An updated and extended second edition supporting the findings of its well-known predecessor which claimed that courts employ common-sense notions of causation in determining legal responsibility.

Abstract:The main purpose of this paper is to defend traditional ethical theory (utilitarianism and deontology) for its application in business against a more recent model consisting of utility, rights, and justice. This is done in three parts: First, we provide a conceptual argument for the superiority of the traditional model; second, we demonstrate these points through an examination of three short cases; and third, we argue for the capability of the traditional model to account for universais and particulars in ethics.

As the gap between the need for and supply of human organs continues to widen, the aim of securing additional sources of these “gifts of the body” has become a seemingly overriding moral imperative, one that could—and some argue, should—override the widespread ban on organ markets. As a medical practice, organ transplantation entails the inherent risk that one human being, a donor, will become little more than a means to the end of healing for another human being and that he (...) or she will come to have a purely instrumental value. In my Steinberger 2009 I argued that Neil Tennant’s Harmony requirement is untenable because of its failure to account for the standard quantifier rules.1 Instead of justifying the customary rules for the existential and universal quantifiers, Tennant’s account appears to sanction only wholly unrestricted – and so patently disharmonious – quantifier rules. In his characteristically thoughtful response Tennant 2010, Tennant offers a sequent calculus version of his Harmony requirement that rules out such pathological would-be quantifiers. While I agree with Tennant (...) that recasting his Harmony requirement in the sequent format as he proposes blocks the said disharmonious quantifier rules, I submit that Tennant’s revamped Harmony requirement nevertheless misses the mark. I present two objections to substantiate my claim. First, I show that the crucial additional assumption underlying Tennant’s sequent calculus-based account – what I call the admissibility assumption – is excessively strong: so strong, in fact, that it renders otiose the core of Tennant’s original account. Second, I argue that the admissibility assumption, as a global requirement on deductive systems, is ill-suited for the purposes of codifying the intuitive notion of harmony. Fortunately, though, as I will demonstrate, we can dispense with the admissibility assumption altogether. (shrink)

In terms of Aristotle's intellectual virtues, the process of clinical reasoning and the discipline of clinical medicine are often construed as techne (art), as episteme (science), or as an amalgam or composite of techne and episteme. Although dimensions of process and discipline are appropriately described in these terms, I argue that phronesis (practical reasoning) provides the most compelling paradigm, particularly of the rationality of the physician's knowing and doing in the clinical encounter with the patient. I anchor this argument, moreover, (...) in Pellegrino's philosophy of medicine as a healing relationship, oriented to the end of a right and good healing action for the individual patient. (shrink)

This paper examines the commonplace assertion that utilitarianism allows for and even, at times, requires the punishment of the innocent. It traces the origins of this doctrine to the writings of the British Idealists and the subsequent development of what is called the post-utilitarian paradigm which posits various justifications for punishment such as retribution, deterrence and reform, finds all of them inadequate, and then, with the addition of other ideas, reconciles them. The idea of deterrence is falsely depicted as the (...) utilitarian contribution to the theory of punishment, while deterrence in fact is one of several elements in the utilitarian theory. The mistake comes from ignoring the pain-pleasure dimension of Benthamite utilitarianism and from regarding the principle of utility itself as the sole criterion of action in a ‘top-down’ fashion. My discussion addresses the differences between analytic and continental philosophy concerning the use of logic and exact reasoning in philosophical practice. These differences are mainly examined in the light of the controversial dominance of Hegel's concept of logic (and theory of concept) in twentieth-century continental philosophy. The inquiry is developed in two parts. In the first (Sections 1-2), I indicate some aspects of the analytic-continental divide, pointing to the role that the topic 'logic and philosophy' plays in it. In the (...) second part (Sections 3-6), I give a short account of the views of logic which are typical of the three main trends of continental philosophy (see Table 1). I also suggest how, with the aid of some typical analytical devices, some continental 'anti-logical' attitudes may be corrected, on their own terms. (shrink)

