Counter-terrorism officials in the USA and the UK responded to the events of 11 September 2001 and 7 July 2005 with an increasing resort to the use of ?intelligence-led policing? methods such as racial and religious profiling. Reliance on intelligence, to the effect that most people who commit a certain crime have a certain ethnicity, can lead to less favourable treatment of an individual with that ethnicity because of his membership in that group, not because of any act he is (...) suspected or known to have committed. This paper explains the context in which intelligence-led policing flourishes, and how this discussion contributes to the profiling debate in both the USA and the UK, and then sets out two key contentions. First, we argue that Article 14 ECHR as applied under the UK Human Rights Act has a more protective, and less ?prosecutorial?, conception of discrimination than has the US Equal Protection Clause, meaning that judges need not find a discriminatory motive to find that discrimination has occurred. Second, we contend that Article 14 provides the judiciary with the key tool of proportionality, which, when properly applied, makes it harder for discrimination to stand up to scrutiny. (shrink)

Adam Smith’s formal legacy to posterity consisted of meticulously revised editions of his two published works, The Theory of Moral Sentiments and The Wealth of Nations; long-standing plans for treatises on Jurisprudence, Rhetoric, and the Fine Arts were abandoned on the grounds that there was no time to complete them. This chapter discusses Smith oeuvre as component parts of an unrealized plan to develop a Science of Man on experimental principles. Smith’s introduction to this grand projet as a student is (...) explored and the influence of Hutcheson and Hume is emphasized as is the fact that Smith developed both the published and unpublished components of his Science of Man simultaneously. The question of the meaning Smith attached to ‘science’ is a continuing theme of the chapter. (shrink)

In this paper I want to discuss David Hume's views about morals, politics and citizenship and the role of philosophers and philosophizing in modern civil society - what I shall call his theory of civic morality. This is a subject which has been neglected by philosophers, presumably because it is of limited philosophical interest. But it is of considerable interest to the historian who wants to understand Hume's development as a philosopher, to locate his thought within a specific, Scottish context (...) and to arrive at some understanding of his surprisingly close and cordial relations with the literary and social world of enlightened Edinburgh. These are large claims and I cannot hope to substantiate them fully in a short paper. My purpose is first, to show that, historically speaking, Hume's preoccupation with civic morality was of central rather than peripheral interest to him as a philosopher and that it helps to explain his otherwise rather puzzling decision to give up philosophizing systematically in the manner of Hobbes and Locke, in favour of polite essay-writing in the manner of Addison and Steele. My second purpose is to suggest that Hume's interest in civic morality, his neo-Addisonian mode of philosophizing about it and the nature of his understanding of politics, citizenship and philosophizing in a modern age was, unlike his thought about religion, responsive to and consonant with some of the most important ideological preoccupations of his Scottish contemporaries. It was, I suspect, a shared interest which helped to contain some of the anxieties Hume's notorious religious scepticism caused his contemporaries. Without it, he could not possibly have emerged as one of the leaders of Edinburgh's intellectual life in the age of the Scottish Enlightenment. (shrink)

According to virtue theory, morality is about the person performing the actions. In The Good Place, Chidi Anagonye is characterized not by habitual moral action but by pained decision making and insecurity. One might say that Chidi can be forgiven for not having yet perfected his character because he is, after all, still acting voluntarily and making moral decisions most of the time. Chidi often wavers and changes his mind about what he should do. Even when he seems to have (...) a good moral intuition about what is right, he second‐guesses himself and overcomplicates things. Chidi falls in the category of incontinence. He has a generally good sense of what a moral person would do in a given situation and a generally reliable moral intuition. Because The Good Place requires near moral perfection, one can confidently say that Chidi deserves his spot in The Bad Place. (shrink)

Despite the drastic differences in their views of the intellect and the location and specific function of the will both Aquinas and Averroes are able to claim that their systems allow for moral agency because they both place the will—a faculty that is of prime importance to the process of moral action—in the individual. Both philosophers think that they are following Aristotle in making their claims about the will and the intellects. This paper will examine the issue of will and (...) the related issue of the intellects as it appears in the Aristotelian texts and in the subsequent work of Averroes and Aquinas. It will argue that at least some of the divergence in Averroes and Aquinas can be attributed to an issue of translation regarding De Anima, and a difference in the role of cogitation and the intellects regarding will. Population aging and longevity in the context of declining social commitments raise concerns about disadvantage, inequality, and the well‐being of older people. In this short piece, we use the concept of precarity as a lens to understand new and sustained forms of insecurity that affect late life, and we illustrate how these risks, when experienced over time and in relation to conditions such as austerity, can deepen disadvantage.

