While Hegel’s political philosophy has been attacked on the left by republican democrats and on the right by feudalist reactionaries, his apologists see him as a liberal reformer, a moderate who theorized about the development of a free-market society within the bounds of a stabilizing constitutional state. This centrist view has gained ascendancy since the end of the Second World War, enshrining Hegel within the liberal tradition. In this book, Renato Cristi argues that, like the Prussian liberal reformers (...) of his time, Hegel was committed to expand the scope of a free economy and concurrently to ensure that the social practice of subjective freedom did not endanger political stability and order. Aware that a system of mutual advantage failed to integrate the members of civil society and that profound social disharmonies were ineradicable, Hegel adopted the views of the French liberal _doctrinaires_, who sought to realize the principles of the French Revolution by supporting Louis XVIII’s sovereign assertion of the monarchical principle. Not surprisingly, Hegel hailed the French _Charte_ of June 1814 as a beacon of freedom. Endorsement of the monarchical principle was meant to prevent the atomized individuals of civil society from gaining control of the state through appeals to popular sovereignty. This challenges most conventional interpretations of Hegel’s theory of the state and draws it closer to the conservative-authoritarian end of the political spectrum than is usual. (shrink)

Nedelsky and Kelsen criticize the notion of subjective rights. While Nedelsky does so on the basis of a relational theory of rights founded on the Hegelian intersubjective recognition, Kelsen rejects Hegel’s theory of rights because property, the paradigmatic subjective right, appears to be constituted prior to intersubjectve recognition. This paper probes into Hegel’s conception of property to elucidate the root of the divergence between Nedelsky and Kelsen. Pierson v. Post is examined as an illustration of that divergence.

Como pensador moderno, Maquiavelo recupera esta síntesis clásica y define la autoridad como la condición de posibilidad de la libertad. Pero, como muestra Eric Nelson, el republicanismo de Maquiavelo es más ateniense que romano. El republicanismo de Michael Sandel tiene una orientación similar. Basado en la ontología social desarrollada por Arendt y Taylor, Sandel postula el valor intrínseco de las nociones de participación y soberanía popular. This essay analyzes the conjunction freedom/authority defended by classical republicanism. As a modern thinker, Machiavelli retrieves this classical synthesis and defines the authority of law as the condition of possibility for freedom. But, as Eric Neson shows, Machiavelli's republicanism is more Athenian than Roman. Michael Sandel's democratic republicanism has a similar orientation. Besed on the social ontology developed by Arendt and Taylor, Sandel postulates the intrinsic value of the notions of participation and popular sovereignty. In this way he can refute Rorty's objections and his idiosyncratic interpretation of Dewey. According to Sandel, Dewey criticizes liberalism's rejection of authority and is able organically to articulate democratic authority and freedom. (shrink)

A critical examination of Kymlicka's conception of republicanism as a mediation between liberalism and communitarianism. The difficulties encountered by Kymlicka's view are traced to the holistic ontology republicanism shares with communitarianism. Mediation with liberalism is better attained by expanding the range of participation beyond the political sphere and a recognition of the value of representation.

In his struggle against Weimar, Geneva, and Versailles, Carl Schmitt enlisted a number of political thinkers as confederates—Machiavelli, Hobbes, Joseph de Maistre, Louis de Bonald, Juan Donoso Cortés, Benjamin Constant, and Hegel. The legitimacy of this claim has gone unchallenged except in the case of Hegel. Many have felt that his liberal credentials, most clearly manifested in his conception of civil society and his allegiance to the reformist policies espoused in Prussia by H.F.K. von Stein, K.A. von Hardenberg, and Wilhelm (...) von Humboldt, were compromised by Schmitt, who appears to have opposed liberalism and contributed to the demise of the Weimar republic. Schmitt’s attempt to tie Hegel’s views to the political outlook of Hobbes and de Maistre also discredits his speculative stance. Jean-François Kervégan’s extraordinary book seeks to extricate Hegel from this troubling association and attempts both to defend Hegel’s liberalism and confirm the philosophical nature of his argument. Without diminishing Schmitt’s Hegelian debt, his exhaustive comparative study, supported by impeccable scholarship, attempts to show that Schmitt distorted Hegel’s liberalism by disregarding the dialectical intent of his philosophy. In the process, Kervégan aims to preserve the Hegelian legacy from any contamination that might accrue to it from association with Schmitt. (shrink)

Several countries maintain universal health coverage, which implies responsibility to organize delivery formats of healthcare services and products for citizens. In Brazil, the health system has a principle of universal access for more than 30 years, but many deficiencies remain and the country observes a day practice for those seeking judicial decisions to determine provision of healthcare.

