I argue that in order to solve the main difficulties confronted by the classical versions of the causal theory of action, it is necessary no just to make room for intentions, considered as irreducible to complexes of beliefs and desires, but also to distinguish among several types of intentions. I present a three-tiered theory of intentions that distinguishes among future-directed intentions, present-directed intentions and motor intentions. I characterize each kind of intention in terms of its functions, its type of content, (...) its dynamics and the rationality and time constraints that bear on it. Since the 1909 work of Carathéodory, formulations of thermodynamics have gained ground which highlight the role of the the binary relation of adiabatic accessibility between equilibrium states. A feature of Carathéodory's system is that the version therein of the second law contains an ambiguity about the nature of irreversible adiabatic processes, making it weaker than the traditional Kelvin-Planck statement of the law. This paper attempts first to clarify the nature of this ambiguity, by defining the arrow of time in thermodynamics (...) by way of the Equilibrium Principle. L’article présente une étude critique des fondements méthodologiques de l’analyse économique du droit traditionnelle dans laquelle le droit est conçu comme le résultat optimal d’une comparaison de coûts et d’avantages sociaux. Cette procédure judiciaire qui vise en fait à simuler des solutions de marché “socialement efficientes” présuppose inévitablement l’omniscience du juge. Cependant dans le contexte de l’équilibre général, l’analyse économique du droit traditionnelle n’a pas de raison d’être, alors qu’elle s’avère impraticable dans le monde réel où elle serait pourtant nécessaire (...) afin de résoudre des problèmes de coordination entre les individus. A cet égard la théorie économique de l’Ecole Autrichienne qui insiste sur les problèmes informationnels de la société et qui décrit le droit comme une procédure de coordination fondée sur des règles abstraites de juste conduite, semble fournir des fondements plus appropriés pour une approche économique du droit. L’article utilise la méthodologie Autrichienne pour reconsidérer l’analyse économique du droit tout en insistant à la fois sur la dimension institutionnelle et la dimension éthique du droit. Le problème central est l’interdépendance entre le droit et l’ordre de marché, mais il est analysé dans des termes fondamentalement différents de ceux de l’analyse traditionnelle.The paper presents a critical analysis of the methodological foundations of conventional law and economics, where law is generally described as the optimal outcome ot a judicial balancing of social costs and benefits. This law making procedure which aims at simulating “socially efficient” market outcomes inevitably presupposes Judges’ omniscience. Nevertheless, in this context of full coordination, this type of law has no raison d’être, whereas it turns out to be infeasible in the real world where it would be necessary in order to solve information and coordination problems. In this respect, Austrian economic and legal theory which focuses on the knowledge problem of society and which describes law as a coordination procedure built on abstract rules of just conduct, seems to provide more appropriate foundations for an economic analysis of law. This paper uses the Austrian approach to reconsider economic analysis of law in a way that allows for both the institutional and the ethical dimensions of law. The central problem seems to lie in the interdependance of law and the ethical dimensions of law. Many of the commentators—let’s ignore their sex for the moment—suggested including women in the Feyerabend conference. Then the question was raised, “but are they of the right quality, status, rank?” That is, do they bring down the average quality of the conference in virtue of their being of inferior status, or, in Vincenzo Politi’s words, not “someone whose work is both relevant to the topic of the conference and also as widely recognized as the work of the invited speakers” (HOPOS-L (...) archive, “CFP: Feyerabend Conference,” Tuesday, July 17, 2012, 14:57:20)? It is extremely important that such a discussion of quality, status, and rank recognize the scourge of evaluation bias and its long-term and pervasive consequences. One well-designed study this past year, published by the National Academy of Sciences, established prominent evaluation bias among both male and female science faculty in their evaluations of a student applying for a managerial job, who was randomly assigned either a male or a female name (Moss-Racusin et al. 2012). These professors examined the qualifications of the students and decided whether to hire them, what salary to give them, and whether to mentor themand howmuch to do so.The resultswere that both male and female scientists hired more men, gave them higher salaries, and offered more mentoring to them, even though themale applications were identical to the female applications. When probed about their reasons for not hiring or mentoring the female applicants, the professors explained that they based their decisions on the inferior competence of the applicant: the female applicants were perceived as less competent by all professors (with identical applications between males and females). This is what “evaluation bias” looks like, and it has been established in many, many contexts since the 1970s—this is only the most recent. (shrink)

Otto Neurath (1882-1945) was a highly unorthodox thinker both in philosophy and economics. The contributions to this sparkling new book conclude that Neurath touched on many of the most critical problems of economic theory during its formative years as a modern discipline. His economics provide insights into the foundational problems of modern economics and should encourage contemporary economic theorists to critically reflect their own hidden presumptions.

