Ce changement a un nom qui est aussi un des grands impensés de la philosophie du XXe siècle : la «perception artificielle». A travers les textes d'Edmund Husserl, Jacques Derrida et Bernard Stiegler et en s'appuyant sur des cas empruntés tant aux jeux vidéos (...) et aux dispositifs de simulation qu'au cinéma, Elsa Boyer se livre à une enquête philosophique à la fois radicale et profonde. Car c'est la perception elle-même que son artificialité l'amène à repenser, par-delà l'opposition entre le réel et l'imaginaire. The stakeholder approach offers the opportunity to consider corporate responsibility in a wider sense than that afforded by the stockholder or shareholder approaches. Having said that, this article aims to show that this theory does not offer a normative corporate responsibility concept that can be our response to two basic questions. On the one hand, for what is the company morally responsible and, on the other hand, why is the corporation morally responsible in terms of conventional and post-conventional perspectives? The (...) reason why the stakeholder approach does not offer such a definition, as we shall see, is because the normative stakeholder approaches tend to confuse the social validity with the moral validity or legitimacy. It leads us to a conventional definition of corporate moral responsibility (CMR) that is not relevant to the pluralistic and global framework of our societies and economies. Cities of the past enjoyed rich soundscapes full of organic sounds. Such sounds can be hard to hear, even for those that are listening, in many of today’s cities and neighborhoods. Evaluating the sounds of life in urban neighborhoods can be one method of determining the health and vibrancy of an area. A silent neighborhood, one not devoid of sound or noise, but rather missing the sounds of human and animal life, can be detrimental to the community and its residents. (...) Ownership is universal and ubiquitous in human societies, yet the psychology underpinning ownership intuitions is generally not described in a coherent and computationally tractable manner. Ownership intuitions are commonly assumed to derive from culturally transmitted social norms, or from a mentally represented implicit theory. While the social norms account is entirelyad hoc, the mental theory requires prior assumptions about possession and ownership that must be explained. Here I propose such an explanation, arguing that the intuitions result from the interaction of (...) two cognitive systems. One of these handles competitive interactions for the possession of resources observed in many species including humans. The other handles mutually beneficial cooperation between agents, as observed in communal sharing, collective action and trade. Together, these systems attend to specific cues in the environment, and produce definite intuitions such as “this is hers,” “that is not mine.” This computational model provides an explanation for ownership intuitions, not just in straightforward cases of property, but also in disputed ownership (squatters, indigenous rights), historical changes (abolition of slavery), as well as apparently marginal cases, such as the questions, whether people own their seats on the bus, or their places in a queue, and how people understand “cultural appropriation” and slavery. In contrast to some previous theories, the model is empirically testable and free ofad hocstipulations. (shrink)

Este libro aborda la relación entre arquitectura y mentalidades educativas. Muestra cómo los imaginarios dominantes son materializados en los espacios arquitectónicos de los colegios oficiales de Bogotá, al captar los movimientos sociales y culturales que los impulsan. Se parte del hecho de que los espacios arquitectónicos nos rodean y nos en-vuelven, y están presentes en cada detalle de nuestras vidas; así, un espacio particular, un rincón, una esquina, un salón o una habitación, que por momentos son o fueron parte de (...) lo vivido, al evocarlos hacen recordar lo ocurrido en su interior, e ir más allá y soñar con lo que pudo haber sido, con lo que fue, con lo que es o con lo que será. Es aquí donde el\' orden imaginario desempeña un papel clave en la vivencia y percepción de los espacios ya que estos se inscriben como "una nueva antropología del deseo", que nos permite determinar las formas de actuación socialmente construidas. Se combinan, entonces, el frío y el calor; lo frío del objeto arquitectónico que adquiere sentido cuando se encuentra con el calor de la vida. Es así como se pueden determinar las condiciones de posibilidad de una institución, un con-cepto: despojándolas de las explicaciones tradicionales, para de esta manera re-conocer que el objeto arquitectónico llamado "escuela" no es solo una construcción física, sino que adquiere múltiples interpretaciones producto de su intención de uso y de las proyecciones ideológicas y saberes sobre la educación. Habitar un territorio es tomarlo, marcarlo con nuestras emociones, sentimientos e ilusiones; en otras palabras, es construirlo, y re-construirlo, de manera permanente, a partir de nuestros imaginarios. Since the 2008 financial crisis, Europe's largest banks have largely remained unchallenged. Is this because of the structural power banks continue to hold over states? This article challenges the view that states are sheer hostages of banks’ capacity to provide credit to the real economy—the conventional definition of structural power. Instead, it sheds light on the geo-economic dimension of banks’ power: key public officials conceive the position of “their own” banks in global financial markets as a crucial dimension of state (...) power. State priority toward banking thus results from political choices as to what structurally matters most for the state. Based on a discourse analysis of parliamentary debates in France, Germany, and Spain, as well as on a comparative analysis of the implementation of a special tax on banks, this article shows that power dynamics within states largely shape political priorities toward banking at both domestic and international levels. John and Curran have convincingly shown that Scanlonian contractualism is a valuable resource for evaluating pandemic response policies, and that we should reject cost–benefit analysis in favour of a contractualist framework. However, they fail to consider the part of contractualism that Scanlon constructed precisely to deal with the question of when the state can restrict individuals from making choices that are harmful to themselves and others: the value of choice view. In doing so, they leave it open for opponents of (...) lockdowns to misuse contractualism to justify mistaken policies. This is because the most powerful contractualist objections to locking down are likely to be based on the VoC. When we apply the value of choice view, we see that a lockdown policy’s justifiability depends on the extent to which particular values of choice are found to be threatened by the policy in question, and what safeguards policy-makers have put in place to increase the value of choice and protect people from the harmful consequences of lockdown. Without the VoC, it is harder to explain why lockdowns, to be non-rejectable, must have certain features. With the VoC, the case for contractualism over cost benefit analysis can be made even stronger. (shrink)

