A particularly privileged position has been (...) reserved for the ars rhetorica, which, considered in its “purely formal instrumentality,” has been treated as though immune from ideological contamination. 1 The fear of becoming entangled in matters of ideological interpretation may, in turn, give rise to new and more seriously flawed readings. Although this is a matter which I shall not now emphasize, it should be clear that when the interpretation of a text is limited to its “purely formal instrumentality,” the vacuum that results can be filled more easily with matter that is new and different. Ideology chased from the doorstep may yet sneak in through the window, sometimes completely stripped of its real historical context. However, what is more important to note here as a premise to my discussion is that, along with the formalism already referred to, one finds in recent studies a tendency to diminish or minimize the significance of writings that were celebrated by the historical traditions of the last century and felt to belong to a shared cultural, religious, or political legacy.Among such writings the De falso credita et ementita Constantini donatione of Lorenzo Valla has certainly played an important part, beginning at least with the clamor that was raised on its behalf by Ulrich von Hutten and Martin Luther. Yet it is quite typical that the work’s most recent [End Page 79] editor, who has dedicated much careful research to Valla’s treatise and its reception, should have attempted to disconnect the meaning of Valla’s treatise in its own time from the influence it would later have, concluding that “the influence [of Valla’s work] manifested itself in accents quite different from those that have resulted from [current] interpretation.” 2 In the view of this scholar, at the time of the composition of Valla’s work, Constantine’s alleged “donation” was no longer a matter of contemporary relevance; rather, it furnished the theme for a brilliant exercise in legal rhetoric. He writes: “By then the Donation of Constantine was no longer an urgent theme for political theory. (Die Konstantinische Schenkung war damals kein beherrschendes Thema der politischen Theorie mehr.)” 3My discussion takes its cue from this point. Without dwelling at length on the various contributions of other scholars, I shall begin first by trying, on the basis of documentary evidence, to restore Valla’s treatise to life, to the climate of its day, in order then to gather and present its meaning along interpretative lines I have already laid out elsewhere. 4According to that usually trustworthy Florentine chronicler, Giovanni Cavalcanti, Filippo Maria Visconti, duke of Milan, at the end of 1443 made a diplomatic avance toward Florence. Principal among the issues dividing the two powers had been the protection afforded by the regime of Cosimo de’ Medici to Francesco Sforza, then holed up in his fiefdoms in the March of Ancona. The Duke now proposed that they should unite in common defense against the Pope, insofar as the latter was sovereign lord of the March. Beyond these particular circumstances, the accord was supposed to find its warrant in the partners’ shared interest in affirming the superiority of civil over ecclesiastical jurisdiction. So the Duke, according to Cavalcanti, advanced his proposal with words that allow us to suspect an early but not surprising echo of Valla’s treatise (first circulated in that very year): “It so happens that even if Constantine consigned to Sylvester so many and such rich gifts—which is doubtful, because such a privilege can nowhere be found—he could only have granted them for his [Sylvester’s] lifetime, [because] the Empire takes precedence over any lordship.” No differently from Valla, Duke Filippo Maria thought the sovereign impersonality of the [End Page 80] law was the prerogative only of the Empire (and... Paraconsistent Weak Kleene Logic is the 3-valued propositional logic defined on the weak Kleene tables and with two designated values. Most of the existing proof systems for PWK are characterised by the presence of linguistic restrictions on some of their rules. This feature can be seen as a shortcoming. We provide a cut-free calculus for PWK that is devoid of such provisos. Moreover, we introduce a Priest-style tableaux calculus for PWK.

