise this class: First, distinct groups coincide, that is numerically distinct groups share all their members at all time. (...) Second, we have access to the inner mechanisms of the groups agents, because members know what they have decided on. Holton has drawn attention to a new semantic universal, according to which no natural language has contrafactive attitude verbs. Because factives are universal across natural languages, Holton’s universal is part of a major asymmetry between factive and contrafactive attitude verbs. We previously proposed that this asymmetry arises partly because the meaning of contrafactives is significantly harder to learn than that of factives. Here we extend our work by describing an additional computational experiment that further supports our hypothesis.

Despite having faced severe criticism in the past, mereological approaches to group ontology, which argue that groups are wholes and that groups members are parts, have recently managed a comeback. Authors such as Katherine Ritchie and Paul Sheehy have applied neo-Aristotelian mereology to groups, and Katherine Hawley has defended mereological approaches against the standard objections in the literature. The present paper develops the mereological approaches to group ontology further and proposes an analysis of group membership as parthood plus further restrictions. (...) While all mereological accounts agree that group members are parts of the group, it has become clear that this analysis is insufficient. I discuss three proposals to develop the mereological analysis of group membership and then put forward a combined solution to the puzzle. No natural language has contrafactive attitude verbs. Because factives are universal across natural languages, this means that there is a major asymmetry between contrafactives and factives. We previously hypothesised that this asymmetry arises partly because the meaning of contrafactives is significantly harder to learn than that of factives. Here we test this hypothesis by using a production-oriented computational experiment that overcomes two limitations of our previous experiments. We find that our results do not support our previous hypothesis.

Estimating word complexity is a well-established task in computer-assisted language learning. So far, however, complexity estimation has been largely limited to comprehension. This neglects words that are easy to comprehend, but hard to produce. We introduce semantic error prediction (SEP) as a novel task that assesses the production complexity of content words. Given the corrected version of a learner-produced text, a system has to predict which content words replace tokens from the original text. We present and analyse one example of (...) such a semantic error prediction dataset, which we generate from an error correction dataset. As neural baselines, we use BERT, RoBERTa, and LLAMA2 embeddings for SEP. We show that our models can already improve downstream applications, such as predicting essay vocabulary scores. (shrink)

Organisations are computing systems. The university’s sports centre is a computing system for managing sports teams and facilities. The tenure committee is a computing system for assigning tenure status. Despite an increasing number of publications in group ontology, the computational nature of organisations has not been recognised. The present paper is the first in this debate to propose a theory of organisations as groups structured for computing. I begin by describing the current situation in group ontology and by spelling out (...) the thesis in more detail. I then present the example of a sports centre to illustrate why one might intuitively think of organisations as computing systems. To substantiate the thesis, I introduce Piccinini’s restrictive analysis of physical computation. As I show, organisations meet all criteria for being computing systems. Organisations are structured groups with the function of manipulating medium-independent vehicles according to rules. Furthermore, I argue for the modal claim that this is a necessary feature of organisations. Having sketched the computational account of organisations, I compare it to other proposals in the literature. (shrink)

