A libertarian theory of justice holds that persons are self-owners and have the Hohfeldian moral power to justly acquire property rights in initially unowned external resources. Different variants of libertarianism can be distinguished according to their stance on the famous Lockean proviso. The proviso requires, in Locke’s words, to leave ‘enough and as good’ for others, and thus specifies limits on the acquisition of property. Left-libertarians accept an egalitarian interpretation of the proviso, ‘right-libertarians’ either reject any kind of proviso or (...) accept rather weak versions of it. In be-tween there is room for moderate interpretations of the proviso, and in particular for a sufficientarian interpretation: a ‘sufficiency proviso.’ The resulting theory of justice can be called ‘moderate libertarianism.’ In this article I make a case for moderate libertarianism, so understood. I argue that moderate libertarianism has advantages over both left- and right-libertarianism because it better coheres with the most plausible rationale for endorsing a libertarian theory of justice in the first place. Need-claims are ubiquitous within moral and political theory. However, need-based theories are often criticized for being too narrow in scope and too focused on the material preconditions for leading a decent life for grounding a substantial theory of social justice. The aim of this paper is threefold. Firstly, it will investigate the nature and scope of needs by analysing existing conceptualizations of the idea of needs. In so doing, we will get a better understanding of needs, which will help us (...) to carve out the importance and singularity of basic need claims. Secondly, on the basis of the analysis of needs, it will argue for the concept of a fundamental interest in free social agency, which is much better suited than the idea of basic needs actually to ground a theory of social justice, as it highlights the social and institutional conditions for free agency. Thirdly, using the distinction between basic needs and fundamental interests, it will clarify their respective role in and importance for grounding moral principles. Overall, the paper offers a friendly critique of need-based theories, while arguing for a shift of focus to the idea of fundamental interests. (shrink)

Lockeans regard taxation as a—perhaps sometimes permissible—infringement of moral property entitlements. This essay discusses whether, or in what form, this charge is defensible. In doing so, it will explore the truth and the limits of the conventionalist reply of Murphy and Nagel to Lockean challenges to taxation. It argues that there is a moral rationale for property conventions that is independent of the question whether and how one can acquire natural, pre-conventional property rights in the state of nature, that this (...) rationale sets a moral standard for how good property conventions are and whether they are justifiable at all, and that once property conventions are in place, people’s moral property entitlements are at least partly determined by these conventions, sometimes even by unjustifiable ones that ought to be reformed. Because taxation can be a part of property conventions, taxation as such is not an infringement of moral property entitlements. But the essay will also argue that some taxation—excessive taxation—does infringe on moral property entitlements. This is because the moral rationale for property conventions sets some standards for what owners should be entitled to, and so excessive taxation will infringe upon moral entitlements that are partly not convention-based. Philip Pettit’s republican conception of freedom is presented as an alternative both to negative and positive conceptions of freedom. The basic idea is to conceptualize freedom as non-domination, not as non-interference or self-mastery. When compared to negative freedom, Pettit’s republican conception comprises two controversial claims: the claim that we are unfree if we are dominated without actual interference, and the claim that we are free if we face interference without domination. Because the slave is a widely accepted paradigm of the (...) unfree person, the case of a slave with a non-interfering master is often cited as providing a good argument for the first republican claim and against a negative conception of freedom. One aim of this article is to raise doubts about whether this is true. The other aim of the article is to show that the prisoner—also a paradigm of the unfree person—presents a good argument against the second republican claim and in favour of a negative conception of freedom. This is called the ‘prisoner-argument’. It will be argued that neither Pettit’s distinction between free persons and free choices nor his distinction between compromising and conditioning factors of freedom can help to rebut the charge of the prisoner-argument. In line with Allen Newell's challenge to develop complete cognitive architectures, and motivated by a recent proposal for a unifying subsymbolic computational theory of cognition, we introduce the cognitive control architecture SEMLINCS. SEMLINCS models the development of an embodied cognitive agent that learns discrete production rule-like structures from its own, autonomously gathered, continuous sensorimotor experiences. Moreover, the agent uses the developing knowledge to plan and control environmental interactions in a versatile, goal-directed, and self-motivated manner. Thus, in contrast to several well-known (...) symbolic cognitive architectures, SEMLINCS is not provided with production rules and the involved symbols, but it learns them. In this paper, the actual implementation of SEMLINCS causes learning and self-motivated, autonomous behavioral control of the game figure Mario in a clone of the computer game Super Mario Bros. Our evaluations highlight the successful development of behavioral versatility as well as the learning of suitable production rules and the involved symbols from sensorimotor experiences. Moreover, knowledge- and motivation-dependent individualizations of the agents’ behavioral tendencies are shown. Finally, interaction sequences can be planned on the sensorimotor-grounded production rule level. Current limitations directly point toward the need for several further enhancements, which may be integrated into SEMLINCS in the near future. Overall, SEMLINCS may be viewed as an architecture that allows the functional and computational modeling of embodied cognitive development, whereby the current main focus lies on the development of production rules from sensorimotor experiences. Adorno notoriously asserted that there is no 'right' life in our current social world. This assertion has contributed to the widespread perception that his philosophy has no practical import or coherent ethics, and he is often accused of being too negative. Fabian Freyenhagen reconstructs and defends Adorno's practical philosophy in response to these charges. He argues that Adorno's deep pessimism about the contemporary social world is coupled with a strong optimism about human potential, and that this optimism explains his (...) negative views about the social world, and his demand that we resist and change it. He shows that Adorno holds a substantive ethics, albeit one that is minimalist and based on a pluralist conception of the bad - a guide for living less wrongly. His incisive study does much to advance our understanding of Adorno, and is also an important intervention into current debates in moral philosophy. (shrink)

