The attitudes of women patients with cancer were explored when they were invited to participate in one of three randomised trials that included chemotherapy at two university centres and a satellite centre. Fourteen patients participating in and 15 patients declining trials were interviewed. Analysis was based on the constant comparative method. Most patients voiced positive attitudes towards clinical research, believing that trials are necessary for further medical development, and most spontaneously argued that participation is a moral obligation. Most trial decliners, (...) however, described a radical change in focus as they faced the actual personal choice. Almost no one got an impression of clinical equipoise between treatments in the trials, and most patients expressed discomfort with randomisation. A patient’s choice to participate was mainly determined by whether the primary focus was on treatment effect or on adverse effects. Both knowledge about and feelings towards trials originated mostly from the media, although paradoxically the media were largely seen as untrustworthy. Mistrust was shown towards the pharmaceutical industry, and although most patients originally trusted that doctors primarily pursued the interest of patients, they did not trust the adequacy of doctors or industry in maintaining self-regulation. From the "Red Menace" to Tiananmen Square, the United States and China have long had an emotionally tumultuous relationship. Richard Madsen's frank and innovative examination of the moral history of U.S.-China relations targets the forces that have shaped this surprisingly strong tie between two strikingly different nations. Combining his expertise as a sinologist with the vision of America developed in _Habits of the Heart_ and _The Good Society_, Madsen studies the cultural myths that have shaped the perceptions of (...) people of both nations for the past twenty-five years. The dominant American myth about China, born in the 1960s, foresaw Western ideals of economic, intellectual, and political freedom emerging triumphant throughout the world. Nixon's visit to China nurtured this idea, and by the 1980s it was helping to sustain America's hopefulness about its own democratic identity. Meanwhile, Chinese popular culture has focused on the U.S., especially American consumer goods—Coca-Cola was described by the _People's Daily_ as "capitalism concentrated in a bottle." Today we face a new global institutional and cultural environment in which the old myths no longer work for either Americans or Chinese. Madsen provides a framework for us to think about the relationship between democratic ideals and economic/political realities in the post-Cold War world. What he proposes is no less than the foundation for building a public philosophy for the emerging world order. (shrink)

This article is a qualitative study charting the dimensional range of a particular type of translative phenomenon, namely, intralingual translation within educational practice. Theoretically, the article is based on a broadened concept of translation that encompasses any kind of sign translation, including the transcending of a language-internal comprehension barrier, such as the one between scientific and lay linguistic registers. Further, the article assumes that such intralingual translation is conceptually identical with the interpretive procedures found in didactic practice, given that the (...) central aim of (much) pedagogy is to make sense of new and unfamiliar knowledge – typically embedded in abstract, scientific concepts – to learners. The article also draws on the Bakhtinian concept of “dialogized heteroglossia,” i.e., the view that different language varieties may be fused into, and brought into dialogue with each other within, one and the same text. Empirically, the article investigates intralingual translation in didactic practice through analyses of textbooks and one classroom lecture in five different academic disciplines, spanning both the natural and social sciences and the humanities. The analyses identify a handful of different translational strategies, some of which are shared across several disciplines, and others of which are unique to a single discipline only. (shrink)

