Cyprian’s appropriation of Scripture and his theological emphases are closely connected with the circumstances of his congregation. As a case study in Cyprian’s biblical interpretation, this article considers all his quotations of and allusions to Philippians through the lens of his pastoral concerns: the unity of the Church; care for the poor and captive; discipline and repentance; and divine truth and eternal glory. The reading strategies Cyprian uses can be categorized as contextual exegesis, model, image, direct application, and prophetic fulfilment. (...) The study provides a fresh perspective on patronage and almsgiving in Cyprian, deepens our understanding of the reception of Paul, and elucidates the interplay of text, context and theology in an important exponent of early Latin exegesis. This article analyzes the photographic exhibit Yuyanapaq: Para Recordar, which was a product of the Peruvian Truth and Reconciliation Commission. It focuses specifically on the curatorial process and political desires shaping Yuyanapaq, and it examines the ways in which photographs were intended to intervene in and script a national consciousness and shared memory during and after Peru’s transition process. Exploring across the three iterations of Yuyanapaq, I ask how we might attempt to bear witness to past conflict without inadvertently perpetuating (...) its logic. (shrink)

In contexts of exposure to atypical stress or adversity, individual and collective resilience refers to the process of sustaining wellbeing by leveraging biological, psychological, social and environmental protective and promotive factors and processes. This multisystemic understanding of resilience is generating significant interest but has been difficult to operationalize in psychological research where studies tend to address only one or two systems at a time, often with a primary focus on individual coping strategies. We show how multiple systems implicated in human (...) resilience can be researched in the same study using a longitudinal, six-phase transformative sequential mixed methods study of 14- to 24-year-olds and their elders in two communities dependent on oil and gas industries. Data collection occurred over a 5-year period, and included: community engagement and the identification of youth health and well-being priorities; participatory youth-centric qualitative research using one-on-one semi-structured interviews and arts-based methods; survey of 500 youth at three time points to assess psychosocial health indicators and outcomes; collection of hair samples to assess stress biomarkers over time; youth-led ecological data collection and assessment of historical socio-economic development data; and community resource mapping with community elders. Analyzing data from these multiple systems will allow us to understand the interrelationship and impact of PPFPs within and across systems. To date, we have undertaken thematic and narrative qualitative analyses, and descriptive analyses of the preliminary ecological and survey data. As we proceed, we will combine these and grounded theory approaches with innovative techniques such as latent transition analysis and network analysis, as well as modeling of economic conditions and spatial analysis of human geographies to understand patterns of PPFPs and their inter-relationships. By analyzing the complexity of data collected across systems we are demonstrating the possibility of conducting multisystemic resilience research which expands the way psychological research accounts for positive development under stress in different contexts. This comprehensive examination of resilience may offer an example of how the study of resilience can inform socially and contextually relevant interventions and policies. (shrink)

Schizophrenia is characterised by marked language deficits, but it is not clear how these deficits arise from the alteration of genes related to the disease. The goal of this paper is to aid the bridging of the gap between genes and schizophrenia and, ultimately, give support to the view that the abnormal presentation of language in this condition is heavily rooted in the evolutionary processes that brought about modern language. To that end we will focus on how the schizophrenic brain (...) processes language and, particularly, on its distinctive oscillatory profile during language processing. Additionally, we will show that candidate genes for schizophrenia are overrepresented among the set of genes that are believed to be important for the evolution of the human faculty of language. These genes crucially include (and are related to) genes involved in brain rhythmicity. We will claim that this translational effort and the links we uncover may help develop an understanding of language evolution, along with the aetiology of schizophrenia, its clinical/linguistic profile, and its high prevalence among modern populations. Language has been argued to arise, both ontogenetically and phylogenetically, from specific patterns of brain wiring. We argue that it can further be shown that core features of language processing emerge from particular phasal and cross-frequency coupling properties of neural oscillations; what has been referred to as the language ‘oscillome’. It is expected that basic aspects of the language oscillome result from genetic guidance, what we will here call the language ‘oscillogenome’, for which we will put forward a list of (...) candidate genes. We have considered genes for altered brain rhythmicity in conditions involving language deficits: autism spectrum disorders, schizophrenia, specific language impairment and dyslexia. These selected genes map on to aspects of brain function, particularly on to neurotransmitter function. We stress that caution should be adopted in the construction of any oscillogenome, given the range of potential roles particular localized frequency bands have in cognition. Our aim is to propose a set of genome-to-language linking hypotheses that, given testing, would grant explanatory power to brain rhythms with respect to language processing and evolution. (shrink)

Despite their obvious importance to social and political life, custom and customary law have largely escaped philosophical scrutiny. There are important recent philosophical analyses of convention, but none of custom. And customary law has been recently neglected by the dominant legal positivism. One reason for the neglect of custom is the familiar dichotomy between nature and convention. Social practices are said to be either by nature, and therefore assumed to be unalterable, or they are said to be by convention, and (...) therefore assumed to be created at will. But customs arise neither simply from nature nor from deliberate stipulation, so they are excluded by the familiar opposition of nature and convention. Custom is a notoriously vague concept: custom seems both to be natural and conventional. I attempt to show how custom bridges human nature and social norms. I argue that custom must be analyzed into two more logically basic concepts: habit and convention. Custom is a habitual convention and a conventional habit. I discuss habit and convention in relation to contemporary psychology and analytic philosophy. Habit roots custom in the physiology of human nature while convention links custom to social norms. Aristotle pioneered this approach to custom by using two words to describe what we call custom: ethos and nomos. Ethos focuses our attention on the habitual dimension of custom while nomos focuses our attention on the conventional dimension of custom. I argue that the function of law is to remedy the deficiencies of custom: law is custom’s instrument for shaping its own evolution. (shrink)