Over recent decades, developments in network governance have seen governments around the world cede considerable authority and responsibility to commercial migration intermediaries for recruiting and managing temporary migrant labour. Correspondingly, a by-product of network governance has been the emergence of soft employment regulation in which voluntary codes of conduct supplement hard legal employment standards. This paper explores these developments in the context of temporary migrant workers employed in Australian horticulture. First the paper analyses the growing use of temporary migrant labour (...) in this industry. It then describes how different types of intermediaries interact with this workforce. The paper then outlines both hard and soft employment regulations, and contrasts them with actual employment conditions, questioning how a network governance approach has affected this vulnerable workforce. The paper concludes that changes in network governance of migration and employment relations have emasculated formal legal regulation, leaving market forces to operate without effective or ethical constraints at the expense of the public good. A part of the scientific literature consists of intermediate results within a longer project. Scientists often publish a first result in the course of their work, while aware that they should soon achieve a more advanced result from this preliminary result. Should they follow the proverb “a bird in the hand is worth two in the bush”, and publish any intermediate result they get? This is the normative question addressed in this paper. My aim is to clarify, to refine, and (...) to assess informal arguments about the choice whether to publish intermediate results. To this end, I adopt a rational decision framework, supposing some utility or preferences, and I propose a formal model. The best publishing strategy turns out to depend on the research situation. In some simple circumstances, even selfish and short-minded scientists should publish their intermediate results, and should thus behave like their altruistic peers, i. e. like society would like them to behave. In other research situations, with inhomogeneous reward or difficulty profiles, the best strategy is opposite. These results suggest qualified philosophical morals. (shrink)

Traditionally, liberals have confined religion to the sphere of the ‘private’ or ‘non-political’. However, recent debates over the place of religious symbols in public spaces, state financing of faith schools, and tax relief for religious organisations suggest that this distinction is not particularly useful in easing the tension between liberal commitments to equality on the one hand, and freedom of religion on the other. This article deals with one aspect of this debate, which concerns whether members of religious communities should (...) receive exemptions from regulations that place a distinctively heavy burden on them. Drawing on Habermas’ understanding of churches as ‘communities of interpretation’, we explore possible alternatives to both the ‘rule-and-exemption’ approach and the ‘neutralist’ approach. Our proposal rests on the idea of mutual learning between secular and religious perspectives. On this interpretation, what is required is (i) the generation and maintenance of public spaces in which there could be discussion and dialogue about particular cases, and (ii) evaluation of whether the basic conditions of moral discourse are present in these spaces. Thus deliberation becomes a touchstone for the building of a shared democratic ethos. (shrink)