In this paper, we take up two objections Raymond Geuss levels against John Rawls′ ideal theory in Philosophy and Real Politics. We show that, despite their fundamental disagreements, the two theorists share a common starting point: they both reject doing political philosophy by way of applying an independently derived moral theory; and grapple with the danger of unduly privileging the status quo. However, neither Rawls′ characterization of politics nor his ideal theoretical approach as response to the aforementioned danger is adequate (...) or so we argue. Moreover, contrary to received opinion, Geuss′ political philosophy is the more reflective and the more philosophical of the two. In a final section, we highlight another agreement: both think that political philosophers should develop conceptual innovations as a way of clarifying and overcoming practical problems. We demonstrate that Geuss could offer a number of reasons for finding Rawls′ conceptual innovations wanting. (shrink)

This commentary challenges Michael Scliefczyk’s proposal for a realistically utopian welfare state (RUWS). As it stands, RUWS says too little about the concrete measures it will offer to avoid political domination and harmful inequalities. Moreover, RUWS follows Rawlsian Property-Owning Democracy (POD) by being silent on crucial issues such as banking regulation, the governance of investments and the issue of actual control over capital. Ultimately, it therefore seems that RUWS does not present an attractive alternative to POD since it suffers from (...) very similar problems and shortcomings as POD. (shrink)

Robert Nozick and Eric Mack have tried to show that a minimal state could be just. A minimal state, they claim, could help to protect people’s moral rights without violating moral rights itself. In this article, I will discuss two challenges for defenders of a minimal state. The first challenge is to show that the just minimal state does not violate moral rights when taxing people and when maintaining a monopoly on the use of force. I argue that this challenge (...) can be met. The second challenge is to show that the just min-imal state has political authority including, most importantly, the moral power to im-pose duties on citizens. I argue that both Nozick and Mack lack the resources to meet that challenge, and that political authority cannot be deflated. This is an important prob-lem because a lack of political authority also undermines a state’s justness. (shrink)

This article investigates the categories of variegated social formations and structural historical heterogeneity, which have been developed from Latin American Marxism as a theoretical attempt that aims to account for the complexity of the debates around historical time. For this, the work of René Zavaleta Mercado (Bolivia) and Aníbal Quijano (Peru) is analyzed, revealing their connections and divergences. It is concluded that there are important meeting points, but also disagreements.