One of the core tenets of cognitive metaphor theory is the claim that metaphors ground abstract knowledge in concrete, first-hand experience. In this paper, I argue that this grounding hypothesis contains some problematic conceptual ambiguities and, under many reasonable interpretations, empirical difficulties. I present evidence that there are foundational obstacles to defining a coherent and cognitively valid concept of “metaphor” and “concrete meaning,” and some general problems with singling out certain domains of experience as more immediate than others. I conclude (...) from these considerations that whatever the facts are about the comprehension of individual metaphors, the available evidence is incompatible with the notion of an underlying conceptual structure organized according to the immediacy of experience. Most eighteenth- and nineteenth-century portrait paintings have eyes staring outward at the beholder. A minority of these eyes have slightly elevated pupils in comparison to the iris. These off-centre pupils are not the norm, but they occur regularly in works by skilful European portrait painters in the eighteenth and nineteenth centuries. This article takes a closer look at selected portrait paintings by Danish artists Jens Juel and Constantin Hansen and argues that the discrepancy between the pupils and the rest of (...) the paintings creates an illusion of movement or presence when looking the paintings in the eye. The discrepancy creates an aesthetic effect corresponding with Merleau-Ponty’s concept of internal discordance. According to Merleau-Ponty, visual art can create the illusion of movement by portraying its parts in different moments. These internal discordances make the painting “move” because the beholder unconsciously creates a fictive link between the parts thereby expanding time in space. The article combines presence theory (Jean-Luc Nancy and Hans Ulrich Gumbrecht), phenomenology (Merleau-Ponty) and art theory and perception theory (James Elkins, Dominic McIver Lopes and Michael Fried) in order to study the effects and possible reasons for creating pupils out of sync with the rest of the painting. When Ian Hacking won the Holberg International Memorial Prize 2009 his candidature was said to strengthen the legitimacy of the prize after years of controversy. Ole Jacob Madsen, Johannes Servan and Simen Andersen Øyen have talked to Ian Hacking about current questions in the philosophy and history of science.

“One who elects to serve mankind by taking the law into his own hands thereby demonstrates his conviction that his own ability to determine policy is superior to democratic decision making. [Defendants’] professed unselfish motivation, rather than a justification, actually identifies a form of arrogance which organized society cannot tolerate.” Those were the words of Justice Harris L. Hartz at the sentencing hearing of three nuns convicted of trespassing and vandalizing government property to demonstrate against U.S. foreign policy. Citizens engaging (...) in civil disobedience are indeed at times accused of being arrogant because they apparently think their own political judgment is superior to that of the democratic majority. This paper examines and evaluates the claim that dissenters are epistemically arrogant. Contrary to the dominant viewpoint in the literature, I argue that epistemic arrogance involves inflating the epistemic worth of one’s view. Indeed, the most plausible charge against civil dissenters consists of two claims: (A) civil dissenters have a higher degree of rational certainty in P than is warranted, and (B) civil dissenters use a method of expression that requires a higher level of rational certainty than is warranted in the propositions that their political view is right and the injustice they fight is substantial. I argue that civil disobedience does not necessarily involve epistemic arrogance. Whether an act of civil disobedience evinces epistemic arrogance has to be determined on a case-by-case basis depending on the extent to which each dissenter lives up to (A) and (B). (shrink)

An increasing number of people worldwide are living with chronic conditions that have an aspect of bodily fragility as part of the condition or as an effect of treatment. In this article, I explore the temporal experience of bodily fragility and the particularities of consciousness states among people with the chronic condition osteogenesis imperfecta (OI) in Denmark. My aim is threefold. First, my goal is to give an insight into life with OI, a rare and rarely studied condition. Second, I (...) shed light on bodily fragility, a theme that lives in the shadows of other analytical foci in anthropology. Third, I will contribute to the anthropological understanding of the connection among body, physical environment, and consciousness. I argue that the lifeworlds of people with OI are haunted by mental and bodily memories and fearful future scenarios, which makes the past and the future collapse into the present. (shrink)