In the United States, people may donate organs and tissues to a family member, friend, or anyone whose specific need becomes known to them. For example, in late 2003 dozens of people came forward to donate a kidney to a professional basketball player known to them only through his sports performances. People may also donate a kidney to no one in particular through a process known as nondirected donation. In nondirected donation, people donate a kidney to the organ allocation system (...) rather than to anyone known to them personally. There are limits, though, to generosity. People are usually not allowed to donate to groups of people, no matter the contours of the group, whether white, black, Catholic or Presbyterian, third-time liver recipient, and so on. As the agency that oversees national transplantation policy, the United Network for Organs Sharing does not allow this sort of restricted donation, though it appears that some regional Organ Procurement Organizations occasionally bend the rules when donors insist that their organs go to children or to first-time recipients. Those ad hoc arrangements are, however, the exception to the rule. (shrink)

This chapter corrects for Susan Sontag's undeserved neglect by contemporary moral philosophers by bringing awareness to some of the unique metaethical insights born of her reflections on photographic representations of evil. I argue that Sontag's thought provides fertile ground for thinking about: (1) moral perception and its relation to moral knowledge; and (2) the epistemic and moral value of our emotional responses to the misery and suffering of others. I show that, contrary to standard moral perception theory (e.g. Blum 1994), (...) Sontag holds that we can have general moral perceptual knowledge. I then explore Sontag's idea that certain emotional responses, like sympathy and compassion, can sometimes be impertinent, in virtue of their having false or illusory content. I explain why this is so, and show the epistemic and motivational problems it poses for moral sentimentalism. (shrink)

H. L. A. Hart, in his classic book Law, Liberty, and Morality, is unsuccessful in arguing that James Fitzjames Stephen’s observations about the role of vice in criminal sentencing have no relevance to a more general defense of legal moralism. He does, however, have a very important insight about the special significance of sexual liberty.

The problems that Millikan addresses in theories of concepts arise from an extensional view of concepts and word meaning. If instead one assumes that concepts are psychological entities intended to explain human behavior and thought, many of these problems dissolve.

Both Thomas Hobbes and John Austin identify civil law with commands issued by a sovereign; thus it is common to think of Austin’s theory of law as closely continuous with Hobbes’s view. Yet this “command of the sovereign” formulation masks deep differences between Hobbes and Austin, not only in their understandings of command and sovereign but also in the commitments that gave rise to their offering theories of law formulated in these terms. Nor is it correct to think that innovations (...) in Hobbes’s conception of law paved the way for Austin’s more full-blown legal positivism: Hobbes’s jurisprudence is, in fundamentals, closely akin to Thomas Aquinas’s natural law jurisprudence. ABSTRACTConfucianism tends to play only a marginal role in current theorizing about justice, which is a global pursuit dominated by Western theory and its strong tendency to assume that justice refers to some substantive conception of distributive, socioeconomic justice. This article examines and compares reconstructions of Confucian justice by Joseph Chan, May Sim, and Fan Ruiping. Each reconstruction makes reference to both classical and modern Western justice theory and thus each involves a comparative approach; indeed, each reconstruction seeks ultimately, in (...) its own distinctive fashion, to present a version of Confucian justice that is comparable with modern Western justice theory. In this article we assess, critically and comparatively, the tertium comparationis and the arguments in each reconstruction. The article is a critical reply to jesse kalin's "a note on singer and kant" ("ethics", 1968). Kalin had argued that kant's categorical imperative entails absurdly counterintuitive consequences--E.G. That it is wrong to punish people. Against kalin, It is argued that such consequences are not entailed by the categorical imperative if it is properly interpreted. A proper interpretation involves, For example, Distinguishing the categorical imperative's function as a criterion for imperfect duties from its function as a criterion for perfect duties.

During the Philippine-American War, the Anti-Imperialist League was the organizational vanguard of an anti-imperialist movement. Research on this period of U.S. imperialism has focused on empire building, ignoring the gendered activity of anti-imperialists in the metropole. The author outlines the constitutive relationship between gendered structures and experience that informed anti-imperialists' “contentious politics,” using archival sources of the Anti-Imperialist League and anti-imperialist debates in newspapers. The author shows how anti-imperialist leaders informally included women's monetary donations, labor, networks, and reputations while formally (...) excluding their full membership. Finally, the author shows how masculinist ambivalence, or the pattern of the gendered inclusions/exclusions of anti-imperialists, explains the incremental transformations and reproductions of gendered structures in anti-imperialists' contentious politics. The author suggests masculinist ambivalence has theoretical utility for explaining gendered inclusions and exclusions in movements that are not explicitly about gender conflict or change. (shrink)