Sequence learning is fundamental to a wide range of cognitive functions. Explaining how sequences—and the relations between the elements they comprise—are learned is a fundamental challenge to cognitive science. However, although hundreds of articles addressing this question are published each year, the actual learning mechanisms involved in the learning of sequences are rarely investigated. We present three experiments that seek to examine these mechanisms during a typing task. Experiments 1 and 2 tested learning during typing single letters on each trial. (...) Experiment 3 tested for “chunking” of these letters into “words.” The results of these experiments were used to examine the mechanisms that could best account for them, with a focus on two particular proposals: statistical transitional probability learning and discriminative error-driven learning. Experiments 1 and 2 showed that error-driven learning was a better predictor of response latencies than either n-gram frequencies or transitional probabilities. No evidence for chunking was found in Experiment 3, probably due to interspersing visual cues with the motor response. In addition, learning occurred across a greater distance in Experiment 1 than Experiment 2, suggesting that the greater predictability that comes with increased structure leads to greater learnability. These results shed new light on the mechanism responsible for sequence learning. Despite the widely held assumption that transitional probability learning is essential to this process, the present results suggest instead that the sequences are learned through a process of discriminative learning, involving prediction and feedback from prediction error. Constitutive Russellian panpsychism seems to combine the strengths of its rivals, physicalism and dualism, while avoiding their weaknesses: by acknowledging the irreducibility of phenomenal properties yet grounding macro- in microphenomenality, the view can avoid both anti-physicalist arguments and the causal exclusion problem for dualism. However, two severe objections have been raised: the combination problem for phenomenal constitution, and the structural exclusion problem for the position’s account of microphenomenal causation. It is currently hotly debated whether the combination problem can be overcome. (...) If not, panpsychists are forced to view macrophenomenality as emergent. Yet emergent panpsychism is subject to the causal exclusion problem, thereby sacrificing panpsychism’s advantage over dualism. With regard to the structural exclusion problem, Mørch provides a solution in terms of microphenomenal powers. I argue that Mørch’s view is not tenable. This notwithstanding, I develop a modification of her view which can solve the structural exclusion problem. Moreover, the emergentist version of this approach can avoid the causal exclusion problem. Thus, I aim to provide both a satisfying account of microphenomenal causation in panpsychism and a viable version of emergent panpsychism in case the combination problem turns out to be unsolvable. Background Thorough information of the patient is an integral part of the process of shared decision making. We aimed to investigate if detailed information about medication may induce nocebo effects. Methods We conducted a randomized, single-blind, pilot-study including n = 51 psychiatric in-patients aged between 18 and 80 years with a depressive disorder and accompanying sleeping disorders. In the intervention group we provided thorough information about adverse effects, while the control group received only a simple consent procedure. In both groups, (...) patients received an open-label placebo pill instead of their sleeping medication. Results No statistically significant differences between the intervention group and the control group were found regarding the main outcome parameter. Conclusion In this study, we were not able detect an effect of informed consent vs. simple consent on the emergence of placebo or nocebo effects. This finding is contrary to most assumptions and publications about this topic. Trial registration Trial registration number: DRKS00017653, registered August 30th 2018. Retrosprectively registered. The problem of algorithmic fairness is typically framed as the problem of finding a unique formal criterion that guarantees that a given algorithmic decision-making procedure is morally permissible. In this paper, I argue that this is conceptually misguided and that we should replace the problem with two sub-problems. If we examine how most state-of-the-art machine learning systems work, we notice that there are two distinct stages in the decision-making process. First, a prediction of a relevant property is made. Secondly, a (...) decision is taken based (at least partly) on this prediction. These two stages have different aims: the prediction is aimed at accuracy, while the decision is aimed at allocating a given good in a way that maximizes some context-relative utility measure. Correspondingly, two different fairness issues can arise. First, predictions could be biased in discriminatory ways. This means that the predictions contain systematic errors for a specific group of individuals. Secondly, the system’s decisions could result in an allocation of goods that is in tension with the principles of distributive justice. These two fairness issues are distinct problems that require different types of solutions. I here provide a formal framework to address both issues and argue that this way of conceptualizing them resolves some of the paradoxes present in the discussion of algorithmic fairness. (shrink)

