This paper examines the law relating to healthcare resource allocation in England. The National Health Service Act 1977 does not impose an absolute duty to provide specified healthcare services. The courts will only interfere with a resource allocation decision made by an NHS body if that decision is frankly irrational is engaged). Such irrationality is very difficult to establish. The ECHR has made no significant contribution to domestic English law in the arena of healthcare provision. The decision of the European (...) Court in the Yvonne Watts case establishes that, in relation to the question of entitlement to seek treatment abroad at the expense of the NHS, a clinical judgment about the urgency of treatment trumps an administrative decision about waiting list targets. That decision goes against the grain of domestic law about healthcare allocation, but is not likely to have wide ramifications in domestic law. (shrink)

As a first-generation college graduate from a poverty-class (...) background, my degrees include a Bachelor of Science in Psychology, a Master of Arts in Religion, and a Graduate Certificate in African American Studies from the University of Georgia. My broad research interests include African American women's religion and literature, focusing primarily on Womanism, and bridging the gap between the Academy and the everyday. I assert that we have much to learn from our ancestors and from each other while living and operating in what Black Buddhist bell hooks labels an imperialist white supremacist capitalist cispatriarchy. I am grateful to be in conversation with these folks through their work.In May 2022, I finished my Master's Thesis (published in ProQuest) under the direction of Dr. Carolyn Jones Medine. My thesis focuses on Womanist Buddhist thought in the works of Alice Walker while paying special attention to her first novel, The Third Life of Grange Copeland, and then tracing the importance of her Buddhist practice across other works, such as essays and poetry. My first peer-reviewed journal [End Page 273] article was also published in 2022. Reading between the Times: An Ongoing Womanist Buddhist Project may be accessed online through MDPI, and it was included as part of a Special Edition of the journal which focused on spirituality, identity, and resistance in African American literature. The correspondence of a one-of-a-kind spiritual maverick who continues to influence thinkers of all stripes.

The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

Described as anomie, this situation can induce deviant behaviour. Addressing the psychosocial ethics of MDR-TB and isolation, this paper responds to the call for consideration of resource allocation and liberty.

A Review of Antonio Damasio's ‘The Feeling Of What Happens: Body and Emotion in the Making of Consciousness’.

This paper provides a reception history of Book Two of the Treatise-Of the passions-as well as an attempt to reconcile Hume's ambitions to systematicity in Book Two with the distracted and distracting nature of the text. We currently have, I think, a good sense of the philosophical importance of Book Two within Hume's science of human nature. Yet we have not made much progress on understanding Book Two on its own terms, and especially why Book Two so often seems on (...) the verge of falling into an explanatory heap. I aim to rectify this situation by giving a reading of Book Two that makes sense of the philosophical importance of Hume's system of the passions, yet also explains why he encounters so many difficulties in setting out his system; such that he is often forced to stretch his explanations to the very edge of the credible. I contend that Hume's system of the passions is best viewed as an unstable explanatory compound, one that progressively dissolves as Hume's explanatory intentions become increasingly ambitious. In Concepts, Kinds, and Cognitive Development, Frank C. Keil provides a coherent account of how concepts and word meanings develop in children, adding to our understanding of the representational nature of concepts and word meanings at all ages. Keil argues that it is impossible to adequately understand the nature of conceptual representation without also considering the issue of learning. Weaving together issues in cognitive development, philosophy, and cognitive psychology, he reconciles numerous theories, backed by empirical evidence from nominal kinds (...) studies, natural-kinds studies, and studies of fundamental categorical distinctions. He shows that all this evidence, when put together, leads to a better understanding of semantic and conceptual development. The book opens with an analysis of the problems of modeling qualitative changes in conceptual development, investigating how concepts of natural kinds, nominal kinds, and artifacts evolve. The studies on nominal kinds document a powerful and unambiguous developmental pattern indicating a shift from a reliance on global tabulations of characteristic features to what appears to be a small set of defining ones. The studies on natural kinds document an analogous shift toward a core theory instead of simple definition. Both sets of studies are strongly supported by cross cultural data. While these patterns seem to suggest that the young child organizes concepts according to characteristic features, Keil argues that there is a framework of conceptual categories and causal beliefs that enables even very young children to understand kinds at a deeper, theoretically guided, level. This account suggests a new way of understanding qualitative change and carries strong implications for how concepts are represented at any point in development. A Bradford Book. (shrink)