Gavin Rae shows that the problematic status of agency caused by the poststructuralist decentring of the subject is a central concern for poststructuralist thinkers. For healthcare professionals and organizations, there is an emphasis on addressing moral distress and compassion fatigue among clinicians. While addressing these issues is vital, this paper suggests that the philosophical concept of agent-regret is a relevant but overlooked issue in healthcare. To experience agent-regret is to regret your harmful but not wrongful actions. This person’s action results in someone being killed or significantly injured, but it was ethically faultless. Despite being faultless, agent-regret is an emotional response concerning one’s agency in (...) a situation that results in death or significant harm. In healthcare, many clinicians are likely to experience regret for faultless actions that significantly harm or cause the death of a patient. The recognition of agent-regret in healthcare is significant because it differs, conceptually and practically, from moral distress and compassion fatigue. Building on the work of Wojtowicz (Citation2022), we should strive to understand clinicians’ agent-regret by recognizing their agency in the situation, not lessening or removing it. (shrink)

Big Data has been variously defined in the literature. In the main, definitions suggest that Big Data possess a suite of key traits: volume, velocity and variety, but also exhaustivity, resolution, indexicality, relationality, extensionality and scalability. However, these definitions lack ontological clarity, with the term acting as an amorphous, catch-all label for a wide selection of data. In this paper, we consider the question ‘what makes Big Data, Big Data?’, applying Kitchin’s taxonomy of seven Big Data traits to 26 datasets (...) drawn from seven domains, each of which is considered in the literature to constitute Big Data. The results demonstrate that only a handful of datasets possess all seven traits, and some do not possess either volume and/or variety. Instead, there are multiple forms of Big Data. Our analysis reveals that the key definitional boundary markers are the traits of velocity and exhaustivity. We contend that Big Data as an analytical category needs to be unpacked, with the genus of Big Data further delineated and its various species identified. It is only through such ontological work that we will gain conceptual clarity about what constitutes Big Data, formulate how best to make sense of it, and identify how it might be best used to make sense of the world. The problem of change recurs across Frantz Fanon's writings. As a philosopher, psychiatrist, and revolutionary, Fanon was deeply committed to theorizing and instigating change in all of its facets. Change is the thread that ties together his critical dialogue with Hegel, Marx, Freud, and Nietzsche and his intellectual exchange with Césaire, Kojève, and Sartre. It informs his analysis of racism and colonialism, négritude and the veil, language and culture, disalienation and decolonization, and it underpins his reflections on Martinique, Algeria, the (...) Caribbean, Africa, the Third World, and the world at large. Gavin Arnall traces an internal division throughout Fanon's work between two distinct modes of thinking about change. He contends that there are two Fanons: a dominant Fanon who conceives of change as a dialectical process of becoming and a subterranean Fanon who experiments with an even more explosive underground theory of transformation. Arnall offers close readings of Fanon's entire oeuvre, from canonical works like Black Skin, White Masks and The Wretched of the Earth to his psychiatric papers and recently published materials, including his play, Parallel Hands. Speaking both to scholars and to the continued vitality of Fanon's ideas among today's social movements, this book offers a rigorous and profoundly original engagement with Fanon that affirms his importance in the effort to bring about radical change. In the wake of two decades in which postmodern theory has become very popular in university humanities and social science departments around the world, Gavin Kitching claims that postmodernism is causing harm to students intellectually. Postmodern theory has engaged the hearts and heads of the brightest students because of its apparent political and social radicalism. Yet Kitching writes: “At the heart of postmodernism is very poor, deeply confused, and misbegotten philosophy. As a result even the very best students who (...) fall under its sway produce radically incoherent ideas about language, meaning, truth, and reality.” This is not another conservative attack on postmodern theory. Rather, it is a carefully considered analysis from a dedicated university teacher who is convinced that we have gone terribly astray. He analyzes why typical postmodern theoretical approaches simply aren’t effective tools for dealing with the realities of people and their activities, and he describes the philosophical confusion that lies at the heart of the problem. He also demonstrates the political implications for students, their universities, and society when students learn to use poorly constructed arguments as the basis of their writing. _The Trouble with Theory _is essential reading for all students writing a thesis in the humanities and the social sciences and for their teachers. This book explores the diverse understandings of the archaeological record in both historical and contemporary perspective, while also serving as a guide to reassessing current views. Gavin Lucas argues that archaeological theory has become both too fragmented and disconnected from the particular nature of archaeological evidence. His view is distinctive in not emphasising external facts: the presence or absence of a corpse, along with evidence that the person who has become a corpse, intended to do so. It emphasises the intentions that the person had in acting, rather than the consequences that follow from those actions. Much of the (...) book is devoted to an attempt to construct a natural history of suicidal self harm and to examine some of the ethical issues that it raises. Fairbairn sets his philosophical reflections against a background of practical experience in the caring professions and uses a storytelling approach in offering a critique of the current language of self harm along with some new ways of thinking. Among other things he offers cogent reasons for abandoning the mindless use of terms such as attempted suicide and parasuicide , and introduces a number of new terms including cosmic roulette , which he uses to describe a family of human acts in which people gamble with their lives. By elaborating a richer model of suicidal self harm than most philosophers and most practitioners of caring professions currently inhabit, Fairbairn has contributed to the development of understanding in this area. Among other things a richer model and vocabulary may reduce the likelihood that those who come into contact with suicidal self harm, will believe that familiarity with the physical facts of the matter - the actions of the suicider and the presence or absence of a corpse - is always sufficient to justify a definite conclusion about the nature of the self harming act. The Western philosophic tradition has tended to tie the question of action to that of freedom, with the relationship structured around the free will/determinism opposition. In contrast, I show that in Being and Nothingness, Sartre offers a stringent and radical critique of these approaches. I briefly outline the conceptual parameters of Sartre’s early ontology, before showing that he rejects the free will tradition because of its underlying conception of freedom and insistence that action is reflective and will-based. According to Sartre, (...) consciousness is not a sum of parts, with one aspect (will) guiding the rest. Consciousness is a differentiated whole, divided between reflective and pre-reflective levels. Will is tied to the reflective level of consciousness and so cannot be said to be foundational given that reflectivity depends upon pre-reflectivity. Instead, it is an expressive effect of consciousness’s spontaneous, pre-reflective, projection of itself towards a particular end and value. (shrink)

