The creation of increasingly complex artificial intelligence (AI) systems raises urgent questions about their ethical and social impact on society. Since this impact ultimately depends on political decisions about normative issues, political philosophers can make valuable contributions by addressing such questions. Currently, AI development and application are to a large extent regulated through non-binding ethics guidelines penned by transnational entities. Assuming that the global governance of AI should be at least minimally democratic and fair, this paper sets out three desiderata (...) that an account should satisfy when theorizing about what this means. We argue, first, that an analysis of democratic values, political entities and decision-making should be done in a holistic way; second, that fairness is not only about how AI systems treat individuals, but also about how the benefits and burdens of transformative AI are distributed; and finally, that justice requires that governance mechanisms are not limited to AI technology, but are incorporated into a range of basic institutions. Thus, rather than offering a substantive theory of democratic and fair AI governance, our contribution is metatheoretical: we propose a theoretical framework that sets up certain normative boundary conditions for a satisfactory account. On 11 September 2019, the verdict was read in the first prosecution of a doctor for euthanasia since the Termination of Life on Request and Assisted Suicide (Review Procedures) Act of 2002 was installed in the Netherlands. The case concerned euthanasia on the basis of an advance euthanasia directive (AED) for a patient with severe dementia. In this paper we describe the review process for euthanasia cases in the Netherlands. Then we describe the case in detail, the judgement of the (...) Regional Review Committees for Termination of Life on Request and Euthanasia (RTE) and the judgement of the medical disciplinary court. Both the review committees and the disciplinary court came to the conclusion there were concerns with this case, which mainly hinged on the wording of the AED. They also addressed the lack of communication with the patient, the absence of oral confirmation of the wish to die and the fact that the euthanasia was performed without the patient being aware of this. However, the doctor was acquitted by the criminal court as the court found she had in fact met all due care criteria laid down in the act. We then describe what this judgement means for euthanasia in the Netherlands. It clarifies the power and reach of AEDs, it allows taking conversations with physicians and the testimony of the family into account when interpreting the AED. However, as a practical consequence the prosecution of this physician has led to fear among doctors about prosecution after euthanasia. (shrink)

Can the evidence provided by software systems meet the standard of proof for civil or criminal cases, and is it individualized evidence? Or, to the contrary, do software systems exclusively provide bare statistical evidence? In this paper, we argue that there are cases in which evidence in the form of probabilities computed by software systems is not bare statistical evidence, and is thus able to meet the standard of proof. First, based on the case of State v. Loomis, we investigate (...) recidivism predictions provided by software systems used in the courtroom. Here, we raise problems for software systems that provide predictions that are based on bare statistical evidence. Second, by examining the case of People v. Chubbs, we argue that the statistical evidence provided by software systems in cold hit DNA cases may in some cases suffice for individualized evidence, on a view on which individualized evidence is evidence that normically supports the relevant proposition (Smith, in Mind 127:1193–1218, 2018). Propongo dilucidar en la filosofía práctica madura de Kant la relevancia del cultivo de la virtud y de la educación para el progreso de las comunidades políticas y ética y muestro que ello puede abordarse de forma integrada desde el paralelo ético-político. Primero, explicaré que la tarea y el deber del ser humano de realizar el fin del bien supremo ético y político se puede esclarecer en relación con el destino de la humanidad. Después argumentaré que la tarea de los (...) seres humanos radica en el cultivo de la virtud, que es un deber que podemos llamar ético-político en el sentido de que las disposiciones morales de los individuos se desarrollan socialmente y sirven a fines comunitarios. Por último, en una visión integrada del paralelismo ético-político, argumentaré que la educación es un medio necesario para lograr el progreso de las comunidades. (shrink)