Este artigo objetiva demonstrar a importância do pensamento de Martin Heidegger (1889-1976) para uma melhor compreensão dos fenômenos da atualidade, tais como as novas tecnologias e o ambiente digital. Heidegger apresenta a essência da técnica como algo não técnico que acaba por atingir diretamente a humanidade numa dominação da técnica sobre o ser humano. O avanço técnico-científico ganha novo espaço e nova abordagem no fim do século XX com o nascimento da internet. Entendemos que a proposta de Heidegger pode auxiliar (...) numa análise crítica da sociedade pós-moderna marcada pela cibercultura e o ciberespaço. A reflexão tem como pano de fundo o livro Ensaios e conferências que, entre outros textos, contém a conferência proferida em 1953: “A questão da técnica”. Nosso autor mais utilizado é Francisco Rüdiger, professor da UFRS e da PUCRS. Os resultados obtidos apontam que a essência da técnica presente nas novas tecnologias, sobretudo, no ambiente digital, a partir de meados do XX, tem afetado a humanidade em seu modo de ser e viver. Com efeito, o pensar técnico gera na humanidade uma grande crise na formação da sua própria identidade, assim como no seu modo de ser e de agir no mundo. Conclui-se, então, que é necessário – como afirma Rüdiger – olhar para as questões da tecnologia e do ambiente digital numa perspectiva analítica e criticamente hermenêutica. A metodologia utilizada foi a hermenêutica fenomenológica a partir de uma ampla análise bibliográfica da temática abordada. (shrink)

According to relevance theory, irony comprehension invariably entails the identification of some opinion or thought and the identification of the speaker’s dissociative attitude. In this paper, it is argued that it is also essential for hearers to identify not only that propositional attitude, but also the affective attitude that the speaker holds towards the source of this echo so that an optimallyrelevant interpretive outcomeis achieved. This notion comprises feelings and emotions of a non-propositional quality which affect the propositional effects obtained (...) in ironical communication. In this article I propose a new explanation of the relationship between Russell and ther first Wittgenstein. There are five main novelties in my interpretation; the use of all relevant unpublished manuscripts of Russell; the discovery of the first apparition of the “multiple theory of judgment” in a purely logical and unpublished context; the role of the Bradleian objection against relations in the evolution of the nation of form in both Russell and Wittgenstein; a general point of view to obtain (...) a common explanation of all the criticisms of Wittgenstein against Russell and of the abandonment to Theory of Knowledge; and the first account of the contribution of Whitehead to the progressive Russellian evolution from atomism to holism. O presente artigo pretende desenvolver uma reflexão sobre a categoria trabalho na filosofia do jovem Marx, levando a cabo a problemática em torno da dialética do trabalho. Para tanto, faz-se uma leitura imanente às obras Manuscritos Econômico-Filosóficos de 1844 (Ökonomisch-philosophischen Manuskripte aus dem Jahre 1844) e A Ideologia Alemã de 1845 (Die deutsche Ideologie), relacionando tal categoria com algumas determinações antropológicas presentes no pensamento do jovem filósofo, a saber, a objetividade (Objektivität) e a genericidade (Gattungswesen) humanas.

En el presente ensayo se intenta delimitar una definición del concepto de _aparato_ hallable en la filosofía tardía de W. Benjamin atendiendo prioritariamente al ensayo sobre la obra de arte de 1935-36. Junto a esa delimitación, se analizan las posibles modulaciones del término y los diversos alcances que es posible atribuirle. Aunque es ciertamente difícil realizar tal labor con exhaustividad y cabal precisión (entre otras razones, por las importantes modificaciones que posee el escrito), se argumentará que una comprensión del concepto (...) resulta esencial para despejar una serie amplia de equívocos o imprecisiones al momento de profundizar en la reflexión benjaminiana en torno al vínculo entre técnica, percepción y estética. En este trabajo se argumenta que no es posible contar objetos reales. Aunque a primera vista esta tesis pueda resultar desconcertante, o un simple ejercicio de «arte conceptual», las razones que la apoyan son fundadas y muy naturales. Se examinan algunas consecuencias importantes de dicha tesis y se ponen en conexión con diversos planteamientos de H. Putnam, P. Unger y E. Sosa.

Hermeneutics is the exploration of the process of textual interpretation. As such, it has long been recognised as an important component within the humanities and social sciences, whether one deals with actual texts or with other the products of meaningful human activity, including social actions and utterances. Here, we offer a brief overview of the contribution that hermeneutics might make to the philosophy of sport. If sports and sporting events are seen to be the results of meaningful human interactions, then (...) they are meaningful phenomena that lend themselves to interpretation. It can thus be argued that a hermeneutics of sport is a valid and important discipline, worthy of consideration and development. We offer a review of the nature and history of hermeneutics in general, briefly exploring the place of key figures such as Schleiermacher, Heidegger, Gadamer and Riceour, as well as key concepts such as that of the hermeneutic circle. In addition, we suggest the importance of a hermeneutics of suspicion, grounded in the work of Marx, Freud and Nietzsche. In the second part of our introduction, we briefly comment on each of the papers that comprise the current volume, and that reflect the diversity of approaches that a hermeneutics of sport might embrace.