This book argues that understandings and explanations of religion are always historically contingent.

In this book, Gavin Rae analyses the foundations of political life by undertaking a critical comparative analysis of the political theologies of Carl Schmitt and Emmanuel Levinas. In so doing, Rae contributes to key debates in contemporary political philosophy, specifically those relating to the nature of, and the relationship between, the theological, the political, and the ethical, as well as those questioning the existence of ahistoric metaphysical, ontological, and epistemological foundations. While the theological is often associated with belief in (...) a fixed foundation such as God or the truth of a religion, Rae identifies another sense rooted in epistemology. On this understanding, the ontological limitations of human cognition mean that, ultimately, human truth is based in faith and so can never be certain. The argument developed suggests that Levinas’ conception of the political is grounded in theology in the sense of religion, particularly the revelations of Judaism. For this reason, Levinas claims that the political decision is based on how to implement a prior religiously-inspired norm: justice. Schmitt, in contrast, develops a conception of the political rooted in epistemic faith to claim that the political decision is normless. While sympathetic to Schmitt’s conception of theology and its relationship to the political, Rae concludes by arguing that the emphasis Levinas places on responsibility is crucial to understanding the implications of this. The continuing relevance of Schmitt’s and Levinas’ political theologies is that they teach us that, while the political decision is ultimately normless, we bear an infinite responsibility for the consequences of this normless decision. Despite Jean-Paul Sartre and Cornelius Castoriadis placing the imagination centre stage in their respective conceptual theories, little work has been done to bring them into conversation on this issue or, indeed, any other. This is perhaps not surprising given Sartre’s early work on this topic has tended to be downplayed in favour of his affirmation of freedom, while Castoriadis not only denigrates Sartre’s thinking generally and his account of the imagination specifically but also posits their relationship as one of opposition. (...) In contrast, this article brings them into conversation on the question of the imagination to call into question Castoriadis assessment of their relation. To do so, I outline Sartre’s position in The Imaginary, showing that Castoriadis assessment of Sartre’s notion is based on a problematic, if common, misunderstanding of Sartre’s notion of nothingness and its relationship to creativity. Having overcome the opposition that Castoriadis affirms between their respective positions, I argue that, while there certainly are differences between their positions, there are also important points of agreement and overlap between them, especially regarding the constitutive role that the imagination plays for consciousness, and the relationships between the imagination and freedom and the imagination and creativity, that point to a shared and original approach. Today’s bodies are akin to ‘walking sensor platforms’. Bodies either host, or are the subjects of, an array of sensing devices that act to convert bodily movements, actions and dynamics into circulative data. This article proposes the notions of ‘disembodied exhaust’ and ‘embodied exhaustion’ to conceptualise processes of bodily sensorisation and datafication. As the material body interfaces with networked sensor technologies and sensing infrastructures, it emits disembodied exhaust: gaseous flows of personal information that establish a representational data-proxy. It is this (...) networked actant that progressively structures how embodied subjects experience their daily lives. The significance of this symbiont medium in determining the outcome of interplays between networked individuals and audiences necessitates that it is carefully contrived. The article explores the nature and function of the data-proxy, and its impact on social relations. Drawing on examples that depict individuals engaging with their data-proxies, the article suggests that managing a virtual presence is analogous to a work relation, demanding diligence and investment. But it also shows how the data-proxy operates as a mode of affect that challenges conventional distinctions made between organic and inorganic bodies, agency and actancy, mortality and immortality, presence and absence. A re-mapping of cultural production in light of the emergence of a form-of-life for works ….

