Der vorliegende Band enthalt sechs teilweise stark iiberarbeitete Aufsatze, die in der Zeit zwischen der Niederschrift des Buches Theorienstrnkturen und Theoriendynamik, Springer-Verlag 1973, im folgenden mit [Theoriendynamik] bezeichnet, und der Monographie The Strncturalist View of Theories. A Pos­ sible Analogue of the Bourbaki Programme in Physical Science, Springer-Ver­ lag 1979, im folgenden kurz [Strnkturalismus] genannt, entstanden sind. In diesen Abhandlungen werden jeweils gewisse Aspekte des strukturalistischen Theorienkonzeptes behandelt. Am starksten iiberarbeitet wurden die Auf­ satze II, IV, V und VI, die (...) urspriinglich in englischer Sprache erschienen waren. Vier der sechs Arbeiten, namlich I, III, IV und VI, bilden auBerdem erweiterte Fassungen von Vortragen. Obwohl das zweite Buch [Strnkturalismus] durch P. Feyerabends ausftihr­ liche Diskussion der strukturalistischen Auffassung im British Journal for the Philosophy of Science, Dezember 1977, angeregt worden ist, stellt es seinem Ansatz und Aufbau nach eher den Versuch einer systematischen Kurzdarstel­ lung des strukturalistischen Vorgehens nach seinem letzten Stande dar. Dem­ gegeniiber entstanden die hier verOffentlichten Artikel stets aus einem ganz be­ stimmten AnlaB. Diese Anlasse konnte man schematisch in drei Klassen unter­ teilen: Entweder ging es darum, eine anschauliche intuitive Ein/iihrnng zu lie­ fern (I und V); oder die Aufgabe bestand darin, die Beziehung zu anderen philosophischen Positionen. wie z. B. derjenigen L. Wittgensteins, H. Putnams, K. Poppers oder T. S. Kuhns. zu analysieren (II. This paper argues that social representations cannot be used as independent variables in causal explanations of social behaviour. It is shown that the structure of investigations often follows a causally explanatory design despite explicit statements to the contrary by the researchers. This fact is analyzed with three investigations. It is argued that verbal data used to assess the contents of a representation as independent variable are logically equivalent to data obtained from the “dependent” overt behaviour. Therefore these two kinds of (...) data must be seen as two illustrations of the same representational contents. The researchers’preference for using verbal data to assess the independent variable and the tendency to introduce a causal relationship between representation and behaviour is shown to result from misplacing folk-beliefs. Folk-beliefs about intentional causality, it is shown, pertain to the same level as other beliefs about the world on the part of the subjects. Hence they are part of the folk-representation itself and must be treated as such; their use in scientific accounts of the belief-action relationship is not implied by data on rational belief systems. It is suggested to conceptualize social representations as integral units of beliefs and action which may be used to explain causally subsequent contingent social events. The function of folk-beliefs in intentional causality for the self-concept of rational people and for social accountability is discussed. (shrink)

This paper investigates whether managerial rhetoric in the Management Discussion and Analysis section of 10-K filings can help gauge the level of managerial opportunism in a firm. We find that the use of trust-related words is connected to inefficient investment decisions and poor operating performance. Furthermore, firms making more frequent use of trust-related words are subject to less monitoring by institutional investors or analysts. Their accounting also relies more heavily on discretionary accruals. These results are consistent with the notion that (...) managerial rhetoric to advertise trustworthiness points towards agency problems plaguing the firm. (shrink)

The subject of this paper is a characterization of the $\Sigma_1$ -definable set functions of Kripke-Platek set theory with infinity and a uniform version of axiom of choice: $KP\omega+(uniform\;AC)$ . This class of functions is shown to coincide with the collection of set functionals of type 1 primitive recursive in a given choice functional and $x\mapsto\omega$ . This goal is achieved by a Gödel Dialectica-style functional interpretation of $KP\omega+(uniform\;AC)$ and a computability proof for the involved functionals.

