Experiencia es la palabra que señala cómo piensa Hegel en su metafísica absoluta el ser del ente. Heidegger, al comentar la «Introducción» a la Fenomenología del espíritu ilumina el concepto hegeliano de experiencia a la luz del tono originario de la palabra Erfahrung. El término indica el ser de la conciencia absoluta en su carácter fundamental del movimiento. Al tiempo que muestra a Hegel como el pensador de lo aboluto, encuentra en la Erfahrung un motivo positivo de afinidad con él.

Eugenio Bulygin is a distinguished representative of legal science and legal philosophy as they are known on the European continent - no accident, given the role of the civil law tradition in his home country, Argentina. Over the past half-century, Bulygin has engaged virtually all major legal philosophers in the English-speaking countries, including H.L.A. Hart, Ronald Dworkin, and Joseph Raz. Bulygin's essays, several written together with his eminent colleague and close friend Carlos E. Alchourrón, reflect the genre familiar from (...) Alf Ross's On Law and Justice, Hans Kelsen's Pure Theory of Law, and Georg Henrik von Wright's Norm and Action. Bulygin's wide-ranging interests include most of the topics found under the rubric of analytical jurisprudence - interpretation and judicial reasoning, validity and efficacy of law, legal positivism and the problem of normativity, completeness and consistency of the legal system, the nature of legal norms, and the role of deontic logic in the law. The reader will take delight in the often agreeably unorthodox character of Bulygin's views and in his hard-hitting arguments in defence of them. He challenges the received opinion on gaps in the law, on legal efficacy, on permissory norms, and on the criteria for legal validity. Bulygin's essays have been wellnigh inaccessible in the past, appearing in specialized journals, often in Spanish or German. Conventional quantitative methods for the measurement of organizational legitimacy consider mainly three sources that make judgments about organizations visible: news media, accreditation bodies, and surveys. Over the last decade, however, social media have enabled ordinary citizens to bypass the gatekeeping function of these institutional evaluators and autonomously make individual judgments public. This inclusion of voices beyond functional and formally organized stakeholder groups potentially pluralizes the ongoing discussions about organizations. The individual judgments in blogs, tweets, and Facebook posts give indication about (...) the broader fit between an organization’s perceived behavior and heterogeneous social norms and therefore constitute an indicator of organizational legitimacy that can be accessed and measured. We propose the use of social media data and sentiment analysis to study the affect-based responses to organizational actions by citizens. We critically discuss and compare the method with existing quantitative methods for legitimacy measurement and apply them to a recent case in the banking industry. We discuss the value of the method for studying the process of legitimacy construction as the expression and negotiation of normative judgments about organizations by various evaluators. (shrink)

The educational use of daily-life contexts is considered a valuable strategy to promote meaningful science learning, since it facilitates the establishment of connections between previous knowledge, personal interests, and new learning. The aim of this work is to provide evidence to support the presence of gardens at educational centers, by assessing key science topics whose learning is promoted at the pre-school, primary, secondary, and university stages. To this end, we analyzed the paired graphic representations of “a garden” that students drew (...) both before and after their participation in a garden-based learning program. Firstly, we obtained the frequency of appearance of every represented element, and afterward characterized the level of change between paired graphic representations. Sample size was of 24–19–25–29 pairs per stage, respectively. Across all stages, an overall improvement in students’ graphic expression was observed, which can be attributed to their experience in the space. At the pre-school stage, the garden favored the establishment of some simple cause-effect relationships which were consolidated at the primary stage, and provided a climate of motivation and affectivity that was evident in the final drawings, given the enormous quantity of details represented, the level of the finished product, and the careful combination and variety of colors. The presence of elements related to water notably increased in final graphic representations from pre-school, primary, and secondary education, thus evidencing that the use of gardens facilitates an approach to responsible water management. At the university stage, students initially demonstrated good knowledge of conventional agriculture, while the gardening experience -which was based on permaculture practices- helped evolve their ideas toward an alternative model of cultivation. The most prevalent science learning across all stages was related to plant knowledge, particularly to their anatomical traits and diversity. Finally, the role of educational gardens as models for students was evidenced, which suggests the importance of teachers and institutions carefully considering which model to offer. Overall, our results support the legitimacy of incorporating gardens to educational centers, particularly for promoting contact with live plants and plant knowledge, and potentially for promoting contact with garden fauna and activities oriented toward learning about it. During the COVID-19 lockdown, individuals were forced to remain at home, hence severely limiting the interaction within environmental stimuli, reducing the cognitive load placed on spatial competences. The effects of the behavioral restriction on cognition have been little examined. The present study is aimed at analyzing the effects of lockdown on executive function prominently involved in adapting behavior to new environmental demands. We analyze non-verbal fluency abilities, as indirectly providing a measure of cognitive flexibility to react to spatial changes. Sixteen (...) students, evaluated before the start of the lockdown in a battery of psychological tasks exploring different cognitive domains, have been reassessed during lockdown. The assessment included the modified Five-Point Test to analyze non-verbal fluency abilities. At T2, the students were also administered the Toronto Alexithymia Scale. The restriction of behaviors following a lockdown determines increased non-verbal fluency, evidenced by the significant increase of the number of new drawings. We found worsened verbal span, while phonemic verbal fluency remained unchanged. Interestingly, we observed a significant tendency to use the left part of each box in the m-FPT correlated with TAS-20 and with the subscales that assess difficulty in describing and identifying feelings. Although