Over the years, he had planted close to 30,000 trees and shrubs on the property, trying to resuscitate a tired Wisconsin sand farm into some semblance of ecological health. 2 Leopold was keenly aware of fire's natural role in ecosystems, but sometimes there's more to fire and living with fire than energy flow, nutrient flush, and plant physiology. 3During the Leopolds' stay at the Shack, a neighbor's trash fire, fanned by a west wind, escaped its bounds and threatened to overtake the pines. Social kinds are heterogeneous. As a consequence of this diversity, some authors have sought to identify and analyse different kinds of social kinds. One distinct kind of social kinds, however, has not yet received sufficient attention. I propose that there exists a class of social-computation-supporting kinds, or SCS-kinds for short. These SCS-kinds are united by the function of enabling computations implemented by social groups. Examples of such SCS-kinds arereimbursement form,US dollar bill,chair of the board. ABSTRACTThe Theory of Event Coding predicts that exposure to affective cues can automatically trigger affectively congruent behaviour due to shared representational codes. An intriguing hypothesis from this theory is that exposure to aversive cues can automatically trigger actions that have previously been learned to result in aversive outcomes. Previous work has indeed found such a compatibility effect on reaction times in forced-choice tasks, but not for action selection in free-choice tasks. Failure to observe this compatibility effect for aversive cues in (...) free choice tasks suggests that control processes aimed at directing behaviour toward positive outcomes may overrule the automatic activation of affectively congruent responses in case of aversive cues. The Sense Complexity Dataset (SeCoDa) provides a corpus that is annotated jointly for complexity and word senses. It thus provides a valuable resource for both word sense disambiguation and the task of complex word identification. The intention is that this dataset will be used to identify complexity at the level of word senses rather than word tokens. For word sense annotation SeCoDa uses a hierarchical scheme that is based on information available in the Cambridge Advanced Learner’s Dictionary. The history of the terms ‘elixir’ and ‘alchemy’ seems paradoxical; derived from Greek, the Arabic al-iksīr signified a dry powder capable of transforming base metals into gold or silver. Evolving through the European languages, elixir has come to mean a magic liquid that can be ingested to cure illness. The second term, al-kīmiyāʼ, which was in its Arabic beginnings almost synonymous with elixir, took a different turn and changed its meaning from a miraculous substance into an abstract noun connoting the (...) art of alchemy. This article intends to show that these changes of meaning are linked to inevitable interrelations between the two synonyms and, consequently, the generally assumed etymology of the Arabic alkīmiyāʼ from the seemingly corresponding Greek expression χυμεία must be questioned. Of particular interest is the hitherto overlooked fact that al-kīmiyāʼ ends in a glottal stop, indicated by the hamza and being a consonant in its own right, which ultimately points to a non-Greek origin. The ontology of social objects and facts remains a field of continued controversy. This situation complicates the life of social scientists who seek to make predictive models of social phenomena. For the purposes of modelling a social phenomenon, we would like to avoid having to make any controversial ontological commitments. The overwhelming majority of models in the social sciences, including statistical models, are built upon ontological assumptions that can be questioned. Recently, however, artificial neural networks have made their way into (...) the social sciences, raising the question whether they can avoid controversial ontological assumptions. ANNs are largely distinguished from other statistical and machine learning techniques by being a representation-learning technique. That is, researchers can let the neural networks select which features of the data to use for internal representation instead of imposing their preconceptions. On this basis, I argue that neural networks can avoid ontological assumptions to a greater degree than common statistical models in the social sciences. I then go on, however, to establish that ANNs are not ontologically innocent either. The use of ANNs in the social sciences introduces ontological assumptions typically in at least two ways, via the input and via the architecture. (shrink)

Medieval bags or pouches have survived mainly in church treasuries, preserved in reliquaries and altars. Usually made of silk, they vary considerably in form, colour, motif and size. Although most surviving pouches have been interpreted as containers for relics that were safely stored away in church treasuries, the form of a sewn bag was not mandatory for wrapping a relic to be placed inside a reliquary or an altar. Nor were all bags intended for ecclesiastical use, as is evident from (...) the number of alms bags preserved in church treasuries. Through an analysis of textual sources and surviving items this article explores alternative uses of these highly tactile textiles that served as containers for valued personal belongings, either as an amulet while traveling, as a container of an individual’s relic donation to a church or even by means of theft. Worn close to the body, around the waist on a belt, around the neck and above or underneath garments, the softness and lightness of bags offered high comfort. Ornaments such as fringes, tassels or ribbons with beads invited wearers to touch it and play with it, thus deepening their engagement with the bag and its content. (shrink)