It is common for religiously motivated actions to be specially protected by law. Many legal theorists have asked why: what makes religion special? What makes it worthy of toleration over and above other non-religious deeply held convictions? The answer I put forward is that religions’ alleged afterlife consequences call for a principle of toleration that warrants special legal treatment. Under a Rawlsian principle of toleration, it is reasonable for those in the original position to opt for principles of justice that (...) accommodate actions with alleged afterlife consequences. And, under a utilitarian principle of toleration, a greater psychological harm is eased by such accommodations. Additionally, this alleged afterlife consequence is found in most of the religions that are thought to warrant some level of special toleration—not only do the Abrahamic religions have alleged afterlife consequences, but many eastern religions do as well, e.g. reincarnation. The easiest and most tempting solution of these problems is to dissolve them by pointing out the artificiality of the issues leading to these "third things." Though tempted, I am not convinced that Kant's philosophy can be treated thus as an exercise in a complicated solution of pseudo-problems. Also, I would thereby deprive myself of the uncomfortable and nagging sense of obscure importance which assails me—and many Kant students share this feeling—whenever I consider these points. I am prepared to admit (...) that the problems may be represented as artificial. But I want to maintain, with special emphasis on the Kantian schema, that a serious reconsideration repays the effort, even if it should force us to reconsider critically also some of Kant's systematic assumptions. In this paper we compare Kierkegaard’s and Marx’s views on social reform. Then we argue that Kierkegaard’s own reasoning is consistent with the expression of neighbor-love through collective action, i.e. social reform. However, Kierkegaard’s approach to social reform would be vastly different than Marx’s. We end by reviewing several questions that Kierkegaardian social reformers would ask themselves. Our hope is that this exploration will provide helpful insights into how those who genuinely love their neighbors ought to seek the common good (...) through collective action. (shrink)

Introduction: Congenital myasthenic syndromes refer to a heterogenic group of neuromuscular transmission disorders. CMS-subtypes are diverse regarding exercise intolerance and muscular weakness, varying from mild symptoms to life-limiting forms with neonatal onset. Long-term follow-up studies on disease progression and treatment-response in pediatric patients are rare.Patients and Methods: We analyzed retrospective clinical and medication data in a cohort of 32 CMS-patients including the application of a standardized, not yet validated test to examine muscular strength and endurance in 21 patients at the (...) last follow-up. Findings obtained in our cohort were compared with long-term follow-up studies of CMS-cohorts from the literature by considering the underlying molecular mechanisms. Outcomes of CMS-ST were compared to results of normal clinical assessment.Results: Thirty-two pediatric patients with defects in eight different CMS-genes were followed by a median time of 12.8 years. Fifty-nine percentage of patients manifested with first symptoms as neonates, 35% as infants. While 53% of patients presented a reduced walking distance, 34% were wheelchair-bound. Even under adequate therapy with pyridostigmine and 3,4-diaminopyridine, CHAT-mutations led to the progression of muscular weakness partly in combination with persistent respiratory and bulbar symptoms. RAPSN, CHRND, and CHRNB1 patients with neonatal manifestation, early respiratory problems, and bulbar symptoms showed a good and maintained treatment response. CHAT and CHRNE patients required higher PS dosages, whereas RAPSN patients needed a lower mean dosage at the last follow-up. The benefits of short-term medication and long-term progression of symptoms were highly dependent on the specific genetic defect. CMS-ST was carried out in 17/21 patients, determined affected muscle groups including bulbar and ocular symptoms, some of which were not reported by the patients.Conclusions: Our findings and comparison with the literature- suggest a better treatment-response and less severe progression of symptoms present in patients suffering from mutations in CMS-genes directly associated with receptor deficiency, while patients with defects leading to synaptopathy and presynaptic defects tend to have worse outcomes. Assessment of affected muscular groups and clinical symptoms by CMS-ST may be a useful tool for optimal therapeutic management of the patients, especially for future clinical studies. (shrink)

During the past few years, the IRBIT domain has emerged as an important add‐on of S‐adenosyl‐L‐homocystein hydrolase (AHCY), thereby creating the new family of AHCY‐like proteins. In this review, we discuss the currently available data on this new family of proteins. We describe the IRBIT domain as a unique part of these proteins and give an overview of its regulation via (de)phosphorylation and proteolysis. The second part of this review is focused on the potential functions of the AHCY‐like proteins. We (...) propose that the IRBIT domain serves as an anchor for targeting AHCY‐like proteins towards cytoplasmic targets. This leads to regulation of (i) intracellular Ca2+ via the inositol 1,4,5‐trisphosphate receptor (IP3R), (ii) intracellular pH via the Na+/HCO3− cotransporters (NBCs); whereas inactivation of the IRBIT domain induces (iii) nuclear translocation and regulation of AHCY activity. The marked intertextual patterning of Maryse Condé’s first novel Heremakhonon is a widely acknowledged feature, with the relationship between Condé’s novel and Aimé Césaire's Notebook of a Return to my Native Land attracting the bulk of critical attention. Through close readings of to date unexamined dramatic codes in Heremakhonon, this article proposes to extend the cultural context in which Condé’s text is traditionally read. Moving beyond the standard critical discussions of authenticity, I track Heremakhonon's mobile positionings in relation to polarizing (...) debates in the broader French literary-critical field between engagement and modernism. This focus allows for an exploration of the complex sets of relationships between the cultures of modernism and engagement that provide the conditions of possibility for Condé’s novel. (shrink)