Current debates in social ontology are dominated by approaches that view institutions either as rules or as equilibria of strategic games. We argue that these two approaches can be unified within an encompassing theory based on the notion of correlated equilibrium. We show that in a correlated equilibrium each player follows a regulative rule of the form ‘if X then do Y’. We then criticize Searle's claim that constitutive rules of the form ‘X counts as Y in C’ are fundamental (...) building blocks for institutions, showing that such rules can be derived from regulative rules by introducing new institutional terms. Institutional terms are introduced for economy of thought, but are not necessary for the creation of social reality. (shrink)

Economists and biologists have proposed a distinction between two mechanisms – “strong” and “weak” reciprocity – that may explain the evolution of human sociality. Weak reciprocity theorists emphasize the benefits of long-term cooperation and the use of low-cost strategies to deter free-riders. Strong reciprocity theorists, in contrast, claim that cooperation in social dilemma games can be sustained by costly punishment mechanisms, even in one-shot and finitely repeated games. To support this claim, they have generated a large body of evidence concerning (...) the willingness of experimental subjects to punish uncooperative free-riders at a cost to themselves. In this article, I distinguish between a “narrow” and a “wide” reading of the experimental evidence. Under the narrow reading, punishment experiments are just useful devices to measure psychological propensities in controlled laboratory conditions. Under the wide reading, they replicate a mechanism that supports cooperation also in “real-world” situations outside the laboratory. I argue that the wide interpretation must be tested using a combination of laboratory data and evidence about cooperation “in the wild.” In spite of some often-repeated claims, there is no evidence that cooperation in the small egalitarian societies studied by anthropologists is enforced by means of costly punishment. Moreover, studies by economic and social historians show that social dilemmas in the wild are typically solved by institutions that coordinate punishment, reduce its cost, and extend the horizon of cooperation. The lack of field evidence for costly punishment suggests important constraints about what forms of cooperation can or cannot be sustained by means of decentralised policing. (shrink)

What, from a semantic perspective, is the difference between singular indefinite and definite descriptions? Just over a century ago, Russell provided what has become the standard philosophical response. Descriptions are quantifier phrases, not referring expressions. As such, they differ with respect to the quantities they denote. Indefinite descriptions denote existential quantities; definite descriptions denote uniquely existential quantities. Now around the 1930s and 1940s, some linguists, working independently of philosophers, developed a radically different response. Descriptions, linguists such as Jespersen held, were (...) referring expressions, not quantifier phrases. Accordingly, descriptions differ with respect their rules of reference. Indefinite descriptions refer to „novel‟ items, definite descriptions to „familiar‟ ones. My dissertation serves as the first systematic effort to bridge the gap between these two seemingly incompatible responses. It provides a satisfactory answer to the above question which links the seemingly intractable divide between Russellians and familiarity theorists. This is achieved by utilizing two observations: Donnellan‟s observation that speakers use descriptions not only as devices of quantification but also as devices of reference, and Devitt‟s observation that these two uses, being regular, systematic, and cross-linguistic, have the status of convention in our language. Taken in conjunction, these two observations, I argue, require postulating that descriptions are semantically ambiguous. These observations compel the thoughtful theorist to maintain that descriptions have two distinct semantic functions, one quantificational and one referential. Accordingly, the semantic contrast between singular indefinite and definite descriptions is two-fold. Descriptions can contrast either quantificationally or with respect to the speaker‟s view of the audience‟s familiarity with the description‟s referent. (shrink)

There is a view on consciousness that has strong intuitive appeal and empirical support: the intermediate-level theory of consciousness, proposed mainly by Ray Jackendoff and by Jesse Prinz. This theory identifies a specific “intermediate” level of representation as the basis of human phenomenal consciousness, which sits between high-level non-perspectival thought processes and low-level disjointed feature-detection processes in the perceptual and cognitive processing hierarchy. In this article, we show that the claim that consciousness arises at an intermediate-level is true of some (...) cognitive systems, but only in virtue of specific constraints on their active interactions with the environment. We provide ecological reasons for why certain processing levels in a cognitive hierarchy are privileged with respect to consciousness. We do this from the perspective of a prediction-error minimization model of perception and cognition, relying especially on the notion of active inference: the privileged level for consciousness depends on the specific dispositions of an organism concerned with inferring its policies for action. Such a level is indeed intermediate for humans, but this depends on the spatiotemporal resolution of the typical actions that a human organism can normally perform. Thus, intermediateness is not an essential feature of consciousness. In organisms with different action dispositions the privileged level or levels may differ as well. (shrink)