Our societies are marked not only by disagreements on the good life, but also by disagreements on justice. This motivates philosophers as divergent as John Gray and Chandran Kukathas to focus their normative political theories on peace instead of justice. In this article, I discuss how peace should be conceived if peace is to be a more realistic goal than justice, not presupposing any moral consensus. I distinguish two conceptions of peace to be found in the literature. One, ordinary peace, (...) conceives of peace as non-violent coexistence based on modus vivendi arrangements. Modus vivendi arrangements, in turn, are explained as a special kind of compromise. Ordinary peace does not presuppose any moral consensus and is therefore realistic, but at the same time it is too minimalist and undemanding to be satisfying. The other conception of peace, ambitious peace, can be found in Kukathas’s work. It is a conception of peace ‘beyond compromise’, not minimalist and undemanding, but, I will argue, not realistic because presupposing at least a second-order moral consensus. In the end, I advocate a division of labour between both conceptions of peace under the umbrella of an overarching ideal of peace. (shrink)

This thesis aims to clarify a number of conceptual aspects of the debate surrounding algorithmic fairness. The particular focus here is the role of causal modeling in defining criteria of algorithmic fairness. In Chapter 1, I argue that in the discussion of algorithmic fairness, two fundamentally distinct notions of fairness have been conflated. Subsequently, I propose that what is usually taken to be the problem of algorithmic fairness should be divided into two subproblems, the problem of predictive fairness, and the (...) problem of allocative fairness. At the core of Chapter 2 is the proof of a theorem that establishes that three of the most popular (predictive) fairness criteria are pairwise incompatible. In particular, I show that under certain conditions, a predictive algorithm that satisfies a criterion called counterfactual fairness will with logical necessity violate two other popular predictive fairness criteria called equalized odds and predictive parity. In Chapter 3, a new predictive fairness criterion is developed using a mathematical framework for causal modeling. This fairness criterion, which I call causal relevance fairness, is a relaxation of another popular fairness criterion, counterfactual fairness, but turns out to be more closely in line with philosophical theories of discrimination. In Chapter 4, another infamous impossibility result in algorithmic fairness is analyzed through the lens of causality. I argue that by using a causal inference method called matching, we can modify the two fairness criteria equalized odds and predictive parity in a way that resolves the impossibility. Lastly, Chapter 5 contains an empirical case study. In it, the fairness of a popular recidivism risk prediction tool is analyzed using the criteria of (predictive) fairness developed earlier. Agricultural intensification and landscape homogenisation are major drivers of biodiversity loss in European agricultural landscapes. Improvements require changes in farming practices, but empirical evidence on farmers’ motivations underlying their on-farm biodiversity management remains fragmented. To date, there is no aggregated overview of behavioural determinants that influence European farmers’ decisions to implement biodiversity-friendly farming practices. This study aims to fill this knowledge gap by conducting a systematic literature review of 150 empirical studies published between 2000 and 2022. We identified 108 potential (...) determinants of farmers’ behaviour, which were integrated into a multilevel framework. The results show that the farmers’ decisions are complex and often non-directional processes, shaped by numerous external (at a society, landscape, community, and farm level) and internal factors. These factors are embedded in regional and cultural contexts. However, the analysis of study sites indicates that the spatial coverage of scientific evidence on biodiversity-friendly farming measures is uneven across Europe. Given the diversity of local and socio-cultural conditions, there is a need for public policies, including the European Union’s Common Agricultural Policy, to address more specifically determinants encouraging biodiversity-friendly farm management. This entails reflecting culture-specific perspectives and incorporating experiential knowledge into multilevel policy design processes, as well as offering regionally adapted advice on measure implementation and biodiversity impacts. En este artículo se discute la relación entre silogismo y demostración con respecto al concepto aristotélico del conocimiento científico formulado en los Analíticos segundos. La argumentación sigue tres líneas principales: (i) se ofrecen razones para rechazar la relegación de la sistematización silogística a la instancia postrera de justificación y exposición didáctica del conocimiento previamente adquirido. Como respuesta alternativa, (ii) se muestra que una explicación aristotélica necesita la silogística en virtud del papel que desempeña la causa como término medio silogístico. En (...) consecuencia, debería estar en condiciones de (iii) sostener que no resulta factible establecer firmemente los principios propios como premisas explicativas sin construir silogismos. This article focuses on the relation between syllogism and demonstration, as related to Aristotle's concept of scientific knowledge in his Posterior Analytics. Three main lines of argumentation are followed: (i) reasons are given to reject that syllogistic systematization plays a unique role as a skill for justification and didactic proof of a body of knowledge previously acquired. Alternatively, (ii) it is showed that an Aristotelian explanation requires syllogistic as to the role of cause as middle syllogistic term. Thus, it should be feasible (iii) to sustain that it is not possible to firmly establish proper principles as explanative premises without constructing syllogisms. (shrink)