Eva Brann, who has taught at St. John’s College, Annapolis, for sixty years, wrote these essays largely as clarifying incitements to students who were reading, or ought to have been reading, the works discussed. In her words: "The first essay looks at the 'Pre-Socratics' Heraclitus and Parmenides. They appear to be in radical opposition, but they are really doing the same, new thing: seeing the world as an intelligible whole. Both observe external nature, construing it in their minds—so, from the (...) outside in. The final essay again describes two ways of world-construing from the outside in—one by penetrating the surface of reality, the other by spinning a web of complexity over it. "The five essays in between focus on works by Kant and display the world as constituted from the human inside out. An appreciative review of the Critique of Pure Reason shows how Kant brilliantly justifies a science of nature by making nature itself the construct of our understanding. But he leads us to the abyss of more idealism; externality and realism escape him. The explication of his one absolute moral commandment similarly defines his morality entirely in terms divorced from objective good and concentrated on internal integrity. Research question The secondary research use of treatment data has the potential to expand medical knowledge and improve patient care. Hospitals play an important role in systematic secondary research use: they generate large amounts of treatment data and are supposed to establish the necessary structures for their use in research. This raises the ethical question: do hospitals have a moral duty to support secondary research use of treatment data by establishing and operating the necessary resources and infrastructure? Procedure Our aim (...) is to outline a conceptual framework to discuss the question and to propose a first normative position. Building on insights from business and organizational ethics, we develop a conceptual framework in which we view hospitals as moral actors. Our normative-ethical analysis is based on a reconstructive stakeholder approach, in which we identify the following general duties of hospitals: orientation towards patient wellbeing; cost efficiency; enabling employees to act in accordance with professional ethical standards; supporting public health and research. We examine whether these general duties provide reasons for a specific duty of hospitals to support secondary research use of treatment data. We discuss potential objections to such a duty arising from other, potentially conflicting general duties of hospitals (e.g., data protection), from practice (e.g., costs/resources), or related discourses (data ownership). Conclusion Certain general duties (orientation towards patient wellbeing, cost efficiency, support of public health) justify a duty of hospitals to support secondary research use of treatment data. The duty to enable employees to act in accordance with professional ethical standards is only an indirect reason; the duty to support research applies solely to university hospitals. Potential objections apply to a certain extent but can be mitigated through targeted measures. (shrink)