Paraconsistent weak Kleene logic is the $3$-valued logic based on the weak Kleene matrices and with two designated values. In this paper, we investigate the poset of prevarieties of generalized involutive bisemilattices, focussing in particular on the order ideal generated by Α$\textrm{lg} $. Applying to this poset a general result by Alexej Pynko, we prove that, exactly like Priest’s logic of paradox, $\textrm{PWK}$ has only one proper nontrivial extension apart from classical logic: $\textrm{PWK}_{\textrm{E}}\textrm{,}$ PWK logic plus explosion. This $6$-valued logic, (...) unlike $\textrm{PWK} $, fails to be paraconsistent. We describe its consequence relation via a variable inclusion criterion and identify its Suszko-reduced models. It is well-known that versions of the lottery paradox and of the preface paradox show that the following three principles are jointly inconsistent: (Sufficiency) very probable propositions are justifiably believable; (Conjunction Closure) justified believability is closed under conjunction introduction; (No Contradictions) propositions known to be contradictory are not justifiably believable. This paper shows that there is a hybrid of the lottery and preface paradoxes that does not require Sufficiency to arise, but only Conjunction Closure and No Contradictions; and it argues (...) that, given any plausible solution to this paradox, if one is not ready to deny Conjunction Closure (and analogous consistency principles), then one must endorse the thesis that justified believability is factive. Language evolution, intended as an open problem in the evolutionary research programme, will be here analyzed from the theoretical perspective advanced by the supporters of the Extended Evolutionary Synthesis. Four factors and two associated concepts will be matched with a selection of critical examples concerning genus Homo evolution, relevant for the evolution of language, such as the evolution of hominin life-history traits, the enlargement of the social group, increased cooperation among individuals, behavioral change and innovations, heterochronic modifications leading to increased (...) synaptic plasticity. A particular form of niche construction will be considered in a multilevel framework. It will be argued that the four points mentioned above prove to be fundamental explanatory tools to understand how language might have emerged as a result of a gene-culture coevolutionary dynamics. The focus of this paper is the analysis of the epistemological and practical role played bypathe/affections in Epicurus’ philosophy. Epicurus firstly considered the affections not as emotional/passional conditions, but as firm criteria of truth and more specifically as the third criterion of the canonic (i.e. the epistemological part of his philosophical system). In this article the critical reactions (in particular by the Peripatetic side: Aristocles of Messene) against the Epicurean position about the function of the affections will be investigated too. Finally, two parts of this paper are devoted to the Cyrenaic tripartition ofpathe(in all likelihood, a subject criticized by Epicurus) and to the probable doctrinal relationship between Epicurus’patheand Aristotle’sNicomachean EthicsBook 2. I present a formal framework historically faithful to Leibniz's analysis of relational sentences, which: (i) engrafts thematic roles and the non-truth-functional connective insofar as (quatenus) into the monadic fragment of first-order logic; (ii) suggests a plausible ontological picture of thematic roles and relational facts; (iii) supports argument deletion and related inferential patterns that are not taken into account by standard first-order logic.

This article aims to show the development of Wittgenstein’s conception of language from a pictorial model to a musical model. At first language is considered as a “means of representation” but in the second phase of Wittgenstein’s work the problem of understanding a proposition and the different shades of meaning supports an analogy with the musical dimension. In this perspective, Wittgenstein approaches the idea of language-game.