Research ethics review is a critical aspect of the research governance framework for human subjects research. This usually requires that research protocols be submitted to a research ethics committee for review and approval. This has led to very rapid developments in the domain of research ethics, as RECs proliferate all over the globe in rhyme with the explosion in human subjects research. The work of RECs has increasingly become elaborate, complex, and in many cases urgent, necessitating supporting rules and procedures (...) of operation. Guidelines for elaborating standard operating procedures for the functioning of RECs have also been proposed. The SOPs of well-placed and well-resourced RECs have tended to pay much attention to details, resulting, as a consequence, in generally long, elaborate, intricate and complex SOPs; a model that can hardly be replicated by other committees, equally under ethics review pressures, but working under much more constraining conditions in resource-destitute environments. In this paper, we looked at the content and length of SOPs from African RECs and compared them to the World Health Organization ’s guidelines as the gold standard. We also looked at the SOPs from the Ethics Review and Consultancy Committee of the Cameroon Bioethics Initiative that we elaborated in a simplified way in 2013, and compared them to the WHO’s guidelines and to the other SOPs. Sixteen SOPs from 14 African countries were collected from various sources. Their average length was of 30 pages. By comparison to the guidance of the WHO, only six of them were found acceptable with more than 70 % of the criteria from the gold standard that were fully described. Among those six, two of them were very long and detailed, while the four remaining SOPs ranged from 16 to 24 pages. The ERCC SOPs are seven pages long but maintain all that is of essence for the rigorous, efficient and timely review of protocols. We are convinced that, because of their brevity, simplicity, clarity and user-friendliness, the ERCC SOPs recommend themselves as a model template to, at least, committees similarly situated and/or circumstanced as the ERCC of the Cameroon Bioethics Initiative is. In fact, brevity, clarity, simplicity and user-friendliness are recognized values. Whatever is brief and clear is better than what is not and saves time. What is simple and user-friendly is better than what is not even though the two have the same aims because it saves both time and mental energy. And if this be true in general, it is even truer of the context and its peculiar constraints that we are addressing. (shrink)

Among various case studies addressing the reception of relativity, very few deal with Portugal at either the international or the national level. The national literature on the topic has mainly concentrated on the reactions to relativity of the Portuguese mathematical community. The absence of Portuguese astronomers alongside Eddington during the 1919 expedition to Principe, then a Portuguese island, has been implicitly equated with the astronomical community's lack of interest in the event. In reception studies dealing with general relativity, analysis has (...) tended to focus on the physics and mathematics communities, less on the astronomers. Given that relativity was born at the interface of physics, mathematics and astronomy, reactions of members of these scientific communities depended on differences in shared traditions, values, problems and expectations, as well as on individual practitioners' idiosyncrasies. This paper addresses the contributions of the overlooked Portuguese astronomical community, evaluates the actions and reactions of its members to the expedition and assesses their role in the process of appropriation of relativity. A radical thinking of space remains for phenomenology a difficulty, which Heidegger has been concerned with. He developed an existential conception of the spatiality of Dasein in Being and Time, which he abandoned in his later philosophy; according to its “turn,” this philosophy proposes a notion of emptiness to describe spatial experience. The paper endorses the view that this notion makes possible a thinking of space in its essence. Pursuing further the reflection concerning the empty space, Maldiney advocates the influence (...) of the East Asian tradition on this issue. However, given that none of these authors considers dance as an art susceptible to disclose space in its essential vacuity, this paper aims to argue that there is a true choreographic empty space. Estas páginas examinan la naturaleza del desafío presente a las democracias latinoamericanas desde la perspectiva de relevantes compromisos democráticos hemisféricos. A la luz de tales compromisos, la reciente crisis política hondureña puede ser considerada una grave regresión: no simplemente por la intervención militar en el derrocamiento de José Manuel Zelaya, sino por el abandono del concepto de que la democracia es un derecho humano y es deber de los gobiernos preservarla y defenderla. Within anthropology, as elsewhere in the human sciences, there is a tendency to divide knowledge making into two separate poles: conceptual (theory) vs. empirical (ethnography). In Theory Can Be More than It Used to Be, Dominic Boyer, James D. Faubion, and George E. Marcus argue that we need to take a step back from the assumption that we know what theory is to investigate how theory—a matter of concepts, of analytic practice, of medium of value, of professional ideology—operates in (...) anthropology and related fields today. They have assembled a distinguished group of scholars to diagnose the state of the theory-ethnography divide in anthropology today and to explore alternative modes of analytical and pedagogical practice. Continuing the methodological insights provided in Fieldwork Is Not What It Used to Be, the contributors to this volume find that now is an optimal time to reflect on the status of theory in relation to ethnographic research in anthropology and kindred disciplines. Together they engage with questions such as, What passes for theory in anthropology and the human sciences today and why? What is theory's relation to ethnography? How are students trained to identify and respect anthropological theorization and how do they practice theoretical work in their later career stages? What theoretical experiments, languages, and institutions are available to the human sciences?