For most of its history, decision theory has investigated the rational choices of humans under the assumption of static preferences. Human preferences, however, change. In recent years, decision theory has increasingly acknowledged the reality of preference change throughout life. This Element provides an accessible introduction and new contributions to the debates on preference change. It is divided into three chapters. In the first chapter, the authors discuss what preference change is and whether we can integrate it into decision theory. In (...) the second chapter, they present models of preference change, including a novel proposal of their own. In the third and final chapter, they discuss how we can rationally choose a course of action when our preferences might change. A cross-cultural survey experiment revealed a widespread tendency to rely on a rule’s letter over its spirit when deciding which acts violate the rule. This tendency’s strength varied markedly across (k = 15) field sites, owing to cultural variation in the impact of moral appraisals on judgments of rule violation. Compared to laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether, and consequently exhibited more pronounced textualist tendencies. Finally, we evaluated a plausible mechanism for (...) the emergence of textualism: In a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (Ntotal = 5495) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an easily identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers and judges. É bem conhecida a oposição estabelecida por Kant entre experiência possível e dialética, na medida em que esta última é caracterizada como a “lógica da ilusão”. Ao mesmo tempo, o modo de pensar metafísico, que ocorre dialeticamente, em sentido kantiano, é uma tendência inevitável da razão, expressa na exigência formal de completude das categorias. Como o pensar, enquanto exercício livre da razão, é em si mesmo mais amplo do que a atividade de conhecer, própria do entendimento, o pensar contém o (...) conhecimento, embora este se qualifique pelas regras e pelos limites determinantes da objetividade. A pergunta que tentaremos formular é se essa relação continente-conteúdo não poderia configurar também uma dependência da experiência em relação ao raciocínio dialético, que estaria de algum modo indicada na função reguladora das idéias da razão. Nesse caso, a oposição formal entre conhecer e pensar seria inseparável da inclusão estrutural (dependência) da experiência no âmbito da razão. Na raiz do problema estaria talvez a tensão (dialética) entre a aspiração subjetiva de totalidade e as exigências objetivas de limitação e segmentação da experiência e a forma da experiência teria de ser finalmente concebida a partir de um fundo de inteligibilidade problemática. Dialectics and experienceThe separation of possible experience as objective knowledge and dialetics as a non-objective or non-theoretical knowledge is one of the most important aspects of kantian critical philosophy. But Kant also says that the activity of reason, as a pure thinking, has more amplitude than understanding knowledge. So we could say that theoric knowledge would depend on rational ( and non-theoretical) knowledge, as something contained in it. Em artigo inédito, Franklin Leopoldo e Silva desenvolve os sentidos da memória na produção da identidade, destacando as relações significativas do presente com o passado e o futuro na construção da história. Desse ponto, o autor acentua o papel das instituições nesse processo – um processo de exercício de poder, no qual se tem, na verdade, a institucionalização do poder – e, dentre elas, em particular a instituição universitária.