A concept for a primitive angiospermous branch system is given in order to have a starting point for the derivation of the diverse and highly differentiated branch systems observed in contemporary angiosperms. Hitherto Troll's (1964, 1969) comparative study of the synflorescences in this plant group — developed out predominantly on herbaceous plants — was the most comprehensive and sophisticated treatment dealing with branch systems. Unfortunately, the work on tropical tree architecture by Hallé et al. (1978) has no reference to the (...) classical studies of Troll and his pupils. Thus Müller-Doblies and Weberling (1984) emphasized the high degree of terminological incompatibility between the two works. Angiosperms are seen as a monophyletic plant division. Consequently, the branch system of the first primitive angiosperms must be the starting point in the evolution of the abundant diversity of branch systems and growth forms of modern angiosperms. If it is accepted that primitive angiospermous shoots were terminated by a large flower, one may assume, that the reproductive end of the shoot was enriched by paracladia early in evolution, thereby developing a terminal inflorescence instead of a single flower. Thus the primitive shoot unit was divided into a basal vegetative region — the trophotagma, branching retardively — and the reproductive terminal region, the anthotagma, branching simultaneously. It is demonstrated through a selection of different examples, that the construction of such a system possesses the options for several modifications, enabling the evolution of the abundant diversity of branch systems which characterizes contemporary angiosperms. The question is: How is a global peace order possible in the shape of an international legal system? The article focuses on the problems of international law within the present system of the UN and tries to actualise the Kantian concept of perpetual peace (1795), with regard to positions of international lawyers. A peaceful international order must have the means to protect against unlawful violence, even by armed forces, e.g. to intervene against gross violations of fundamental human rights. It is (...) necessary that even the great powers are obliged to act only within this legal framework. In this paper I discuss the nature of the “I” (or “self”) and whether it is presupposed by the very existence of conscious experiences (as that which “has” them) or whether it is, instead, in some way constituted by them. I argue for the former view and try to show that the very nature of experience implies a non-constituted synchronic and diachronic transcendence of the experiencing “I” with regard to its experiences, an “I” which defies any objective characterization. Finally I (...) suggest that the self, though irreducible to inter-experiential relations, is not a “separately existing entity”, but should be conceived of as a dimension , namely the dimension of first-personal manifestation of the experiences. This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. The Old Turkish inscriptions that were written roughly between the beginning of the eighth and the middle of the ninth century A.D. and represent the first testimonies of a Turkish language, include important information about contacts of the ruling Türks and later the Uighurs, who were also Turkish-speaking, with other peoples inside and outside of their el, i.e., their steppe empire. This information is partly explicit, when, for example, we read about a delegation being sent to the other side, and (...) partly implicit, by which we mean outside influences that we can trace in the texts in different ways. Buridan endorses the basic idea that q follows from p iff it is impossible that p is true but q is false. Since he also accepts the law that, if p is impossible, the conjunction (p ∧ q) must be impossible, he comes to regard the principle ‘Ex impossibili quodlibet’ (EIQ) as basically correct. However, his logic is based on a ‘nominalist’ view according to which propositions are tokens of spoken, written or thought language existing in space of time, and (...) the truth of such a proposition presupposes that it exists. This conception prompted Buridan to modify the definition of ‘consequence’, but none of his attempts was fully successful. Yet, a large part of his theory of consequences is based on the usual account of necessary truth-conservation. As regards principle EIQ, Buridan distinguishes two variants of impossibility. Proposition p is possible iff the state of affairs as described by p is possible; this doesn’t guarantee, however, that p is ‘possibly true’. E.g. ‘No proposition is negative’ is considered by Buridan as describing a possible state of affairs, but this proposition is not possibly true, because in order to be true, it would have to exist, and as soon as it comes into existence, it becomes false. Accordingly, EIQ requires that the antecedent p is really impossible and not only impossibly true. (shrink)

A case study is presented of a recent proposal by the major metrology institutes to redefine four of the physical base units, namely kilogram, ampere, mole, and kelvin. The episode shows a number of features that are unusual for progress in an objective science: for example, the progress is not triggered by experimental discoveries or theoretical innovations; also, the new definitions are eventually implemented by means of a voting process. In the philosophical analysis, I will first argue that the episode (...) provides considerable evidence for confirmation holism, i.e. the claim that central statements in fundamental science cannot be tested in isolation; second, that the episode satisfies many of the criteria which Kuhn requires for scientific revolutions even though one would naturally classify it as normal science. These two observations are interrelated since holism can provide within normal science a possible source of future revolutionary periods. (shrink)
