Beyond Liminality: Ontologies of Abundant Betweenness examines the concept of liminality in the social sciences and humanities, and advocates for a more critical use of the concept while offering more precise alternatives. Originally conceived in response to the near-universal ritualization of changes of status (i.e., 'rites of passage'), liminality was a welcome and much-needed correction to the reigning static and structural models of culture at the time. However, it soon escapes its initial realm and was enthusiastically--and most uncritically--absorbed by many (...) if not all scholarly disciplines. The very success of the concept suggests that there is something about it that resonates with our own cultural sentiments. However, the assumptions that underlie diagnoses of liminality are seldom noted and even more seldom analyzed and critiqued. This book examines the history of the concept, its evolution, and its current status, and asks whether liminality accurately reflects lived realities which might better be described by fluidity, hybridity, multiplicity, constant motion and recombination, and abundant betweenness. Av noen teoretikere har dette kravet til fortjent straff blitt forstått som et negativt krav, som setter en begrensning på oppnåelsen av straffens formål. Straffen må da være «ikke ufortjent». I denne artikkelen argumenterer jeg for at en slik forståelse av fortjenesteideen er utilstrekkelig. Straff som fortjent må ansees som et positivt, selvstendig formål for strafferetten. Artikkelen drøfter hvordan vi bør forstå kravet om likhet for loven i Grl. § 98. Vi spør hvorvidt en appell til likhet for loven har selvstendig normativ funksjon, og eventuelt hvorfor og hva som kreves for at likhetskravets skal realiseres. Artikkelen tar utgangspunkt i et behov for avklaring av disse spørsmålene, da verken forarbeidene til grunnlovsrevisjonen i 2014 eller etterfølgende rettsvitenskapelig litteratur, i særlig grad avklarer hva likhet for loven betyr. Vi utvikler en teori om at likhetsprinsippet i § (...) 98 er et grunnprinsipp for retten som fastlegger begrunnelsesbyrden ved utformingen av lov og annen regulering, og ved rettsanvendelsen. Likhetsprinsippet innebærer at likebehandling krever i seg selv ingen begrunnelse, mens ulikebehandling må kunne begrunnes i henhold til kravene i andre ledd. De to leddene i paragrafen er derfor etter vårt syn uatskillelige: Første ledd stadfester hva som er utgangspunktet, mens andre ledd presiserer hva som ikke regnes som relevante begrunnelser for ulikhet. Likhetskravet er dermed ikke et krav om likt utfall, men et krav om likeverdighet, som vi hevder er en konstitutiv verdi for verdien av politisk rettferdighet. Den forståelsen av likhetskravet i § 98 som vi utvikler, knytter første og andre ledd i § 98 sammen, og åpner for at også første ledd kan bli mer aktivt brukt av domstolene. (shrink)

Contemporary Western societies are obsessed with the “obesity epidemic,” dieting, and fitness. Fat people violate the Western conscience by violating a thinness norm. In virtue of violating the thinness norm, fat people suffer many varied consequences. Is their suffering morally permissible, or even obligatory? In this paper, I argue that the answer is no. I examine contemporary philosophical accounts of oppression and draw largely on the work of Sally Haslanger to generate a set of conditions sufficient for some phenomena to (...) count as oppression, and I illustrate the account’s value using the example of gender oppression. I then apply the account to fat people, examine empirical evidence, and argue that the suffering of fat people counts as oppression. (shrink)

Until recently most scholars have viewed Kierkegaard as a philosopher, a theologian, a psychologist, or a social thinker. Professor Eller sees Kierkegaard first and foremost as a religious thinker, and states that Kierkegaard himself felt his works could be best understood if they were read with this in mind. Partly restored by Vincent Déroche, a small Corinthian capital found during the “grande fouille” of Delphi, and never previously published, features a highly original figurative decoration. On the two preserved sides, the front-facing depiction of a feline’s head is surrounded by feathers and “stems,” motifs whose origins lie in Egyptian religious iconography. The animal probably represents the cat goddess Bubastis. This type of capital can be compared to Corinthian capitals referred to as “chimera capitals,” a well-documented series from the late (...) Hellenistic and Imperial periods in Greece and Italy. It also shares similarities with Hathoric and Egyptian capitals known in Rome. However, the Delphi example remains unique and, in the absence of an archaeological context, its dating cannot be determined precisely. A relatively broad chronological range has been suggested, ranging from the middle of the 1st to the middle of the 2nd century AD. During this period, Egyptian cults are well attested in Phocis and Boeotia. Although Plutarch dedicated his treatise De Iside et Osiride to his friend Clea, superior of the Thyads of Delphi and devoted to Osirian rites, archaeological evidence of potential Egyptian cults in Delphi has so far been limited to a statuette of Isis. Do the cat heads imply a connection with the cult of Artemis, which has been associated with Bubastis since the time of Herodotus? In the absence of further documentation, it would be prudent to describe this small Delphic capital as “enigmatic.”. (shrink)