our data were collected from a small sample, they evidence that the restriction of behaviors determines a leftward bias, suggesting a greater activation of the right hemisphere, intrinsically connected with the processing of non-verbal information and with the need to manage an emotional situation. Some important ideas in Kelsen's Pure Theory of Law can be traced back to Kantian tradition, which has been very influential in Kelsen's thought, particularly in his early period. Among them we find the distinction between two radically different worlds (the world of facts and the world of norms), the normativity of legal science and the idea of validity as a binding force, based on the famous doctrine of the basic norm. These tenets and, especially, the use of a normative (...) concept of validity prove to be incompatible with Kelsen's positivistic programme of a value‐free legal science. The science of law cannot state that legal norms are obligatory or binding without trespassing the limits of Kelsen's ideal of a legal science; on the other hand, it is possible to define the concept of a legal system without resorting to the basic norm. So, if Kelsen is to be regarded as a consequent positivist, the Kantian ingredients of his theory must be rejected and the descriptive concept of validity as membership must be substituted for the normative notion of validity as a binding force. This article moves from the observation that one of the key characteristics of contemporary Italian fiction is a preoccupation with ethics and more specifically with the issues raised by the “ethical turn” in contemporary philosophy and theory. Current literary criticism, it is argued, has been slow to respond to the ethical dimension of these narratives whose innovative and important cultural contribution has yet to be fully appreciated. It is therefore necessary to develop a keener sensitivity to the ethical discourses developed (...) in these literary texts, but this can only be achieved by first confronting some fundamental questions about the relationship between ethics and literature today. The answers to these questions make it possible to elaborate an initial conceptual framework that can re-orient reading and enable the critic to respond adequately to the ethical issues raised in and by the narrative. Accordingly, in this article the author proposes to explore from a theoretical perspective the relationship between ethics and literature in the context of the historical and philosophical predicaments of contemporary society. The discussion is divided into two parts: the first is devoted to an exploration of contemporary ethical thinking, and the second on the contribution that literature can make to that thinking. In the first part, the author proposes an approach to ethics based on the virtue tradition which, since Aristotle, has defined ethics as the search for "the good life." This tradition, however, is transformed through an engagement with the work of Gilles Deleuze and Immanuel Levinas. From Deleuze the author draws the idea that the good life is one devoted to pursuing human plenitude through the multiplication of connections and intensities. From Levinas, on the other hand, emerges a powerfully haunting description of an ethical life marked by absolute responsibility for and obligation to the other. These two seemingly opposed views are not construed as irreconcilable and contradictory but rather as vectors which keep opposing tensions in check and ultimately define a necessary negotiation between the desire for human plenitude and the acknowledgement of responsibility for other human and non human life. Ultimately my argument is that such tensions establish the ethical terrain in which contemporary narratives seek to intervene. In the second part of the article, the nature and possibilities of such an intervention are explored through six theses which provocatively articulate the relationship between literature and ethics. The cornerstone thesis is that literature is an encounter. Each subsequent thesis endeavours to develop this initial assertion and explore its consequences. The theses are accompanied by a gloss which unfolds its meaning and significance: the answers that the given thesis provides but also the questions that it raises. Together, the theses provide a heuristic framework for a literary criticism sensitive to ethical issues and therefore capable of grappling with the important cultural work carried out in fictions that have struggled to receive the recognition they deserve. Este estudo explora alternativas de gênero e sexualidade construídas por grupos étnicos subalternizados que antagonizam com o que estabelece a norma resultante da cosmovisão dos colonizadores europeus. Sustentamos a tese de que a resistência de grupos étnicos subalternizados, dispersos pelo mundo, evidencia cosmovisões alternativas. Como resultado principal, consideramos que, tendo em vista que no Brasil a Lei nº 11.645, de 10 de março de 2008 estabelece a obrigatoriedade do ensino de “História e Cultura Afro-Brasileira e Indígena” em todos os componentes (...) curriculares da Educação Básica, compreendemos que é papel também do Ensino de Ciências problematizar as noções biologizantes e reducionistas de corpo, à luz do que nos ensinam os grupos étnicos subalternizados sobre gênero e sexualidade. Assim, o desenvolvimento e a análise de propostas de ensino de ciências que articulem gênero, sexualidade, colonialismo e as culturas de povos subalternizados é um campo de pesquisa latente de investigações. This paper examines one aspect of the relation between philosophy and myth, namely the function myth has, for some philosophers, in narrowing the distance between appearance and reality. I distinguish this function of myth from other common functions, and also show how the approach to reality through myth differs from a more empirical philosophical approach. I argue that myth plays a fundamental role in Plato's approach to the appearance/reality distinction, and that understanding this is important to the interpretation of Plato's (...) frequent use of language suggesting the existence of a world of unchanging ideal objects and a world of transient, variable particulars. Con el dossier monográfico que aquí presentamos la revista _Ingenium_ pretende ofrecer distintas perspectivas sobre ese complejísimo fenómeno histórico-cultural que llamamos Barroco. Pero hemos de matizar, antes de presentar cada una de las contribuciones aquí reunidas, que el objetivo del dossier es en cierto sentido doble: si bien por un lado, como decimos, a nivel explícito las aproximaciones al Barroco que encontrará el lector están determinadas por presupuestos y marcos teóricos diversos (aunque se den evidentes intersecciones entre algunos de ellos), (...) y, por lo tanto, puede decirse que uno de los objetivos del dossier es el de proporcionar una mirada plural _al_ Barroco; por otro lado, sin embargo, un objetivo adicional sería el de llamarnos la atención sobre la esencia radicalmente plural _del_ Barroco mismo.