This article addresses two great global challenges of the 2020s. On one hand, the accelerating climate crisis and, on the other, the deepening crisis of representation within liberal democracies. As temperatures and water levels rise, rates of popular confidence in existing democratic institutions decline. So, what is to be done? This article discusses whether sortition – the ancient Greek practice of selecting individuals for political office through lottery – could serve to mitigate both crises simultaneously. Since the 2000s, sortition has (...) attracted growing interest among activists and academics. Recently it has been identified in countries like the UK and France as a mechanism for producing legitimate political answers to the climate challenge. However, few theoretical reflections on the potentials and perils of sortition-based climate governance have yet emerged. This article contributes to filling the gap. Based on a critique of the first successful case of sortition used to enhance national environmental policy – in Ireland in 2017–18 – we argue that sortition-based deliberation could indeed speed up meaningful climate action whilst improving the health of democratic systems. However, this positive outcome is not preordained. Success depends not only on green social movements getting behind climate sortition but also on developing flexible, context-specific designs that identify adequate solutions to a number of problems, including those of power ; expertise ; and participation. This essay goes beyond the dominant conception of constituent power developed by Emmanuel Sieyès and Carl Schmitt by excavating an alternative through the practices of twentieth-century workers’ councils and the interpretations of council democracy by Cornelius Castoriadis and Hannah Arendt. Interpreters of the constituent power often agree on its fundamentally antagonistic relation to constituted power, hereby making constituent politics a momentary experience, which cannot be sustained in constituted politics. Council democracy, instead, discloses a modality of politics, which bridges the gap (...) between constituent power and political form in order to provide institutional means through which the spirit of revolution can survive the founding moment. With this alternative concept of council democratic constituent power, this essay contributes to radical democratic theory by stipulating ways in which institutions can be rethought radically democratic as a way in which constituent power (creativity, novelty, freedom) can be institutionally approximated and continually reexperienced. Development projects in Sub-Saharan Africa propose to alleviate hunger in rural areas by introducing new agricultural practices and technologies, yet there is limited empirical evidence of how an agricultural intervention can lead farming households to transition to food security. Research on food security pathways considers agricultural interventions that increase farmers’ income to be particularly effective for reducing food insecurity. Consistent with this stance, Malawian agricultural policy aims to address hunger by encouraging smallholder farmers to intensify and commercialize maize production. This (...) paper explores if smallholders’ market and livelihood orientations do indeed lead them to favor an income pathway to food security. Qualitative analysis of 60 smallholder farmer interviews in Malawi found that, upon achieving improvements in production yields and diversity, rather than commercialize, many farmers re-organized their production and consumption to reduce market dependency. Farmers deployed this strategy to increase their food security, explaining that the choice to self-provision food and farming inputs was both an expression of farming identity and a lived understanding of their marginal position in commodity markets. The author finds that, in failing to consider how production relations affect food access, scholarship inadequately theorizes farm-level food security transitions and reproduces discursive framings of hunger. Food sovereignty narratives more accurately captured what mattered for Malawian smallholders’ food security, suggesting that engagement with this concept could improve scientific understandings of food security transitions. Two of the dominant frameworks for criticizing capitalism and liberal democracy in contemporary political theory is Socialist republicanism, on the one hand, and radical democracy, on other hand. Whereas radical democratic thinkers have for decades criticized liberal democracy for being elitist, hierarchical and outright anti-popular, socialist republicans have for the last 10 years developed critiques of capitalism centred on the neo-republican idea of freedom as non-domination and proposed various arguments for workplace democracy and cooperative forms of ownership. Despite the common (...) ambition of uncovering hierarchical relations of economic, political and social power, and creating new egalitarian and participatory modes of political organization, no systematic comparison of socialist republicanism and radical democracy exists. This paper fills this gap by comparing the different understandings of (a) institutions and (b) political action and (c) their diverging historical and political relations to socialism. (shrink)