I offer an interpretation of the target of Søren Kierkegaard’s corrective to Luther as not merely cultural Lutheranism but Luther's very conception of what it means to be receptive to grace. On this interpretation, while Kierkegaard affirms that salvation is by grace alone, and through faith alone, he thinks that Luther errs when he conceives of salvation as a process in relation to which the believer is merely passive. Instead, in Kierkegaard’s view, receptivity to grace involves a distinctive, middle-voiced, form (...) of human agency in which the believer learns to acknowledge her need for grace. With reference to Kierkegaard’s discourses on patience, and their thematic proximity to the spirituality of the Philokalia, I illustrate this conception of active-passivity and show how it is compatible with an uncompromising Lutheran emphasis on human powerlessness. With reference also to his insistence of the irreducible importance of the participant’s perspective, I further draw out from Kierkegaard an account of why the temptation may arise to erroneously interpret the core tenets of Luther's teaching, in the mode of a theory of soteriological passivity. A dual-processing model of moral whistleblowing in organizations is proposed. In this theory paper, moral whistleblowing is described as a unique type of whistleblowing that is undertaken by individuals that see themselves as moral agents and are primarily motivated to blow the whistle by a sense of moral duty. At the individual level, the model expands on traditional, rational models of whistleblowing by exploring how moral intuition and deliberative reasoning processes might interact to influence the whistleblowing behavior of moral agents. In At the Will of the Body , Arthur Frank told the story of his own illnesses, heart attack and cancer. That book ended by describing the existence of a "remission society," whose members all live with some form of illness or disability. The Wounded Storyteller is their collective portrait. Ill people are more than victims of disease or patients of medicine they are wounded storytellers. People tell stories to make sense of their suffering when they turn their diseases (...) into stories, they find healing. Drawing on the work of authors such as Oliver Sacks, Anatole Broyard, Norman Cousins, and Audre Lorde, as well as from people he met during the years he spent among different illness groups, Frank recounts a stirring collection of illness stories, ranging from the well-known--Gilda Radner's battle with ovarian cancer--to the private testimonials of people with cancer, chronic fatigue syndrome, and disabilties. Their stories are more than accounts of personal suffering: they abound with moral choices and point to a social ethic. Frank identifies three basic narratives of illness in restitution, chaos, and quest. Restitution narratives anticipate getting well again and give prominence to the technology of cure. In chaos narratives, illness seems to stretch on forever, with no respite or redeeming insights. Quest narratives are about finding that insight as illness is transformed into a means for the ill person to become someone new. (shrink)

Several accounts of the evolution of religion distinguish two phases: an earlier shamanic stage and a later doctrinal stage. Similarly, several theories of human cognition distinguish two cognitive modes: a phylogenetically older system that is largely intuitive and a later, more distinctively human system that is more rational and articulate. This article suggests that cognition in the earlier stage in the evolution of religion is largely at the level of intuition, whereas the cognition of doctrine or religion is more conceptual (...) and rational. Early religious cognition is more embodied and is more likely to carry healing benefits. The evolutionary origins of religion in humans seem to depend on developments in the cognitive architecture. It is further suggested that the cognition of early religion shows less conceptual differentiation, is characteristically participatory rather than objectifying and is less individualistic. The development of religion in recent centuries appears to show some approximate recapitulation of the stages through which religion originally evolved. (shrink)

The approach to mental health and well‐being taken here illustrates the complementary perspectives approach and assumes that there are useful and intersecting contributions from science (including medicine) and from religion and spirituality. What counts as poor mental well‐being depends on the interaction of relatively objective criteria with culturally contingent value judgments. I then discuss theological perspectives on depression, including a consideration of sources of hope and tolerance of dysphoria, and argue that depression can be part of a spiritual journey. I (...) then look at the relationship between psychosis and religion, including the work of Isabel Clarke, arguing that a spiritual approach to psychosis can complement a medical approach. Finally, I present a pastoral case study illustrating the interface between neurological and spiritual aspects of the sense of presence. A religious perspective can challenge and complement current assumptions about mental health in a potentially fruitful way. (shrink)