In this paper, I describe and discuss two mental phenomena which are somewhat neglected in the philosophy of mind: focused daydreaming and mind-wandering. My aim is to show that their natures are rather distinct, despite the fact that we tend to classify both as instances of daydreaming. The first difference between the two, I argue, is that, while focused daydreaming is an instance of imaginative mental agency, mind-wandering is not—though this does not mean that mind-wandering cannot involve mental agency at (...) all. This personal-level difference in agency and purposiveness has, furthermore, the consequence that instances of mind-wandering do not constitute unified and self-contained segments of the stream of consciousness—in stark contrast to focused daydreams. Besides, the two kinds of mental phenomena differ in whether they possess a narrative structure, and in how we may make sense of the succession of mental episodes involved. (shrink)

The article argues that persons should be conceived as self-owners and entitled to acquire private property within justifiable property conventions because they should be able to live as project pursuers. This is the ‘project pursuit argument’. It leads to a conception of self-ownership that is stringent, but weaker than standard libertarian notions of self-ownership, and to an understanding of private property as a convention that has to meet a sufficientarian threshold in order to be justifiable.

In many critical investigations of machine vision, the focus lies almost exclusively on dataset bias and on fixing datasets by introducing more and more diverse sets of images. We propose that machine vision systems are inherently biased not only because they rely on biased datasets but also because theirperceptual topology, their specific way of representing the visual world, gives rise to a new class of bias that we callperceptual bias. Concretely, we define perceptual topology as the set of those inductive (...) biases in machine vision systems that determine its capability to represent the visual world. Perceptual bias, then, describes the difference between the assumed “ways of seeing” of a machine vision system, our reasonable expectations regarding its way of representing the visual world, and its actual perceptual topology. We show how perceptual bias affects the interpretability of machine vision systems in particular, by means of a close reading of a visualization technique called “feature visualization”. We conclude that dataset bias and perceptual bias both need to be considered in the critical analysis of machine vision systems and propose to understand critical machine vision as an important transdisciplinary challenge, situated at the interface of computer science and visual studies/Bildwissenschaft. International debates surrounding the management of universities in Western states have focused heavily upon the implications of neo-liberalism and the economisation of knowledge at national and international levels. However, investigations at the institutional level reveal that programmes for the development of human capital, organisational reputation and service quality in education and research are encouraged through regimes of self-development, directed towards organisational objectives. This article utilises governmentality theory to explore the relationship between governance and subjectivity within the Australian higher education system. (...) The governance of higher education, it will be argued, is enabled by mentalities of government which are dependent upon contemporary technologies, techniques for self-evaluation and career-planning, expertise about university labour, and—importantly—practices which engender an enterprising academic identity. To explore the utility of this analysis in contemporary Western liberal states, this study explores the construction of subjectivity implicit within Monash University’s Performance Development Online technology. Embedded with “technologies of the self,” this performance management platform is positioned within Monash as a gateway which requires academics to reflect upon their careers and selves, encouraging the genesis of marketable identities. This article points to the utility of further research into the development of career in a changing academic environment. (shrink)