While Jacques Derrida’s influence on posthumanist theory is well established in the literature, given Martin Heidegger’s influence on Derrida, it is surprising to find that Heidegger’s relationship to posthumanist theory has been largely ignored. This article starts to fill this lacuna by showing that Heidegger’s writings not only influences but also has much to teach posthumanism, especially regarding the relationship between humanism and posthumanism. By first engaging with Heidegger’s destruction of metaphysics and related critique of anthropocentrism, I show that, while (...) rejecting Heidegger’s conclusions for being too humanist, posthumanism shares, and indeed is largely unreflectively defined by, Heidegger’s critique of the binary logic underpinning anthropocentric humanism. With this, posthumanism aims to go beyond Heidegger by overcoming all forms of humanist understanding, an attempt that brings us back to the relationship between humanism and posthumanism and Heidegger’s notion of trace. With this, I not only show that Heidegger influences posthumanism through his destruction of metaphysics, critique of anthropocentrism and notion of trace, but also point towards an understanding of posthumanism that distinguishes it from humanism and transhumanism. Preliminary research on the Edition of One (EO1) project, "W(h)ither the Avant-garde?" Includes a report on the art-world ca.2006-2010.

We give an overview of the practice of developing and using complex climate models, as seen from experiences in a major climate modelling center and through participation in the Coupled Model Intercomparison Project. We discuss the construction and calibration of models; their evaluation, especially through use of out-of-sample tests; and their exploitation in multi-model ensembles to identify biases and make predictions. We stress that adequacy or utility of climate models is best assessed via their skill against more naïve predictions. The (...) framework we use for making inferences about reality using simulations is naturally Bayesian, and has many points of contact with more familiar examples of scientific epistemology. While the use of complex simulations in science is a development that changes much in how science is done in practice, we argue that the concepts being applied fit very much into traditional practices of the scientific method, albeit those more often associated with laboratory work. ABSTRACT Judith Butler’s work has tended to be read through two axes: an early gender theory/later ethical theory division, and/or an ethical/political divide. In contrast, I aim to undercut both hermeneutical strategies by turning to her epistemology, as manifested through her analyses of normativity and “frames,” to argue that the latter acts as the hinge uniting her so-called early and later works and the ethical and political dimensions of her thinking. From this premise, I maintain that Butler affirms that these (...) frames are conditioned by power relations and contingency, points to the existence of multiple frameworks that simultaneously compete against one another, and insists that frames are culturally specific and determining of the categories that identify what counts as a legitimate life for a particular community and the ways in which each life is to be treated. By highlighting the social, performative, and normative dimensions of epistemic practices, Butler offers an epistemology based in the construction of contingent and contestable frameworks and shows how the contestation between distinct frameworks conditions the ethical-political life of each community. This paper explores the embedding of data producing technologies in people's everyday lives and practices. It traces how repeated encounters with digital data operate to naturalise these entities, while often blindsiding their agentive properties and the ways they get implicated in processes of exploitation and governance. I propose and develop the notion of ‘data doxa’ to conceptualise the way in which digital data – and the devices and platforms that stage data – have come to be perceived in Western societies (...) as normal, necessary and enabling. The ‘data doxa’ concept also accentuates the enculturation of many individuals into a data sharing habitus which frames digital technologies in simplistic terms as panaceas for the problems associated with contemporary life, figures of progress and convenience, and mediums of knowledge, pleasure and identity. I suggest that three types of data-based relations contribute to the formation of this doxic sensibility: fetishisation, habit and enchantment. Each of these relations come to mediate public understandings of digital devices and the data they generate, obscuring the multifaceted nature and hidden depths of data and their propensity to double up as technologies of exposure and discipline. As a result of this situation, imaginative educational programs and revamped regulatory frameworks are urgently needed to inform individuals about the contribution of data to the leveraging of value and power in today's digital economies, but also to protect them from experiencing data-based harms.