This article brings together two concepts of ethical practice into a single construct that describes how modern corporations can responsibly meet the information needs of their stakeholder networks in a way that promotes both corporate self-interest and widespread distributive justice. Internet technology is providing corporations with transformative tools that permit and encourage the exercise of social responsibility through "dynamic transparency." "Prudential justice" is a concept representing a set of values that can provide an ethical justification for corporate implementation of dynamic (...) transparency. This article argues that by using dynamic transparency in accordance with the provisions of prudential justice, firms can avoid many crises and manipulative or deceptive information transfers, can fulfill their responsibilities regarding stakeholders' informational rights, and can undergo an organizational culture transformation that allows them to move from pure corporate egoism to a beneficial mix of self-interest and corporate social responsibility. This work brings together three themes whose relationship has gone unexplored in the recent literature of philosophy: the transcendental phenomenology of Edmund Husserl, the phenomenological ontology of Martin Heidegger and the discipline of logic, especially formal logic. Part One and Two of the work present a detailed explication of Husserl's and Heidegger's philosophy of logic which are respectively characterized as an archeology of logic based upon transcendental phenomenological criticism and a radical phenomenology of logic based upon phenomenological criticism which issues (...) from a concern with the question of the meaning of Being. Part Three, then, offers a comparative analysis combined with a critical appraisal of these two philosophies of logic in order to achieve a more penetrating understanding of the relationship between Husserl and Heidegger. Thus, in one sense, this work takes the domain of logic and the varying approaches to it by Husserl and Heidegger as a clue to the similarities and dissimilarities within the thinking of these two phenomenologists, especially with regard to the understanding each has of the goal and method of phenomenology, and the results proper to phenomenological reflection. Law and the Formation of Modern Europe explores processes of legal construction in both the national and supranational domains, and it provides an overview of the modern European legal order. In its supranational focus, it examines the sociological pressures which have given rise to European public law, the national origins of key transnational legal institutions and the elite motivations driving the formation of European law. In its national focus, it addresses legal questions and problems which have assumed importance in parallel (...) fashion in different national societies, and which have shaped European law more indirectly. Examples of this are the post-1914 transformation of classical private law, the rise of corporatism, the legal response to the post-1945 legacy of authoritarianism, the emergence of human rights law and the growth of judicial review. This two-level sociological approach to European law results in unique insights into the dynamics of national and supranational legal formation. (shrink)

How should we evaluate the global protests against the financial crisis from 2011 and onwards? Do demonstrations on central squares such as Syntagma, Puerta de Sol and Zucotti Park point towards alternative democratic models beyond representative democracy? This article identifies a schism between the protests as events and the protests as self-organisation. Whereas the protests as events remains the dominant interpretation of the protests – delivered with negative connotations by Ivan Krastev and with positive consequences by Slavoj Žizek and Alain (...) Badiou – this article will investigate the protests as self-organisation by emphasizing some of the many examples of autonomous political institution-building and creation of permanent structures of political participation, which have appeared as natural continuations of the protests. I argue that the protests as self-organisation can be seen as re-actualisations of the practices and ideals of council democracy as interpreted by Hannah Arendt and Cornelius Castoriadis. By interpreting the protests through the prism of council democracy, I argue that the manifold political and societal initiatives that have appeared in the wake of these protests attempt to realise a specific notion of democratic autonomy and political freedom. ABSTRACT Cornelius Castoriadis is one of the most important democratic thinkers in the second half of the twentieth century, and his theory of autonomy and the self-instituted character of society are fundamental to many post-Marxist theories of democracy. The role of the council system in Castoriadis' work, though, has rarely been investigated, and his analysis of the twentieth century workers' councils of has seldom been connected to his important concepts of autonomy and the instituting power. The article remedies this lack (...) of engagement with Castoriadis' analysis of the council system and argues that the emergence of workers' councils in Castoriadis' own lifetime, during the Hungarian Revolution of 1956, provided a crucial impetus for his formulation of a theory of autonomy. Moreover, the article argues that the role of the council system in Castoriadis' work provides a privileged vantage point in order to nuance the critique – voiced by for example Jürgen Habermas and Claude Lefort – that Castoriadis exclusively valorise constituent politics without properly appreciating the importance of ordinary politics. Contrary to this interpretation, the article demonstrates how Castoriadis look to the councils to understand how democratic politics entails both freedom to act anew and the need for institutional structure. In public debate GMPs are oftenreferred to as being unnatural or a violationof nature. Some people have serious moralconcerns about departures from what is natural.Others are concerned about potential risks tothe environment arising from the combination ofhereditary material moving across naturalboundaries and the limits of scientificforesight of long-term consequences. To addresssome of these concerns we propose that anadditional element in risk assessment based onthe concept of familiarity should beintroduced. The objective is to facilitatetransparency about uncertainties inherent inthe risk assessment of (...) the GMP. Familiarityconventionally involves data and experiencerelating to the plant species and the ecosystemin question. We would like to extend thisconcept to the molecular level of plantbreeding and suggest that GMP characteristicsshould be compared to a reference baselinedetermined by conventional breeding techniques.Three GMPs are ranked according to familiarityat the plant and ecosystem level and themolecular level. The approach may help tointegrate discussion of the scientificarguments and moral questions raised in thedebate about GMOs by providing an operationalscheme within which moral concerns are broughtwithin the framework of science-based riskassessment. Risk assessment studies of herbicide resistant sugarbeet have revealed no risks to human health or the environment.Indeed it appears that commercial growth of this crop mightsecure benefits such as decreased pesticide use and increasedbiodiversity. However, widespread resistance to GM crops such asherbicide resistant sugar beet still persists in Europe. It isargued that this is not just because people do not know therelevant facts. Rather it is because popular resistance to GMfood is driven in part by concerns other than the fear (...) ofnarrowly defined risks to health and the environment. These otherconcerns include an aversion to commercial monopoly and anegative view of pesticide use in general. Herbicide resistantsugar beet may also be perceived as a ``Trojan horse,'''' i.e., acrop whose licensing would create a precedent and make it morelikely that other, less environmentally friendly, crops will beapproved within the current strictly technical and science-basedrisk assessment procedures. To meet these public concerns, a kindof technology assessment reflecting factors such as benefits andconsumer choice is called for. (shrink)