Objective Standards of care regarding obstetric management of life-threatening anomalies are not defined. It is hypothesised that physicians' management of these pregnancies is variable and influenced by demographic factors. Design A questionnaire was mailed to members of the Society of Maternal–Fetal Medicine with valid US addresses assessing obstetric management of both ‘uniformly lethal’ (eg, anencephaly, renal agenesis) and ‘uniformly severe, commonly lethal’ (eg, trisomy 13 and 18) anomalies. Respondents were asked to answer as if not limited by state/institutional restrictions. Fisher's (...) exact or χ2 tests were used as appropriate and correction made for multiple comparisons in analyses that were not prespecified. Results The response rate was 36% (732/2038). Nearly 100% of respondents discuss termination for both uniformly and commonly lethal anomalies. In continuing pregnancies, with patient request for obstetric non-intervention 99% of providers would comply for either uniformly or commonly lethal anomalies. The majority ‘encourage’ such management, but some were non-directive or discouraged this management. In continuing pregnancies, with patient request for full obstetric intervention the majority of respondents was willing to comply for both uniformly (71%) and commonly (82%) lethal anomalies. While most practitioners ‘discouraged’ full intervention, some were non-directive or encouraged this management. Demographics and severity of anomaly influenced counselling. Conclusion Discrepancies exist regarding the management of life-threatening fetal anomalies. Patients may be offered different options based on practitioner demographics. The majority of physicians comply with patient wishes. Differences were noted when comparing the management of lethal with that of severe commonly lethal anomalies, suggesting that practitioners make a distinction when counselling patients. (shrink)

A theory from the behavioral and social sciences is presented from the structuralist point of view. A more comprehensive theory-net is outlined, some basic terms and core assumptions are formulated, and an expansion of the theory towards two intended applications is given. Finally, some results of a first empirical test of the theory are reported. The aim of the paper is to show that the structuralist account of scientific theories is not confined to mathematical theories from the natural sciences, but (...) can also be applied to relatively informal constructions of the behavioral and social sciences. Background: Managing HIV treatment is a complex multi-dimensional task because of a combination of factors such as stigma and discrimination of some populations who frequently get infected with HIV. In addition, patient-provider encounters have become increasingly multicultural, making effective communication and provision of ethically sound care a challenge. Purpose: This article explores ethical issues that health service providers in the United States and Botswana encountered in their interaction with patients in HIV care. Research design: A descriptive qualitative design was used (...) to collect data from health service providers and patients using focused group discussions. This article is based on responses from health service providers only. Participants and context: This article is based on 11 focused group discussions with a total sample of 71 service providers in seven US sites and one Botswana site. Ethical considerations: Ethical review boards at all the study sites reviewed the study protocol and approved it. Ethical review boards of the study’s coordinating centers, Rutgers University and the University of California at San Francisco, also approved it. The study participants provided a written informed consent to participate. Findings: HIV service providers encountered ethical challenges in all the four Beauchamp and Childress’ biomedical ethics of respect for patients’ autonomy, beneficence, justice, and nonmaleficence. Discussion: The finding that HIV service providers encounter ethical challenges in their interaction with patients is supported by prior studies. The ethical challenges are particularly prominent in multicultural care and resource-constrained care environments. Conclusion: Provision of HIV care is fraught with ethical challenges that tend to pose different issues depending on a given care environment. It is important that strong partnerships are developed among key stakeholders in HIV care. In addition, health service providers need to be provided with resources so they can provide quality and ethically sound care. (shrink)