Né vers 1600 en Italie, l'opéra encourait les foudres de Marcello dès 1720. L'ouverture des salles au public, les nécessités commerciales et le vedettariat l'avaient éloigné des idéaux qui présidèrent à sa naissance. L'opuscule de Benedetto Marcello aborde, sur le ton de la dérision et de la satire, tous les aspects de l'opéra, du livret à la musique, en passant par les chanteurs, les compositeurs, les directeurs de théâtre, la mise en scène, etc. Le texte méritait une nouvelle traduction française (...) (la dernière datait de la fin du dix-neuvième siècle), plus précise et plus complète, car le savant compositeur de l'Estro poetico-armonico y déploie une verve irrésistible, proche de celle dont se servira Carlo Goldoni dans l'imprésario de Smyrne. Cette satire représente l'étincelle qui allait embraser le flambeau de la réforme par le biais du comte Francesco Algarotti (1712-1764) poète et écrivain. Son Essai sur l'Opéra en musique contient en effet tous les points importants sur lesquels Calzabigi et Gluck allaient asseoir leur reconstruction : choix du livret, rôle de la poésie et de la musique, rôle des chanteurs, du compositeur, moyens et contrôle artistiques des productions. La traduction française qu'un fit Chastellux en 1773, nonobstant sa finesse et son élégance, fait pourtant figure de " belle infidèle ". Force nous était donc d'élaborer là encore une nouvelle traduction de ce texte fondateur. A côté de ces deux grands titres, nous avons réuni un dossier important d'écrits émanant des acteurs de la réforme : Métastase, Angiolini, Calzabigi, Gluck et Du Roullet. (shrink)

In this paper I argue that in several passages Plato sympathizes with the following view: sensible particulars undergo continuous, pervasive physical change; as a consequence, where there seems to be one and the same object which is identical through time, there is in fact a succession of impermanent objects numerically distinct from each other but similar to each other. I illustrate the difference between this view—which invites interesting comparisons with modern and contemporary theories—and other, superficially similar views which Plato criticizes. (...) I also suggest that this view might contribute to explaining Plato’s contention that sensible particulars lack being and are confined to coming to be. Finally, I show that my interpretation was well attested in antiquity; and I put forward the hypothesis that part of the aim of certain Aristotelian claims about substance might be to correct Plato in this respect. l Discorso sull’ineguaglianza sembra scandito, come una via crucis, in una serie di tappe che dall’aurora dell’umanità condurrebbero direttamente alle tenebre del dispotismo: l’assoggettamento alle comodità della vita domestica, il trionfo della vanità, la strutturazione dei rapporti di dominio, la trappola di un patto iniquo, la concentrazione del potere nelle mani di una casta privilegiata e infine del solo tiranno. Come mostra questo libro, la linearità apparente di questa traiettoria è tuttavia contestata dal contrappunto di una serie di sentieri interrotti, (...) da una temporalità plurale nella quale i tempi si accavallano, si intrecciano, collidono. È la storia dell’affetto e della libertà che cementano la famiglia; la storia del desiderio di stima e rispetto che fissa i primi doveri della civiltà; la storia dell’eroe che in nome della comunione delle terre contrasta la loro recinzione o del brigante che si sottrae alla servitù del lavoro salariato. È la storia dell’uguaglianza che salva chi sa custodirla dal reciproco asservimento di proprietari e nullatenenti e, soprattutto, la storia della democrazia, dei popoli soggetti unicamente alle leggi che loro stessi si sono dati, risollevati dall’avvilimento della tirannide al costo del sacrificio delle comodità e della vita. In this paper we analyse the connection between the contested ethno-cultural labelling of Gipsy-Travellers in Wales and their position of social marginalisation, with special reference to spatial issues, such as the provision of campsites and public housing. Our main aim is to show how the formal and informal (mis)labelling of minority groups leads to a number of morally and politically questionable outcomes in their treatment on the part of political authorities. Our approach combines a close reading of official policy documents, (...) government-commissioned and independent empirical research with a theoretical framework drawn mainly from contemporary political philosophy, and especially from the debate on redistribution and recognition.