ABSTRACT:The link between firm corporate social performance (CSP) and executive compensation could be driven by a sorting effect (a firm’s CSP is related to the initial levels of compensation of newly hired executives), or by an incentive effect (incumbent executives are rewarded for past firm CSP). Existing empirical work focuses exclusively on the incentive effect. In contrast, in this paper we explore the sorting effect of firm CSP on the initial compensation of newly hired executives. In doing so, we develop (...) a novel theoretical approach based on an integration of stakeholder theory and human capital theory, suggesting a positive association between the initial compensation of executives and firm CSP strengths and concerns. It also suggests that the strength of this relationship varies between different executive roles (as a function of stakeholder-management responsibilities). We find support for this theoretical framework in a large sample of newly-hired executives employed by Standard & Poor 1500 firms. (shrink)

Digital social analytics is a subset of Big Data methods that is used to understand the social environment in which people and organizations have to act. This paper presents an analysis of eight projects that are experimenting with the use of these methods for various purposes. It shows that two specific technological features influence the work with such methods in all the cases. The first concerns the need to distribute choices about the structure of data to third-party actors and the (...) second concerns the need to balance machine intelligence and human intuition when automating the analysis. These features set specific conditions for knowledge production, and the paper identifies two opposite approaches for engaging with each of these conditions. These features and approaches are finally combined into a two-dimensional affordance space that illustrates how there is flexibility in the way project leaders interact with the features of the data environment. It thereby also shows how digital social analytics come to have different affordances for different projects. (shrink)

In the second half of 1993, two articles — one then published and one as yet to be published — posed challenges to my presuppositions about the nature of business ethics. The first of these was Andrew Stark’s “What’s the Matter with Business Ethics?” This article is now well-known in business ethics circles with many being highly critical of its philosophical content and Stark already having had some opportunity to reply to these critics. According to him, business ethics as it (...) has developed in the literature and in academia is irrelevant to most practicing managers since what has been produced in the academy is too general, too theoretical and too impractical. No doubt there will be more said about and by Stark on whether academic business ethics can fit into the practical work world of corporate managers. For my part, I suggest that while Stark’s critique of business ethics contains some flawed understanding and analysis, it is a critique that nonetheless needs to be taken seriously by those who wish to see business ethics flourish in the corporation. I will have some more to say about Stark’s position later in this commentary. (shrink)
