Trouvés dans une brocante, les quinze cahiers du journal d’Emilie Serpin (1837-1914) sont un formidable document sur la trajectoire sociale d’une fille d’instituteur qui fut, de 1861 à 1871, institutrice privée dans deux familles nobles de l’Anjou, avant de devenir elle-même, par un mariage tardif et inespéré, mère de famille. Tenu de manière régulière de 1864 à 1871, ce journal a deux faces : journal de piété d’une jeune femme qui, après avoir perdu son fiancé, se réfugie dans une pratique (...) religieuse intense, mais aussi chronique sociale de la vie des familles nobles que sa position lui permet d’observer de l’intérieur de manière très critique. Riche « source » pour l’histoire sociale et l’histoire des mentalités, le journal d’Émilie Serpin est d’abord, à ses propres yeux, une sorte d’œuvre à laquelle sa passion de l’écriture lui fait accorder autant d’importance qu’à ses pratiques pieuses : c’est à cet « atelier d’écriture » que sera consacrée cette présentation. B. Mitford. A close study of the texts shows that several conclusions firmly settled by Mitford, the dating in particular, must be reconsidered. This paper offers the opportunity to bring to light the historical significance of the numerous offerings dedicated to the local Nymph.

_Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. A comprehensive excursion, into anthropology, ethnography, linguistics, social and political science lead me to the conclusion that human societies are ruled by systems of shared concepts, and that these systems of thought function as a kind of public or external mind, which produces and maintain the social forms of life. Taking into account the fact that philosophy originally - in ancient Greece - was a ‘public affair’, I came up with the idea that philosophy should try to map the public (...) mind. In other words, the idea that philosophers should draw up a project for making what I call philosophical maps, i.e. maps of public thought. In what follows, I will give a brief account of this idea in the hope that other philosophers may draw inspiration from it. Of course, all this involves speculation, but it does not interfere with regular philosophy. It simply adds something to it from the outside as it were, that is from a descriptive point of view. As I will make clear, this idea is consistent with the efforts of Wittgenstein to achieve a radical descriptive philosophy. (shrink)

On a souvent accusé Hegel de ne pas arriver à dire ce qu’il voulait dire. Notre hypothèse est que l’obscurité du dire hégélien tient en grande partie à une volonté délibérée de ne pas réduire la complexité des choses à un savoir de surface, de façon à obliger le lecteur à assimiler le sens qui se cache derrière les représentations bien connues. Pour étayer notre hypothèse, nous montrons comment le dire et le vouloir se nouent dans l’écriture du système hégélien (...) aussi bien dans sa mouture phénoménologique que dans sa mouture encyclopédique. Par ce biais, il s’agit de clarifier à la fois le problème de l’instanciation du système hégélien et celui de sa finalité, laquelle n’est autre que celle d’une philosophie qui se veut institution du sens. La traduction, que les romantiques pratiquent abondamment, concourt à mettre en œuvre un horizon philosophique et culturel complexe. Elle permet de potentialiser les œuvres en les ouvrant à leur sens universel. Celui-ci est ce qui constitue la norme de la traduction au détriment de l’intention de l’auteur et de la compréhension du lecteur. Du point de vue dynamique de la culture romantique, la traduction est le moyen qui permet de transformer une œuvre close sur elle-même en une tendance à se (...) rapporter à l’infini. La traduction, en cultivant l’idée d’universel, prépare le dialogue polémique sur l’universel qu’accomplit la critique. Elle est moins la trahison de l’œuvre que son ouverture à l’infini. Le romantisme nous lègue par là un premier jalon en vue d’une constitution moderne de la traductologie comme science. La traduction y est en effet moins envisagée comme le milieu prosaïque d’un échange, que comme le levier potentialisant d’un progrès culturel. (shrink)

The three essays reprinted in this book were first published in 1963 as individual chapters of a psychiatric treatise entitled Psychiatrie der Gegen wart (Psychiatry of the Present Day). The editors, W. H. GRUHLE (Bonn), R. JUNG (Freiburg/Br. ), W. MAYER-GROSS (Birmingham, England), M. MUL LER (Bern, Switzerland), had not planned an encyclopedic presentation; they did not intend to present a "handbook" which would be as complete as possible in details and bibliographic reference. Their intention was to "raze the walls" (...) separating Continental and Anglo-Saxon psychiatries and to offer a synopsis of developments in psychiatry during the last decades on an international basis. The editors requested, therefore, cooperation of scholars from many foreign countries, large and small, on both sides of the Atlantic. A section entitled "Borderlands of Psychiatry", in which MARGARET MEAD (New York) discusses the relation of "Psychiatry and Ethnology", HANS HEIMAN (Bern), the relation of "Religion und Psychiatrie", and ROBERT VOLMER (Paris), "Art et Psychiatrie", is a good illustration of the trilingual character of the whole work. Two of the editors, GRUHLE and MAYER-GROSS, died before the publi cation had been completed. In a kind of posthumous eulogy, Professor JUNG and Professor MULLER praised the initiative and accomplishments of MAYER-GROSS, "who during the last five years of his life had given a great deal of his time to this work. He had set his mind on a synthesis of German and Anglo-Saxon psychiatry. (shrink)

Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. Parmenides advances four arguments against becoming. Two of these are sound. Plato's and Aristotle's attempt to refute them fail. They react to Parmenides' challenge by differentiating and grading being and existence. Thus they deviate from Parmenides' strict concept of existence which is the only reasonable one. What's wrong with Parmenides' train of thought is a decisive premise: that becoming is a transition from non-existence to existence. The reality of becoming can be maintained if this premise is given up. One has (...) to see that becoming is a purely temporal affair not involving existence and that existence is timeless.