Se diserta sobre “RESISTENCIA TRIBUTARIA” JUSTIFICADA EN EL ECUADOR. Ello, porque gobierno del presidente Daniel Noboa estableció todo un “paquete” de “impuestos de guerra”, como la Contribución Temporal de Seguridad (CTS); un incremento del IVA, a discreción del presidente de la República, el pechaje del sector construcción, transferencias al exterior y otros impuestos. Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica (en adelante, la Ley), publicada en el Registro Oficial, Suplemento No. 516 del 12 de (...) marzo de 2024, trayendo a discusión los aspectos jurídicos que vician de posible inconstitucionalidad dicha Ley, con fundamento en la normativa constitucional y tributaria de Ecuador. Con la Ley, dado el contexto de su aprobación, el gobierno creó un ´impuesto de guerra´, para financiar una guerra inexistente, partiendo del hecho que la Corte Constitucional del Ecuador estableció que en el país no existe un “Conflicto Armado Interno” (CAI). Así lo estableció en sus Dictámenes 5-24-EE/24 del 9 de mayo de 2024 y 6-24-EE/24 del 13 de junio de 2024, en los que declaró inconstitucionales los decretos ejecutivos No. 250 de 30 de abril de 2024 y 275 del 22 de mayo de 2024, relacionados con el Estado de Excepción que ha regido en Ecuador desde el 10 de enero de 2024, soportado éste en la presunta existencia de un CAI, “decertado” y reconocido sin fundamento jurídico, pese a que no cumple con los supuestos fácticos y normativos fijados, con fuerza ius cogens, por el Derecho Internacional Humanitario (DIH)7 para ser calificado como tal. El ´impuesto de guerra´, fijado en la Ley, por inconstitucional, es confiscatorio. Los Dictámenes, en el plano de la reflexión tributaria, reflejan la patética violación al principio de la constitucionalidad y de la legalidad fiscal, resultando viciada de nulidad absoluta la Ley y, con ella, la configuración del tributo, porque el hecho imponible (CAI) es inexistente, implicando que el presupuesto establecido por la Ley para configurar cada `impuesto de guerra´ jamás tendrá materialización práctica (por inexistente) y nunca tendrá validez jurídica (por inconstitucional), resultando en un tributo confiscatorio, surgido contra la Carta Fundamental y evidente fraude a la legalidad tributaria del país, en perjucio del patrimonio personal o corporativo de los contribuyentes, residentes fiscales o establecimientos permanentes en el país a los que somete a un pago indebido sancionado en el artículo 122 10 , concordado con los artículo 306 al 307 del Código Tributario del Ecuador. La nulidad absoluta e ineficacia del hecho imponible, por inconstitucional, deriva en la invalidez plena y la irrelevancia constitucional del inexistente hecho generador del tributo -proveniente de un acto de naturaleza jurídica - por la no realización fáctica, tangible y concreta del presupuesto generatriz establecido (CAI) en la Ley para su configuración. Como consecuencia, nunca jamás surge válidamente la obligación tributaria, cuya exigencia resulta ineficaz, por ilegal e ilusoria. La obligación tributaria, tiene que calificarse, en tal sentido, como no nacida lícitamente en el ámbito fiscal. Con ello, habría de resultar confiscatorio el pago de la alicuota del `impuesto de guerra´ fijado por el gobierno ecuatoriano de modo inconstitucional abusando del ejercicio del poder tributario relacionado con la urgencia en materia económica. Ante las hondas repercusiones económicas que genera en la población y el sector productivo del país, se describen las posibles vías institucionales disponibles en la regulación ecuatoriana para impugnar la Ley ante la Corte Constitucional del Ecuador -o en la jurisdicción constitucional- sin menoscabo de la eventual activación de la competencia derogatoria de la Asamblea Nacional frente a la misma. Se reafirma el principio de justicia tributaria y la vigencia del Estado social de derechos y de justicia consagrado en la República del Ecuador y la plena efectividad de los derechos y garantías fundamentales de los hermanos ecuatorianos ubicados en la posición de destinatarios de un "impuesto de guerra" tan arbitrario como inconstitucional, que riñe con el enunciado constitucional y convencional del respeto a la dignidad humana y la incolumidad de la propiedad privada frente a actuaciones del Estado que representan un claro abuso en el ejercicio del poder público en desmedro de la legalidad fiscal, generador de un supuesto de patética injusticia tributaria adoptada a contracorriente de toda regulación en materia de impositiva con la publicación de la Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica. En la lucha contra conductas gubernamentales transgresoras de la dignidad humana y frente a leyes inconstitucionales que afectan los derechos fundamentales, la libertad económica y la propiedad privada de los hermanos contribuyentes ecuatorianos y sus empresas afectadas. Este esfuerzo intelectual, realizado por nuestra familia de abogados, es una reverencia a la gesta de nuestros libertadores y un llamado al pueblo ecuatoriano económicamente afectado a resistir, por medios institucionales, frente al pago de impuestos arbitrarios e ilegales que atentan contra los principios fundamentales del orden público económico previsto en la Ley Fundamental. Lo anterior, como una singular expresión reglada, lícita y avanzada de dar al traste con una ley orgánica fiscal tan arbitraria como injusta, activando los mecanismos de protección de los derechos fundamentales constitucionalmente establecidos en el Ecuador. La pretensión judicial traduciría, mutatis mutandis, en la activación institucional de la añeja figura de la "resistencia tributaria" (objeción fiscal, desobediencia tributaria), que, en sus orígenes, nació como expresión de la desobediencia civil frente a leyes impositivas injustas, con el precedente del escritor estadounidense Henry David Thoreau, encarcelado por negarse a pagar un tributo electoral, reticente a contribuir con la continuidad de la esclavitud y la financiación de la Guerra entre México y EEUU, basado en la idea de que las personas deben priorizar su conciencia sobre la obediencia a leyes injustas. -/- .