A leading political theorist’s groundbreaking defense of ideal conceptions of justice in political philosophy Throughout the history of political philosophy and politics, there has been continual debate about the roles of idealism versus realism. For contemporary political philosophy, this debate manifests in notions of ideal theory versus nonideal theory. Nonideal thinkers shift their focus from theorizing about full social justice, asking instead which feasible institutional and political changes would make a society more just. Ideal thinkers, on the other hand, question (...) whether full justice is a standard that any society is likely ever to satisfy. And, if social justice is unrealistic, are attempts to understand it without value or importance, and merely utopian? Utopophobia argues against thinking that justice must be realistic, or that understanding justice is only valuable if it can be realized. The revival of Aristotelian virtue ethics can be seen as a response to the modern problem of disenchantment, that is, the perceived loss of meaning in modernity. However, in Virtue and Meaning, David McPherson contends that the dominant approach still embraces an overly disenchanted view. The orphaned son of an Anglican clergyman, David Hartley was originally destined for holy orders. Declining to subscribe to the Thirty-Nine Articles, he turned to medicine and science yet remained a religious believer. This, his most significant work, provides a rigorous analysis of human nature, blending philosophy, psychology and theology. First published in two volumes in 1749, Observations on Man is notable for being based on the doctrine of the association of ideas. It greatly influenced scientists, theologians, social reformers (...) and poets: Samuel Taylor Coleridge, who named his eldest son after Hartley, had his portrait painted while holding a copy. Volume 2 is particularly concerned with human morality and the duty and expectations of mankind. Many guidelines and commentators endorse the view that clinical research is ethically acceptable only when it has social value, in the sense of collecting data which might be used to improve health. A version of this social value requirement is included in the Declaration of Helsinki and the Nuremberg Code, and is codified in many national research regulations. At the same time, there have been no systematic analyses of why social value is an ethical requirement for clinical research. Recognizing this (...) gap in the literature, recent articles by Alan Wertheimer and David Resnik argue that the extant justifications for the social value requirement are unpersuasive. Both authors conclude, contrary to almost all current guidelines and regulations, that it can be acceptable across a broad range of cases to conduct clinical research which is known prospectively to have no social value. The present article assesses this conclusion by critically evaluating the ethical and policy considerations relevant to the claim that clinical research must have social value. This analysis supports the standard view that social value is an ethical requirement for the vast majority of clinical research studies and should be mandated by applicable guidelines and policies. Dark matter is a fundamental component of the standard cosmological model, but in spite of four decades of increasingly sensitive searches, no-one has yet detected a single dark-matter particle in the laboratory. An alternative cosmological paradigm exists: MOND (Modified Newtonian Dynamics). Observations explained in the standard model by postulating dark matter are explained in MOND by proposing a modification of Newton's laws of motion. Both MOND and the standard model have had successes and failures – but only MOND has repeatedly (...) predicted observational facts in advance of their discovery. In a final, short summary of his life and works, David Hume wrote My Own Life as he suffered from gastrointestinal issues that ultimately killed him. Despite his bleak prognosis, Hume remains lighthearted and inspirational throughout. He discusses his life growing up, his family relationships, and his desire to constantly improve his works and his reputation as an author. He confesses, "I have suffered very little pain from my disorder; and what is more strange, have... never suffered a moment's (...) abatement of my spirits; insomuch that were I to name the period of my life which I should most choose to pass over again, I might be tempted to point to this later period." This short biography ends with a series of letters from Hume's close friend and fellow author Adam Smith to their publisher William Strahan, recounting Hume's death and giving a stirring eulogy in honor of their friend. To the extent that dualism is even taken to be a serious option in contemporary discussions of personal identity and the philosophy of mind, it is almost exclusively either Cartesian dualism or property dualism that is considered. The more traditional dualism defended by Aristotelians and Thomists, what I call hylemorphic dualism, has only received scattered attention. In this essay I set out the main lines of the hylemorphic dualist position, with particular reference to personal identity. First I argue that overemphasis (...) of the problem of consciousness has had an unhealthy effect on recent debate, claiming instead that we should emphasize the concept of form. Then I bring in the concept of identity by means of the notion of substantial form. I continue by analyzing the relation