Abstract:In this paper I argue that Hume’s decision to include an account of curiosity within his theory of the passions is what gives Book 2 of the Treatise its distinctive shape, in which an account of what Hume calls “indirect” passions precedes an account of the nature of the will, which is itself followed by an account of the “direct” passions, then curiosity. On my reading, Hume concludes his theory of the passions with an account of curiosity because this is (...) where it ought to go, given how Hume understands the love of truth to arise in human nature. Not only this, but I contend that Hume’s need to account for the nature of curiosity within his theory of the passions can explain his decision to open Book 2 with a discussion of the indirect passions, rather than the direct passions. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. Durkheim, in his very role as a "founding father" of a new social science has become like a figure in an old religious painting, enshrouded in myth and encrusted in layers of thick, impenetrable varnish. This book undertakes detailed, up-to-date investigations of Durkheim's work in an effort to restore its freshness and reveal it as originally created. These investigations explore his particular ideas, within an overall narrative of his initial problematic search for solidarity, how it became a quest for the (...) sacred, and how, at the end of his life, he embarked on a project for a new great work on ethics. A theme running through this is his concern with a modern world in crisis and a hope in social and moral reform. Accordingly, the book concludes with a set of essays on modern times and on a crisis that Durkheim thought would pass but which now seems here to stay. (shrink)

This short article summarizes and extends the panel discussion that followed the Boyle Lecture 2021 by Tom McLeish. The panel largely accepted the central claims of the lecture and focused rather on its implications. That included the importance of teaching history and philosophy of science alongside science itself, and the importance of finding helpful and appropriate ways of engaging the public in the scientific process. There was considerable discussion of the place of meditative and contemplative practices in science. It seems (...) that intuition and imagination play an important role in scientific discovery, if not in more formal theorizing, and are close to contemplative experience. Emphasizing that aspect of science might lead to a refocusing of natural theology, focusing more on scientific processes than on scientific findings. (shrink)

Biological sex should be “acknowledged” and “accepted”—but which responses to gender dysphoria might this preclude? Trans-identified people may factually acknowledge their biological sex and regard transition as purely palliative. While generally some level of self-deception and even a high level of nonlying deception of others are sometimes justified, biological sex is important, and there is a nontrivial onus against even palliative, nonsexually motivated cross-dressing. The onus is higher against co-opting the body, even in a minor and/or reversible way, to make (...) a false communication concerning one’s sex. Hardest to defend is the destruction of sexual–reproductive functions and causally downstream functions such as lactation: due to the transcendent nature of sexual–reproductive functions, an appeal to the “principle of totality” here is misplaced. This is not to say that social, and milder medical, transition is absolutely excluded even for severe unmanageable dysphoria, nor that subsequent to any transition, detransition is necessarily required. At their first meeting Polynices and Tydeus come to blows. They are reconciled by Adrastus, who expresses the hope that their quarrel will lead to loyal friendship between them, as it did. Esse pro fuisse dixit, says Lactantius, more ingenuously than Klotz, who tries to make the same thing more palatable by saying esse est pro imperfecti quodammodo infinitiuo. Some have taken the accusative and infinitive to be a general statement, but Heuvel is clearly right in saying that it is (...) Tydeus and Polynices whom the poet has in mind. The most favoured solution has been Grater's conjecture isse, but that produces an unnatural expression ; Mozley renders it by ‘grew’, thereby translating not what stands in his text but what ought perhaps to stand there, namely esse, a conjecture of Gil, which has been almost entirely overlooked. This contracted form is found in extant literature only at Lucretius 3.683 and Ovid, Met. 7.416 . The first letters of a line are particularly liable to omission; despite Hill, I do not find it at all surprising that at 1.544 perseus lost its first letter and the remnant became aureus. (shrink)