Why concern oneself with Otto Neurath’s economic thought in its historical context? Could anything be more out of fashion than a theory proposing a centrally managed planned economy? Than the views of a theorist whose ideas on in-kind economic planning drove the notion of economic planning to its utmost extreme ? Indeed, Neurath’s ideas appeared too radical and utopian even for the social democrats of the 1920s. So why give even a second thought to them today? Would it not be (...) better to follow the advice a colleague gave me in the 1980s and to pass over Neurath’s “youthful sins” silently so as not to tarnish the reputation that – finally, after a lengthy delay – has been accredited to Neurath for his impressive philosophical achievements within the framework of logical empiricism?In the years since the 1980s, however, Neurath’s economic writings have attracted much more interest than anyone would previously have suspected. Today we are aware of the fact that Neurath formulated ideas at an unexpectedly early stage that are currently relevant in ecological economy, social choice theory and developmental economy. And that his reflections vis-à-vis “associational socialism” could provide interesting impulses for a new theory of socialism. Viewed from this perspective, Neurath’s status is secure as a precursor of theoretical developments and debates that are in full swing today. But is that enough? After all, if the role of the precursor is an endearing one, isn’t it also quite thankless? For even in the areas in which Neurath can be regarded as a precursor, the relevant questions are posed today with far greater precision and with reference to current facts – so why should anyone concern oneself with a precursor whose fundamental assumptions differ so greatly from those of the overwhelming majority of economists working today? In an oft-quoted paper entitled “To What Extent Was the Austrian School Marginalist?”, Streissler challenged earlier interpretations of Menger’s work that had accorded equal billing to Menger alongside Jevons and Walras as co-discoverer of the marginalist principle. In Streissler’s words, Menger was exceptionally great because he created marginalism at the same time that he surpassed it: the essence of Menger’s contribution to economic science was to be located in his subjectivist vision of the economy rather than in marginalism per se. Streissler’s interpretation presaged Professor Kirzner’s subsequent rendering of Menger’s work, namely, that Menger’s subjectivist vision of the system as whole forms the very core of his contribution. This paper argues that, while these modern subjectivist reinterpretations are more faithful to Menger’s work than the earlier restrictive marginalist interpretations, they have nonetheless failed to identify Menger’s ‘vision.’ It is submitted here that this vision is to be located in Menger’s intention of constructing a theory of complex economic phenomena. Building upon Alfred Whitehead’s “process philosophy”, this paper provides a philosophically realist reconstruction of Menger’s theory of complex phenomena before investigating its pervasiveness and significance in the economic sphere.Dans un article célèbre intitulé “To What Extent Was the Austrian School Marginalist?”, Streissler remit en cause les interprétations antérieures de l’oeuvre de Menger qui faisaient de ce dernier un des co-inventeurs du principe marginaliste au même titre que Jevons et Walras. Ces réinterprétations subjectivistes modernes de l’oeuvre de Menger sont certes plus fidèles à celle-ci que les interprétations étroites antérieures données sous l’angle marginaliste. Ces réinterprétations modernes n’ont pas pour autant identifié la vision qu’avait Menger de la sphère économique. L’article suggère que cette vision se situe dans la théorie des phénomènes complexes de l’économie que Menger se propose d’élaborer. En se fondant sur “ la pensée du procès ” d’Alfred Whitehead, l’article propose une reconstruction philosophico-réaliste de la théorie des phénomènes complexes de Menger avant d’illustrer sa pertinence et son importance dans la sphère économique. In Autopoiesis and Cognition, Humberto R. Maturana and Franscico J. Varela state that “the way an autopoietic system maintains its identity depends on its particular way of being autopoietic, that is, on its particular structure, different classes of autopoietic systems have different classes of ontogenies”. With this in mind, in this article I develop how this conception of autopoietic systems is both present in, and operates through, Wynter’s employment of space and place, poetry, and wonder.

An exchange between Christopher Tollefsen and Steven Jensen highlights the contrast between a theory of natural law that relies purely first-person account of intention and one that relies more on elements from the physical world. Tollefsen, a proponent of New Natural Law theory, argues that the fetus’s death in the Phoenix case was an unintended side effect of saving the mother’s life. Jensen criticizes NNL generally and particularly for this conclusion. He argues that facts outside the agent make this procedure (...) immoral. This essay provides a more neutral perspective on the debate by laying out each argument clearly and identifying the fundamental issues present in the discussion. A fundamental and probably irreconcilable difference involves whether certain intentions should be included in the species of an action or characterized as fairly or unfairly accepted side effects. Nevertheless, the differences between these two accounts are not as great as they initially appear. (shrink)

Este estudio, centrado en su Tractatus de sex dierum operibus, pone de manifiesto que la causalidad es el eje de su comprensión ontológica de la realidad :desde el punto de vista filosófico, la causalidad explica (...) la existencia real de lo múltiple a partir del Uno, y en la perspectiva teológica muestra la creación como obra de Dios Uno y Trino. La causalidad implica, para Thierry, la participación y garantiza por tanto la capacidad causal de los seres naturales, con la consiguiente autonomía real en su orden, pero dependiente de la causa suprema, sin la cual nada existiría.