between form and matter, defending the traditional theses of prime matter and of the unicity of substantial form. I then argue for the immateriality of the substantial form of the human person, viz. the soul, from an account of the human intellect. From this follows the soul's essential independence of matter. Finally, although the soul is the immaterial bearer of personal identity, that identity is still the identity of an essentially embodied being. I explain how these ideas are to be reconciled. Moral and social philosophers often assume that humans beings are and ought to be autonomous. This tradition of individualism, or atomism, underlies many of our assumptions about ethics and law; it provides a legitimating framework for liberal democracy and free market capitalism. In this powerful book, David Weissman argues against atomistic ontologies, affirming instead that all of reality is social. Every particular is a system created by the reciprocal causal relations of its parts, he explains. Truthmakers have come to play a central role in David Armstrong's metaphysics. They are the things that stand in the relation of truthmaking to truthbearers. This chapter focuses on the relation. More specifically, it discusses a thesis Armstrong holds about truthmaking that is of special importance to him; namely, the thesis that truthmaking is an internal relation. From the author of Wittgenstein's Poker and Would You Kill the Fat Man?, the story of an extraordinary group of philosophers during a dark chapter in Europe's history On June 22, 1936, the philosopher Moritz Schlick was on his way to deliver a lecture at the University of Vienna when Johann Nelböck, a deranged former student of Schlick's, shot him dead on the university steps. Some Austrian newspapers defended the madman, while Nelböck himself argued in court that his onetime teacher (...) had promoted a treacherous Jewish philosophy. David Edmonds traces the rise and fall of the Vienna Circle—an influential group of brilliant thinkers led by Schlick—and of a philosophical movement that sought to do away with metaphysics and pseudoscience in a city darkened by fascism, anti-Semitism, and unreason. Zhuangzi and the Becoming of Nothingness offers a radical rereading of the Daoist classic Zhuangzi by bringing to light the role of nothingness in grounding the cosmological and metaphysical aspects of its thought. _A powerful treatise that demonstrates the existence of altruism in nature, with surprising implications for human society_ Does altruism exist? Or is human nature entirely selfish? In this eloquent and accessible book, famed biologist David Sloan Wilson provides new answers to this age-old question based on the latest developments in evolutionary science. From an evolutionary viewpoint, Wilson argues, altruism is inextricably linked to the functional organization of groups. “Groups that work” undeniably exist in nature and human society, although special (...) conditions are required for their evolution. Humans are one of the most groupish species on earth, in some ways comparable to social insect colonies and multi-cellular organisms. The case that altruism evolves in all social species is surprisingly simple to make. Yet the implications for human society are far from obvious. Some of the most venerable criteria for defining altruism aren’t worth caring much about, any more than we care much whether we are paid by cash or check. Altruism defined in terms of thoughts and feelings is notably absent from religion, even though altruism defined in terms of action is notably present. The economic case for selfishness can be decisively rejected. The quality of everyday life depends critically on people who overtly care about the welfare of others. Yet, like any other adaptation, altruism can have pathological manifestations. The study of human judgment and its limitations is essential to an understanding of the processes involved in the acquisition of scientific knowledge. With that end in mind, David Faust has made the first comprehensive attempt to apply recent research on.

The “ultimate objective” of this book, says David Schmidtz, “is to examine the degree to which being moral is co-extensive with being rational”. For Schmidtz, an “end” gives us a reason for action provided that its pursuit is not undercut by some other end. Morality has a two-part structure. A person’s goal is “moral” if “pursuing it helps [her] to develop in a reflectively rational way,” provided its pursuit does not violate “interpersonal moral constraints”. Interpersonal constraints are imposed by (...) “collectively rational” social institutions, institutions that “make people in general better off by nonexploitative means”. Schmidtz’s view is a form of “actualism.” Our reasons are given by our actual goals, subject to the qualification mentioned above, and moral constraints are given by actually existing collectively rational institutions. Schmidtz concedes that this framework cannot guarantee that it is rational for every agent to be moral, and he concedes that his moral theory might be incomplete. Nevertheless, he argues, “morality and rationality make room for each other in a variety of ways”. (shrink)