This article presents a novel perspective, arguing for a virtue-based weak version of political realism in Ottoman political thought (OPT). By recognizing realist elements in human nature and poli- tics in OPT tradition, we can gain a deeper understanding of the place of morality in politics. Challeng- ing the common sense understanding of morality that pervades all areas of politics, this paper provides compelling evidence to show how the understanding of the nature of politics in OPT was ever-chang- ing, singular, (...) and, to a certain extent, free of morality. This unique framing of politics and human na- ture in the OPT tradition makes it a realist one. Finally, I delve into the role of universals in explaining the intricate relationship between politics and morality through various analytical distinctions. (shrink)

In Hermes, lxxiv , p. 1 Professor M. Pohlenz publishes an article entitled ‘Plutarchs Schriften gegen die Stoiker’ which throws much light on these important sources for Stoicism. I had myself made a study of these works, and for the most part find myself in complete agreement, but in my opinion something can be added to his inquiry into Plutarch's sources; and I venture to think that the subject repays attention not so much for itself as because it illustrates an (...) important principle, namely, that investigation of sources must be accompanied by literary appreciation: one must look not only for the flaws that will admit the dissecting knife but also for the intended structure of one's subject. Objective The UK Human Papillomavirus (HPV) vaccine programme commenced in the autumn of 2008 for year 8 (age 12–13 years) schoolgirls. We examine whether the vaccine should be given when there is a difference of opinion between daughters and parents or guardians. Design Qualitative study using semi-structured interviews. Participants A sample of 25 stakeholders: 14 professionals involved in the development of the HPV vaccination programme and 11 professionals involved in its implementation. Results Overriding the parents' wishes was perceived as problematic (...) and could damage the relationship between school and parents. A number of practical problems were raised in relation to establishing whether parents were genuinely against their daughter receiving the vaccine. Although many respondents recognised that the Gillick guidelines were relevant in establishing whether a girl could provide consent herself, they still felt that there were significant problems in establishing whether girls could be assessed as Gillick competent. In some areas school nurses had been advised not to give the vaccine in the absence of parental consent. None of the respondents suggested that a girl should be vaccinated against her consent even if her parents wanted her to have the vaccine. Conclusions While the Gillick guidelines provide a legal framework to help professionals make judgements about adolescents consenting to medical treatment, in practice there appears to be variable and confused interpretation of this guidance. Improved legal structures, management procedures and professional advice are needed to support those who are assessing competence and establishing consent to vaccinate adolescents in a school setting. We study a propositional bimodal logic consisting of two S4 modalities £ and [a], together with the interaction axiom scheme a £ϕ → £ aϕ. In the intended semantics, the plain £ is given the McKinsey-Tarski interpretation as the interior operator of a topology, while the labelled [a] is given the standard Kripke semantics using a reflexive and transitive binary relation a. The interaction axiom expresses the property that the Ra relation is lower semi-continuous with respect to the topology. The (...) class of topological Kripke frames characterised by the logic includes all frames over Euclidean space where Ra is the positive flow relation of a differential equation. We establish the completeness of the axiomatisation with respect to the intended class of topological Kripke frames, and investigate tableau calculi for the logic, although tableau completeness and decidability are still open questions. It may be affirmed with some confidence that on this topic no generally accepted solution will be found in default of new evidence, for which we can only faintly hope. Against certainty on the matter it would seem that the Everlasting has fixed his canon: quis iustius induit arma scire nefas. Dogmatism is out of place; we must be content with whatever theory is least difficult to reconcile with the texts and with a reasonable interpretation of the course of events (...) at the time and the comments on them of contemporary observers. The thesis advanced in this paper is that there are strong reasons for supposing that the Lex Pompeia Licinia contained a date by which Caesar's command ended, that this date was not the end of February of the year 50 or the year 49 or the end of December of the year 50, that it did not contain a clause forbidding the discussion of a successor to Caesar before March 1, 50, and that if the date ending his command lies between the end of February and the end of December of the year 50, it may have been in fact the Ides of November in that year.