Derrida’s highly personal mourning texts are collected and published in a unique book under the title The Work of Mourning edited by Pascale-Anne Brault and Michael Naas, two outstanding translators of Derrida’s works. The English collection is published in 2001, while the French edition came out later in 2003 titled Chaque fois unique, la fin du monde. In his deconstructed eulogies, Derrida, being in accordance with ‘the mission impossible’ of deconstruction, namely, ‘to allow the coming of the entirely other’ in (...) its otherness, seems to find his own voice. In my paper, I will focus on this special segment of Derrida’s death-work ; namely, on his mourning texts written for his dead friends, paying special attention to the rhetoric ‘circling around’ fidelity, friendship, and the other in his textual mourning. Jolles greift damit den morphologischen Gedanken einer Vielgestaltigkeit von Form vor dem Hintergrund der sprachwissenschaftlichen Debatten seines politisierten akademischen Umfelds in Leipzig auf, das den Saussure’schen Systemgedanken der Sprache unter Rückbezug auf Wilhelm von Humboldt holistisch umdeuten wollte. Der Aufsatz verortet Jolles’ Überlegungen in der formorientierten Literatur- und Kulturtheorie der Zeit. (...) Anhand seiner Zeitbegriffe und seines Formkonzepts wird gezeigt, wie er die zeitgenössischen Ideen der Ganzheit und der Verzeitlichung von Form im Ausgang morphologischer Fragen auf eigenwillige Weise interpretierte.In his book Einfache Formen André Jolles develops the idea of a special temporality of so-called »simple forms«, which he calls »Jedesmaligkeit«, referencing Goethe’s reflections on the ›versatile forms‹ of nature. Jolles adopted the morphological idea of a versatility of form against the background of the linguistic debates of his politicized academic environment in Leipzig. In accordance with contemporary holistic thinking his colleagues reinterpreted Saussure’s idea that language is a system, drawing in particular on Wilhelm von Humboldt. The essay situates Jolles’ reflections in the form-oriented literary and cultural theory of the time. On the basis of his concepts of time and his thinking in terms of form, the article shows how he adapted the contemporary ideas of the wholeness and temporalization of form in an idiosyncratic way in the wake of morphological questions. Actualmente, «pensar la mujer» constituye una tarea inacabada y debatida. En pleno siglo XX, la fenomenóloga Edith Stein explora tal despliegue interrogándose por su naturaleza y valor propio. La presente investigación expone el itinerario que establece la filósofa desde la reflexión de la persona humana a la comprensión de la mujer. Para tal efecto, se articulan desde la obra steiniana los principales conceptos y matices que, mediante el análisis fenomenológico posibilita examinar las nociones constituyentes del sujeto en su dimensión corporal (...) y espiritual. Finalmente, se esboza la peculiaridad de la esencia femenina, cuya indagación permite detenerse en la pregunta esencial por la mujer. La conclusión avanza hacia un balance de los principales aspectos desarrollados como aporte al diálogo contemporáneo. (shrink)

Metaphor's peculiar property to yield cognitive insight-- often in otherwise false sentences -- has been the focus of contemporary studies of metaphor. In Metaphor: Its Linguistic Structure and Cognitive Force, Eva Kittay develops the semantic field theory of metaphor (SFTM). The task of the present work is to formalize some of the central claims of SFTM. Formalization forces us to make the central concepts of SFTM precise and operational, and it enables us to evaluate the consistency and explanatory power of (...) SFTM through empirical testing. To empirically test our formalization of SFTM, we constructed a working computer program from it. This program, called NETMET, is highly successful in generating syntactically complex and semantically interesting metaphors. Its success provides empirical confirmation of SFTM. (shrink)

One Seit Platon (mit dem Spott von Diogenes) über Kant ist die Fundamentalfrage "Was ist der Mensch?" bis heute nicht nur von der Philosophie (als regina scientiarum), sondern von der Wissenschaft überhaupt nicht beantwortet. Phänomenologisch hat der Mensch a posteriori physische (somatische), psychische(perceptio, emotio, cognitio), mentale (logische), spirituelle (conscientia, volitio, actio) "Sphären". Ontologisch in Kontext von to ti en einai (Aristoteles) sollte der Mensch a priori ein "Programm" (Information) vor der Kosmogonie haben. Der (Neo‐) Positivismus (z.B. Hume bis Carnap, Russel*; (...) * Nobel Laureate) verwirft Fragen der Metaphysik als Scheinprobleme. Damit bleibt das Menschen‐Wesen in Kontext von Postulaten, wie res cogitans (Descartes), Monaden(Leibniz), "Gott, Freiheit, Unsterblichkeit", Seligkeit und (moralischer) Vollkommenheit (Kant), absoluter Geist (Hegel) in der theologischen Dimension. Antwort könnte eine zukünftige (holistisch‐multidimensionale) philosophische theoretische und Experimentaltheologie (kontrollierbare Beobachtung) durch weitere Forschung geben, in Kontext (bzw. Existenz) von A. Physikotheologie bzw. (a) höhere (als drei) geometrische/physikalische Dimensionen (Hilbert, Riemann /Friedmann, Minkowski, Schmutzer), (b) Paralleluniversen (z.B. L. Randall), (c) Quantentheorie/‐philosophie (Planck*, u.a.), (d) Gravitations‐/Relativitätstheorie (Newton/Einstein*), (e) Vakuumenergie (Sato), etc. B. ChemoBiotheologie bzw.
